Dear Mr. Harris:
On October 4, 2018, the Division of Energy, Mineral and Land Resources released your
mining site (Permit 74-54) from further reclamation requirements. In accordance with
this determination we are also rescinding your NPDES Stormwater Permit Number
NCG020067 for stormwater and wastewater discharge. Stormwater NPDES Permit
Number NCG020067 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of
stormwater to waters of the State without valid coverage under an NPDES permit is
against federal and state laws and could result in fines. If something changes and your
facility would again require stormwater or wastewater discharge permit coverage, you
should notify this office immediately. We will be happy to assist you in assuring the
proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you
would inform the new or prospective owners of their potential need for NPDES permit
coverage.

For coverage under NPDES General Permit NCG020000, the Division of Energy, Mineral and Land
Resources (DEMLR) is forwarding herewith the reissued Certificate of Coverage and
Stormwater/Wastewater General Permit. This permit is reissued pursuant to the requirements of North
Carolina General Statute 143-215.1 and the Memorandurn of Agreement between the state of Nortli
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as Subsequently
amended.) The following information is included with your permit package:
• New Certificate of Coverage
• Stormwater/Wastewater General Permit
• Technical Bulletin for the General Permit
• Discharge Monitoring Report (DMIZ) Forms
• Annual Discharge Monitoring Report Forms
• Qualitative Monitoring Report Forms
The General Permit authorizes discharges of Stormwater and/or, wastewater (as applicable to your site),
and it specifies your obligations with respect to discharge controls, management, monitoring and record
keeping, Please review the new permit to familiarise yourself with all changes in the reissued permit.
Significant changes to the General Permit are outlined in the Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DEML,IZ. This
permit does not affect the legal requirements to obtain other permits which may be required by the N.C.
Department of Environmental Quality, nor does it relieve the permittee from responsibility for
compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order,
judgment or decree.

In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued stormwaler general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the stale of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
A copy of General Stormwater Permit NCG020000
A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater
• Five copies of Qualitative Monitoring Report Form
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Please find attached the Pump and Monitoring Plan for the above mine. 1 have been to the site several
times and the isolated wetlands are adjacent to the mine site. The mine is an existing mine that has a
permit to enlarge the operation. Deborah and myself have discussed this project with Mi. Bizzell and
his proposed plan is what we discussed. The pump and monitoring plan proposes to dewater to
approximately twenty feet and dump the water into a rim ditch that will distribute the groundwater over
the entire area of the wetlands. The mine site is surrounded by surface water on three sides. American
materials proposes to install a well to gage the hydraulics.
After site visits and discussions with other staff, we do not believe that this mining activity will have an
adverse impact on the isolated wetlands if they follow their pump and monitoring plan. This office
recommends that the Pump and Monitoring Plan be approved as is for now.

Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental
Protection Agency dated December 6, 1983.

unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General

Unless such demand is made, this decision shall be final and binding.
