On April 25, 2014, the Division of Energy, Mineral and Land Resources received your request to rescind
your coverage under Certificate of Coverage Number NCG020667. In accordance with your request,
Certificate of Coverage Number NCG020667 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
of the State without valid coverage under an NPDES permit is against federal and state laws and could result
in fines. If something changes and your facility would again require storrnwater or wastewater discharge
permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the
proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform the
new or prospective owners of their potential need for NPDES permit coverage.

I visited the Busy B&D mine on May 2nd. Mining appears to have stopped. The mine still needs to be reclaimed but the
pump has been removed and water is beginning to fill the mine. I recommend that the rescission request for
NCG020667 be granted. Please let me know if you need any additional information.

Dear Mr. Brown:
In accordance with your application for a discharge permit received on November 17,
2005 we are forwarding herewith the subject certificate of coverage to discharge under the
subject state — NPDf S general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
This general permit allows the discharge of stormwater and certain types of wastewater
from your facility. In your Notice of Intent, you specified that only mine dewatering would be
discharged from this facility. If point -source discharges of stormwater occur, you will be
required to adhere to the conditions in this permit for stormwater discharges.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land
Resources, Coastal Area Management Act or any other federal or local governmental permit that
may be required.

The application for a mining permit for the above referenced mine site has been found
to meet the requirements of G.S. 74-51 of The Mining Act of 1971. As we have received the
required security to cover this application, 1 am enclosing the mining permit.
The conditions of Mining Permit No. 67-64 were based primarily upon information
supplied in the application with conditions added as necessary to insure compliance with The
Mining Act of 1971. This permit expires on March 16, 2014. G.S. 74-65 states that the
issuance of a mining permit does not supersede or otherwise affect or prevent the enforcement
of any zoning regulation or ordinance duly adopted by an incorporated city or county or by any
agency or department of the State of North Carolina.
As a reminder, your permitted acreage and affected acreage for this site are both 5.0
acres, as indicated in the application and on the mine maps dated December 1 and 2, 2003.
