On August 25, 2014 the Division of Energy, Mineral and Land Resources received your request to rescind
your coverage under Certificate of Coverage Number NCG 130065. In accordance with your request,
Certificate of Coverage Number NCG 130065 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
of the State without valid coverage under an NP17ES permit is against federal and state laws and could result
in fines. If something changes and your facility would again require stormwater or wastewater discharge
permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the
proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform the
new or prospective owners of their potential need for NPDES permit coverage.

Inspection Summary:
A rescission request from Henderson County was received by RCO on August 25, 2014. An inspection of this facility was
conducted October 3, 2014 by Mike Randall (RCO Stormwater) and Laura Herbert (ARO). Based on our inspection, we
agree that the stormwater exposure of the process is minimal and that the permit can be rescinded. Natalie Berry of
Henderson County was our on -site contact during the inspection. Note that since the issuance of the permit in 2011,
capital improvements have been made including the installation of a new convenience center where recyclables are
dropped off for separation and pickup by recylers and separation of the leachate collection system from the stormwater
system. The following areas (with associated comments) were inspected.
Convenience Center - This center is new and was noted as being clean with potential stormwater exposures minimized or
not significant. Natalie indicated that they sweep this area, usually daily. Used oil collection, cooking oil collection,
battery collection, used diesel/keros44-.oliection, and electronic collection areas are all under a shed with sedondary
containment. However we did note some drums and car batteries outside on pallets. Natalie was instructed that these
should be moved under cover, and during our inspection the batteries were moved under the shed roof. -She indicated that
they would move all drums under roof, even if they had to extend the shed roof. This is a BMP and Henderson County was
reminded to maintain this BMP. The electronics wrapping area is not under cover, but this appears to be a low -risk activity
with respect to stormwater exposure. Once wrapped, the electronics are stored in the back of a semi -trailer (for pick-up).
The Whitegoods collection area (including the bin) is not undercover, but appears to be a low -risk activity with respect to
stormwater, Freon is removed prior to binning these items.
Commerical Recylers area - This is the area where commercial recyclers deliver their materials. The collection bins have
sloped drains underneath each that collect any leachate from the bins, and this is piped to the leachate collection system
(which goes to a sanitary sewer/treated).
Transfer Station - previously the recycle area was here, however this has been moved to the new convenience center (see
above comment). This area is covered with three enclosed sides. In response to a DWM inspection (May 10, 2013) which
discovered that the leachate collection system from this area was tied into the stormwater system (violation), the county .
converted the stormwater system into the leachate system as part of the required corrective actions. This area is.permitted
by DWM and the leachate is pumped to a sanitary sewer for treatment. With the new leachate collection system,
exposure of the leachate to stormwater has beeii addressed and exposure of the transfer operation to stormwater has been
minimized.
Vehicle Maintenance Area (adjacent to the Transfer Station) - We noted two drums outside that appeared to contain used
oil filters and used oil or antifreeze. There was some spillage noted around the drums. We instructed Henderson County to
move ALL drums In the building to prevent this type of potential exposure and to dean up the area where the spill was.
Natlie agreed that they would do this. An illicit discharge previously discovered has been addressed (drain in floor has been
eliminated). The crew was washing equipment at the time of the inspection. This practice should be reviewed by
Henderson County and exposure to the stormwater drains limited, or potentially an NPDES wastewater permit review of this
process may be necessary.
Fuel Station - Two above ground off -road diesel tanks and one gas tank were observed. Henderson County was reminded
that they must follow the Spill Prevention, Control and Countermeasure Plan (SPCC) Program for these tanks.

Mike Randall and I inspected the subject site on Friday, October 3, 2014. Based on our inspection, we both agree that
the stormwater exposure of this process is minimal and that the permit can be rescinded. See the attached inspection
report for more details on our inspection findings. Will RCO issue the Rescission Letter? Also, will you all include a copy
of the inspection report with the letter? I would like to send one to Natalie if it is not attached to the Rescission
Letter. If you have any questions of need more information, just let me know.

We have been working with Natalie for some time now trying to characterize this site. Prior to the SW transfer, Susan
Wilson was working with Natalie. Natalie was instructed by both Susan and us to develop an SWPPP plan. I met with
Natalie on March 7, 2014 to review her drafted SWPPP plan and discuss the site. During the meeting Natalie indicated
that at this site, people bring in white goods/scrap metal and electronic goods for recycle. These goods are then sorted
for pick up by recyclers. In addition she indicated that there is a grate/outlet (potential SW exposure) under the white
goods/scrap metal collection container. This site is adjacent to a closed landfill, a school bus garage, and vehicle
maintenance area (see attached site plan that Natalie provided in March). There's a lot going on out here, and I think a
site visit is necessary to determine what operation, if any, is subject to SW permitting requirements. Natalie should
clarify what activities are occurring at this site. On the form she indicates that no "processing of recyclable materials
takes place." I recommend a site inspection prior to a decision on the rescission request. I will follow up with Ken
regarding his discussion with Natalie. We will schedule an inspection in the near future, and let you know our findings,

forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state — NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215
and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency
dated October 15, 2007 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the
certificate of coverage. This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of land Resources, Coastal Area
Management Act or any other federal or local governmental permit that may be required.

Brian — I've been working with Henderson Co to make sure they get their NOI in for their recycle facility. Looks like they
have applied. If you're working on that one — let it rip and I can make sure they get their outfalls straightened out, etc.
They're in the process of constructing some new areas that will be better re. SW runoff — so it's a bit in flux.
