ATC requests must be submitted at least 90 days prior to construction'. For existin mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities: This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place. !2enstWctlon, modification or Installation of any new tLeAtmentcomonents aten existin site requires an ATC. (if the site is already covered by NCG020000, the ATC request may be submitted without an NOI). Some wastewater treatment facilities used to treat or recycle process wastewater (even if commingled with stormwater) at mining sites will require an ATC prior to construction per 15A NCAC 2H .0138. Please see the NCG020000 General Permit for details about which treatment facilities require an ATC (summarized in Table 1 at the end of this form). For example, an ATC is required for treatment of mine dewatering discharge from clue pits and non -closed -loop wastewater recycle systems. Edenton Road Street, Hertford, NC, in Perquimans County. The rcquested permit arca is located on wide, flat, sandy farmland and will not present any problems regarding runoff to adjacent areas. The purpose of the excavation will be to serve eventually for recreational purposes by Mr. White and as a water source for agricultural use on his farm. The excavation area will be located geographically 120 feet from the nearest public highway or dwelling and is accessible only by a private access road. A constructed berm with foliage and trees will provide adequate screening of the miming operation. Access to the per.mit area is limited by private property, and private gated road access. There will be minimum 25ft wide unexcavated buffers on all sides of the permit area. Upon receipt of the approved permits from NCD1JNlt, Mr. Brown plans to excavate the minc to an average depth of 20 feet below seasonal high water level, and will include construction of proper cut slopes on all sides of the excavated area, as required in the permit. Reclamation of the mine area will include grading, leveling, and grassing of all affected areas. The entire process should be completed within 5 years. At this time Brown's band Developing, Inc. is submitting a mining permit application to the NCDENR Division of Energy, Mineral and .I.,and Resources, and a dewatering permit application to the NCDI�NR Division of Water. Quality. Copies of each application arc included in duffs packer. All adjacent landowners have been contacted and made aware of the proposed thine operation, and land entry agreements have been obtained. The mine area will be well -marked with warning and keep out signs to prevent inadvertent public access. Edenton Road St., Hertford, NC 27944 County: Perquimans County Prepared by: Ken Elliott, consulting Date: November 11, 2013 This plan defines responsibilities for operating, inspecting, and maintaining equipment and structures used for constructing and dewatering the Joe Towe White Sand Mine safely, and that dewatering will not degrade or negatively impact any wetlands or waters of the state. Description and Operation of the Joe Towe White Sand Mine: The Joe Towe White Sand Mine is a proposed 3.4-acre sand mine excavation operated by Frankie Brown, Brown's Land Developing, Inc., in a 6.25 acre permit area located at the intersection of S. Edenton Road Street and US 17 Bypass in the south Extraterritorial Jurisdiction area of Hertford, NC. The permit area is on high sandy farmland owned. by Joe Towe White, Jr. At this time Mr. Brown is submitting an application with the NCDENR Division of Energy, mineral and Land Resources to construct the sand mine and begin operation in December 2013. Mr. Brown has received an approved Conditional Use Permit from the Town of Hertford Planning and Zoning Department for construction of this mine. Sand Mine Dewatering: The operator plans to construct a 0.26 acre sedimentation pond located 30 feet from the northwest corner of the main excavation. The 10 foot deep pond will be excavated and constructed with 2-ft tall by 10-ft wide sand berms surrounding it which will have full groundcover installed. Dewatering the main pond will allow for full depth excavation and proper reclamation of the edges of the pond. It is the intention of Mr. Brown to only dewater the excavation as needed, which will not entail full-time dewatering. The operator will install a 6-inch dewatering pump between the 2 ponds at the northwest corner of the main excavation. Discharge from the dewatering pump will enter the sediment pond on its east side, and there will be a constructed water height control device (see attached diagram) discharge point located on the west side of the sediment pond. The discharge point will release clear water to a 25 foot long constructed riprap-protected ditch, leading to existing farm irrigation ditches and then 0.75 miles to Raccoon Creek and 1.4 miles to the Perquimans River (see attached map for outflow route and discharge point locations), Water will be pumped from the main pond to the sediment pond by a bin gasoline -powered transfer pump operating at idle speed. Estimated maximum flow from the pump will be 10,000 gallons/hour. It is the intention of Mr. Brown to drop the water level in the main pond approximately 20 feet below natural ground level when needed. The overflow from the sediment pond will be controlled by a water height control device constructed in the west sediment pond berm, 1 foot below natural ground level. This control structure will allow water to flow through the baffle into a 25ft long x 15" wide buried PVC pipe leading west to an existing 6ft wide irrigation and drainage ditch running north and east 1100 feet to Raccoon Creek and then 1.4 miles to Perquimans River. For erosion control, the overflow water will exit the water height control discharge onto a 20ft long riprap-lined apron in the