You reported that continued permit coverage is not required because the site activities are not regulated by the NPDES stormwater permittinrpropram. Discharging regulated industrial stormwater, discharging wastewater, or operating a treatment facility without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. The Division may pursue enforcement action on persons that have voluntarily relinquished permit coverage when continuing permit coverage was necessary. Basically after speaking with them I believe it would be best if we issued one permit to this facility - the President of Nomaco, Inc. has the signatory authority for both facilities and some of the stormwater from one site may run into and comingle with the stormwater from the other. He said the parking lots were adjacent and contiguous. Did you get a chance to view the Spongex facility/parking lot when you were there? Do you have any reservations about issuing this permit as one permit or do you believe there any potential impacts to wetlands? If we don't receive any objections, we'll issue the COC on January 5th, 2008. Because of the contour of the land, there might be drainage to the same system. There are only 2 discharge points. The product is different One foam is a polyethylene foam — Nomaco Spongex is PVC foam. The property is leased (needs to verify). I don't have any concerns about issuing the permit and there should be no wetlands impact. I haven't done that extensive a site survey but wetland maps show the closest one about 1,000 feet away. Let me know if you need anything else. Oh, Kelly mentioned in an email to me about Novozymes that when she goes on maternity leave, you'll be handling that permit. I already answered her concerns. The owner and signatory control is with the Nomaco President Julian Young (the stormwater permit would be issued to him) 2. The facilities are on contiguous lots and have contiguous parking lots between the buildings 3. Stormwater from one building area may go to the other site and discharge with the stormwater from the other site. If Spongex, LLC or the Nomaco, Inc. Tarboro facility were to be sold or moved your stormwater permit would then have to be revised. The permit owner, Julian Young, will be responsible for abiding to the stormwater permit conditions at both sites and will be responsible for stormwater discharge at both addresses - Nomaco, Inc. at 3006 Anaconda Drive and Spongex, LLC at 3002 Anaconda Drive.
