Ill. REQUIRED ITEMS
A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.
1. This completed and signed form. This certification must be -completed and signed by both the
current permit holder and the new applicant if this is.a change of ownership.
2. Legal documentation of the property transfer to a new owner.
3. A copy of any recorded deed restrictions, covenants, or easements, if required by the permit.
4. The designer's certification (DWQ Engineer and Designer Certification Forms are available from
each DWQ Regional office), if required by the permit and if not already submitted to DWQ.
5. If the proposed permittee is a firm, partnership, association, institution, corporation, limited liability
company, or other corporate entity, provide documentation showing the authority of the named
representative to act on behalf of the proposed permittee.
6. The $40.00 processing fee. If this is an initial transfer from the original permittee the processing
fee is not required. Subsequent ownership transfers will require the $40.00 processing fee.

This completed form, including all supporting documents and processing fee (if required), should be
sent to the appropriate Regional Office of the North Carolina Department of Environment and Natural
Resources, Division of Water Quality, as shown on the attached map.
Please note that if the Proposed Permittee listed above is not the property owner, the property owner
must complete and sign page 4 of this document. Both the lessee / developer and the property
owner will appear on the permit as permittees.

of the lease agreement or other contract, which indicates the party responsible for the construction
and/or operation and maintenance of the stormwater system, has been provided with the submittal.

compliance with the DWQ Stormwater permit. As the property owner, it is my responsibility to notify
DWQ by submitting a completed Name/Ownership Change Form within 30 days of procuring a
developer, lessee or purchaser for the property. I understand that failure to operate and maintain the
stormwater treatment facility in accordance with the permit is a violation of NC General Statute
(NCGS) 143-215.1, and may result in appropriate enforcement action including the assessment of
civil penalties of up to $25,000 per day, pursuant to NCGS 143-215.6.

The Division of Water Quality rescinded your coverage under Certificate of Coverage Number
NCG070066. We replaced your coverage with .Certificate of Coverage Number NCG020789, with an
effective date of May 25, 2011.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit is against federal and state laws and
could result in fines. If something changes and your facility would again require stormwater or
wastewater discharge permit coverage, you should notify this office immediately. We will be happy to
assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Mike,
We've received an NOI from the Hanson Brick for their site in Monroe (Union County) for
coverage of their clay and shale mine. The site discharges stormwater to an unnamed tributary
to South Fork Crooked Creek (C). The NOI is attached. Please let me know if you would like
me to send a hardcopy of the NOI and the large site plan.
Does the Mooresville Regional Office have any concerns about issuing this facility a COC for
this general permit, and are there any potential impacts to wetlands? If we don't receive any
objections, we'll issue the COC in 30 days.

Your application for modification of the above referenced mining permit has been
approved. The modification is to increase the permitted acreage to 396.46 acres and the
affected acreage to 196.22 acres as indicated on the mine map last revised July 25, 2002.
The modification includes the addition of 22.1 acres to the permit with 21 acres of new mine
area, including the construction and maintenance of the associated erosion and sedimentation
control measures. A copy of the modified permit is enclosed.
The conditions in the modified permit were based primarily upon the, initial application.
Modifications were made as indicated by modification request and as required to insure
compliance with The Mining Act of 1971. The expiration date, mine name and permit number
shall remain the same as before the modification.
G.S. 74-65 states that the issuance of a mining permit does not supersede or otherwise
affect or prevent the enforcement of any zoning regulation or ordinance duly adopted by an
incorporated city or county or by any agency or department of the State of North Carolina.
As a reminder, your permitted, acreage at this site is 396.46 acres and the amount of
land you are allowed to disturb is 196.22 acres.

laws, rules and regulations

all lands and waters affected by this mining operation will receive the
greatest practical degree of protection and restoration.

