Dear Sirs:

You have our approval to place fill material in 1.968 acres of wetlands or waters for the purpose of
preparing a road crossing and lot fill at River Walk subdivision, as you described in your application dated 7
October 1996. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2671. This certification allows you to use Nationwide Pennit Number 26
when it is issued by the Corps of Engineers,
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below. A conservation easement or deed restrictions shall be placed on the
remaining wetlands to prevent future fill. Stonnwater management shall be carried out as described in you..23
October 1996 letter. In addition, you should get any other federal, state or local penn its before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Coastal Stonnwater, Non-
Discharge and Water Supply Watershed regulations.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which confonns to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P,O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are fmal and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

Dear Mr. Dorney,

This letter is in response to our telephone conversation this week during which we
discussed project modifications to Wesley Common Group's proposal, Project # 960696
and # 960631 in Pitt County. You had informed me that if we could provide for two
conditions, the Division of Water Quality would issue the Section 401 Water Quality
Certification for this proposed project.

I have contacted the project designer for the subdivision (Baldwin & Associates) and
have determined that it is possible to place bags of concrete in Outlets 10 and 11, 12 and
13 as depicted on the plat prepared by Baldwin & Associates entitled River Walk, dated
11/1 0/95, The intention of placing these barriers to stormwater flow adjacent to the Tar
River is to provide additional retention for storm water purification. You also requested
that the upland development provide multiple outlets for the storm water management
plan. Mr. Baldwin informed that the plan would allow for five outlets of the upland
storm water system to disperse the storm water flow in the wetland area.

We trust that these modifications as requested will allow the NC Division of Water
Quality to issue the Section 401 Water Quality Certification for this project. Thank you

Dear Me Dorney,

This letter is in response to your September 13, 1996 correspondence regarding Project #
960696 in Pitt County for the Wesley Commons Group. We had forwarded under a
previous cover the wetland boundary survey for the site, but have included another copy
for your convenience and consideration in this matter.

In our preliminary discussions with the Wesley Commons Group we had investigated the
possibility of consolidating the upland areas by filling the 1.968 and 4.448 acre wetland
pockets which lie on the southern or upper terrace of the property and to mitigate by
creating wetlands along the Tar River flood plain adjacent to the 7.535 acres. During the
collection of data which included vegetation analysis and water table monitoring we
conferred with the US Army Corps of Engineers to determine that the wetland area
which lies within the tloodway represents the most vital and crucial wetland on the
property. This wetland area not only demonstrates a high value for wildlife habitat but
also provides the greatest contribution to water quality and a buffer from adjacent
high!:,Tfound development. Upon further review, we determined that the 4.448 acre
wetland area exhibited moderately high water quality attributes and concluded that the
project should be redesigned to minimize impacts in those wetland areas. It was
determined that the 1.96 acre wetland area on the south side of the property was above
headwaters and therefor subject to opportunities for fill under Nationwide Permit #26. It
was determined by the US Army Corps of Engineers that this area could be filled under
Nationwide Pennit #26 because it would cause minimal impact as defined in 33CFR
Part 330.1(8) and for which a Nationwide Permit #26 has been issued by the US Army
Corps of Engineers to authorize this work.

The redesign of the project has resulted in an additional need to cross the 4.448 acre
wetland slough to obtain access to the 12.79 acre upland area which has been applied for
under Nationwide Permit #14. The combination of these permits has resulted in a

density which is necessary for this project to be viable yet has avoided the significant
wetland areas on the property, We feel that the redesign of the project reflects the
practical alternative to the original plan which would have impacted the higher quality
wetland areas on the site. We have limited the till into areas of wetlands that do not have
significant usage and have minimized the impact to the central wetland slough by means
of a till road as presented under our request for Nationwide Permit # 14, We have
attached a site plan which shows the entire development as you have requested and are
currently in the process of designing the storm water management measures as required
by the city of Greenville,

We hope that this additional information is sufficient to satisfy your inquiry with regard
to this project and would allow the Division of Water Quality to issue the permit for
Project #960696, Wesley Commons Group.

Division of Coastal Management place your project on administrative hold.

Please provide us with information supporting your position that your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters
and/or wetlands. Specifically can you construct your residential development without wetland
fill or by only filling wetlands without significant uses? Also a site plan for the entire
development must be provided before we can complete the review of the project. Also please

converted farmland? Any documentation such as maps and narrative that you can supply to

On 2 July 1996 you wrote the Division of Water Quality (DWQ) regarding your plan
to fill 1. 968 acres of wetlands for the purpose of constructing an apartment complex in
Greenville in Pitt County. Your letter sought approval from DWQ to fill in these wetlands.
We will need a sketch site plan to help determine whether there are practicable alternatives
to this f1ll. Please send seven copies of this plan to DWQ so we can continue to process
