The Division of Water Quality received your request to rescind your coverage under Certificate of
Coverage Number NCG020057. In accordance with your request, Certificate of Coverage Number
NCG020057 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit is against federal and state laws and
could result in fines. If something changes and your facility would again require stormwater or
wastewater discharge permit coverage, you should notify this office immediately. We will be happy to
assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

In response to your renewal application for continued coverage under the Stormwater General Permit the Division of
Water Quality (DWQ) is forwarding herewith the reissued Certificate of Coverage and stormwater General Permit.
'['his permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency,
dated October 15, 2007 (or as subsequently amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of the stormwater General Permit
• A copy of a Technical Bulletin for the General Permit
• hive copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Annual Discharge Monitoring Report Form (if applicable)

The General Permit authorizes discharges of stormwater only, and -it specifies your obligations with respect to
stormwater discharge controls, management, monitoring, and record keeping. Please review the new permit to
familiarize yourself with all the changes in the reissued permit. 'rhe significant changes made are outlined in the
Technical Bulletin, which is attached.
Your coverage under the General Permit is transferable only through the specific action of DWQ.

Unimin Corporation in response to a decrease in orders due to the worldwide economic recession is shutting
down their Crystal Plant in Spruce Pine and is laying off workers at their Red Hill plant.
"We are going to be mothballing the plant due to slow business conditions from the worldwide economic
recession," Unimin Execution Vice President Joe Shapiro said.
"We are closing it temporarily. We expect to reopen it when business conditions improve, and we do expect
business conditions to improve."
According to Shapiro, the plant, which has a total 47 employees (40 hourly and seven salaried) is laying off all of
the hourly employees.
Most of the lay-offs were effective Jan. 23. The remaining workers not laid off in January will be kept until
February so the company can perform an orderly shut down of the plant.
The seven salaried employees at the Crystal Plant are being reassigned to facilities in Mitchell and Avery counties
and will continue to work for the company.
At"th"eir plant in Red Hill, which has 73 employees (10 salaried and 63 hourly), the e company'is laying off"13—j
hourly-employees"effective ]an: 23-through:Jan.-25, depending on which job the employee performs.

Shapiro said that the lay offs are temporary and expects to hire the employees back.
"When the plant reopens, and it will reopen, we expect to be bringing people back," Shapiro said.
Before these moves, the company permanently laid-off_30_ofahe`46-hourly-em`ployees_at_the_Quarti/Feldspar
<plant in_Spruce'Pine-that°caught"fire-Nov: MThe remaining 16 employees were kept and reassigned to different
facilities.
Those that were permanently laid off met in groups with Chris Silvers, director of the Employment Security
Commission's Spruce Pine office, on Thursday Jan. 22 to discuss job options and enroll in Mayland Community
College's Workforce Investment Act program.
Silvers also said that there is not a whole lot going on in the local job market.
"Our advice is start seeking work in the fields that you have skills," Silvers said. "The best thing to do at this
point is to let a network of friends, family, or neighbors know you are seeking work."

As per our telephone discussion today, please find enclosed copies of my original request on
December 13, 2002, subsequent requests on March 16, 2004, July 26, 2004, February 16, 2005 and
finally on October 1, 2007 (copies attached) to grant Representative Outfall Status to Unimin
Corporation — Green Mountain Plant No, 1 (Permit NCG020032) as per Condition No. 6 of
Monitoring & Records contained in the General Stormwater Permit, Unimin would like for you to
please act upon my requests. The Asheville Regional Office inspectors, Laurie Moorhead and Starr
Silvis, stated in their May 22, 2006 inspection report (copy attached) that they will be following up
with Raleigh to determine the status of the application. We have yet to receive any response to date.
In addition, as per the attached inspection report conducted by Laurie Moorhead and Starr
Silvis on May 22, 2006 (Unimin Corporation — Green Mountain Plant #2, Permit NCG020057) and
my letter to Aisha Lau on October 1, 2007, Unimin would like to request rescission of the
NCG020057 permit for Green Mountain Plant #2. However, if the SIC Code requires a general
stormwater pernvt, the site will qualify for a no exposure exemption as per the Asheville Regional
Office personnel inspection report.
Unimin graciously requests that you approve Representative Outfall Status for Green Mtn.
Plant Na 1 and perform a rescission of the general permit for Green Mtn. Plant No. 2. If you have