In accordance with the application for this mining permit, which is hereby approved by the
Department of Environment and Natural Resources, hereinafter referred to as the Department,
and in conformity with the approved Reclamation Plan attached to and incorporated as part of
this permit, provisions must be made for the protection of the surrounding environment and for
reclamation of the land and water affected by the permitted mining operation. This permit is
expressly conditioned upon compliance with all the requirements of the approved Reclamation
Plan. However, completed performance of the approved Reclamation Plan is a separable
obligation, secured by the bond or other security on file with the Department, and may survive
the expiration, revocation or suspension of this permit.
This permit is not transferable by the permittee with the following exception: If another
operator succeeds to the interest of the permittee in the permitted mining operation, by virtue
of a sale, lease, assignment or otherwise, the Department may release the permittee from the
duties imposed upon him by the conditions of his permit and by the Mining Act with reference
to the permitted operation, and transfer the permit to the successor operator, provided that
both operators have complied with the requirements of the Mining Act and that the successor
operator agrees to assume the duties of the permittee with reference to reclamation of the
affected land and posts a suitable bond or other security.
In the event that the Department determines that the permittee or permittee's successor is not
complying with the Reclamation Plan or other terms and conditions of this permit, or is failing
to achieve the purposes and requirements of the Mining Act, the Department may give the
operator written notice of its intent to modify, revoke or suspend the permit, or its intent to
modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a
hearing at a designated time and place on any proposed modification, revocation or
suspension by the Department. Alternatively and in addition to the above, the Department
may institute other enforcement procedures authorized by law.
Definitions
Wherever used or referred to in this permit, unless the context clearly indicates otherwise,
terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49.
Modifications
July 14 1992: This permit has been modified to allow the commencement of mining activities
as indicated on the Mine Map Layout plan and corresponding Details and Specifications sheet
dated November 1, 1991 and as specified by the additional information dated April 20, 1992
With several stipulations incorporated herein.
Septem,t)er 22 1999, This permit has been modified to allow construction of a new
Reclaiming Building, Crusher Building, Clay Building, an additional Conveyor, and a 30 foot
extension to an existing culvert to provide additional haul road access as indicated on the
mine map dated August 9, 1999 and supplemental information dated August 6, 1999,
June 8 2000 This permit has been modified to allow construction of a new kiln, an addition
to the grinding room, a concrete slab around the existing material prep building and several
stone surfaced parking and brick storage yards as indicated on the mine map and detail sheet
both dated February 9, 2000. This modification increases the affected acreage at the site to
134.22 acres and includes all associated erosion and sedimentation control measures as
submitted with the modification request received by the Land Quality Section on May 3, 2000.

july-13 200 i : This permit has been modified to increase the affected acreage to 168.87
acres as indicated on the Mine Map dated June 4, 2001,
April 4, 2002: This permit has been modified to increase the affected acreage to 175.22 acres
as indicated on the mine maps fast revised January 15, 2002 and received by the Land
Quality Section on April 3, 2002. The modification includes the addition of 5.9 acres of mine
excavation in the southern portion of the property and the construction of a 30 ft by 40 ft. shed
near the existing stockpile area, including the associated erosion and sedimentation control
measures. The modification also includes the transformation of the 50 foot undisturbed
buffers along the railroad at Basins A and B to 50 foot unexcavated buffers.
u ust 19_.2002, This permit has been modified to increase the permitted acreage to 396.46
acres and the affected acreage to 196.22 acres as indicated on the mine map last revised July
25, 2002. The modification includes the addition of 22.1 acres to the permit with 21 acres of
new mine area, including the construction and maintenance of the associated erosion and
sedimentation control measures.
Expiration Date
This permit shall be effective from the date of its issuance until April 4, 2012.
Conditions
This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and
to the following conditions and limitations.
OPEBATING CONDITIONS:
1. A. Any wastewater processing or mine dewatering shall be in accordance with the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission.
B. Any stormwater runoff from the affected areas at the site shall be in accordance
with any applicable permit requirements and regulations promulgated by the
Environmental Protection Agency and enforced by the N.C. Environmental
Management Commission. It shall be the permittee`s responsibility to contact
the Stormwater Section, Division of Water Quality, to secure any necessary
stormwater permits or other approval documents.
2. A. Any mining process producing air contamination emissions shall be subject to
the permitting requirements and rules promulgated by the N.C. Environmental
Management Commission and enforced by the Division of Air Quality.
B. During mining operations, water trucks or other means that may be necessary
shall be utilized to prevent dust from leaving the permitted area.
A. Sufficient buffer shall be maintained between any affected land and any
adjoining waterway or wetland to prevent sedimentation of that waterway or
wetland from erosion of the affected land and to preserve the integrity of the
natural watercourse or wetland.
B. Any mining activity affecting waters of the State, waters of the U. S., or wetlands
shall be in accordance with the requirements and regulations promulgated and
enforced by the N. C. Environmental Management Commission.

4. A. Adequate mechanical barriers including but not limited to diversions, earthen
dikes, silt check dams, silt retarding structures, rip rap pits, or ditches shall be
provided in the initial stages of any land disturbance and maintained to prevent
sediment from discharging onto adjacent surface areas or into any take, wetland
or natural watercourse in proximity to the affected land.
B. Erosion and sedimentation control measures shall -be installed and maintained
as indicated on the Mine Layout plan and corresponding Details and
Specifications sheet dated November 1, 1991 and as specified by the additional
information dated April 20, 1992 with the following stipulations:
1) Ail pipes outlets shall be stabilized with a ground cover sufficient to
restrain erosion;
2) The brick dams shall have a minimum base width of 35 feet to provide
stability for the structure;
3) The NCDOT Class Il rip rap used to construct Outlet Mats A and B on the
above referenced Mine Layout Plan shall be placed at a minimum depth
of 27 inches; and
4) The minimum depth of brick bats used to construct the spillway sections
of the earthen berm constructed near SR 1378 shall be 12 inches.
C. Mining activities, including the installation and maintenance of approved erosion
and sediment control measures, shall be conducted as indicated on the Mine
Map dated .tune 4, 2001 and the supplemental information dated June 5, 2001
with the following stipulations:
Silt fence shall be installed and maintained along the outside toe of any
constructed visual screening berms until permanent cover has been
established on said berms;
2. All run off shall be directed into the approved sediment basins or internal
to the mine excavation; and
3. A 100 foot long gravel construction entrance shall be constructed at the
intersection of the access road and SR 1379 and SR 1378, using No. 57
washed stone or equivalent.
D. - Mining activities; including the installation and maintenance of the associated
erosion and sediment control measures, shall be conducted as indicated on the
mine maps (Sheets 1 and 3 of 3) last revised January 15, 2002 and received by
the Land Quality Section on April 3, 2002 and the details sheet (Sheet 2 of 3)
dated November 21, 2001.
E. Mining activities in the Proposed New Mine Area, including the installation and
maintenance of all erosion and sedimentation control measures, shall be
conducted as indicated on the mine map last revised July 25, 2002 and in
accordance with all supplemental information associated with said map.

