The Division of Energy, Mineral and Land Resources received your rcqucst to rescind your coverage
under Certificate of Coverage Number NCG080667. In accordance with your request, Certificate of
Coverage Number NCG080667 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NI'DES permit is against federal and state laws and
could result in fines. If something changes and your facility would again require stormwater or
wastewater discharge permit coverage, you should notify this office immediately. We will be happy to
assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential aced for NPI)ES permit coverage.

You reported that although you retain ownership or control of the facility, you have ceased all regulated
activity, and there are no materials remaining on site that may resent a risk of stormwater 2ollution.

Operating a treatment facility, discharging wastewater, or discharging specific types of stormwater to
waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of
up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished
permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the
site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future
you wish to again discharge to the State's surface waters, you must first apply for and receive new
coverage under an NPDES permit.

Inspection Summary:
This inspectin was conducted in response to a Recission Request from the Town of Carolina Beach.
The site is no longer being used as a maintenance garage. The site is being used as storage for 6 portable generators on
trailers but is under cover and not exposed to stormwater.
BUT 4-55 gallon metal drums were observed and exposed to stormwater. Two of the drums contained port-o-john fluid, one
contained paint and the other was not fabled and showed signs of rusting.
Also, and an old generator with batteries and cracked oil tank with oil smell was not under cover and exposed to
stormwater.
Once the old generator and filled drums are removed or covered please contact this office so a follow up inspection can be
conducted.
A recission is NOT recommeded at this time.

I assume that you have read Jean Conway's inspection results. Please notify the Town of Carolina Beach of our findings
and relay the steps that she outlines in order to reconsider the rescission request. Also ask if the emergency generators
that are stored there are also maintained there, and if so, the frequency and volume of motor oil involved, so that we
know if it is appropriate to rescend.

I went to the site today but cannot recommend a rescission:

herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of Agreement
between North Carolina and the US Environmental Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to request an individual permit by submitting an individual permit application. Unless such demand is
made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water
Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of
coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the Division
