(CEC), on behalf of Daniel Communities. The permit application requested authorization for the impacts associated with the High Hampton Redevelopment Plan. The comments provided by the DWR in response to this plan are listed and discussed below. NC Division of Water Resources comments: 1. The review of the project cannot be completed until the Public Comment period has closed and the Division can review any comments received. If the U.S. Army Corps of Engineers requests a response to any comments received as a result of the Public Notice, please provide the Division with a copy of your response to the USA CE. [15A NCAC 02H. 05 02 (c)] The public comment period closed August 19, 2019. All responses to comments received from the U.S. Army Corps of Engineers will be also be provided to the Division of Water Resources. 2. The culvert that was installed at After -the -Fact stream impact #14 is perched at the outlet and therefore it does not meet the requirement to provide for low flow passage of aquatic life. Please provide a remediation plan for this culvert location which will support aquatic passage. [ISA NCAC 02H .0506(b)(2)] Please find the attached Figures — UT2 Enhancement Plan & Profile and Details (Attachment A) which proposes the installation of boulders steps to create step pools to correct the perched culvert shown in the attached photographs located at stream 32 Clayton Street Asheville, NC 28801 828-698-9800 Tel DWR # 20180765 Ver 3 September 17, 2019 Page 2 of 4 impact #14.
