APPROVAL of 401 Water Quality Certification

Dear Mr. Thornton:
You have our approval to retain and place fill material in 1.23 acres of wetlands or waters for the
purpose of constructing a road crossing and upland building at Thornton Road, as you described in
your application dated 9 January 1996 . After reviewing your application, we have decided that this
fill is covered by General Water Quality Certification Numbers 2671 and 2732. These certifications
allow you to use Nationwide Permit Numbers 14 and 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other'federal state or local permits before you go ahead with your
project.
If you do not accept 4ny of the conditions of this certification, you may'&sk for an adjudicatory
hearing. ?-ou must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
401 of the. Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-

Dear Mr. Dorney and Mr. Alsmeyer:
The purpose of this letter is to inform you of proposed and potential existing
wetland impacts and request Nationwide Permits 26 and 14, and a Section 401
Water Quality Certification, for the project to be known as the Thornton
Property. The project is located just north of Raleigh, NC (Wake County) and is
adjacent to the west side of Thornton Road, east of US 1 North; as shown on the
enclosed vicinity map.
The impacts described in this application cover suspected existing impacts and
those required to construct a roadway to access upland areas. The wetland
delineation has been reviewed in the field and approved by Mr. Brandon
DeRosa of the US Army Corps of Engineers. The current wetland extents are
included on the impact map.
The previously filled area (approximately 0.60 acres) was estimated based on a
comparison of 1991 topographic maps to a current map of the extent of fill. It
assumes that all fill since 1991 was in wetlands. Inspection of historical aerial
photographs and other background research suggest that there was no fill in
wetlands prior to 1991. Therefore the estimate of previous wetland impact
should be viewed as the maximum' possible. An additional 0.31 acres has been
proposed in case any additional impacts are required for the safe stabilization of
the area.
It will be necessary to impact 0.32 acres (see map) of jurisdictional wetlands
above headwaters for placement of the proposed roadway. In order to minimize
impact, the road crossing is perpendicular to wetland alignment.

The wetland must be crossed to utilize uplands. The road crossing is at a right angle to the
wetland, at the narrowest point.
