I addressed those issues in my letter to them (cc'd Bradley Bennett) and stated that I would expect my comments to be implemented into their plans unless they felt strongly about my comments and wanted further discussion with me about it. . they seemed agreeable. I didn't know at the time Hardee had already been issued, but stated that (assuming we went ahead or would issue the NCG permit), prior to dewatering, they address my concerns. Some I rather they address before, but at this point I think they will address my concerns. I did speak with the engineer on the phone last week to let him know he'd get my letter. They are proposing 30-40 feet deep, not necessary, they should be shallow wells. 5-10 feet should suffice, especially if they are putting them in the wetlands. I told Jody I planned to come out and see the level spreader as soon as they begin dewatering. I'll check on this system regularly since we will have it permitted, that way we can also see the long term effects and potentially what happens if the system is maintained properly. Please provide a USGS quadrant map with an overlay of the mine site. The USGS map is helpful in identifying any blue line streams or potential wetlands outside the boundary of the mine site. The map should be large enough to accommodate the identification of the access roads, excavation area, settling basins, spoil piles, undisturbed buffers, and level spreader locations. The map provided showed wetlands mostly within the mine site (proper) but left some uncertainty that wetlands had been identified outside the mine site (specifically to the north of the mine site). DWQ is interested in the protection of all wetlands, including those located outside the mine site boundaries. 2. Provide a copy of the delineation certified by the US Army Corp of Engineers or a letter from the USACOE indicating concurrence with the wetland boundaries identified on the map provided. 3. Monitoring wells should be of sufficient number to provide data on hydrology of each wetland that has the potential to be impacted by dewatering activities. The monitoring wells should be of sufficient depth to demonstrate wetland hydrology. Use of existing wells that are 40-50 feet deep are too deep to demonstrate wetland hydrology and should not be used to demonstrate whether wetland impacts are occurring. Placement of the monitoring wells should be in the wetlands, just outside the undisturbed buffer. The two monitoring wells identified on the map are located outside the wetland boundaries and are not shallow monitoring wells. 4. Mining roads or berms should not be built within the 50' undisturbed buffer, since an undisturbed buffer refers to an area that has not been disturbed. Building a road or berm is a disturbance. 5. The number of level spreaders and their locations should provide recharge to all wetlands that have the potential of being impacted by dewatering activities. 6. Include in the O & M plan a statement that requires the permittee to discontinue dewatering activities immediately and contact DWQ upon noticing any impacts to surface waters or significant changes in wetland hydrology and vegetation due to dewatering and will not resume dewatering until DWQ has conducted an inspection of the mine site. DWQ will be notified if the daily flow exceeds the projected flow or pump rates are increased to any level spreader exceeding those identified in the plans. 7. Please provide the calculations (including any assumptions made) that demonstrate the accuracy of the projected daily discharge of water that will need to be removed from the mine excavation pit. Please account as well for the contribution to flow from stormwater. Explain how adequate settling will be achieved during the early stages of digging (and dewatering) when the size of the pit is too small to provide adequate settling. 8. Monitoring wells should be of sufficient number to provide data on hydrology of each wetland that has the potential to be impacted by dewatering activities. The level spreader diffuses discharged wastewater through the required fifty (50) foot vegetated buffer. The 'infiltration process will continually recharge the water table and also protect the wetland areas from any impacts associated with the mining operations. Monitoring wells have been indicated along the project perimeter in various locations. These wells have been placed in proximity of the wetland areas and/or with proximity of wells that exist to the west and north of the project site. These monitoring wells will provide both water table elevation and chemical data. Quarterly testing and reports; as specified in Section CA Table 6 of the NPDES General Permit; are required to be submitted to NCDENR and records shall be retained in the mining office. All tested parameters shall be in accordance with Section C.3 Table 9 of the NPDES General Permit. The stilling basin / level spreader BMP will be required