I don't remember this discussion about Carolina Biodiesel, and we don't have any paper record that I can find about
NCGOS vs NCG06. I see that in 1993 Unity Oil was permitted under NCGO8 at this site. So, 1 guess they were a heating
oil distribution company, which makes sense for NCG08,
Wait .... Maybe this is the one that started off taking in the grease/oil, straining it, and otherwise processing it a
minimum amount to clean it up and re -sell it still as essentially non-food grade oil (only suitable for French -frying at
CharGrill). But they had plans to make bio-diesel or other products as the market developed. Does that correspond
with the correspondence you saw in their file? if so, I think we left it at that time that when/if the NCGO8 ever became
insufficient to address the stormwater pollution risk, we could consider what type of permit coverage to replace it with.
I think the choice at that time was whether to just switch owners of the NCGO8, or whether to issue a new NCG06 or an
NCS. 1 think we chose the low -effort path, and just processed a Name/Ownership change for this green/recycling start-
up business (at the time.)
Dave, unless you feel that these folks are a stormwater risk that should be addressed by a permit change now, 1 think we
would see orocessinq their new permit opolicatioo as low priority for us over the next several months. We probably will
wont to re-evaluate their permit coverage someday, but not now unless you see a significant risk. If there is no
immediate significant risk, then I think we would be content to consider that they are under permit with us, they ore on
the RRO inspection schedule, they hove to implement a SPPP, and they hove to do visual monitoring.
Food materials -> mulch, grease -> drummed for re -sale, Process water -a probably discharged: I hope you mean to the
POTW. If there is a surface water discharge of the process water then they need a wastewater permit from our brothers
and sisters in NPDES (or they need to cease and desist immediately.)
Let us know what you think about this. If you would copy us on your inspection report, I'll file it to serve as a refresher
when/if we pull this file to investigate alternative permit coverage.

Ken,
I was at this facility in Durham last week and conducted an NCGO8, which does not require analytical - no
vehicle maintenance. The facility did fairly well during their inspection, SPPP, Qualitative was compliant. Their
observation monitoring point was not in an all encompassing point - and we addressed that. They did not
have a copy of the permit - but had paid their annual fees.
As I reviewed their documents, I saw some correspondences from September 2010 concerning moving them
to a permit that fits their process better - NCG06 - or possibly an individual. Do you retail any resolution to
this or is the NCGO8 the proper permit for them?
They collect used grease from restaurants and cook it down to separate the food materials, grease and water.
The food material is applied to mulch, which turns to rich "soil", and the grease is put in drums and sent off to
be reused as fuel. The water discharges, I think - not sure.
Any thoughts? They may be fine, just waiting for your input before writing their letter.

Marc,
Thanks for taking the time to speak to me today. I've spoken with Brian Lowther, and with Robert Patterson on how we
should look at facilities with biodiesel production. Brian returned your NCG08 application last October, and Robert has
permitted other biodiesel facilities recently. It looks like we've permitted these facilities in a couple of different ways in
the past. Here's what makes sense to us for your circumstances at 1410 Cross Street in Durham:
• We are returning your application submitted on the NOI form for General Stormwater Permit NCG130000. It
looks to us like a better fit between the permitting conditions and the manufacturing activities can be found in
our General Permit NCG060000,
As per our phone call today, and as per our current understanding of your facility at 1410 Cross Street, we can
permit your facility under the Stormwater General Permit NCG060000. This General Permit is specifically for
facilities categorized in SIC Major Group 20, as well as some other Major Groups. You have reported on the
December 2009 application being returned today that one of your SIC codes is 2076, which would be
appropriate for NCG06. SIC 2076 is for, "Estoblishments primarily engoged in manufacturing vegetable oils..., or
in processing similor purchased oils other than into edible cooking oils." You and I read this selection from the
OMB's 1987 SIC Manual together over the phone, and you agreed that this was a pretty good description of the
manufacturing process at 1410 Cross Street.
In addition it seems to us that Brian's earlier communication indicating that an Individual Stormwater Permit is
appropriate is also still a valid permitting path for you. The other SIC code that you reported in today's returned
application, SIC 2869, would cause us to consider first an Individual Permit. We use Individual Permits when we
have not developed a General Permit for a particular industry sector, or where because of unusual site
conditions we judge that a General Permit may not be sufficiently protective of the receiving waters, or where
we feel like we don't know an industry well enough to assess the risks inherent in that industrial activity (like,
perhaps, the manufacture of biodiesel.) The permittee can also request to be switched from one permit type to
another, and we occasionally accommodate those requests when we judge the action is merited, as when site
activities or conditions change, or when our initial issuance of a permit was in error. Typically, but not always,
businesses prefer coverage under a General Permit when we agree that it's appropriate.
There may be other sites where our General Permit NCG08 is appropriate — for example, sites where biodiesel is
perhaps being distributed like a fuel oil, but not actually being processed in the way we understand the activity
at 1410 Cross Street. This suggests that the permit still active at the 1404 Angier Avenue site was probably
appropriate when that site was a fuel oil/heating oil site (NCG080079.) But, as I understand conditions at that
site now, it may no longer be appropriate.
In summary, it looks to us like both NCG06 and an Individual Permit may be valid ways to permit your site.
NCG08 may be appropriate for sites that resemble heating'oil distributors. And while NCG13 may be
appropriate for some sites, it seems to us that these might be fewer in number than those where the other
General Permits would be the best choice.

I understand from our phone conversation that the 1410 Cross Street site is currently dormant. Here's what I'd suggest
as a course of action before you're ready to resume operations:
• Reapply for authorization to discharge stormwaters from your site. Discharging stormwater from an industrial
activity without a permit is a violation of North Carolina law and rule. You can apply either under NCG06, or
under an Individual Permit. The application forms are different, but both may be found on our website.
• If you are still the owner, or operator, of the site at 1404 Angier Avenue, let's review the site activities and
permit coverage together by phone to be sure it's appropriate. We at least want to correct the ownership away
from Unity Oil Co. If you are no longer associated with that site, then please petition us to have your contact
information and the name Carolina Biodiesel removed from our database. Absent any contrary information, it
looks to us like you are still the operator, and therefore the responsible party, for that site.

This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .l and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

and IV of General Permit No. NCG080000 as attached.
This Certificate of Coverage shall become effective June 18, 1993.
