In accordance with your request, Certificate of Coverage Number NCG140351 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit is against federal and state laws and could result in fines. If something changes and your facility would again require stormwater or wastewater discharge permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the proper permit coverage. The consultant presented stormwater calculations and you checked the stormwater pond size against the SA/DA table - - good. I'm confused about the design of the wastewater recycle system on several counts. a) There is no design narrative sufficient to tell me what the design basis is. My approach on the few sNCG14s that have wastewater components has been to consider that the submittal should be viewed very similarly to a wastewater submittal to the NPDES wastewater unit. That is, before we can issue the permit, we need at least a rudimentary engineering understanding of what's happening with the wastewater. Maybe not to the degree that our wastewater folks require, but at least we should know what the treatment processes are, and what the flow path is. The applicant has not shown that to me in a way that I can understand it. b) Because this permit has a wastewater component, our issuance of the permit is also an issuance of the authorization to construct. Just like in wastewater, we are authorizing not just the discharge, but the construction of treatment facilities. That deserves an engineering review. I don't think we need to check concrete specs, rebar sizing, pavement thickness, pipe hydraulics, etc. But I do think that with my background in design, and your background in wastewater that a gross review of the construction sizing, similar to the SA/DA check that you performed, is appropriate. One thing we might want the designer to identify is what is the design rain for the recycle system, i.e. when has he designed it to overflow? ,/ c) I'm concerned with the multiple 6" PVC pipes that seem to rtin from the recycle system to the stormwater pond. 'what's that about? I guess it's some kind of overflow, but there's no design narrative to tell me that. They could just be a normal discharge, meaning the system will only "recycle" when it's not raining - I think we would have a problem with that design for wastewater. The designer needs to tell us in a way that we can understand what's going on. He should be aware that at some threshold, if he combines the wastewater discharge with the stormwater, z think, NCG14 requires him to teat t e whole flow as wastewater. Meaning he will have limits on the combined discharge. Maybe that's ww2Tat-1fe1-s a ter —some kind of dilution effect?? It would help if the designer would identify how the features of his design mesh with the permit requirements and the permit differentiation between stormwater and wastewater discharges. d) It seems to me that one of our tasks in an engineering review is to get a sense of whether or not the design details all sort of "hang together". I realize, we certainly can't "re -engineer" the facility. That's not our job, and it's not appropriate in a professional sense. But we should get an idea of how the design measures up with regard to the internal rigor and the correlation with the requirements of the rule and permit. One sign is whether the submittal documents are internally consistent. It does not appear to me that the footprint of the detail —'presented on the recycle system matches that presented on the Grading/Drainage Plan - they don't appear internally consistent. Further, it is worth questioning, I think, why the calculations presented are sealed and dated September '02, but the drawings presented are sealed and dated December '04. It may be that there is a good reason for the two-year lag in time. Maybe it takes two years to design a ready mix plant - I don't know. I think it's worth asking about. 3. Also, the regions have been on an enforcement emphasis with respect to the ready mix industry for over a year, I think. It's my impression that they are also preparing to rachet-up enforcement again. Where do they drain to? 5 uther, we know that process wastewaters from ready mix plants have high pH, and that the permit requires that the pH be between 6 and 9. Absent a design narrative, nd with no indication of.pH correction equipment on the Grading Plan, I conclude that the design does not include a pH correction step.' It is not approvable as submitted. n Further, he has indicated that vehicle cleaning will be taking place. But that D'activity is not located on the Grading Plan. We don't know where it is draining to, �!( /therefore we don't know if that water is intended for the recycle system, or would V it be illegally discharged in the stormwater? 7. Further, he has indicated that mixing drum cleaning will be taking place. But the location on the submitted documents is not identified. I presume that the recycle 1 ystem configuration indicates that the wash out will be on a ramp adjacent to the A/recycle system. But that's an un-authorized assumption on my part. The documents need to tell us where drum clean out will'be. Given the lack of effective communication of the features of the design, it seems to me we may want to encourage a more complete communication with this designer. Specifically, we may want to ask him to identify the sampling points on his Grading Plan. This sort of request is standard in the wastewater permitting world. Recognizing that the location of samples may influence the physical construction of the facility, I think we need to help the designer include this feature in his design submittal to us. 9. Finally, I think we are supposed to add the blank Engineer's Certification page to the permit package. That's the form on which we require the design engineer to attest that the system has been constructed in accordance with the plans submitted to us. OK FOR TSS AND SETTLEABLES. - The applicant asserts that muriatic acid will be used to control pH, by a protocol already in place in other MacLeod sites, but not presented for our review in this submittal. Given the holding capacity in excess of the 25-year storm, I think this is OK FOR pH, too. e) I think the ATC question is moot, since apparently the system is already built. I see your note with the applicant's invitation to DWQ to come and see the facility, so I conclude that it already exists. A list of the modifications required is attached. This approval is conditioned upon the incorporation or addition of these modifications to the plan. If these modifications are not included in the plan and implemented on the construction site; the site will be in violation of the Cabairus County Soil Erosion and Sedimentation Control Ordinance (Sec. 17[I]) and the Sedimentation Pollution Control Act of 1973. (G.S. 1 I3A-61rd1). Please be advised that the Ordinance (Sec. 17[c]) and Title 15 NCAC 4B .0017(a) requires that a copy of the approved erosion control plan be on file at the job site. You should consider this letter to give the Notice required by Ordinance (Sec. 19) and G.S. 113A-61(d) of our right of periodic inspection to insure compliance with the approved plan. Also, activities indicated on approved plans not completed within eighteen (1'8) months of the date of approval shall be deemed null and void. This could include the Division of Water Quality under storm water or water quality regulations, the U.S. Army Corps of Engineers under Article 404 jurisdiction, county, city or town agencies under local ordinances, or other approvals that may be required. This approval cannot supersede that may be required. This approval Cannot supersede any other permit or approval." Cabarrus County Soil Erosion and Sedimentation Control Ordinance and the North Carolina's Sedimentation Pollution Control Program is performance oriented, requiring protection of the natural resources and adjoining properties. If following the commencement of this project it is determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the Ordinance (Sections 1 thru 23) and the Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 thru 66), this office may require revisions to the plan and implementation of the revisions to insure compliance with the Ordinance and the Act. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form which you have provided. You are requested to file an amended form if there is any change in the information included on the form. In addition, it would be helpful if you notify this office of the proposed starting date for this proj ect. Also, note that the Ordinance (Sec. 19[g]) indicates a certificate of occupancy will not be issued if the tract is deemed to be in violation of this ordinance.