to be inspected either quarterly and after any discharge operation or on a monthly basis. The stilling basin should be inspected for sediment accumulation. If sediment is found to be 25% or more of the original design depth then all sediment shall be removed and the basin will be returned to original design conditions. An inspection of the level spreader should verify that the spreader lip has not been bypassed and that the filter strip remains vegetated and channelized flow does not occur during operation. If needed, the vegetated buffer should be reestablished and channelization should be removed. Vegetation should remain; at all times; a minimum six (6) inches in height. All silt fencing shall remain at the excavation limits as specified by site plans. Any accumulated sediment should be removed from the base when the depth reaches one (1) foot. They also submitted a site plan that shows the mine, wetlands, etc. (too big to send you), but not much detail about their flow spreader (or maybe it's just far from an acceptable level spreader design). Because it's a sand mine, we typically don't review their treatment system designs for dewatering for the NCG02 permit (i.e., no ATC submittal is required), so I'm not sure how to address this. Hopefully I'll hear more from DLR soon, and if 401 gets involved, surely they will need to approve their level spreader design. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.), and the North Carolina Mining Act of 1971 (as amended, 1982: G.S. 74-76 et seq., 15 NCAC 5). The applicant is requesting authorization to mine sand from 18.97 acres at a site off Winding Way, south of Woodard Rd. Slopes of 3:1 will be maintained around the pit and these are to be planted with grasses and allowed to re -vegetate with naturally occurring tree and shrub species. We have the following concern slrecommendations regarding the proposed project: • The applicant proposes to stabilize the disturbed portions of the site with grasses. We recommend the use of locally native species such as switchgrass (Panicum virgatum). Also, we recommend shrub species such as wax myrtle (Myrica cerifera), silverling (Baccharis halimifolia), and/or marsh elder (1va frutescens) be planted for stabilization around the pond's edge. The use of these species will provide food and cover for wildlife not afforded by lawn grasses typically used for stabilization. Although the applicant states that a 50 ft vegetated buffer will be provided adjacent to all wetlands, the mine map indicates three areas of wetland impacts totaling 0.143 acre for the construction of a haul road and two berm (?) areas. Describe specific erosion control measures to be installed prior to land disturbing activities and during mining to prevent offsite sedimentation (include specific plans for sediment and erosion control for mine e,xcavation(a), waste piles, access/mine roads crud process areas), and give a detailed sequence of installation and schedule for maintenance of the measures. Locate and label all sediment and erosion control measures on the mine map(s) and provide typical cross-sections/construction details of each measure. Engineering designs and calculations shall be required when needed to justify the adequacy of any proposed measures. The entire project site will be surrounded by an existing vegetated buffer to act as a filter for any surface sediment movement. Since the mine is a pit, movement of sediment from the pit will be negligible. 3. a. Will the operation involve washing the material mined, recycling process water, or other waste water handling? The discharge will consist of exfiltrated groundwater and collected rainwater, all of which will be pumped to a stilling basin. Once it reaches the stilling basin, it will be diverted to a level spreader and sheet flow through a vegetated buffer to the Royal Oak Swamp which feeds to the Beaverdam Swamp. lid APPLICATION FOR A MINING PEPUMIT c. Indicate whether the proposed mine locale is served by a public water system or private wells. Due to distance to existing wells and relative shallow depth of mine, no impact is expected. d. If you answered yes to any of the above questions, provide evidence that you have applied for or obtained the appropriate water quality permit(s) (i.e., non -discharge, NPDES, Stormwater, etc.) from the Division of Water Quality, Water Quality Section. In addition, the applicant is required to register water use with the Division of Water Resources if the operation withdraws more than 100,000 gallons per day and needs a capacity use permit from the Division of Water Resources if the operation lies in a capacity use area and withdraws more than 100,000 gallons per day. Permit application is attached. 