The pump has been removed and dewatering is no longer occurring. I recommend that the dewatering permit be rescinded. Please let me know if you need any additional information or if need to visit the site again to verify that the pump is still removed. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). An Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional Office within 60 days of your receipt of this permit. This site will discharge to a receiving stream designated as High Quality Waters (HQW). As a result, a more stringent TSS limit and wastewater discharge volume applies (per Table_8 in_the permit). The equivalent 7Q10 flow for the UT to Stones Creek at this location is estimated to be zero efs, therefore, mine dewatering wastewater discharge to the UT to Stones Creek should be directed through the wetlands prior to the stream and limited to 3,600 gallons per day (gpd) or less. This must be included in your 0&M Plan, which is an enforceable part of the permit. Please note that mine dewatering wastewater includes wet pit overflows caused sole] by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges. If they need higher, they'll likely have to change to a non - discharge system. That's due to what the 02B .0221 & .0224 rules require for wastewater discharges to class SA and FIQW waters... since the 7Q10 in the receiving stream is essentially zero. They will have to keep daily discharge logs as part of the Pumping O&M plan. Let me know if you would like to discuss further. Thanks. One thing I am a bit concerned about is their proposed pumping rate. I don't see how they are going to be able to mine to an average depth of 25 feet (and a max depth of 35 feet) in Onslow County but only pump 3600 gpd. That estimate seems REALLY low to me. This section of the stream is dry at low flow but the discharge is proposed to be directed to the wetland first and eventually to the stream channel (which appears to be more than 600 ft away) and may not even reach the stream at the proposed pump rate. The 0&M Plan needs to ensure that dewatering occurs into the wetlands, designed to be non - erosive (level spreaders, veg. filter, sheet flow, etc.) and limit the pump rate to 3600 gpd. Possibly a stipulation included that no pumping occur during heavy rainfall events. Linda and I will work with Sonya Edens regarding approval of the O&M Plan. Mining is an industrial activity by definition. Mine pit discharges typically do not implement treatment systems that eliminates all settleable solids (far from it). They cannot meet that standard any more than a ready mix concrete facility can, unless they are using filters prior to discharging the wastewater. DWQ is not imposing the 2B rules concerning industrial wastewater discharges to SA waters. Since DWQ's decision to allow such was accommodated in the last permit renewal, I won't spend any more time on that soap box at this time, but it's important to keep these concerns for the record. I'll need to make a site visit to determine the 7Q10. You may want to let their consultant know that we need to make a site visit at low tide for that area to figure out the 7Q10, and preferably not during a rain event. I will try to coordinate with the permittee since we'll need permission for access to the site and I need to get another staff member here that can walk to the creek with me. The site is approximately 5 acres with 2.2 acres of actual mining area, 1.84 acres of haul road, 0.15 acres of sediment basin area and some disturbed buffer area. There are some wetlands located on the south side of the property. These have been approved by Mr. David Bailey (copy of JD is attached) and the project proposes to maintain 50' buffer from the wetlands. A mining permit application (fees, maps, application, etc.) was submitted to NCDENR — Land Quality Section late April 2012. Additional information request was received June 12, 2012. Site preparations - Clear, grub and strip topsoil from areas under the embankment to remove tress, vegetation, roots, and other objectionable material. Delay clearing the pool area until the dam Is complete and then remove brush, trees, and other objectionable materials to facilitate sediment deenout. Stockpile all topsoil or soil containing organic matter for use on the outer shell of the embankment to facilitate vegetative establishment. Place temporary sediment control measures below the basin as needed. 