Discharging regulated industrial stormwater, discharging wastewater, or operating a treatment facility

day. The Division may pursue enforcement action on persons that have voluntarily relinquished permit
coverage when continuing permit coverage was necessary. if in the future you wish to again discharge to
the State's surface waters, you must first apply for and receive new coverage under an NPDES permit.

Hi Jimmy,
Permit coverage under NCG140294 approved this afternoon. I'll be sending you a paper confirmation tomorrow.
My apologies for the delay. Our procedure previously has always been to have the Regional Office (Raleigh Region in
this case) make a confirming site visit on every request to rescind permit coverage. They just have not had the staff time
to follow our standard procedure.
I've approved the request based my certainty that ST Wooten is aware that cement must be removed from the site, that
any bins or chambers with wastewater must be emptied, etc - - the site just has to be cleaned up so that there's no
significant threat of polluted discharges arising from the site.
We do not view aggregate or sand remaining on site as a significant threat, as long as it' located a sufficient distance
away from streams or runoff conveyances so that entrance into the surface water is unlikely.

In accordance with your request received June 2, 2003, the Division is forwarding the subject permit
modification. This modification documents the change in name/ownership at the subject facility. Ali other terms
and -conditions in the original permit remain unchanged and in full effect. This permit modification is issued
under the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U. S. Environmental Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit modification
are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the
North Carolina General Statutes, filed with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, North Carolina 27699-6714. Unless such demand is made, this decision shall be final and binding.
This permit does not affect the legal requirement to obtain other permits which may be required by the
Division of Water Quality, the Division of Land Resources, Coastal Area Management Act, or any other Federal or
Local government permit that may be required. If you have any questions concerning this permit, please contact

This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Duality or permits required by the Division of Land Resources,
