Permit coverage rescinded on the following basis, ❑ You reported that you have ceased all regulated activity ands-lh fac' ity. ❑ You reported that although you retain ownership or control of the facility, you have ceased all regulated activity, and there are no materials remaining on site that may present a risk of stormwater pollution, You reported that continued permit coverage is not required because the site activities are not regulated by the NPDES stormwater permitting program. ❑ Note other basis: ❑ DEMLR Regional Office (RO) inspection and concurrence 2 No RO inspection. We are relying, on your representation that a permit is no longer required. Discharging regulated industrial stormwater, discharging wastewater, or operating a treatment facility without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. The Division may pursue enforcement action on persons that have voluntarily relinquished permit coverage when continuing permit coverage was necessary. if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive new coverage under an NPDES permit. I'll be sending you a paper confirmation tomorrow. My apologies for the delay. Our procedure previously has always been to have the Regional Office (Raleigh Region in this case) make a confirming site visit on every request to rescind permit coverage. They just have not had the staff time to follow our standard procedure. I've approved the request based my certainty that ST Wooten is aware that cement must be removed from the site, that any bins or chambers with wastewater must be emptied, etc - - the site just has to be cleaned up so that there's no significant threat of polluted discharges arising from the site. We do not view aggregate or sand remaining on site as a significant threat, as long as it' located a sufficient distance away from streams or runoff conveyances so that entrance into the surface water is unlikely.
