Box 1388 Lumberton, NC 28359 Dear Mr. Hites: D EHNR November 20, 1996 Robeson County DWQ Project # 961058 You have our approval to place fill material in 0.35 acres of wetlands or waters for the purpose of constructing a sanitary sewer extension to serve southeastern Farmer s Market at Lumberton, NC, as you described in your application dated 6 November 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3022. This certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Purpose of proposed work: Serve proposed Farmers Market and Horse Arena with sanitary sewer. 14. State reasons why the applicant believes that this activity must be carried out in wetlands. Also, note measures taken to minimize wetland impacts. Sewer must be installed along the Little Jacob Swamp Canal since other routes would re uire excessivo cuts. Box 33726 Raleigh, North Carolina 27636-3726 RE: 24" SANITARY SEWER EXTENSION TO SERVE SOUTHEASTERN FARMERS MARKET LUMBERTON, NORTH CAROLINA Gentlemen: An application for a Section 404/401 Certification from the North Carolina Divi- sion of Water Quality and the U.S. Army Corps of Engineers has been filed for the above-referenced project. As part of that application, we are required to contact you regarding the presence of any federally listed endangered or threatened species or critical habitat in the area that may be affected by the proposed project. According to our research, only two known endangered species could potentially occur in this area, the red-cockaded woodpecker and the American alligator. The proposed project area consists mainly of a bottomland hardwood type of cover with predominant tree species being red maple, sweet gum, black gum and water oak. This effectively eliminates the woodpecker as it requires large, contiguous, mature pine forests to live and reproduce. The project area is also well drained by the Little Jacob Swamp Canal which prohibits the alligator from having enough aquatic habitat. In addition, the proposed sewer mains will be installed in an existing easement that has been cleared and maintained for quite some time. Therefore, the temporary impact due to construction on the terrestrial habitat in the area may be considered minimal. Please review the attached maps of the project area and provide your assessment of any potential impacts this job may have on federally protected species. As part of that application, we are required to contact you regarding.the presence of any historic properties in the permit area which may be affected by the proposed project. The area in question is a wooded region bounded by agricultural property just south of the City of Lumberton. The sewer mains will be installed in an existing drainage easement parallel to the Little Jacob Swamp Canal that was cleared years ago. There are no existing structures on or adjacent to the proposed project area. Also, because of the location and topographic nature of this particular region, it is unlikely that any archaeological sites of any significance will be affected by this construction. Please review the area shown on the attached maps and provide your assessment of any potential impacts this job may have.