The facility has been conducting qualitative and analytical sampling events as required by the permit. The
site map clearly shows the drainage areas for each outfall. The location of the outfall corresponding to the
drainage area should be marked on the map. During the inspection it was difficult for inspectors to
ascertain the outfall location for each drainage area due to abundance of pipes and culverts at Mine Fork
Creek near the entrance. One of the pipes was discharging cloudy water though it was not raining during
the inspection. The source of this discharge should be determined and documented and if possible treated
to reduce turbidity. Additionally, the runoff from the process building down the road to the southern entrance
did not appear to be captured by the map or the narrative description of the outfalls. All outfalls must be
monitored unless a respresentative status has been applied for and received.
Mr. Snyder-man's assistance during the inspection was extremely helpful and appreciated. He indicated that
the facility has applied for representative outfall status over one year ago. We are following up with Raleigh
to determine the status of the application.
Inspectors noticed that there was extensive erosion on the road leading from the southern entrance to the
mine dewatering area. The erosion is currently directed into the creek. We suggest redirecting the flow into
the small sediment basin prior to discharge. Additionally, the sediment basin should be cleaned out.
Permit conditions require Best Management Practices (BMP) inspections to be conducted at least once
every seven calendar days and within 24 hours of any storm event that results in a discharge (NCG020000
Part III Section A.3).

Mr. Bennett, I have submitted numerous request over the past six (6) years for representative outfali
status of Unimin Corporation's Green Mtn. Plant 1. My latest letter to Aisha Lau (dated Oct. 1, 2007)
requested not only that she please act upon my previous. requests for representative outfall status (dated
12/1312002, 3/16/2004, 7126/2005) at Green Mtn. Plant'l but to also request that the general permit for
Green Mtn. Plant 2 (NCG020057) be.rescinded per recommendation of the Asheville Regional Inspectors
Laurie Moorhead and Starr Silvis (Water Compliance Inspection Report 512212006). 1 am becoming very
concerned that it has taken almost six years to act upon my initial request for representative status at PA.
1 and would greatly appreciate your Department acting upon this.request as well as rescinding Green

This Certificate of Coverage shall remain in effect for the duration of the General Permit.

