Dear Mr. Ferguson:
A Compliance Evaluation Inspection performed at the Daybook Mine (Green Mountain Plant #1) on March 4, 2016,
by personnel from this office verified that no industrial activity was taking place at the tit q"pf the inspection. Your
recent request to keep the NCG020032 permit, but to discontinue stormwater monitoring is hereby approved based on
the following conditions:
There shall be no industrial activities taking place, no stockpiles of raw materials (to include chemical
additives) stored on the site, or wastewater or stormwater industrial discharges while the permittee is not
monitoring.
No wastewater shall be generated and all wastewater treatment units, if any, shall be cleaned and stabilized,
and inactivated as to render them harmless to the environment while the site is dormant.
The Stormwater Pollution Prevention Plan (SPPP) shall be kept updated to reflect the status of the facility.
Updates and conditions of the SPPP of note are:
o The BMP Summary shall be reviewed and updated annually.
o Training programs shall be developed and training provided at least once a year for facility
personnel with responsibilities for:,spill response and cleanup, preventative maintenance
activities, and for any of the facility's operations that have the potential to contaminate
stormwater runoff,
o All aspects of the Stormwater Pollution Prevention Plan shall be'reviewed and updated on an
annual basis. The annual update shall include an updated list of significant spills or leaks of
pollutants for the previous three years, or the notation that no spills have occurred. The
annual update shall include written recertification that the stormwater outfalIs have been
evaluated for the presence of nonstormwater discharges. (ShouIdT on-stormwater discharges
be discovered the permittee shall contact this office as soon a plc�sible but in no case greater
than 24 hours or the next business day).
a Inspections of the facility and all stormwater systems shall occur as part of the Preventative
Maintenance and Good Housekeeping Program at a minimum on a semi-annual schedule.

• Qualitative and analytical monitoring actions as described in Part IDI, Sections A, B, C, D, and E do not
have to be condugtpd — as long as the above conditions and all other permit conditions and limitations are met,
including:
o :. The annual permit fee must be paid, failure to pay the annual permit fee will be
considered a violation of the subiect permit. I
• This office must be notified in writing and all components of the stormwater permit requiring updates made at
least 30 days prior to commencing any industrial activity on the site, even if they are temporary.

Inspection Summary:
I inspected the site with Jeff Ferguson and Daniel Garland, both with Unimin.
The Daybook Mine (Green Mountain Plant #1) is not active and had no activity occurring. The site is being monitored and
maintained. The mine has an inactive permit with DLR and is in compliance. Site visit was to discuss requesting dormant
status to discontinue stormwater monitoring.
We discussed that the annual stonnwater permit fees will still need to be paid, and if at any time the mine wants to start
back up a request would need to be submitted to return to active status..
I suggested to Jeff that he submit his request in writing. We received the request on March 21, 2016. 1 recommend granting
dormant status for the site.

`Phis letter is in follow-up to the NPDES Stormwater Permit Compliance inspection conducted on
December 16, 2008. The facility was found to be out of compliance with permit NCG020032.
The primary Issue was the sediment (product) being discharged to Mine Creek.

7he inspector_reviewe¢the SPPP, nd toured the site with Jeff Ferguson. Qveiaq, the site is following good housekeeping
and main tenance.practices and `meeting permit monitoring requirements. The inspector and Mr. Ferguson identified a
sediment discharge of product to Mine Fork Creek impacting the receiving stream. This is a permit compliance issue. Mr.
Ferguson indicated there are plans to modifylexpand the facility and the company would strive to change the existing
conditions to prevent such losses permanently. Until then housekeeping practices will be increased.
Prior to this inspection, the permittee had requested Representative Otitfall Status (ROS) for this facility. Until the site
gains full compliance with the permit, the inspector determined approving ROS to be impractical.

The facility has been conducting qualitative and analytical sampling events as required by the permit. The
site map clearly shows the drainage areas for each outfall. The location of the outfall corresponding to the
drainage area should be marked on the map. During the inspection it was difficult for inspectors to
ascertain the outfall location for each drainage area due to abundance of pipes and culverts at Mine Fork
Creek near the entrance. One of the pipes was discharging cloudy water though it was not raining during
the inspection. The source of this discharge should be determined and documented and if possible treated
to reduce turbidity. Additionally, the runoff from the process building down the road to the southern entrance
did not appear to be captured by the map or the narrative description of the outfalls. All outfalls must be
monitored unless a respresentative status has been applied for and received.
Mr. Snyderman's assistance during the inspection was extremely helpful and appreciated. He indicated that
the facility has applied for representative outfall status over one year ago. We are following up with Raleigh
to determine the status of the application.
Inspectors noticed that there was extensive erosion on the road leading from the southern entrance to the
mine dewatering area. The erosion is currently directed into the creek. We suggest redirecting the flow into
the small sediment basin prior to discharge. Additionally, the sediment basin should be cleaned out.
Permit conditions require Best Management Practices (BMP) inspections to be conducted at least once
every seven calendar days and within 24 hours of any storm event that results in a discharge (NCG020000
Part III Section A.3).

No mining occurs at this site. Olivine is transported to this site from Unimin's Green'Mountain Plant #1 in
Yancey County and is bagged and shipped from the Mitchell County site (Green Mountain Plant #2). No
crushing or wet processing occurs at this Mitchell County site. The only stormwater runoff leaving Green
Mountain Plant #2- is parking lot runoff.
Unimin should consider requesting :rescission of the NCG020057 permit for Green Mountain Plant #2,
assuming that the Standard Industrial Classification (SIC Code) for this particular site does not automatically
require stormwater permit coverage. Should the SIC Code automatically require a general stormwater
permit, the Green Mountain Plant #2 site does qualify for a no exposure exemption.

In accordance with your request received June 23, 2000, the Division is forwarding the subject permit modification.
This modification documents the change in ownership at the subject facility. All other terms and conditions in the original
permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental
Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit modification are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General

pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U-S. Environmental Protection Agency, dated December 6, 1983,

* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin on this permit which outlines permit components and
addresses frequently asked questions

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
Please note that in 1999 Senate Bill 1366 established changes to the permit fee structure for DWQ permits effective
January 1, 1999. This change requires that you pay an annual fee to assure continued coverage under this permit.
You will be invoiced for this fee beginning next year. A copy of the current fee schedule is included with this letter.
