On November 19, 2013, the Division of Energy, Mineral and Land Resources received your request to
rescind your coverage under Certificate of Coverage Number NCG020334. In accordance with your
request, Certificate of Coverage Number NCG020334 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit is against federal and state laws and
could result in fines. If something changes and your facility would again require stormwater or
wastewater discharge permit coverage, you should notify this office immediately. We will be happy to
assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for N PDES permit coverage.

Joe Dupree was at the Jerry Bulluck Sand Pit in December with Chris Pullinger. Although they were not there for a
rescission of the NPDES, Joe reports that they closed out the mining permit — and there were not stormwater issues —
rescind the permit.
Durham Coca Cola — no action as of yet that I know of.

NCG020334 Jerry Bulluck Sand Pit in Edgecombe County. The Land Quality Section of DEMLR has determined that the
mine has been satisfactorily reclaimed, and they have been released from further reclamation responsibility as of
9/26/2013. In case you need it, the facility contact is Jerry Bulluck, phone [phone], email [e-mail]
NCG060322 Durham Coca-Cola Bottling Company in Durham County. Production has stopped at the plant, and they are
now a distribution facility only. The facility contact is Michael Wilkinson, phone [phone], email

Certificate of Coverage and stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as
subsequently amended.)

The General Permit authorizes discharges of stormwater only, and it specifies your obligations with

General Permit are outlined in the attached Technical Bulletin.
Your coverage tinder the General Permit is transferable only through the specific action of DWQ.
This permit does not affect the legal requirements to obtain other permits which may be required by
DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

permit expired on 8/3111997. To assure consideration for continuing coverage under your permit, you
must apply to the Division of Water Quality (DWQ) for renewal of your permit. Enclosed you will find a
permit Renewal Application Form, Supplemental Information request, and a Stormwater Pollution
Prevention Plan Certification for your facility. Filing the application form along with the requested
supplemental information will constitute your application for renewal of this permit. .
The application and supplemental information must be completed and returned to DWQ by May
15, 2012. Failure to request renewal within this time period will result in the inactivation of your expired
permit in our system. Discharge of stormwater without coverage under a valid stormwater NPDES permit
constitutes a violation of N.C. General Statute 143-215.1 and may result in the assessment of civil
penalties of' up to $25,000 per day.

Dear Mr. Bulluck:
I received a call from Ms. Judy Ingram of the Cool Springs Sand Company on 31 July 2007. Ms. Ingram
was inquiring as to the specific analytical monitoring requirements for your general stormwater permit
and what we expected to see the next time we came out for an inspection.
After reviewing your file and the permit and speaking with our central office, we feel that the monitoring
requirements for "Wastewater Associated with Sand/Gravel Mining", found in Part III, Section C,
Paragraph 2 of the permit, would best represent your operations and the wastewater discharge resulting
from those operations. Specifically, this monitoring regime requires you to monitor quarterly for pl-I,
settleable solids, turbidity and flow. Based on footnote #5 for table 7, you would not be required to
monitor for total suspended solids because the sand you're mining at your site is not considered industrial
in nature. Please note that a certified lab must perform the required tests and that you must keep all
associated records on file for a period of 5 years.
Also, because of the nature of your facility and the fact that the only time you have a discharge is when it
rains, you would not be required to install a recording flow device as is indicated in footnote #4 for table
7. A flow estimate, based on the total area, including the surface area of the ponds and the surrounding
land that drains to the ponds, and the amount of rainfall during a rain event, will be sufficient. Please note
that you will need to install a rain gauge to measure rainfall.