F. An erosion and sediment control plan(s) shall be submitted to the (department for
approval prior to any land disturbing activities not indicated on the revised
erosion control plan or mine maps submitted with the approved application for a
mining permit and any approved revisions to it. Such areas include, but are not
limited to, expansion outside of the approved pit area, creek crossings, or
_ expansion of overburden or waste disposal areas.
5. All mining permit boundaries (396.46 acres) shall be permanently marked at the site on
100 foot intervals unless the line of sight allows for larger spacing intervals.
6. The angle for graded slopes and fills shall be no greater than the angle which can be
retained by vegetative cover or other adequate erosion control measure, structure, or
device. In any event, exposed slopes or any excavated channels, the erosion of which
may cause off -site damage because of -siltation, shall be planted or otherwise provided
with ground cover, devices or structures sufficient to restrain such erosion.
7. The affected land shall be graded so as to prevent collection of pools of water that are,
or likely to become, noxious or foul. Necessary structures such as drainage ditches or
conduits shall be constructed or installed when required to prevent such conditions.
8, A. Existing vegetation or vegetated earthen berms shall be maintained between the
mine and public thoroughfares whenever practical to screen the operation from
the public.
B. Three rows of loblolly pines on 7 foot staggered spacings shall be established,
or, as an alternative, an eight foot high berm with two horizontal to one vertical
sideslopes, shall in installed and permanently stabilized as indicated in the
supplemental information dated June 5, 2001 between any mining activities and
SR 1378 and SR 1379 (Hayes Road), U.S. Highway 74, and any other areas
where existing vegetation does not provide adequate visual barriers to screen
the mining activities at the site.
C. The vegetated earthen diversion berms located along SR 1378 (Hayes Road)
shall also be maintained as visual barriers to screen the Proposed New Mine
Area from the public.
9. A. Sufficient buffer shall be maintained between any excavation and any mining
permit boundary or right-of-way to protect adjacent property.
B. Buffer zones at this site shall be maintained as indicated on the mine map last
revised July 25, 2002.
10. A physical barrier consisting of a fence or earthen berm, etc., shall be maintained
around the perimeter of any highwall.
11. A. No on -site disposal of refuse or other solid waste that is generated outside of the
mining permit area shall be allowed within the boundaries of the mining permit
area unless authorization to conduct said disposal has first been obtained from
both the Division of Waste Management and the Land Quality Section,
Department of Environment and Natural Resources. The method of disposal
shall be consistent with the approved reclamation plan.

B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971
generated on -site and direct€y associated with the mining activity may be
disposed of in a designated refuse area. All other waste products must be
disposed of in a disposal facility approved by the Division of Waste
Management. No petroleum products, acids, solvents or their storage
containers or any other material that may be considered hazardous shall be
disposed of within the permitted area,
C. For the purposes of this permit, the Division of land Resources considers the
following materials to be "mining refuse" (in addition to those specifically listed
under G.S. 74-49 (14) of the N.C. Mining Act of 1971):
1 on -site generated land clearing debris
2 conveyor belts
3 wire cables
4) v-belts
5) steel reinforced air hoses
6) drill steel
D. If mining refuse is to be permanently disposed within the mining permit
boundary, the following information must be provided to and approved by the
Division of Land Resources prior to commencement of such disposal:
1. the approximate boundaries and size of the refuse disposal area;
2. a list of refuse items to be disposed;
3. verification that a minimum of 4 feet of cover will be provided over the
refuse;
4. verification that the refuse will be disposed at feast 4 feet above the
seasonally high water table; and
5. verification that a permanent vegetative groundcover will be established.
12. An Annual Reclamation Report shall be submitted on a form supplied by the
Department by February 1 of each year until reclamation is completed and approved.
13. The operator shall notify the Department in writing of the desire to delete, modify or
otherwise change any part of the mining, reclamation, or erosion/sediment control plan
contained in the approved application for a mining permit and any approved revisions
to it, Approval to implement such changes must be obtained from the Department prior
to on -site implementation of the revisions.
14. The security which was posted pursuant to N.C.G.S. 74-54 in the form of a $500,000.00
blanket bond is sufficient to cover the operation as indicated in the approved
application. This security must remain in force for this permit to be valid. The total
affected land shall not exceed the bonded acreage.
15. A. Authorized representatives of the Division of Archives and History shall be
granted access to the site to determine the presence of significant
archaeological resources.
B, Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human

