8. PROJECT SUMMARY: The applicant proposes to expand an existing docking facility by
installing a new 12.5'x 10' boatlift.

9. PROJECT DESCRIPTION:
The project site is located at 8208 Bald Eagle Lane, adjacent to the AIWW and Middle Sound, in
Wilmington, New Hanover County. To find the property from the Wilmington Regional Office, take
Highway 17 North from Wilmington to Porters Neck (Kirkland). Turn right onto Porters Neck Road
and travel to the stop sign. At the intersection of Porters Neck Road and Bald Eagle Lane, turn right
and travel 0.15 miles. The subject property will be located along the left hand side of the road at
house number 8208.
Existing man-made features on the property include a single-family residential dwelling and a
private docking facility. High ground vegetation consists of mature Live Oak, lawn grasses and
ornamental shrubs. The high ground portion is elevated approximately V-22' above the normal
high water (NHW) level, and the shoreline (+/- 127 linear feet) is naturally stabilized. There is a
fringe of Coastal Wetlands bordering the eastern shoreline that is comprised primarily of Smooth
Marsh Cordgrass. In this area, the Coastal Wetlands span the length of the property at a width of
35'-40'. Residential properties border the land to the north, south and west and the AIWW borders
the property to the east.
The existing pier and docking facility were authorized in April 2019 under CAMA General Permit No.
74274-D. The facility was replaced under CAMA emergency General Permit 15A NCAC 07H .2500
due to damages sustained as a result of Hurricane Florence. The original permit was issued in 2006
and then amended to include the addition of two floating docks in 2014, under CAMA General
Permit 63123-D. The existing docking facility is located along the eastern portion of the property
and extends approximately 130' into the AIWW. The facility consists of a 5' x 162' access pier, 14'x
16' T -head shaped platform, and two 8' x 16' floating docks (one located on either side of the
existing platform). The existing docking facility is centrally located along the eastern property line
and terminates in alignment with the adjacent docking facilities to the north and south, along the
inside edge of the federal channel setback. As constructed, the existing facility is within the 1/4 width
of waterbody limitation.
The waters of Middle Sound (adjacent to the project site) are classified as SA-ORW by the North
Carolina Division of Water Resources. They ARE NOT designated as a Primary Nursery Area
(PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of
shellfish. Based on visual observations made by DCM staff during the September 2019 site visit,
there appears to be NO Submerged Aquatic Vegetation (SAV) in the vicinity of the proposed project.
Water depths in the vicinity of the existing facility range from -3' to -7', relative to normal low water
(NLW).
PROPOSED PROJECT:
The applicant proposes to expand the existing docking facility by installing a new 12.5'x 10' boatlift.
According to the application package, a new boatlift would be installed along the northern side of
the existing elevated platform, between the platform and the 8'x 16' floating dock located along the
northern side of the existing docking facility. The proposed boatlift would be angled perpendicular
to the channel and would provide dockage for a single vessel. The additional lift would create up to
three (3) potential docking spaces, when combined with the existing structures (i.e. floating docks).

The proposed boat lift would not encroach within the 15 -foot riparian corridor setback of neither
adjacent property owner and would be within the 1/a width limitation. In addition, the proposed lift
would be located outside of the federal channel setback that runs along the AIWW.
10. ANTICIPATED IMPACTS:
The proposed structure would incorporate approximately 125 sq, ft. of Estuarine Waters and Pubic
Trust Area. The boatlift would remain consistent with similar pier length requirements (established
pier -head line) and would be located outside of the federal channel setback, and within 1/4 width of
the waterbody. Minor increases in turbidity should be expected during construction. Water depths
in the vicinity of the proposed project range from -3.0' to -7.0' @ normal low water.

Ms. Sondra Vitols is requesting that a Major Permit be issued for the addition of a boat lift at
8208 Bald Eagle Lane, Wilmington, NC 28411. This boat lift would be for the recreational use
of the homeowner.
There exists on the property a 4' x 88' finger pier, a 240 sgft platform, one 8'x16' floating dock,
and one 6' x 16' floating dock. The proposed boatlift would require the installation of two
pilings over the water where the MHW is approximately 7'.
The pilings would be set using a barge, water jet, and would be driven with a vibratory hammer
to reach the rated capacity (approximately 9-10' deep).

Dear Mr. Penny:
The Division of Coastal Management hereby acknowledges receipt of your application,
acting as agent for Sondra Vitols, requesting authorization under the Rules of the N.C.
Coastal Resources Commission for development activities at 8208 Bald Eagle Lane,
adjacent to the AIWW and Middle Sound, in Wilmington, New Hanover County. It was
received as complete on September 9, 2019 and appears to be adequate for processing at
this time. The projected deadline for making a decision on your permit application is
November 23, 2019. An additional 75 -day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by
the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 9, 2019,
you may request a meeting with the Director of the Division of Coastal Management and
permit staff to discuss the status of your project. Such a meeting will be held within five
working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A -119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in
an incomplete application.

The Department of Environmental Quality hereby gives public notice as required by NCGS 113A -
119(b) that the following applications were submitted for a development permits in Areas of Environmental
Concern as designated under the CAMA: On September 9, 2019, Sondra Vitals proposed to install a boat lift to
an existing docking facility at 8208 Bald Eagle Lane, adjacent to AIWW & Middle Sound, in Wilmington,
New Hanover County, on September 3, 2019, Robert Reifproposed to replace a failing bulkhead at 709 Hughes
Rd., adjacent to Mill Creek, in Hampstead, Pender County, on September Il, 2019, Batt's Properties, Inc.
proposed to install a six -slip docking facility & boardwalk at 602 Roland Ave., adjacent to Topsail Sound, in
Surf City, Pender County, and on August 28, 2019, Mark Yusko proposed to dredge at an existing docking
facility at 116 Bridgers Ave., adjacent to Banks Channel & Topsail Sound, in Topsail Beach, Pender County.

Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to October 9, 2019 will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies. Notice of
the permit decision in these matters will be provided upon written request.
