PROJECT SUMMARY: The applicant proposes to reconfigure the permitted 50 -slip marina and riverfront park area with boat ramp and associated amenities for The Bluffs on the Cape Fear through a major modification to State Permit No. 62-09. The Bluffs on the Cape Fear Page 2 9. PROJECT DESCRIPTION The applicant's property is located off Strawberry Hill Drive NE in Leland, Brunswick County along the Cape Fear River. To locate the project site from the Wilmington Regional Office (WiRO), travel northwest from Wilmington to Navassa using US -74 W (Martin Luther King Jr Pkwy) for about 15 miles crossing the Isabel Holmes Bridge over the Northeast Cape Fear River. Once you go over the bridge and cross the river, get in the right lane to take a right onto US -421 N. Travel about 3 miles until you reach the 1-140 bypass. Go under the bridge and turn left to merge onto 1-140 W. After about 5 miles take the Exit -8 toward Mt Misery Road NE and turn left onto this road to head north to Leland. Go almost two miles until you reach Dogwood Road NE and take a right to head towards the new sub -development. Travel a little more than three quarters a mile and Strawberry Hill Drive NE will be located on your right. Turn right onto Strawberry Hill Drive NE and go a mile to reach the private residential community known as The Bluffs on the Cape Fear. Once you enter the new subdivision, travel until you reach the traffic circle and take your 2N1 exit onto Fallen Pear Lane NE. Continuing down Fallen Pear Lane NE will take you first to the entrance of the proposed 50 -slip marina and will eventually terminate at the proposed riverfront park and boat ramp. The project site is bordered by industrial -general zoned DuPont commercial property to the east and rural residential zoned properties to the south and west. The Cape Fear River borders the sub -development to the north. The entire subdivision consists of approximately 587 acres, which is located within the planning jurisdiction of Brunswick County. The project site's elevation ranges from 0' to 40' above normal high water (NHW) and there is approximately +/- 5,400' of shoreline along the Cape Fear River. Approximately 1,279' of shoreline are located within the common areas of the sub -development as reported by the applicant. There are no Coastal Wetlands present on site within The Bluffs on the Cape Fear, however there are §404 wetlands and a creek named Bay Branch that runs through the property. A §404 wetland survey was conducted but not submitted with this application. A Notice of Jurisdictional Determination was issued by the U.S. Army Corps of Engineers (USACE) on March 3, 2008 (COE Action ID No. SAW - 2006 -32722). The majority of the waterfront lots are platted to the mean high water (MHW) line according to the plans submitted with this application dated August 15, 2019, with the exception of Lots 239 through 244, and Lots 466 through 468 for the common area of the 50 -slip marina. Under this request, they have also removed the riparian shoreline dedication for Lot 468 by moving the lot lines landward of MHW. These lots have already been platted by Brunswick County. Additionally, Lots 500 through 504 located adjacent to the common area of the riverfront park area and boat ramp are also planned to stop landward of the MHW line and appear not to have riparian shoreline dedications to the Cape Fear River. These lots have not been platted by Brunswick County. The N.C. Division of Energy, Mineral, & Land Resources (DEMLR) approved a state Erosion & Sedimentation Control Plan (Project ID: Bruns -2006-221) for the sub -development on November 30, 2007. The N.C. Division of Water Resources (DWR) issued a state Stormwater Permit (#SW8 070677) for the subdivision on January 3, 2008. The USACE authorized the proposed project under COE Action ID No. SAW -2006-32722 on May 19, 2009. River Bluff Holdings II, LLC. received CAMA Permit No. 62-09 on June 5, 2009 for the development of the 714 -lot subdivision with associated water dependent community common areas including the 50 -slip marina and riverfront park with boat ramp. State Permit No. 62-09 was modified on June 9, 2010 to shift the 50 -slip marina approximately 20' to the west and for the construction of one debris deflector located upstream to protect the marina. This CAMA permit was renewed on August 19, 2015, again on July 13, 2017, and finally once again on January 24, 2019. The USACE modified their DA permit under COE Action ID No. SAW - 2006 -32722 on July 9, 2019 to include the proposed modifications under this application. The DEMLR issued a State Stormwater Management Permit No. SW8 190802 on September 4, 2019 for the construction, operation, and maintenance of the BMP's and built -upon area associated with Phase 5 of the subject project. Construction of the approved subdivision is underway and some roads, bridges and residential homes have been constructed with associated utility lines installed. None of the water dependent structures authorized by CAMA Permit No. 62-09 have been constructed with the exception of the marina access pier. A fixed pier measuring approximately 563' in length by 10' in width has been The Bluffs on the Cape Fear Page 3 constructed within the §404 wetlands to the west of Lot 240 from the parking area down to the 30' Coastal Shoreline Buffer leading to the proposed marina (see Sheets 1 and 2 of 9). At the end of the fixed access pier leading to the proposed marina, a 20' by 30' T -Head fixed open platform has been built as well. These existing fixed structures located at the