I see your November 11, 2008, email to Sarah reporting that the permittee, Jeff
Ferguson I presume, has contacted you to ask about his request for rescission of
stormwater permit NCG020057 at Unimin's Green Mountain Plant #2.
I've reviewed the files today, and I note that GM#2 is -2+ miles remote from GM#1, a
sister facility supplying the mined ore to GM#2. Here's the significant history I see
in the files.
7/30/93 - NCG020057 issued in response to the permittee's application.
12/17/99 - COC reissued in response to the permittee's request.
2/7/05 - COC reissued in response to the permittee's request.
5/22/06 - ARO inspection letter to Unimin, noting that the site might not be required
to have an NPDES stormwater permit at all, or possibly the site might qualify for the
No Exposure.Exclusion from permitting based on observations on site. Inspection
report notes that no crushing or wet processing occurs at GM#2, and that the only
runoff is from the parking lot. [Significantly, perhaps, the CEI records that while
olivine is the material being mined at GM#1, it is being bagged and shipped from GM#2,
the facility under consideration and with our COC NCG020057.)
10/l/07 - Permittee's letter request for either rescission or No Exposure (note that
he did not submit the No Exposure NOT form, just a letter request - I'ts my opinion
that we or you need the NOI form in order to grant any No Exposure request.)
7/14/08 - Jeff's email to Bradley with a second request for permit rescission at
GM#2.
10/7/08 - Jeff's third request for a rescission (and second request for No Exposure,
as an alternative; again, no NOI for the No Exposure request).
11/17/08 - You fielded a call from Jeff, I presume, asking about the rescission, and
emailed us to ask the status.
I picked up this file today, and in a background search I see a newspaper article (Jan
28, 2009) in the Mitchell News -Journal noting layoffs and closings at several of
Unimin's facilities in the area: closing Crystal Plant in Spruce Pine, layoffs at Red
Hill plant, layoffs at the Quartz/Feldspar plant in Spruce Pine. But, no mention of
the Green Mountain #1 plant (a mine with a DLR permit) or the GM#2 plant.
I've gone back to the federal rule, the SIC code book, the DLR mining permit database,
and Starr's description of site activities to see what should happen at this site.
(I've also placed a call to Jeff, but have not heard back from him yet. It's possible
he's not even there anymore, or that he is on furlough, given the circumstances
reported in the MNJ.) Here's what I think should be considered:
1. The DLR does not have this site under a mining permit. Typically, if DLR doesn't
think they are a mine, neither do we. Why they asked for coverage under NCG02 three
times over 12 years is open to conjecture. Maybe we told them to. Maybe they were
contemplating mining on the site. There's no record in our files on this point. But,
we need to get our permitting consistent with the circumstances on the ground now.
2.' As to continued coverage under NCG02. We are compelled to cover under NCG02 any
facility with an SIC code of 14. BIMS shows this facility as SIC1423, mining or
quarrying Crushed and Broken Granite. That's not what they do here, either at GH#i,
or especially at GM#2. So, it looks like our original SIC code is no longer (or
ever?) the SIC of choice. So, as we currently understand the site circumstances,
SIC1423 does not pertain.
3. Further as to continued coverage under NCG02: Since GM#2 receives material from a
remote mining site (GM#1), it appears to me to be excluded from the description of SIC

Major Group 14, by virtue of the nature of olivine (olivine is used as a component of
Green Sand, a mold material used in foundries casting aluminum, ie it's a component of
a refractory material) and by virtue of the following wording in Major Group 14
describing similar -looking activities that are categorized elsewhere, "Establishments
primarily engaged in crushing, pulverizing, or otherwise treating earths, rocks, and
minerals mined in Industry Group 145... not in conjunction with mining or quarrying
operations, are classified in Manufacturing, Industry 3295."
- - Note that (olivine mining) is specifically identified in category SIC1459, meaning
that remote facilities that (process olivine) are not SIC14, but SIC3295.- -- -
Going to SIC3295 for corroboration, I see, "Minerals and Earths, Ground or Otherwise
Treated Establishments operating without a mine or quarry and primarily
engaged in crushing, grinding, pulverizing, or otherwise preparing... refractory
minerals."
4. So, to me the question comes down to, how much "crushing, grinding, pulverizing, or
otherwise treating" is going on at GM#2?
- If GM#2 has any crushing, grinding, or pulverizing (obviously) Ott any segregation,
culling, washing, sizing, - or screening, as evidenced by either a rejects pile, or
differentiation of interim products prior to shipping out, then I thank that meets the
intent of "otherwise preparing" the refractory minerals (the olivine). For example,
is there a hopper with a screen in the bag loading operation? Then I think the
screened material (rejects) establishes that "otherwise preparing" the minerals is
taking place at GM#2. If this represents the activity at GM#2, then SIC3295 applies,
and the facility needs our General Stormwater Permit, NCG07, which covers-SIC32.' In
this scenario, we will be quick to rescind their permit for GM#2, but only after they
apply for NCG07. My suspicion is that GM#2 probably does have some sort of material
preparation activities as part of the bagging and loading operation. Starr's report
that no crushing or wet processing is occurring at the site is encouraging news, but I
think it does not fully establish that no preparation at all is occurring. [[OUTCOME
1 = new permit under NCG07, only upon receipt of NOI.]]
- On the other hand, if there really isn't any of this "otherwise preparing" the
olivine as described above, then I think the facility falls outside of the NPDES
permitting program, and we should rescind their permit, as per their request. I
intend to question Jeff on just this point when/if I get to speak to him. [[OUTCOME 2
rescind NCG020057, only upon Jeff's corroborating report of site activities.]]
- There is a third outcome, based on Starr's recommendation that the facility might
qualify for No Exposure. If the facility is captured by the NPDES Stormwater
permitting program as per the rationale for OUTCOME 1, but there truly is no exposure
of industrial materials or processes on the site, then No Exposure may be granted.
But, Unimin has to apply for it via the NCI form, not just by letter request. This is
important because the form contains legal .language specifically binding the
applicant. That legal language is not present in his informal letter request.
[[OUTCOME 3 = No Exposure Exclusion from permitting, only upon NOI receipt.]]
I need more information, which I am seeking from Jeff, via phone message. I'll follow
up Monday with an email.
Presently, my inclination is to deny the rescission request on this basis:
a) Can't proceed to OUTCOME 1 without an NOI for NCG07.
b) Can't institute OUTCOME 2 without further confirmation that no "otherwise
preparing" is going on, I'm uncomfortable rescinding without. Note also, that the
permittee has only referenced Starr's conclusions. He has not provided a
corroborating rationale that establishes HIS responsibility for the determination.
c) Can't institute OUTCOME 3 without an NOI for NCGNE.
I'll hold this for about a week, to give time for Jeff to respond to my attempts to
contact him. Advise me if you think more time would be better. At that time, I'm
going to deny the request for rescission, unless Jeff or ARO provides 'information to
the contrary.