2. Cut -off -trench - Excavate a out -off trench along the centerline of the earth flit embankment. Cut the trench to stable soil material, but In no case make it less than 2 feet deep. The cut-off trench must extend Into both abutments to at least the elevation of the riser crest. Make the minimum bottom width wide enough to permit operation of excavation and compaction equipment, but in no case less than 2 feet. Make side slopes of the trench no steeper than 1: 1. Compaction requirements are the same as those for the embankment. Keep the trench dry during backfilling and compaction operations. 3. Embankment - Take fill material from the approved areas shown on the plans. It should be clean mineral soft, free of roots, woody vegetation, rocks, and other objectionable material. Scarify areas on which flit Is to be placed before placing fill. The fill material must contain sufficient moisture so It can be formed by hand into a ball without crumbling. If water can be squeezed out of the bail, It Is too wet for proper compaction. Place flit material In 8 to 8 inch continuous layers over the entire length of the fill area and compact It. Compaction may be obtained by routing the construction hauling equipment over the fill so that the entire surface of each layer Is traversed by at least one wheel or tread track of heavy equipment, or a compactor may be used. Construct the embankment to an elevation 10 percent higher than the design height to allow for settling. 4. Emergency spillway - Install the emergency spillway In undisturbed soil. The achievement of planned elevations, grade, design width, and entrance and exit channel slopes are critical to the successful operation of the emergency spillway. Construct with an Impermeable liner to insure basin dewaters from surface. 5. Inlets - Discharge water Into the basin In a manner to prevent erosion. Use diversions with outlet protection to divert sediment -laden water to the upper end of the pool area to Improve basin trap efficiency (References: Runoff Control Measures and Outlet Protection). 6. Erosion control - Construct the structure so that the disturbed area is minimized. Divert surface water away from bare areas. Complete the embankment before the area Is cleared. Stabilize the emergency spillway embankment and all other disturbed areas above the crest of the principal spillway Immediately after construction. (Reference: Surface Stabilization) 7. Safety - Sediment basins may attract children and can be dangerous. Avoid Steep side slopes, and fence and mark basins with warning signs if trespassing is likely. Follow all state and local requirements. CHECK SEDIMENT BASINS AFTER PERIODS OF SIGNIFICANT RUNOFF. REMOVE SEDIMENT AND RESTORE THE BASIN TO ITS ORIGINAL DIMENSIONS WHEN SEDIMENT ACCUMULATES TO ONE HALF THE DESIGN DEPTH. MATERIALS 1. Use a synthetic filter fabric of at toast 95% by weight of polyoiefins or polyester, which Is certified by the manufacturer or supplier as conforming to the requirements in ASTM D 6461, which Is shown In part in Table 8.62b (Refer to the Erosion and Sediment Control Planning and Design Manual, Chapter 6, Section 62.2). Synthetic filter fabric should contain ultraviolet ray Inhibitors and stabilizers to provide a minimum of 6 months of expected usable construction life at a temperature range of 0 to 120' F. 2. Ensure that posts for sediment fences are 1.33 lb/ltnear ft steel with a minimum length of 5 feet. Make sure that steel posts have projections to facilitate fastening the fabric. 3. For reinforcement of standard strength filter fabric, use wire fence with a minimum 14 gauge and a maximum mesh spacing of 6 Inches, QQN831RUCTUN 1. Construct the sediment barrier of standard strength or extra strength synthetic fitter fabrics. 2• Ensure that the height of the sediment fence does not exceed 24 Inches above the ground surface. (Higher fences may Impound volumes of water sufficient to cause failure of the structure.) 3. Construct the filter fabric from a continuous roll out to the length of the barrier to avoid joints. When joints are necessary, securely fasten the filter cloth only at a support post with 4 feet minimum ovortap to the ne)d post. 4. Support standard strength filter fabric by wire mesh fastened securely to the upslope side of the posts. Extend the wire mesh support to the bottom of the trench. Fasten the wire reinforcement, then fabric on the upslope side of the fence post. Wire or plastic zip ties should have minimum 50 pound tensile strength. 5. When a wire mesh support fence Is used, space posts a maximum of 8 feet apart. Support posts should be driven securely Into the ground a minimum of 24 Inches. 8. Extra strength filter fabric with 5 fleet post spacing does not require wire mesh support fence. Securely fasten the fitter fabric directly to posts, Wire or plastic zip ties should have minimum 50 pound tensile strength. 