Box 590 Raleigh, NC 27602 Dear Mr. Shouse: You have our approval to place till material in 0.22 acres of wetlands or waters for the purpose of' constructing a softball field at Walnut Creek Recreation Complex, as you described in your application dated 31 May 1996. Alter reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This Certification replaces on issued on 8 June 1996 due to the incorrect acreage on the application. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any oilier tederal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. S. Army Corps of Engineers (AEC) on October 31, 1990 for impacts to 1.80 acres of wetland/surface waters associated with development of a multi-purpose recreational complex in Wake County. This facility is located near the southeastern city limits of Raleigh between SR 2544 (Sunnybrook Road) and I-440 (Figure 1). The N.C. Division of Environmental Management (DEM) issued 401 Water Quality Certification for this project on September 28, 1990. Copies of the permit and certification are attached with this letter. Initial plans called for development of an outdoor amphitheater (Walnut Creek Amphitheatre) on property south of I-440, and dual softball complexes with associated amenities on the northern tract. The amphitheater and one softball complex were completed in 1990 and 1991, based on available funding and public need. Approximately 1.62 acres of jurisdictional wetlands and surface waters were impacted by this phase of development. The City of Raleigh wishes to proceed with completion of the second softball complex (see attached site plan). This effort will require unavoidable encroachment into a small tributary system located on the eastern perimeter of the project area, potentially resulting in 0.20 acre of impact. Impacts associated with this phase of development were part of the initial 1990 permit request. Wetlands and surface waters on the subject property were delineated by Environmental Services, Inc. (ESI) in the fall of 1990 and subsequently approved by your office (see attached wetland delineation). However, due to time delays, the delineation and the permit have expired. AEC biologist Mr. Brian Derosa met on-site with Mr. David Shouse, City of Raleigh, and ESI biologist, Mr. Richard Harmon, on May 17, 1996 to review the original delineation. Mr. Derosa concurred that conditions remained unchanged from the 1990 submittal. Therefore, the City of Raleigh seeks re-authorization of NWP #26 for 0.20 acre of impact associated with development of this second softball complex. A Pre-discharge Notification application is hereby submitted, along with support documentation. The period allowed by regulation for us to review your pre-discharge notification has expired. Consequently, your proposed project is authorized provided it complies with the criteria for authorization by Nationwide Permit #26. A separate Department of the Army permit is not required providing the work is performed as described in the pre-discharge notification and in accordance with the conditions listed in 33 CFR 330.5(b)(1-14) (copy of list enclosed). Other State and local authorizations may also be required. This verification will be valid until the nationwide permit is modified, reissued or revoked. All nationwide permits are scheduled to be modified, reissued or revoked prior to January 13, 1992. It is incumbent upon you to remain informed of changes to the nationwide permits.