proposed marina are at least 3' from the bottom of the decking to the substrate since they are located within §404 wetlands (see Sheet 6 of 9). The applicant states that the waterbody varies in width along this stretch of the Cape Fear River, measuring approximately 275' wide at the proposed marina and 230' wide at the proposed riverfront park area and boat ramp with water depths approximately -15' deep at MLW located at the waterward end of the proposed structures. The Brunswick County Land Use Plan classifies the area in the vicinity of the project area as Low Density Residential (R-7500). The waters in the project area are classified as C/SW by the N.C. Division of Water Resources (DWR). The waters are designated as a Primary Nursery Area (PNA) and they are closed to the harvest of shellfish by the N.C. Division of Marine Fisheries (DMF). 10. PROPOSED PROJECT The applicant proposes to reconfigure the permitted 50 -slip marina and riverfront park area with boat ramp and associated amenities for The Bluffs on the Cape Fear through a major modification to State Permit No. 62-09. These water dependent structures were approved along with the development of the subdivision, but have not been constructed at this time with the exception of the fixed access pier and T - Head fixed open platform leading to the proposed marina as previously described. Construction of the approved subdivision is underway and some roads, bridges and residential homes have been constructed with associated utility lines installed. According to the applicant, Brunswick County approved a maximum of 730 residential units for the subdivision. There are currently 715 lots proposed for the subdivision, and the individual lot numbers, residential units, or total number of lots may change as new phases of the sub -development are planned and platted. The applicant at this time does not propose any modifications to the subdivision nor to the permitted boat ramp with the exception of increasing the width of the boat ramp by 2' located outside of the 75' Estuarine Shoreline Area of Environmental Concern (AEC) (see Sheet 5 of 9). The applicant proposes to reconfigure the 50 -slip marina layout so that the slips are angled more into the prevailing river flow and change the elevated lift slips to floating lifts. The permitted marina layout can be compared to the modified reconfigured marina layout on Sheet 2 of 9. This change would increase the overall length of the marina and would necessitate minor relocation of the debris deflectors. The marina's floating dock system would be redesigned from one floating dock oriented parallel to the shoreline to four floating docks measuring 80', 232', 448', and 73' long all by 8' wide. A total of 26 floating finger piers would extend out perpendicularly at angles from the floating dock spine each measuring 3' wide and varying in length from 26' to 41' in order to meet the''%width of the waterbody. Each individual finger pier's length can be found on Sheet 3 of 9 where only the proposed reconfigured plans are illustrated. There are no proposed changes to the number of slips for the marina. The 50 permitted boatlift slips have been changed to 50 floating lifts each measuring 24'x 11'. The applicant proposes to install two debris deflectors 36' in length at each end of the marina to protect it from floating debris (see Sheet 9 of 9). The western debris deflector would be located within the 15' riparian setback, and the adjacent riparian property owner Kevin Morse has waived the riparian setback. The eastern debris deflector would not be located within the 15' riparian setback. The previously authorized pumpout station would remain on the westernmost finger pier adjacent to the temporary tie-up slip (T-1) and no changes have been proposed to this facility. The applicant proposes to also modify the ramp landing floating platform to 12'x 8' that would connect the fixed access pier to the proposed floating docks for the marina. A 44'x 4.5' ramp would attach from the proposed 24'x 6.5' fixed access pier that would extend waterward from the existing 20' x 30' T -Head fixed open platform. The applicant states the width of the waterbody at this location is approximately 275' wide and all proposed water dependent structures would conform The Bluffs on the Cape Fear Page 4 to the '% width of the waterbody. All proposed water dependent structures associated with the marina would be located waterward of 2' at Mean Low Water (MLW) according to the applicant (see Sheets 6 and 7 of 9). The applicant also proposes to modify the riverfront park area with boat ramp and associated amenities. The permitted riverfront park area and associated amenities layout can be compared to the modified riverfront park area and associated amenities layout on Sheet 4of 9. Instead of only having one access walkway leading to the proposed fixed open platform with a covered gazebo at each end known as the "fishing pier", the applicant proposes to construct two access walkways each at 6' wide located to the west of the previously authorized boat ramp and would originate landward of the 75' Estuarine Shoreline AEC. One of these access walkways would lead to the proposed 30' x 30' covered pavilion with 30' x 10' open deck, and the other would lead directly to the fishing pier (see Sheet 5 of 9). The proposed access walkways would convert to fixed access piers once located within the 75' Estuarine Shoreline AEC. From the proposed covered pavilion with an open deck, the applicant proposes to connect this structure to the fishing pier with