APPROVED REQC AMATION PLAN
The Mining Permit incorporates this Reclamation Plan, the performance of which is a
condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan
is a separable obligation of the permittee, which continues beyond the terms of the Mining
Permit.
The approved plan provides:
Minimum Standards As Provided By G.S 7�4-5_3
The final slopes in all excavations in soil, sand, gravel and other unconsolidated
materials shall be at such an angle as to minimize the possibility of slides and be
consistent with the future use of the land.
2. Provisions for safety to persons and to adjoining property must be provided in all
excavations in rock.
3. All overburden and spoil shall be left in a configuration which is in accordance with
accepted conservation practices and which is suitable for the proposed subsequent use
of the land.
4. No small pools of water shall be allowed to collect or remain on the mined area that
are, likely to become noxious, odious or foul.
5. The revegetation plan shall conform to accepted and recommended agronomic and
reforestation practices as established by the North Carolina Agricultural Experiment
Station and the North Carolina Forest Service.
S. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein
incorporated. These activities shall be conducted according to the time schedule
included in the plan, which shall to the extent feasible provide reclamation
simultaneous with mining operations and in any event, provide reclamation at the
earliest practicable time after completion or termination of mining on any segment of
the permit area and shall be completed within two years after completion or termination
of mining.
RECLAMATION CONDITIONS:
1. Provided further, and subject to the Reclamation schedule, the planned reclamation
shall be to restore the mine excavations to lake areas and to grade and satisfactorily
revegetate the adjacent disturbed areas as per the approved mine maps and
reclamation plan for this site.
2. The specifications for surface gradient restoration to a surface suitable for the planned
future use are as follows:
A. The lake areas shall be excavated to maintain a minimum water depth of four
feet measured from the normal low water table elevation.
B. All sidesiopes to the lake excavations shall be graded to a minimum of 3
horizontal to 1 vertical above the water line and a minimum of 2 horizontal to 1
vertical below the water line to the bottom.

C. All remaining affected areas shall be graded to a 2 horizontal to 1 vertical or
flatter slope.
D. Any settling ponds or sediment basins shall be backfilled and stabilized.
E. The processing, stockpile, and other disturbed areas neighboring the mine
excavation shall be leveled and smoothed.
F. Compacted surfaces shall be disced, subsoiled or otherwise prepared before
revegetation.
G. No contaminants shall be permanently disposed of at the mine site. On -site
disposal of waste shall be in accordance with Operating Condition Nos. 11.A.
through D.
H. The affected land shall be graded to prevent the collection of noxious or foul
water.
3. Revegetation Plan:
After site preparation, all disturbed land areas shall be revegetated as specified in the
Vegetation Plan outlined on the mine map, Sheet 3 of 3, last revised January 15, 2002.
Whenever possible, disturbed areas should be vegetated with native warm season
grasses such as switch grass, Indian grass, bluestem and gamma grass.
In addition, the permittee shall consult with a professional wildlife biologist with the N.C.
Wildlife Resources Commission to enhance post -project wildlife habitat at the site.
4. Reclamation Plan:
Reclamation shall be conducted simultaneously with mining to the extent feasible. In any
event, reclamation shall be initiated as soon as feasible after completion or termination of
mining of any mine segment under permit. Final reclamation, including revegetation, shall
be completed within two years of completion or termination of mining.
This permit, issued July 20, 1972, renewed February 8, 1982, simultaneously renewed and
modified July 14, 1992, modified September 22, 1999, June 8, 2000 and July 13, 2001,
and renewed and modified April 4, 2002, is hereby modified this 19th day of August, 2002
pursuant to G.S. 74-52.

• Stormwater discharges associated with oil and gas extraction operations; and
• Stormwater discharges associated with tourist gem mines
• NCDOT borrow pits are covered under NCS000150
The following discharges are covered by NPDES general permit NCG520000 instead of NCG020000:
• Point source discharges of stormwater and wastewater from in -stream sand mining operations (i.e., sand
dredging or dipping operations)
For new mining sites that require an authorization to construct (ATC) wastewater treatment facilities: This
NOI is also an APPLICATION FOR an ATC for new.wastewater treatment facilities. ATC requests must be
submitted at least 90 days prior to construction'.
For existing mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities:
This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place.
Construction, modification, or installation of anV new treatment components at an existin_g site requires an
ATC. (If the site is already covered by NCG020000, the ATC request may be submitted without an NOI).
Some wastewater treatment facilities used to treat or recycle wastewater at mining sites will require an ATC rp for
to construction per 15A NCAC 2H .0138. Please see the NCG020000 General Permit for details about which
treatment facilities require an ATC (summarized in Table 1 below). The authorization to construct or continue
to operate will be issued at the same time as the Certificate of Coverage (COC) for the NCG02 permit. Design of
treatment facilities must comply with requirements of 15A NCAC 2H .0138 & .0139.
Construction of wastewater treatment facilities subject to the ATCIATO requirements in the NCG02 permit
at new or existing mining sites requires submission of three (3) sets of plans and specifications signed

