coverage under Certificate of Coverage Islumber NCG070215. In accordance with your request,
Certificate of Coverage Number NCG0702-15 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of
stormwater to waters of the State without valid coverage under an NPDES permit is against
federal and state laws and could result in fines. If something changes and your facility would
again require stormwater or wastewater discharge permit coverage, you should notify this office
immediately. We will be happy to assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would
inform the new or prospective owners of their potential need for NPDES permit coverage.

III. REQUIRED ITEMS
A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must lie completed and signed by both the
current permit holder and the new applicant if this is a change of ownership.
2. Legal documentation of the property transfer to a new owner.
3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by 1lhe permit and if not already submitted to DWQ.
5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. if this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

This package is being sent in order to change the permit holders of the below -listed stormwater permits
in North Carolina. As background, on October 28, 2016, Boral Bricks Inc. converted to a limited liability
company named Boral Bricks LLC. On April 1, 2017, Boral Bricks LLC and Forterra Brick, LLC merged into
Meridian Brick LLC, with Meridian Brick LLC being the surviving entity. Additionally, Meridian Brick LLC is
the successor in interest to both Boral Bricks LLC and Forterra Brick, LLC by operation of law.
Additionally, a letter from Paul Samples, (:EO for what was Boral Bricks LLC, Forterra Brick, LLC and is
now Meridian Brick LLC, is included which grants me, J. David McKeown, signatory authority for any

In accordance with your application for a discharge permit received on January 3, 2017 we are
forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of'Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except upon approval of the
Division of Energy, Mineral and Land Resources. The Division of Energy, Mineral and Land
Resources may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
the Division of Energy, Mineral and Land Resources, the Coastal Area Management Act, or any other
federal or local government permit that may be required.
In addition to your application for coverage under NCG070000, we also received your request to
rescind coverage under NCG020000. In accordance with your request, your coverage under
Certificate of Coverage NCG020789 has been rescinded effectively immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of' stormwater to
waters of the State without valid coverage under the appropriate NPDES permit is against federal and
state laws and could result in lines. If your facility begins mines dewatering activities, or if
stormwater is discharged from the sediment pond on your property, your facility would again require
coverage underNCG020000. In that case, you should notify this office immediately.

For stormwater permit number NCG020789 held by Forterra Brick -Monroe, please find enclosed the
documents to change the permit to the NCC-70000 series.
During a previous inspection, the inspector noted that the facility was covered by permit number
NCG020789 but felt the more correct coverage would be under the NCG070000 series permit. At our
request, a second inspection was conducted to verify the proper permit coverage. As noted in this second
inspection, which is attached for reference, this verdict was verified.
As such, this submission contains the following documents:
1. NOI to be covered under the NCG070000 series permit
2. Check in the amount of $100
3. Email and inspection report agreeing that the permit should be changed

David please see the attached stormwater inspection report. We concur that the site should be permitted under
NCG070000. The mine inspection was a result of a complaint of mud on Hayes Road. The road was clean during the
inspection but they were not Mauling West of Hayes Road. Please have them re -install construction entrances on both
sides on Hayes Road.

Comment: The inspection was a result of a reauest W evaluate what is the approodate General Stormwater
Permit for the site. Mlninp (NCG020000) or brick manufacturing(NCG070000). After observing_
all the site outfalls the stormwater discharging from the site is from the brick making industrial
activity. Very little stormwater leaves the site from the mining activily, it drains to the pit on the
East side of Haynes Road and with the large sediment basin on the West side of Haynes Road,
no evidence of a stormwater discharge was observed.
