In accordance with your request, Certificate of Coverage Number NCG020418 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters Of the State without valid coverage under an NPDES permit is against federal and state laws and could result in fines. If something changes and your facility would again require stormwater or wastewater discharge permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the proper permit coverage. See attached report. According to IBEAM, the last inspection for the mining permit, which was done in October 2012, noted that all areas had been reclaimed except for the haul road. In addition, the mining permit for Harris Trucking Pit #3 (63-38) was incorporated into the ruining permit for Harris Trucking Pit #2 (63-29) back in January 2013. See attached ruining permit renewal/modification letter. Based on this information and since the subject rescission request is for the COC that was specifically issued for Pit #3, the FRO has no objections to rescission of NCG020418. Your time and assistance during the inspection is greatly appreciated. Permit coverage authorizes the discharge of stormwater and/or wastewater from the facility to receiving waters designated as unnamed tributary to tittle River, a Class WS-iII;HQW stream in the Cape Fear River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General Permit-NCG020000, Certificate of Coverage-NCG020418. As a result of discussions with you and observations made during the inspection, it appeared that mining activities for Pit #3 have ceased and reclamation has begun. Jones, Jennifer Subject: RE: 63-29 DLR - Water Quality Review Sheet 2010 Their mining permit application was marked as "No Dewatering Proposed", which I assume means no intentional dewatering of the pit with a pump. The mine map shows two stormwater basins, one with no outlet and ore with a stone outlet, but it also appeared as though any discharges from the basins might stay on the property and flow back into the mine pit. I think a letter to SPU regarding the mining permit modification to add the two pits together would suffice along with revising their SWPPP and site map. I don't really see a need for them to request a formal modification to their existing stormwater permit. Do we even do that? 1 was thinking they could just revise their site map and SWPPP to include the additional acreage since they are basically incorporating Pit #2 into Pit #3. What would they need to submit to modify their existing COC? A letter describing the situation perhaps? Then we would issue them a revised COC? Not sure how this might work. Thoughts? Do they need a modification? Application is for modification to combine Pit #2 with Pit #3. Pit #3 has active stormwater permit coverage under COC NCG020418. Permit coverage currently issued for Pit #3 only could apply to entire site provided the SWPPP and site map are updated to reflect additional acreage. Application states that there will be no dewatering and "...excavation will be conducted to contain all storm water from disturbed areas within the mine pit area." However, two sediment basins are shown on the mine map, one with no outlet and one with a stone outlet. The Division of Water Quality attempts to operate in a fiscally responsible and efficient manner.