Your application for modification of the above referenced mining permit has been
approved. The modification is to increase the permitted acreage to 396.46 acres and the
affected acreage to 196.22 acres as indicated on the mine map last revised July 25, 2002.
The modification includes the addition of 22.1 acres to the permit with 21 acres of new mine
area, including the construction and maintenance of the associated erosion and sedimentation
control measures. A copy of the modified permit is enclosed.
The conditions in the modified permit were based primarily upon the -initial application.
Modifications were made as indicated by modification request and as required to insure

In accordance vrith the application for this mining permit, which is hereby approved by the
Department of Environment and Natural Resources, hereinafter referred to as the Department,
and in conformity with the approved Reclamation Plan attached to and incorporated as part of
this permit, provisions must be made for the protection of the surrounding environment and for
reclamation of the land and water affected by the permitted mining operation. This permit is
expressly conditioned upon compliance with all the requirements of the approved Reclamation
Plan. However, completed performance of the approved Reclamation Plan is a separable
obligation, secured by the bond or other security on file with the Department, and may survive
the expiration, revocation or suspension of this permit.
This permit is not transferable by the permittee with the following exception: If another
operator succeeds to the interest of the permittee in the permitted mining operation, by virtue
of a sale, lease, assignment or otherwise, the Department may release the permittee from the
duties imposed upon him by the conditions of his permit and by the Mining Act with reference
to the permitted operation, and transfer the permit to the successor operator, provided that
both operators have complied with the requirements of the Mining Act and that the successor
operator agrees to assume the duties of the permittee with reference to reclamation of the
affected land and posts a suitable bond or other security.
in the event that the Department detr±rmines that the permittee or permittee's successor is not
complying with the Reclamation Plan or other terms and conditions of this permit, or is. failing
to achieve the purposes and requirements of the Mining Act, the Department may give the
operator written notice of its intent to modify, revoke or suspend the permit, or its intent to
modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a
Dearing at a designated time and place on any proposed modification, revocation or
suspension by the Department. Alternatively and in addition to the above, the Department
may institute other enforcement procedures authorized by law.

Modifications
July 14, 1992: This permit has been modified to allow the commencement of mining activities
as indicated on the Mine Map Layout plan and corresponding Details and Specifications sheet
dated November 1, 1991 and as specified by the additional information dated April 20, 1992
With several stipulations incorporated herein.
September 22,_ 1999; .This permit has been modified to allow construction of a new
Reclaiming Building, Crusher Building, Clay Building, an additional Conveyor, and a 30 foot
extension to an existing culvert to provide additional haul road access as indicated on the
mine map dated August 9, 1999 and supplemental information dated August 6, 1999.
June 8. 2000: This permit has been modified to allow construction of a new kiln, an addition
to the grinding room, a concrete slab around the existing material prep building and several
stone surfaced parking and brick storage yards as indicated on the mine map and detail sheet
both dated February 9, 2000. This modification increases the affected acreage at the site to
134.22 acres and includes all associated erosion and sedimentation control measures as
submitted with the modification request received by the Land Quality Section on May 3, 2000.

July 13� 2001: This permit has been modified to increase the affected acreage to 168.87
acres as indicated on the Mine Map dated June 4, 2001,
April 4, 2002: This permit has been modified to increase the affected acreage to 175.22 acres
as indicated on the mine maps fast revised January 15, 2002 and received by the Land
Quality Section on April 3, 2002. The modification includes the addition of 5.9 acres of mine
excavation in the southern portion of the property and the construction of a 30 ft by 40 ft. shed
near the existing stockpile area, including the associated erosion and sedimentation control
measures. The modification also includes the transformation of the 50 foot undisturbed
buffers along the railroad at Basins A and B to 50 foot unexcavated buffers.
August 19, 2002: This permit has been modified to increase the permitted acreage to 396.46
acres and the affected acreage to 196.22 acres as indicated on the mine map last revised July
25, 2002. The modification includes the addition of 22.1 acres to the permit with 21 acres of

This permit shall be effective from the date of its issuance until April 4, 2012.
Conditions
This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and
to the following conditions and limitations:
OPERATING CONDITIONS:
1. A. Any wastewater processing or mine dewatering shall be in accordance with the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission,
B. Any stormwater runoff from the affected areas at the site shall be in accordance
with any applicable permit requirements and regulations promulgated by the
Environmental Protection Agency and enforced by the N.C. Environmental
Management Commission. It shall be the permittee's responsibility to contact
the Stormwater Section, Division of Water Quality, to secure any necessary
stormwater permits or other approval documents.
2. A. Any mining process producing air contamination emissions shall be subject to
the permitting requirements and rules promulgated by the N.C. Environmental
Management Commission and enforced by the Division of Air Quality.
B. During mining operations, water trucks or other means that may be necessary
shall be utilized to prevent dust from leaving the ;permitted area.
3. A. Sufficient buffer shall be maintained between any affected land and any
adjoining waterway or wetland to prevent sedimentation of that waterway or.
wetland from erosion of the affected land and to preserve the integrity of the
natural watercourse or wetland.
B. Any mining activity affecting waters of the State, waters of the U. S., or wetlands
shall be in accordance with the requirements and regulations promulgated and
enforced by the N. C. Environmental Management Commission.