Unimin Corporation in response to a decrease in orders due to the worldwide economic recession is shutting
down their Crystal Plant in Spruce Pine and is laying off workers at their Red Hill plant.
"We are going to be mothballing the plant due to slow business conditions from the worldwide economic
recession," Unimin Execution Vice President Joe Shapiro said.
"We are closing it temporarily. We expect to reopen it when business conditions improve, and we do expect
business conditions to improve."
According to Shapiro, the plant, which has a total 47 employees (40 hourly and seven salaried) is laying off all of
the hourly employees.
Most of the lay-offs were effective Jan. 23. The remaining workers not laid off in January will be kept until
February so the company can perform an orderly shut down of the plant.
The seven salaried employees at the Crystal Plant are being reassigned to facilities in Mitchell and Avery counties
and will continue to work for the company.
At their plant in Red Hill, which has 73 employees (10 salaried and 63 hourly), the company is laying off 13
hourly employees effective Jan. 23 through Jan. 25, depending on which job the employee performs.
No layoffs are being made at the Schoolhouse Plant in Spruce Pine.
Shapiro said that the lay offs are temporary and expects to hire the employees back.
"When the plant reopens, and it will reopen, we expect to be bringing people back," Shapiro said.
Before these moves, the company permanently laid off 30 of the 46 hourly employees at the Quartz/Feldspar
plant in Spruce Pine that caught fire Nov. 29. The remaining 16 employees were kept and reassigned to different
facilities.
Those that were permanently laid off met in groups with Chris Silvers, director of the Employment Security
Commission's Spruce Pine office, on Thursday Jan. 22 to discuss job options and enroll in Mayland Community
College's Workforce Investment Act program.
Silvers also said that there is not a whole lot going on in the local job market.
"Our advice is start seeking work in the fields that you have skills," Silvers said. "The best thing to do at this
point is to let a network of friends, family, or neighbors know you are seeking work."

Water Quality (DWQ) is forwarding herewith the reissued Stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
Please note that in 1998 Senate Bill 1366 established changes to the permit fee structure for DWQ permits effective
January 1, 1999, This change requires that you pay an annual fee to assure continued coverage under this permit.
You will be invoiced for this fee beginning next year. A copy of the current fee schedule is included with this letter.
