Greetings. I left you a voicemail this morning and last week re: our longstanding NPDES permit app. Relating to that
subject - I was contacted today by Dave Parriel. He indicated he needed to conduct an NP=related inspection asap.
I let him know we'd like to work with him.... however, we have not received the permit... Mr. Parnel's records indicated
it had been issued within the last 2 weeks. What must have happened is since we have waited so long for the
process .... we have since initial application submittal, relocated our corporate office from Woodstock, Ga. to Jasper, Ga.

In accordance with your application fora discharge permit received on October 4,
2007, .we are forwarding herewith the subject certificate of coverage to discharge under the.
subject state - NPDES general permit. This permit is issued pursuant 'to the requirements of
North Carolina General Statute.1413-215.1 and the Memorandum of Agreement between
North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
Please take notice that this certificate of coverage is not transferable except by
specific action of the Division of Water Quality. The Division of Water Quality may require
modification or revocation and reissuance of the certificate of coverage. ;
Ir accordance with the diffuse flow requirements of the Tar -Pamlico River Basin
riparian buffer protection rule (15FL NCAC 2B .0259), all stormwater drainage from portions of
this site constructed after January 1; 2000 must be discharged through a level spreader or
another device that satisfies the diffuse flow requirement in the rule. Level spreader design
requirements are described in Chapter 8 of the North Carolina Stormwater BMP Manual,

This permit does not affect the legal_ requirements to obtain other permits which may
be required by the Division of Water Quality or permits, required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit
that may be required.

I agree that Ron's earlier visit be used as RRO's investigation and proceed with
issuing the permit.

Tom,
Your application has been re -assigned to me, and it is now on my desk for
processing. I apologize for our delay. I expect to be able to turn my attention to
it by the end of May, and to have a Certificate of Coverage under the General Permit
to you by mid -June.
I have one comment from a quick scan of your NOI. In Item 11 you note that the
Stormwater Pollution Prevention Plan has been brought over from a former location.
Please note that a SPPP is intended to be a site -specific guide to managing the
stormwater flows from the permitted site. The required contents include a graphic
Site Plan (obviously not transferrable from one location to another) as well as
narrative information that is site specific. Please be sure that the SPPP
transferred from your other facility has been fully modified to reflect the actual
site conditions at 136 Full Circle in Battleboro, Edgecombe County, and that it
contains the required information listed in the General Permit.
Your obligations under the General Permit NCG070000 (once we issue the Certificate of
Coverage to you) include twice -per -year visual monitoring (and twice -per -year
analytical monitoring if you have vehicle maintenance areas) and preparation of a
site -specific SPPP. The General Permit is under revision, and within the next week
the new version may be found on our website. For the next few days our draft version
of the permit may be found at:

(Note that there may be very minor changes to this draft when we issue the final
form.) Within the week the new final version of NCG070000 will be posted on our
website.
Stephanie - I hear from Myrl that you have picked up Edgecombe County now that Ron
Boone has left. If a compliance inspection of Full Circle is eventually scheduled,
I'd like to provide this heads up to check on the specificity of their SPPP.

I'm trying to track down a NOI from Full Circle Solutions, Inc. in Battleboro, NC
(RRO). Applicant has not received a: response from us, yet.
Application # NCG070177, received 10/4/07, assigned to Aisha, $100 fee paid.
One bit of previous history - facility initially submitted an NCGNE, but we rejected
it based on a visit by Ron Boone.

Dear Mr. Waldrop:
The Division has reviewed your submittal of the No Exposure Certification for Exclusion from
NPDES Stormwater Permitting form, which we received on March 19, 2007. The Division is unable
to concur with your certification of no exposure.
During a recent inspection of your facility, staff from DWQ's Raleigh Regional Office found that
materials, on your site either are exposed, or have the potential to be exposed. DWQ cannot grant
your requested exemption from permit coverage when materials are exposed or have the
potential to be exposed.
Further, it appears that the site is discharging stormwater without a permit, and may be subject
to enforcement action and to a civil,penaity assessment of up to $25,000.00 per day for each
violation. Please make application for an NPDES individual stormwater permit using EPA Forms
1 and 2F, available on the DWQ Stormwater Permitting Unit website at:
http://h2o.enr.state.nc.us/su/Forms--Documents.htm.

Ron,
Yeah, his permit application should come to the Stormwater Permitting Unit, and it
may or may not be assigned to me. There are several of us that will be able to work
through the complicating circumstances at this site, it doesn't necessarily have to
come to me just because I have some short history with them on the NEC rejection.

The gentleman from Full Circle {Tom Snow} called me on Friday and left a
message on my machine about the NEC issue. Of course they're still hopeful
to get the NEC and took steps in that direction per my advice, but they just
didn't/couldn't do enough. I already informed their site manager, Shane
Flynn, that we won't be able to issue and that they should receive a letter
soon.
Mr. Snow did let me know their former COC number. Is was NCG070094.

We decided to follow your lead, and just send a rejection of their
request for no exposure. No NOV, as per your recommendation. I thought
that letter went out last week, and that we copied you. I'll check back
in my correspondence to be sure. - - - - Yes, it went out Wednesday,
9/19/07, with a copy to you. And, the letter notifies them that it
appears to us that they are discharging without a permit, and it directs
them to apply for a stormwater permit.