4. A. Adequate mechanicai barriers including but not limited to diversions, earthen
dikes, silt check dams, silt retarding structures, rip rap pits, or ditches shall be
provided in the initial stages of any land disturbance and maintained to prevent
sediment from discharging onto adjacent surface areas or into any lake, wetland
or natural watercourse in proximity to the affected land.
B. Erosion and sedimentation control measures shall be installed and maintained
as indicated on the Mine Layout plan and corresponding Details and
Specifications sheet dated November 1, 1991 and as specified by the additional
information dated April 20, 1992 with the following stipulations:
1 } All pipes outlets shall be stabilized with a ground cover sufficient to
restrain erosion;
2) The brick dams shall have a minimum base width of 35 feet to provide
stability for the structure,-
3) The NCDOT Class If rip rap used to construct Outlet Mats A and B on the
above referenced Mine Layout Plan shall be placed at a minimum depth
of 27 inches; and
4) The minimum depth of brick bats used to construct the spillway sections
of the earthen berm constructed near SR 1378 shall be 12 inches.
C. Mining activities, including the installation and maintenance of approved erosion
and sediment control measures, shall be conducted as indicated on the Mine
Map dated June 4, 2001 and the supplemental information dated June 5, 2001
with the following stipulations:
Silt fence shall be installed and maintained along the outside toe of any
constructed visual screening berms until permanent cover has been
established on said berms;
2. All run off shall be directed into the approved sediment basins or internal
to the mine excavation; and
3. A 100 foot long gravel construction entrance shall be constructed at the
intersection of the access road and SR 1379 and SR 1378, using No. 57
washed stone or equivalent.
D. .Mining activities, including the installation and maintenance of the associated
erosion and sediment control measures, shall be conducted as indicated on the
mine maps (Sheets 1 and 3 of 3) last revised January 15, 2002 and received by
the Land Quality Section on April 3, 2002 and the details sheet (Sheet 2 of 3)
dated November21, 2001,
E. Mining activities in the Proposed New Mine Area, including the installation and
maintenance of all erosion and sedimentation control measures, shall be
conducted as indicated on the mine map last revised July 25, 2002 and in
accordance with all supplemental information associated with said map.

F. An erosion and sediment control plan(s) shall be submitted to the Department for
approval prior to any land disturbing activities not indicated on the revised
erosion control plan or mine maps submitted with the approved application for a
mining permit and any approved revisions to it. Such areas include, but are not
limited to, expansion outside of the approved pit area, creek crossings, or
expansion of overburden or waste disposal areas.
5. All mining permit boundaries (396.46 acres) shall be permanently marked at the site on
100 foot intervals unless the line of sight allows for larger spacing intervals.
6. The angle for graded slopes and fills shall be no greater than the angle which can be
retained by vegetative cover or other adequate erosion control measure, structure, or
device. In any event, exposed slopes or any excavated channels, the erosion of which
may cause off -site damage because of -siltation, shall be planted or otherwise provided
with ground cover, devices or structures sufficient to restrain such erosion.
7. The affected land shall be graded so as to prevent collection of pools of water that are,
or likely to become, noxious or foul. Necessary structures such as drainage ditches or
conduits shall be constructed or installed when required to prevent such conditions.
8. A. Existing vegetation or vegetated earthen berms shall be maintained between the
mine and public thoroughfares whenever practical to screen the operation from
the public.
B. Three rows of lobiolly pines on 7 foot staggered spacings shall be established,
or, as an alternative, an eight foot high berm with two horizontal to one vertical
sideslopes, shall in installed and permanently stabilized as indicated in the
supplemental information dated June 5, 2001 between any mining activities and
SR 1378 and SR 1379 (Hayes Road), U.S. Highway 74, and any other areas
where existing vegetation does not provide adequate visual barriers to screen
the mining activities at the site.
C. The vegetated earthen diversion berms located along SR 1378 (Hayes Road)
shall also be maintained as visual barriers to screen the Proposed New Mine
Area from the public.
9. A. Sufficient buffer shall be maintained between any excavation and any mining
permit boundary or right-of-way to protect adjacent property.
B. Buffer zones at this site shall, be maintained as indicated on the mine map last
revised July 25, 2002.
10. A physical barrier consisting of a fence or earthen berm, etc., shall be maintained
around the perimeter of any highwall.
11. A. No on -site disposal of refuse or other solid waste that is generated outside of the
mining permit area shall be allowed within the boundaries of the mining permit
area unless authorization to conduct said disposal has first been obtained from
both the Division of Waste Management and the Land Quality Section,
Department of Environment and Natural Resources. The method of disposal
shall be consistent with the approved reclamation plan.