7. Excavate a trench approximately 4 inches wide and 8 Inches deep along the proposed line of posts and upslope from the barrier (Figure 8.62a). 8. Piece 12 Inches of the fabric along the bottom and side of the trench. 9. Backfill the trench with soil placed over the filter fabric and compact. Thorough compaction of the backfill Is critical to silt fence performance. 10. Do not attach filter fabric to existing trees. MAINTENANCE Inspect sediment fences at least once a week and after each rainfall. Make any required repairs Immediately. Should the fabric of a sediment fence collapse, tear, decompose or become Ineffective, replace it promptly, Remove sediment deposits as necessary to provide adequate storage volume for the next rain and to reduce pressure on the fence. Assemble the skimmer following the manufacturers Instructions, or as designed. 2. Lay the assembled skimmer on the bottom of the basin with the flexible joint at the Inlet of the barrel pipe. Attach the flexible joint to the barrel pipe and position the skimmer over the excavated pit or support. Be sure to attach a rope to the skimmer and anchor It to the side of the basin. This will be used to pull the skimmer to the side for maintenance. Inspect skimmer sediment basins at least weekly and after each significant (one-half inch or greater) rainfall event and repair Immediately. Remove sediment and restore the basin to its original dimensions when sediment accumulates to one-haff the height of the first baffle. Pull the skimmer to one side so that the sediment underneath it can be excavated. Excavate the sediment from the entire basin, not just around the skimmer or the first call. Make sure vegetation growing In the bottom of the basin does not hold down the skimmer. If the skimmer is clogged with trash and there Is water In the basin, usually jerking on the rope will make the skimmer bob up and down and dislodge the debris and restore flow. If this does not work, pull the skimmer over to the side of the basin and remove the debris. Also check the orifice inside the skimmer to see If It 15 clogged; if so remove the debris. If the skimmer arm or barrel pipe is clogged, the orifice can be removed and the obstruction cleared with a plumber's snake or by flushing with water. Be sure and replace the orifice before repositioning the skimmer. Freezing weather can result In Ice forming In the basin. Some special precautions should be taken In the winter to prevent the skimmer from plugging with Ice. Fertilizar Topdressino: 1. Fertilizer used for topdreseing on all roadway areas except slopes 2:1 and steeper shall be 10-20-20 written approval of the Engineer, a different analysis of fertilizer may be used provided grade and shall be applied at the rate of 500 pounds per acre (560kg per hectare). Upon the 1-2-2 ratio Is maintained and the rate of application adjusted to provide the same amount of plant food as 10-20-20 analysis. 2. Fertilizer used for topdressing on slopes 2:1 and steeper and waste and borrow areas shall be 16-8-8 grade and shall be applied at the rate of 500 pounds per acre (560 kg per hectare). Upon written approval of the Engineer, a different analysis of fertilizer may be used provided the 2-1-1 ratio Is maintained and the rate of application adjusted to provide the some amount of plant food as 16-&B analysis. 1, Crimping will be required on these project adjacent to any section of roadway where traffic Is to be maintained or allowed during construction. The bottom and sides of the fabric should be anchored in a trench or pinned with 8-inch erosion control matting staples. 6. Do not splice the fabric, but use a continuous piece across the basin, hWHIENANCE Inspect baffles at least once a week and after each rainfall. Make any required repairs immediately. PERMANENT GROUNDCOVER FOR ALL DISTURBED AREA, SHALL BE PROVIDED WITHIN 15 WORKING DAYS OR 30 CALENDAR DAYS, WHICHEVER PERIOD IS SHORTER, FOLLOWING COMPLETION OF ANY PHASE OF GRADING, AND WITHIN 15 WORKING DAYS OR 90 CALENDAR DAYS, WHICHEVER PERIOD IS SHORTER, FOLLOWING COMPLETION OF CONSTRUCTION OF DEVELOPMENT. 2.) THE ANGLE FOR GRADED SLOPES AND FILLS SHALL NOT BE GREATER THAN THE ANGLE THAT CAN BE RETAINED BY VEGETATIVE COVER OR OTHER ADEQUATE EROSION -CONTROL DEVICES OR STUCTURES. IN ANY EVENT, SLOPES LEFT EXPOSED WILL, WITHIN 21 CALENDAR DAYS OF COMPLETION OF ANY PRASE OF GRADING, BE PLANTED OR OTERWISE PROVIDED WITH TEMPORARY OR PERMANENT GROUND COVER, DEVICES, OR STRUCTURES SUFFICIENT TO RESTRAIN EROSION.
