we are forwarding herewith the subject certificate of coverage (COC) to discharge under the
subject state — NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended). In accordance with your request, Certificate of Coverage Number
NCG050118 is simultaneously rescinded.
Please take notice that this certificate of coverage is not transferable except upon
approval of the Division of Energy, Mineral, and Land Resources. The Division of Energy,
Mineral, and Land Resources may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Energy, Mineral, and Land Resources, the Coastal Area
Management Act, or any other federal or local government permit that may be required.

During a routine review of our environmental permits and related records, Valspar noted a
discrepancy between the facility SIC code (2851) and the applicable SIC codes for the current
facility General Storm Water Permit (# NCG0501 18).
Valspar contacted Ms. Donna Hood (NCDENR-DEMLR) to notify NCDENR of the discrepancy
and solicit guidance on what steps needed to be taken. Ms. Hood recommended that we request
rescission of the NCG0501 18 permit and file a NOI for a NCG090000 General permit with the
Permitting Section.
Based on this guidance, Valspar hereby requests rescission of our current permit (# NCG0501 18).
Enclosed are the following documents:

Representative Outfall Status Request

Dear Mr. Keene:
The Mooresville Regional Office staff have reviewed your request dated August 24, 2009 for a
determination that stormwater discharge outfall (SDO) 003 be granted representative outfall status for
stormwater outfalls 001 and 002. Based on the information and maps provided and the site visit of
September 25, 2009, we cannot approve this request. 40 CFR §122.21(g)(7), authorizes sampling of
representative outfalls when conducting analytical monitoring. Since you do not perform analytical
monitoring under NCG050118 (no vehicle maintenance is performed on site) representative outfall status
cannot be granted.
However, from the site visit of September 25, 2009, the Mooresville Regional Office staff determined that
there is only one outfall which discharges stormwater from your site. The stormwater pond on site
collects the stormwater from what is currently designated as Outfalls 001 and 002 and discharges the
comingled water through the discharge pipe from the pond through Outfall 003. Therefore, Qualitative
Monitoring should only be performed at Outfall 003 semi-annually as required by NCGO50118 and
Qualitative monitoring at Outfalls 001 and 002 can be discontinued. This approval is effective with the
next sampling event.
Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit. If changes in
drainage areas, structures, or other activities occur that significantly alter the basis of this outfall
determination please contact our Office. If you have any questions or comments concerning this letter,

• Part I[ Section A — Several minor exparnsiorts and clarifications of the required content of the Stormwater
Pollution Prevention Plan have been added. Please be sure that your pill) is updated to comply with the new
requirements.
• Part 11 Section B — Qualitative monitoring must now be conducted during a representative storm event.
• Part if Section B — The permittee is required to keep a written record of his response to problems identified by his
qualitative monitoring observations.
• Part 11 Section C - For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil
Per month, new provisions require (hat discharges front the vehicle maintenance areas be sampled twice per year,
and that the sampling results be compared to new numerical benchmark values. (The previous cutoff
concentrations have been eliminated.)
• Part I1 Section C -- For facilities with vehicle maintenance activities usin- more than 55 oil
per month new provisions require the perrnittee to execute Tier One and Tier Two response arctionsebaseds Of liwtor oil he
first benchmark exceedence (Tier One) and the second consecutive benchmark execedence (Tier Two). Tier Two
requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three
consecutive monitoring events show no benchmark excecdences.
• Part II Section C — This part contains a new provision that four exceedences orally particular benchmark will
trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may
direct the perrnittee to apply for an individual permit, or may direct the implementation or installation of specific
stormwater control measures.
Your coverage under the Gcneral Permit is transferable only through the specific action of DWQ
This permit does not aflect tite legal requirements to obtain other permits which may be required by DENIZ, nor does
it relieve the perrnittee from responsibility for compliance with any other applicable federal, state, or local law, rule,

of Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency
dated December 6, 1983.
The following information is included with your permit package:
■ A copy of the stormwater general permit.
■ A Stormwater Pollution Prevention Plan Certification Form. This form certifies that you have
developed and.implemented the Stormwater Pollution Prevention Plan (SPPP) required in your
permit. This form must be completed and returned to the Division within 30 days of receipt of
this letter. DO NOT send the SPPP with the signed form.
Five copies of Analytical Monitoring forms.
■ Five copies of Qualitative Monitoring forms.
■ A copy of a Technical Bulletin on the stormwater program which outlines program components
and addresses frequently asked questions.
■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the Iegal requirements to obtain other permits which may be required by
DWQ or permits required by the Division of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