B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971
generated on -site and directly associated with the mining activity may be
disposed of in a designated refuse area. All other waste products must be
disposed of in a disposal facility approved by the Division of Waste
Management. No petroleum products, acids, solvents or their storage
containers or any other material that may be considered hazardous shall be
disposed of within the permitted area.
C. For the purposes of this permit, the Division of Land Resources considers the
following materials to be "mining refuse" (in addition to those specifically listed
under G.S. 74-49 (14) of the N.C. Mining Act of 1971).
1 on -site generated land clearing debris
2 conveyor belts
3 wire cables
4) v-belts
5 steel reinforced air hoses
6� drill steel
D. If mining refuse is to be permanently disposed within the mining permit
boundary, the following information must be provided to and approved by the
Division of Land Resources prior to commencement of such disposal:
1. the approximate boundaries and size of the refuse disposal area;
Z. a list of refuse items to be disposed;
3. verification that a minimum of 4 feet of cover will be provided over the
refuse;
4. verification that the refuse will be disposed at least 4 feet above the
seasonally high water table; and
5. -verification that a. permanent vegetative groundcover will be established.
12. An Annual Reclamation Report shall be submitted on a form supplied by the
Department by February 1 of each year until reclamation is completed and approved.
13. The operator shall notify the Department in writing of the desire to delete, modify or
otherwise change any part of the mining, reclamation, or erosion/sediment control plan
contained in the approved application for a mining permit and any approved revisions
to it. Approval to implement such changes must be obtained from the Department prior
to on -site implementation of the revisions.
14. .The security which was posted pursuant to N.C.G.S. 74-54 in the form of a $500,000.00
blanket bond is sufficient to cover the operation as indicated in the approved
application. This security must remain in force for this permit to be valid, The total
affected land shall not exceed the bonded acreage.
15, A. Authorized representatives of the Division of Archives and History shall be
granted access to the site to determine the presence of significant
archaeological resources.
B. Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human
Skeletal Remains Protection Act," should the operator or any person in his
employ encounter human skeletal remains, immediate notification shall be
provided to the county medical examiner and the chief archaeologist, North
Carolina Division of Archives and History.

APPROVED RECLAMATION PLAN
The Mining Permit incorporates this Reclamation Plan, the performance of which is a
condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan
is a separable obligation of the permittee, which continues beyond the terms of the Mining
Permit.
The approved plan provides:
Minimum Standards As Provided By G.S. 74-53
1. The final slopes in all excavations in soil, sand, gravel and other unconsolidated
materials shall be at such an angle as to minimize the possibility of slides and be
consistent with the future use of the land.
2- Provisions for safety to persons and to adjoining property must be provided in all
excavations in rock.
3. All overburden and spoil shalt be left in a configuration which is in accordance with
accepted conservation practices and which is suitable for the proposed subsequent use
of the land.
4. No small pools of water shall be allowed to collect or remain on the mined area that
are, likely to become noxious, odious or foul,
The revegetation plan shall conform to accepted and recommended agronomic.and
reforestation practices as established by the North Carolina Agricultural Experiment
Station and the North Carolina forest Service.
6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein
incorporated. These activities shall be conducted according to the time schedule
included in the plan, which shall to the extent feasible provide reclamation
simultaneous with mining operations and in any event, provide reclamation at the
earliest practicable time after completion or termination of mining on any segment of
the permit area and shall be completed within two years after completion or termination
of mining.
RECLAMATION CON ITIONS.
1. Provided further, and subject to the Reclamation schedule, the planned reclamation
shall be to restore the mine excavations to lake areas and to grade and satisfactorily
revegetate the adjacent disturbed'areas as per the approved mine maps and
reclamation plan for this site.
2. The specifications for surface gradient restoration to a surface suitable for the planned
future use are as follows:
A. The lake areas shall be excavated to maintain a minimum water depth of four
feet measured from the normal low water table elevation.
B. All sidesiopes to the fake excavations shall be graded to a minimum of 3
horizontal to 1 vertical above the water line and a minimum of 2 horizontal to 1
vertical below the water line to the bottom.