4. a. Will the operation involve crushing or any other air contaminant emissions? Yes No X If yes, indicate evidence that you have applied for or obtained an air quality permit issued by the Division of Air Quality or local governing body. b. How will dust from stockpiles, haul roads, etc., be controlled? Due to the sandy nature of soil, dust is not expected to be a problem. Also buffer distances to inhabited areas are extensive. -7- APPLICATION FOR A MINING PERMIT 5. a. A buffer will be required between any mining activity and any mining permit boundary or right-of- way. It may be an unexcavated buffer (no excavation, but roadways, berms and erosion & sedimentation control measures may be installed within it), an undisturbed buffer (no disturbance within the buffer whatsoever), or a combination of the two, depending upon the site conditions. Note that all buffers must be located within the mining permit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site? A minimum buffer of 25 feet is recommended, although a wider buffer may be needed depending on site conditions. Show all buffer locations and widths on the mine map(5). A minimum buffer of 50' will be maintained. b. A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands unless smaller undisturbed buffers can be justified. Depending on site conditions, a buffer wider than 50 feet may be needed. Minimum 2 horizontal to I vertical slopes or flatter for clayey material and minimum 3 horizontal to I vertical slopes or flatter for sandy material are generally required, unless technical justification can be provided to allow steeper slopes. Side slope excavations will be 3 to 1. Wide enough buffers exist between the mine and adjacent property lines to ensure no violation of boundaries. APPLICATION FOR A MINING PERMIT b. Provide a cross-section on the mine maps) for all fill slopes (berms, wastepiles, overburden disposal areas, etc.), clearly indicating the intended side slope gradient, installation ofany benches and/or slope drains (with supporting design information) if needed, and the method of final stabilization. A side slope of 3 to I or flatter will be maintained. In excavation(s) of unconsolidated (non -rock) materials, specify the angle of all cut slopes including specifications for benching and sloping. Cross-sectionsfor all cut slopes must be provided on the mine map(ti). NIA cf. In hardrock excavations, specify proposed bench widths and heights in feet. Provide cross -sections of the mine excavation clearly noting the angles of the cut slopes, widths of all safety benches and mine benches, and the expected maximum depth of the excavation. NIA 7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling house, public road, public, commercial or industrial building from any mine excavation. Locate all such structures on the mine map if they are within 300 feet of any proposed excavation. The mining operation is located at a sufficient distance from any existing neighboring structures, etc. to disallow any physical hazard to them. No blasting or vibratory equipment is to be used. 8. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area and when it will be implemented. Vegetated earthen berms, appropriate fencing and adequate boulder barriers may be acceptable high wall barricades. A construction detail/cross-section and location of each type of barricade to be used must he indicated on the mine map(r). A steel gate will be located at the mine entrance. A fence will be installed along property boundaries that abut residentially zoned properties if it is deemed necessary. APPLICATION FOR A MINING PERMIT 9. RECLAMATION PLAN Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate the sequence and general methods to be used in reclaiming this land. This must include the method of reclamation of settling ponds and/or sediment control basins and the method of restoration or establishment of any permanent drainage channels to a condition minimizing erosion, siltation and other pollution. This information must be illustrated on a reclamation map and must correspond directly with the information provided on the mine map(s). In addition, design information, including typical cross -sections, of any permanent channels to be constructed as part of the reclamation plan and the location(s) of allpermanent channels must be indicated on the reclamation map. The area will be reclaimed as a wooded area with a pond and soil road access. Pit banks will be grassed and allowed to re -vegetate with naturally occurring tree and shrub species. The haul road will be maintained to allow access to the stocked pond which will be placed within the pit area. 2. Is an excavated or impounded body of water to be left as a part of the reclamation? Yes X No If yes, illustrate the location of the body(s) of water on the reclamation map and provide a scaled cross -sections) through the proposed body(y) of water. The minimum water depth must be at least 4 feet, measured from the normal low water table elevation, unless information is provided to indicate that a more shallow water body will be productive and beneficial at this site.
