Box 431 Paw Creek, North Carolina 28130-0431 Dear Mr. Morvan: Dee Freeman Secretary Subject: Denial of Permit Rescission Request Stormwater Certificate of Coverage NCG070158 General Stormwater Permit NCG070158 Precast Construction Products, Inc. 7000 Old Mt Holly Road, Charlotte Mecklenburg County Mr. Ron Eubanks from Charlotte-Meck#enburg Storm Water Services (CMSWS) conducted an inspection of your facility on June 11, 2008, to determine compliance with your Certificate of Coverage under General Stormwater Permit N00070000, for discharges from facilities engaged in activities associated with Stone, Clay, Glass, and Concrete Products manufacturing. At the time of the inspection you were not in compliance with the requirements of NCG070000 and you were issued Notice of Violation NOV-2008-PC-0501. In response to the Notice of Violation, you requested rescission of your Certificate of Coverage under NCG070000 or August 20, 2008. Your request was based on a City of Charlotte construction) project to rework the stormwater infrastructure in and around your site, which you believed would remove the stormwater outfall on your property. You were informed (verbal communication through Mr. Eubanks) that permit rescission would not be considered or processed until the Division of Water Quality (DWQ) could assess the stormwater flow after the construction was completed. The projected completion date of the stormwater project was late 2008 but was not completed until the end of 2009. During this time the Certificate for Coverage under NCG070000 had expired and the permit fees went unpaid due to the uncertainty of the need for permit coverage. Ms. Marcia Ailocco from DWQ and Mr, Ron Eubanks from CMSWS visited the subject facility on February 22, 2010, to ascertain the flow of stormwater at the facility post construction. The site visit found that stormwater flows from the site to two separate outfalls and there is exposure of industrial activities to stormwater; therefore permit coverage is still required. Immediately prior to the site visit a quaYying rain event had occurred and therefore water quality readings were taken. The readings demon5tratEtd impacts to the stormwater runoff (elevated pH) from the industrial activities at the Precast Construction Products site. The water quality readings and associated locations relative to the Precast Construction Products site are noted in the enclosed document. Denial of permit Rescission, Page 2 March 9, 2010 It was noted during the site visit that concrete truck cleanout washwater may be comingling with stormwater on site. Please be aware that concrete truck washwater is considered a wastewater by the Division of Water Quality and cannot be discharged to surface waters without a separate permit. Your coverage under NCG070000 does not allow for this type of discharge. You should take any necessary steps needed to ensure the wastewater is not discharged from your site. Therefore, the Division of Water Quality is denying your request for rescission of your coverage under General Stormwater Permit NCG070000. The Stormwater Permitting Unit will be contacting you to submit a Notice of Intent to continue your Coverage under the General Permit and to forward the outstanding invoices for the stormwater permit fees from 2008 and 2009. The first is the large drop inlet in the middle of the property that was recently installed as part of a City of Charlotte Stormwater rehabilitation project. The property is sloped so the area directly adjacent to this inlet drains to it. The second outfall is the drop inlet in front of the property along Old Mount Holly Road. Approximately 113 of the site runoff would enter this outfall as sheet flow on the impervious surfaces of site or from sheet flow through the chain link fence to the drainage ditch along Old Mount Holly Road. Page: 2 Precast Construction Products Water Quality readings 2/22/10 The water quality readings were taken by M. Alloccc. (DWQ) and R. Eubanks (MCWQP) using an YSI multi - meter calibrated by MCWQP. Sample 1— Water quality readings were taken in the ditch that fronts the PCP property after the water was exposed to concrete residue that had sloughed off through the chain link fence. This water was entering the newly constructed drop inlet along Old Mount Holly Read. Time — 11:36 am pH — 9.36 SU Conductivity — 203 [6/cm Temperature -- 8.22 degrees C Dissolved oxygen —10,65 mg/L Sample 2 — Water quality readings were taken of the water entering the drop inlet along Old Mount Holly Road that was draining from the eastern portion of the PCP property. This permit expires on March 31, 2003, The Division staff is currently in the process of rewriting this permit and is scheduled to have the permit reissued by early spring of 2003. Once the perrnit is reissued, your facility would be eligible for continued coverage under the reissued permit.