C. All remaining affected areas shall be graded to a 2 horizontal to 1 verticai or
flatter slope.
D. Any settling ponds or sediment basins shall be backflled and stabilized.
E. The processing, stockpile, and other disturbed areas neighboring the mine
excavation shall be leveled and smoothed.
F. Compacted surfaces shall be disced, subsoiled or otherwise prepared before
revegetation.
G. No contaminants shall be permanently disposed of at the mine site. On -site
disposal of waste shall be in accordance with Operating Condition Nos. 11.A.
through D.
H. The affected land shall be graded to prevent the collection of noxious or foul
water.
3. Revegetation Plan.
After site preparation, all disturbed land areas shall be revegetated as specified in the
Vegetation Plan outlined on the mine map, Sheet 3 of 3, last revised January 15, 2002.
Whenever possible, disturbed areas should be vegetated with native warm season
grasses such as switch grass, Indian grass, bluestem and gamma grass.
In addition, the permittee shall consult with a professional wildlife biologist with the N.C.
Wildlife Resources Commission to enhance post -project wildlife habitat at the site.
4. Recla Con Plate:
Reclamation shall be conducted simultaneously with mining to the extent feasible. In any
event, reclamation shall be initiated as soon as feasible after completion or termination of
mining of any mine segment under permit. Final reclamation, including revegetation, shall
be completed within two years of completion or termination of mining.
This permit, issued July 20, 1972, renewed February 8, 1982, simultaneously renewed and
modified July 14, 1992, modified September 22, 1999, June 8; 2000 and July 13, 2001,
and renewed and modified April 4, 2002, is hereby modified this 19th day of August, 2002
pursuant to G.S. 74-52.

or dipping operations)
For new mining sites that require an authorization to construct (ATC) wastewater treatment facilities: This
NOI is also an APPLICATION FOR an ATC for new wastewater treatment facilities. ATC requests must be
submitted at least 90 days prior to construction'.
For existin_g mining sites that require an Authorization to Operate (ATO) wastewater treatment facilities:
This NOI is also an APPLICATION FOR an ATO for wastewater treatment facilities in place.
Construction, modification, or installation of any new treatment components at an existing site requires an
ATC. (If the site is already covered by NCG020000, the ATC request may be submitted without an NOI).
Some wastewater treatment facilities used to treat or recycle wastewater at mining sites will require an ATC 2LLor
to construction per 15A NCAC 2H .0138. Please see the NCG020000 General Permit for details about which
treatment facilities require an ATC (summarized in Table 1 below). The authorization to construct or continue
to operate will be issued at the same time as the Certificate of Coverage (COC) for the NCG02 permit. Design of
treatment facilities must comply with requirements of 15A NCAC 2H .0138 & .0139,
Construction of wastewater treatment facilities subject to the ATC/ATO requirements in the NCG02 permit
at new or existing mining sites requires submission of three (3) sets of plans and specifications signed

Change in permit coverage

Dear Mr, Garvey:
As you and I discussed by phone on Friday, March 4, 2011, DWQ's Stormwater Permitting Unit concurs with the
instruction from our Mooresville Regional Office inspector, Mr. Samar Bou-Ghazale, to Hanson to apply for
coverage for your surface water discharges under a different DWQ permit, our General Permit NCG020000. This
change represents a new emphasis in the Implementation of our program for brick manufacturing facilities with
clay pits on the same site.
Beginning in the early 1990's, Hanson's Monroe facility and other brick manufacturers have been provided
discharge authorization under North Carolina's NPDE!�'pfbgrai#ilvia our NPDES Stormwater General Permit,
NCG070000, for stone, clay, and glass manufacturing industrial activities. Per my review of your files in our
office last week, I can report that in January 1996, and partially as a result of our visit to your Monroe facility,
DWQ decided to develop a new General Permit for brick manufacturers with clay pits on the same site.
Unfortunately other priorities in other program areas intervened, and the Stormwater Permitting Unit was never
able to develop the intended new General Permit. This left Hanson and other brick manufacturers covered under
the original General Permit, NCG070000. DWQ subsequently renewed your coverage under NCG070000 three
more times at the end of successive five-year permit terms.
We no longer intend to develop a new industry -wide General Permit for your industry, in part in recognition of the
staff resources required, and the ongoing limitations imposed by competing priorities. We note that across your
industry we have not received widespread water quality complaints from our Regional Office staff as to your
industry in general, nor specifically as to your Monroe facility.
Our perspective on past permitting actions is that Hanson's Monroe facility applied for the General Permit
NCG070000, and that DWQ issued or reissued that permit four times over the last 17 years. Hanson's permit
coverage represented DWQ's permitting strategy at the time. However, DWQ has developed a new emphasis in
our permitting strategy for the brick manufacturing locations where clay pits are located on the same site: As
these facilities have come to our attention we are directing those facilities to re -apply for coverage under our
mining General Permit for NPDES discharges, NCG020000. Several other facilities have already made this
transition. We are conscious of the interruption this may cause on -going businesses and we are implementing this
strategy In as low -impact a manner as possible, namely as I referred to, only as facilities come to our notice.

In our telephone conversation, you indicated that Hanson's Monroe facility would apply for coverage under
NCG020000, as directed by Mr. Bou-Ghazale from our Mooresville Regional Office. Upon receipt and approval of
your application we will concurrently rescind your coverage under your current permit, NCG070000 and your
current Certificate of Coverage NCG070066. You should also expect to receive an inspection report from Mr.
Bou-Ghazale from his recent visit to your site.
I've discussed this change in coverage with the supervisor of the Stormwater Permitting Unit, Bradley Bennett, and
you may contact him or me with any questions.
