Preston Howard, Jr., P.E., Director November 13, 1996 Surry County DWQ Project # 961020 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. Jamie Shem Soil and Environmental Consultants 244 West Millbrook Road Raleigh, NC 27609 Dear Mr. Shern: You have our approval to place fill material in 0.14 acres of wetlands or waters for the purpose of developing land at Pike Electrical property, as you described in your application dated 23 October 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. A stormwater management plan including a wet detention basin if total fill for this development exceeds one-third acre (including this fill). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Thomas and Dorney: US Army Corps of Engineers Attn.: Mr. John Thomas 6508 Falls of the Neuse Road Suite 120 Raleigh, NC 27615 It will be necessary to impact about 0.14 acres (see map) of jurisdictional wetlands and "waters of the US" to develop the Pike Electrical property according to the current site plan. All jurisdictional areas on the property are above headwaters. The approximately 125 acre site is adjacent to the east side o" the Surry County Airport. The amount of impact is based on a grading permit obtained for about half of the property. Grading is scheduled to begin immediately. No disturbance of the rest of the property is currently planned. Should additional impacts be planned in the future, on the balance of the property, the appropriate permits will be applied for as impacts approach the threshold for permitting. The jurisdictional area is comprised of a vegetated seep and intermittent and perennial stream channels. The small amount of impact makes it presumably not necessary to notify NC Dept. of Cultural Resources, National Marine Fisheries, or US Fish and Wildlife Service. However, it is customary for S&EC to notify the Corps and DWQ of our intent to utilize a Nationwide Permit 26 as a professional courtesy.