a proposed 70' x 6' fixed access pier. A second proposed 80'x 6' fixed access pier would lead from the proposed access walkway by the authorized boat ramp directly to the fishing pier. These two proposed fixed access piers would extend the proposed fishing pier further waterward into the Cape Fear River from its previously authorized location by approximately 40 feet. According to the applicant, this modification request to extend the proposed fishing pier waterward is needed based on a more detailed tree survey. The proposed fishing pier has also been modified to a 34.5' x 14' fixed open platform with a covered gazebo at each end measuring approximately 14' x 14' to the drip lines. The applicant states there are no changes proposed to the permitted boat ramp and retaining walls location, dimensions, or construction methodology with the exception of the boat ramp widening by 2' outside of the 75' Estuarine Shoreline AEC. According to the applicant, the boat ramp's width needs to be increased by two feet above the AEC due to the length of the ramp and safety concerns. Instead of having three access walkways to the east of the permitted boat ramp leading to the proposed floating dock with kayak launch and to the proposed covered pavilion, the applicant proposes to construct only two access walkways each at 6' wide outside of the AEC. One of these access walkways would lead to the proposed 30'x 60' covered pavilion, and the other would lead straight to the proposed floating dock with kayak launch. Once the proposed access walkway adjacent to the permitted boat ramp meets the AEC, it would convert to a proposed 74' x 6' fixed access pier. A proposed 32' x 4.5' ramp would connect the fixed access pier to the proposed floating dock with kayak launch utilizing the 12' x 8' proposed ramp landing floating platform oriented perpendicularly to the shoreline. Connected to the ramp landing floating platform, the applicant also proposes to modify the parallel to shore floating dock to 60' x 8' providing two temporary tie-up slips (T-2 & T-3). Located on the landward side of the floating dock, the applicant plans to add a 12.5' x 5' kayak launch. The applicant states the width of the waterbody at this location is approximately 230' wide and all proposed water dependent structures would be located behind the %4 width of the waterbody and would not encroach intoeither 15' riparian setback. All proposed water dependent structures associated with the riverfront park area and boat ramp with associated amenities would be located waterward of 2' at Mean Low Water (MLW) according to the applicant (see Sheet 8 of 9). 11. ANTICIPATED IMPACTS According to the plans with this application and the ones submitted January 6, 2009 with the original application, Lots 240 through 244, 466 and 467 located at the proposed marina were not plotted to the MHW line and therefor do not have riparian shoreline dedications. However, according to the plat map referred to on the Brunswick County GIS website Lots 466 and 467 have been platted to the MHW line and therefor would have riparian rights to the Cape Fear River, which could potentially create a controversy in the future if the lots were to sale to private individuals and then apply for their own private docking facility. Additionally, the plans submitted with this application have also removed the riparian shoreline dedication for Lot 468 in order to expand the proposed 50 -slip marina and add a downstream The Bluffs on the Cape Fear Page 5 debris deflector. It appears all three of these lots have been platted to MHW and have riparian rights according to the plat map on Brunswick County GIS website, although the plans with this application do not show this to be the case. Another discrepancy with these plans submitted with this application and the lots that have already been platted by Brunswick County, Lot 240 located at the proposed marina is actually Lot 239, and has already been sold to a private individual. The applicant also plans to remove the riparian shoreline dedications for Lots 500 through 504 located at the proposed riverfront park area and boat ramp with associated amenities. These lots have not been platted by Brunswick County and are subject to change as new phases of the subdivision are planned. The proposed marina would incorporate approximately 22,567 ft2 of Estuarine Waters and Public Trust Area AECs. The shoreline length at this location is approximately 962 linear feet, which meets the 27 square feet per linear foot of shoreline allowable incorporated public trust area for residential private marina development. The fixed access piers and open platform associated with the marina would shade approximately 1,085 ft2 of §404 wetlands within the 75' Estuarine Shoreline AEC. There would be no §404 wetland shading impacts at the riverfront park area with boat ramp and associated amenities. The proposed riverfront park area would incorporate approximately 1,332 ft' of Estuarine Waters and Public Trust Area AECs. The shoreline length at this location is approximately 317 linear feet, which also meets the 8 square feet per linear foot of shoreline allowable incorporated public trust area for major docking facility development. The proposed development at this site would also shade approximately 1,644 fill of high ground within the 75' Estuarine Shoreline AEC. The proposed docking facilities would not encroach into the adjacent 15' riparian setbacks, however the western debris deflector located at the marina would encroach into the Morse's 15' riparian corridor