After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for die purpose and design that you described in your application. 11' you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go. ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 clays of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733- 1786. As a result prior to the DEM's receipt of a Permit application, I submitted comments to the Wetlands Group. The following is another copy (version) of RRO's comments and the attached staff report. The wetlands that are proposed to be impacted primarily include the stream channel (the unnamed tributary of Marks Creek in the Neuse River Basin). The stream channel is approximately 5 to 10 feet wide and 5 to 8 feet deep, providing little or no opportunity for overbank flooding. The stream it self had a sandy bottom with minimal leaf litter accumulation, indicating storm event flow and scour are likely significant in this stream. Current information that I (RRO) have available indicates that no Federal Endangered Species currently are known to use this portion of the stream. RRO's Recommendation.. Norwood, Wake County, Marks Creek, Neuse River Basin, 960159 Staff biolosists with the North Carolina Wildlife Resources Commission have, reviewed the subject project. Our comments are provided in acc*rdanca with certain provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.). The applicant proposes to destroy 0.82 acres of wetlands, primarily stream channel, to create a fish pond. We recommend that the applicant create 0.82 acres of emergent wetlands at the upper reaches of the pond to mitigate for the 0.82 acres of wetlands that will be destroyed.