ditch. Time and distance will allow all sedimentation to occur to acceptable levels before the overflow water reaches outfall and then the waters of the State. Water will have to travel a minimum of 150 feet to reach the overflow point which will give enough surface area to allow sufficient sedimentation to occur. There will be a minimum 2ft tall berm around the perimeter of the sediment pond to prevent offsite stormwater from entering the sediment area and damaging sedimentation rates. Sedimentation and Erosion Control Sediment pond overflow will drain into a constructed 25ft x 6ft wide feeder ditch that leads 1100 feet through field drainage ditches to Raccoon Creek and then 1.4 miles to Perquimans River. Overflow into the feeder ditch will be stabilized by riprap installed in the feeder ditch at the overflow (see diagram) to prevent erosion of the ditch. All erosion and sedimentation will remain inside of the permit area. During mining operations and dewatering, the majority of the water leaving the excavation will remain inside of the permit area and will only overflow occasionally. The sediment pond will be approximately 10 feet deep, and there is a sand layer below the bottom of the area. The porosity of the soil under the sediment pond will allow most of the water pumped into the pond from dewatering to seep back into the ground naturally. Any excess water overflowing from the sediment pond will flow downstream through existing irrigation and drainage ditches 1100 feet towards Raccoon Creek, and then 1.4 miles to the Perquimans River. Maintaining the Sediment Pond Overflow Control Structure, Settlement Pond and pitches Inspections and maintenance are required to obtain the intended function of safely dewatering the sand mine, and to maintain the life of any adjacent wetlands or waters of the State. Items to inspect and maintain during the 5 year life of the mine dewatering permit are: • Inspect the water control structures regularly, especially following heavy rains and runoff, or during periods of operation of the structure. • Remove accumulated debris from the concrete block overflow control structure. • Inspect the structure for excessive settlement or seepage. • Inspect all components of the structure, including appurtenances, and repair or replace any damaged items as needed. • Inspect embankments, berms and appurtenant structures, and repair as needed. • Repair any damage to vegetated areas or berms with compacted earth fill, reshaping, sodding, reseeding and mulching as needed. • Inspect riprap outlet stabilization structures in ditches regularly, replace dislodged rock as necessary. • Promptly repair all leaks in delivery facilities by replacing valves, fittings, gaskets, and worn or damaged parts. • Maintain all screens, filters, valves, timers and other electrical and mechanical equipment in good operating condition, following manufacturer's recommendations Monitoring the Process and Effects of Dewatering Analytical and qualitative monitoring of mine dewatering wastewater will be in accordance with the NCG020000 permit, as follows: • All ponds in the Joe Towe White Sand Mine permit area will be inspected daily by the operator to identify any abnormal conditions. • All berms and erosion control and sedimentation control structures will be inspected following significant (1/2-inch) rainfall events for damages, and all structures will be repaired immediately. • Special inspections will be conducted immediately following severe storms, vandalism, and other significant events. • Dewatering process will be inspected daily during periods of dewatering the excavation. • Overflow of wastewater process will be inspected daily during periods of dewatering the excavation. • Outflow of dewatering wastewater will be monitored quarterly at the overflow exit stabilization structure for pH, settleable solids, turbidity, and total flow. Samples will be collected and tested onsite for pH, and the remainder will be tested for the remaining parameters by a North Carolina certified lab. • Rain gauge data will be collected by monitoring rain gauge data monthly and after each rain event. Records Data will be collected as follows: • Data will be collected from samples taken from the wastewater point source discharge in operation at the time. • Point source discharge data: data from the site taken quarterly, date & time, general weather conditions, pH of sample, status of process at point source, inlet or outlet, other DWQ required data. • Visual monitoring of adjacent farmland for potential dehydration during mining or dewatering activities will take place weekly. Solutions to any degradation caused by any mining activity will include alteration of dewatering process. DWQ, will be consulted as needed; alterations to process will be recorded. • Elliott Consulting will maintain the following records in a permanent file at the Elliott Consulting office at PO Box 112, 202 Elliott Road, Aydlett, INC 27916: a record of all significant actions taken; as -built drawings; permits; analytical results from sampling; and related material. Copies of all inspections, monitoring reports and lab analyses shall be provided to NCDWQ on a regular basis and as requested. Water height control structure is standard structure used by agricultural and horticultural farms in North Carolina to raise or lower water height in ditches and ponds per need. PURPOSE To convey water from one elevation to a lower elevation within, to, or from a water conveyance system, such as a ditch, channel, canal, or pipeline designed to operate under open channel conditions. Typical structures: drops, chutes, turnouts, surface water inlets, head gates, pump boxes, and stilling basins. CONSTRUCTION (SEE ATTACHED DIAGRAM) Structure consists of 25' x 15" horizontal PVC plastic outflow pipe