On June 3, 2014, the Division of Energy, Mineral and Land Resources received your request to rescind your
coverage under Certificate of Coverage Number NCG020418. In accordance with your request, Certificate
of Coverage Number NCG020418 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
Of the State without valid coverage under an NPDES permit is against federal and state laws and could result
in fines. If something changes and your facility would again require stormwater or wastewater discharge
permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the
proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform the
new or prospective owners of their potential need for NPDES permit coverage.

The last (and probably only) stormwater inspection for the subject facility was conducted by myself back in May 2012, 1
noted then that mining activities had apparently ceased and reclamation had begun and even provided Mr. Harris with a
rescission request form. See attached report. According to IBEAM, the last inspection for the mining permit, which was
done in October 2012, noted that all areas had been reclaimed except for the haul road. In addition, the mining permit
for Harris Trucking Pit #3 (63-38) was incorporated into the ruining permit for Harris Trucking Pit #2 (63-29) back in
January 2013. See attached ruining permit renewal/modification letter. Based on this information and since the subject
rescission request is for the COC that was specifically issued for Pit #3, the FRO has no objections to rescission of
NCG020418.

On May 8, 2012, a site inspection was conducted for the Harris Trucking Pit #3 site located off Rubicon Road in
Moore County, North Carolina. Your time and assistance during the inspection is greatly appreciated. Permit
coverage authorizes the discharge of stormwater and/or wastewater from the facility to receiving waters
designated as unnamed tributary to tittle River, a Class WS-iII;HQW stream in the Cape Fear River Basin. The
site visit and file review revealed that the subject facility is covered by NPDES General Permit-NCG020000,
Certificate of Coverage-NCG020418.
As a result of discussions with you and observations made during the inspection, it appeared that mining activities
for Pit #3 have ceased and reclamation has begun. Due to these conditions, the enclosed Compliance Inspection
Report shows that the questions regarding compliance with the conditions of the NCG020000 permit have been
marked as NE (Not Evaluated). As relayed to you during the inspection, permit coverage can be rescinded once
all industrial activities have ceased and there are no materials exposed to stormwater. A copy of the Rescission
Request Form is enclosed for your use.

Their mining permit application was marked as "No Dewatering Proposed", which I assume means no intentional
dewatering of the pit with a pump. The mine map shows two stormwater basins, one with no outlet and ore with a
stone outlet, but it also appeared as though any discharges from the basins might stay on the property and flow back
into the mine pit. I think a letter to SPU regarding the mining permit modification to add the two pits together would
suffice along with revising their SWPPP and site map. I don't really see a need for them to request a formal modification
to their existing stormwater permit.

A modification to their existing stormwater permit for Pit #3? Do we even do that? 1 was thinking they could just revise
their site map and SWPPP to include the additional acreage since they are basically incorporating Pit #2 into Pit #3. What
would they need to submit to modify their existing COC? A letter describing the situation perhaps? Then we would issue
them a revised COC? Not sure how this might work. Thoughts?

Application is for modification to combine Pit #2 with Pit #3. Pit #3 has active stormwater permit
coverage under COC NCG020418. Permit coverage currently issued for Pit #3 only could apply to entire site
provided the SWPPP and site map are updated to reflect additional acreage. Application states that there will
be no dewatering and "...excavation will be conducted to contain all storm water from disturbed areas within
the mine pit area." However, two sediment basins are shown on the mine map, one with no outlet and one with
a stone outlet. Permit coverage should be maintained to allow for potential discharges from any basins with
monitoring conducted per the conditions of the NCG020000 general permit

This annual fee is required by the North Carolina Administrative Code. It covers the administrative costs associated with your
permit. It is required ofany person holding a permit for any time during the annual fee period, regardless of the facility's operating
status. failure to pay (lie fee by the due date will subject the permit to revocation. Operating without a valid permit is a violation
and is subject to a S 10,000 per day fine. If the permit is revoked and you later decide a permit is needed, you must reapply, with the

Dear Mr. Harris:
On .July 31, 2007 the North Carolina General Assembly and Governor Lasley put into effect a new
budget that included a 20% increase to all fees associated with Division of Water Quality annual
fees, new permit applications, permit modifications, certifications, and project fees. $100 is the
new permit application fec, instead ofthe former $80 application fee for General Stormwater
permits.
The Division of Water Quality attempts to operate in a fiscally responsible and efficient manner.
This increase represents the first change in fees since 1999 and reflects inflationary pressures over
that time.
As of September 1, 2007, all permit fees collected must meet the legal requirements of these
changes.

In accordance with your application for discharge permit received on April 21, 1997 we are forwarding
herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Water Quality, The Division of Water Quality may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.

This certificate of coverage shall become effective July 18. 1997.
This Certificate of Coveratle shall remain in effect for the duration of the General Permit.