setback who have waived their 15' riparian setback. All water dependent structures would be located in water depths greater than 2' at MLW and would not exceed the '% width of the waterbody according to the applicant. Water depths were surveyed by Arnold Carson and sealed on 10/10/06 and a copy of the hydrographic survey is available in the WiRO office file for review. A new hydrographic survey was not submitted with this application. There appears to be no Submerged Aquatic Vegetation (SAV) nor shellfish beds in the project area. This area is a PNA and is closed to the harvest of shellfish by the DMF. Minor increases in turbidity in the Cape Fear River should be expected during times of construction for these proposed water dependent structures. The proposed marina would provide 50 permanent slips as well as one temporary tie-up slip (T-1) located at the western end of the facility next to the pumpout station. The proposed floating dock located next to the permitted boat ramp would provide access to two temporary tie-up slips (T-2 & T-3) for vessels utilizing the boat ramp. The riparian corridor for the proposed marina includes Lots 466 through 468, whose property lines appear to extend to MHW as shown on Brunswick County GIS website. These three lots appear to still be owned by River Bluff Holdings 11, LLC., but it is the staff's opinion that the execution and recording of deed restrictions prior to construction of the marina should be required as a permit condition for the entire shoreline used for the water dependent facilities. As proposed, the project appears to be CONSISTENT with the Specific Use Standards for Estuarine Waters and Public Trust Areas AECs, as set forth in 15A NCAC 07H.0208 (b) (5) for the proposed marina and as set forth in 15A NCAC 07H .0208 (b) (6) for the proposed docking facility located at the riverfront park site. This office has no objection to the proposed work, provided that it is consistent with all other local, state, and federal permitting requirements. 4. DCM MP -1 Section 6.0 Additional Information 4.1 Section 6. a. Project Narrative The project is located on the Cape Fear River off Strawberry Hill Dr NE in Brunswick County. Development of the approved subdivision is underway with roads, utilities and homes being constructed. None of the water dependent structures authorized by CAMA permit #62-09 have been constructed with the exception of a portion of the marina access walkway from the parking area down to the 30' buffer. CAMA permit #62-09 authorized a 53 -slip marina with lifts and a boat ramp with associated walkways, access pier and temporary tie-up floating dock. An additional observation and fishing fixed platform located beyond MHW with covered gazebos and pavilion were also authorized at the boat ramp site. Brunswick County approved a maximum of 730 residential units. The current modification requests to reconfigure the marina slip layout so thatthe slips are angled more into the prevailing river flow and change the elevated lift slips to 24'x 11' floating lifts. This change increases the overall length of the marina and necessitates minor relocation of the debris deflectors. The pumpout station will remain on the westernmost finger pier adjacent to a temporary tie-up slip (T-1). The marina fixed access pier (partially constructed) alignment has been modified to avoid topography changes and the width has been increased to 10' to allow safe two-way access to the 53 - slip marina. The 10' -width also allows the pier to be constructed from completed portions of the pier without the need to clear a wider corridor or operate machinery within the 404 wetlands. Deck boards are 3'-4' above existing grade. A 20' x 30' open platform has been added to the end of the 10' -wide access pier. A 24'x 6.5' pier connects this platform and a 44' x 5.5' ramp that leads to the floating docking system. The floating docking system consists of 4 floating docks at 80', 232', 448' and 73' lengths, all 8' wide and associated fingers piers to support the 1 temporary and 50 -floating lift slips. Two debris deflectors, both 36 long, are located at either end of the marina to protect it from floating debris. There is no change in the permitted number of slips. See Appendix A for details. At the boat ramp site, due to the length of the ramp and safety concerns, the ramp width above the 75' AEC has been increased two (2) feet. There are no changes to the authorized ramp location, dimensions or construction methodology beyond the noted widening above the 75' AEC. The location of the permitted 20'x 40' pavilion has been slightly adjusted and the size has been increased to 30' x 60'. An additional 30' x 30' pavilion and 30' x 10' open deck and associated walkways has been added to the western side of the boat ramp lot. Based on a more detailed tree survey, the permitted 30' x 16' platform with 15'x 15' covered gazebos at each end has been moved waterward and reduced to 34.5' x 14' with 14' x 14' covered gazebos. Two fixed access piers lead to the platform, one 70' long and one 80' long (both 6' wide). The permitted 54' x 6' temporary tie-up floating dock (slips T1 and T2) has been modified to 60' x 8' and a 12.5' x 5' kayak launch has been added. See Appendix A for details. At the marina, shading impacts over 404 are 5,310 s.f. outside of the AEC and 1,085 s.f. within the AEC. There are no 404 shading impacts at the boat ramp site. Shading over open water is 22, 567 s.f. at the marina, including the 24' x 11' floating lifts. At the boat ramp there is 1,332 s.f. over open water.