running under farm path. Alignment: Apron will be straight throughout entire length if possible. If curve is necessary to align the apron with the receiving channel, the curve will be located in the upstream section of the riprap. Materials: Riprap will consist of a well graded mixture of NCDOT Class A (2" to 6") stone or slag. Thickness: Minimum thickness of riprap will be 1.5 times the maximum stone diameter. Filter: Operator plans to install a layer of heavy duty silt fence filter cloth between the riprap and the underlying soil to prevent soil movement into or through the riprap. Filter cloth will extend to the top of both channel banks, and edges will overlap 12 inches. Upstream end will be buried 12 inches and downstream end will be buried if necessary. Maintenance: inspect riprap outlet structures weekly and after significant rainfall events to see if any erosion around or below the riprap has taken place, or if stones have become dislodged. Repair all damage immediately. Maintain all vegetation adjacent to the channel in healthy condition to prevent scour or erosion during out -of -bank flow. Ken Elliott, consulting September 27, 2013 Berm Construction Details Joe Towe White Sand Mine Hertford, NC Perquimans County Narrow -based berm The narrow -based berm is the most common berm having a top of 4 feet (1.2 m) and side slopes of two horizontal: 1 vertical. This berm is the most economical to build as it requires the least material. The steep side slopes of this type of berm eliminate the possibility of working on it with farm machinery. 4' 2 � Steep -back slope berm This berm has a broad -based slope of 8 horizontal:1 vertical on the front side and a steep slope of 2 horizontal:1 vertical on the back side. The front side can be worked over with farm machinery while the steep -back is left permanently vegetated. This berm type could be located at the edge of a lane, gully, etc. where the front side is to be worked. 2 �1 4, � 8 1 � 1 Berm Construction The berm construction comprises of the scraping back of the topsoil from the area where the berm and storage basin is to be built. A subsoil material, free of stones, rubble, stumps etc. and with at least 10% clay should be used to construct the berm. The material for the berm may be obtained from the area behind or in front of the berm location or moved from a borrow pit located elsewhere on the farm. An earth mover will be required to move material from a pit located a distance away while a bulldozer would be used if material is located in the berm area. The berm material is to be placed in layers and compacted as each layer is added. After the berm has a final shape the sides of the berm should also be compacted. Emergency Overflow To provide for larger -than designed peak flows, two types of overflow system are used, namely: 1. "The level -top vegetated berm crest" which provides for very flat berm top so that the water will overflow along the berm length in a thin layer so as not to create erosion problems. 2. "A notched spillway" which is located at the one end of the berm, ie. where the berm meets the original ground, and is lined with rock rip rap or vegetation. The emergency spillway is to be designed so that it will safely carry the maximum expected flow from a storm that will occur once every 25 years. Water height control structure is standard structure used by agricultural and horticultural farms in North Carolina to raise or lower water height in ditches and ponds per need. PURPOSE To convey water from one elevation to a lower elevation within, to, or from a water conveyance system, such as a ditch, channel, canal, or pipeline designed to operate under open channel conditions. Typical structures: drops, chutes, turnouts, surface water inlets, head gates, pump boxes, and stilling basins. CONSTRUCTION (SEE ATTACHED DIAGRAM) Structure consists of 25' x 15" horizontal PVC plastic outflow pipe running under farm path. A concrete block 4' x 4' box is attached on the north end of the PVC outflow pipe and has a 6" PVC plastic tee allowing adjustable height of the water level in the adjacent pond. Water flows through the 6" tee, into the control box, through the buried 15" outflow pipe and discharges into the outfall ditch. Overflow ditch is lined with riprap for 20 feet down its length. This berm is the most economical to build as it requires the least material. The front side can be worked over with farm machinery while the steep -back is left permanently vegetated. This berm type could be located at the edge of a lane, gully, etc. where the front side is to be worked. 2 a1 4' � 8 Berm Construction The berm construction comprises of the scraping back of the topsoil from the area where the berm and storage basin is to be built. A subsoil material, free of stones, rubble, stumps etc. and with at least 10% clay should be used to construct the berm. The material for the berm may be obtained from the area behind or in front of the berm location or moved from a borrow pit located elsewhere on the farm. An earth mover will be required to move material from a pit located a distance away while a bulldozer would be used if material is located in the berm area. The berm material is to be placed in layers and compacted as each layer is added. After the berm has a final shape the sides of the berm should also be compacted. Emergency Overflow To provide for larger -than designed peak flows, two types of overflow system are used, namely: 1. "The level -top vegetated berm crest" which provides for very flat berm top so that the water will overflow along the berm length in a thin layer so as not to create erosion problems. 2. "A notched spillway" which is located at the one end of the berm, ie. where the berm meets the original ground, and is lined with rock rip rap or vegetation.
