In response to your renewal application for continued coverage under stormwater General Permit NCG220000, the
Division of Water Quality (DWQ) is forwarding herewith a new Certificate of Coverage (COC) under the recently modified
stormwater General Permit NCG210000 for Timber Products. Stormwater discharges from Wood Chip Mills are now
eligible for coverage under General Permit NCG210000. The modified general permit was reissued on March 25, 2011
(effective April 1, 2011).
Rather than renew your coverage under General Permit NCG220000, which expired in 2008, the Division has transitioned
your facility under General Permit NCG210000 and issued you a new permit (with a different COC number). The Division
does not intend to renew General Permit NCG220000. This action was noticed publically from February 15 through March
18, 2011; the proposed modification to general permit NCG210000 was available on our website on February 8, 2011.
This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007
(or as subsequently amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG210000
• A copy of a revised Technical Bulletin for this General Permit
• Two copies of the Stormwater Discharge Monitoring Report (SDMR) Form
• Two copies of the Qualitative Monitoring Report (QMR) Form
The General Permit authorizes discharges of stormwater associated with industrial activities at your facility, and it specifies
your obligations with respect to discharge controls, management, monitoring, and record keeping. Please review the new
permit to familiarize yourself with all the requirements.

Some significant differences in this General Permit from the old NCG220000 that your facility was covered under are:
➢ Stormwater Discharge Monitoring:
• Analytical monitoring is required if the facility retains exposed piles of sawdust, wood chips, bark, mulch, or other
similar material on site for more than seven (7) days.
• Monitoring frequency is twice a year (instead of annually).
• Monitoring parameters include pH (new), Chemical Oxygen Demand (COD) instead of BOD, and TSS (same).
• Vehicle maintenance activities trigger stormwater monitoring requirements for pH, Oil & Grease (O&G), and TSS.
• Tiered response requirements apply when samples exceed benchmark concentrations. Benchmarks are not limits.
• Monitoring results must be reported to DWQ within 30 days of lab report receipt (instead of annually).
• Qualitative Monitoring must be performed twice a year (instead of monthly).
You have entered this permit in "Year 3 — Period 2" of the sampling schedule, which ends June 301h. However, because of
the delayed mail -out of permit packages, your facility is expected to comply with sampling requirements beginning no
later than "Year 4 — Period V' That means your facility must sample a representative storm event between July 1 and
December 31, 2011(or, if applicable, reporting "No Flow" from a representative storm event on the SDMR Form within 30
days of that deadline, as outlined in Part III, Section E.)
➢ Stormwater Pollution Prevention Plan (SPPP:
• SPPP requirements reflect the current standard for most stormwater general permits and are more detailed than
the NCG220000 permit. Please review all the Items thoroughly to update your current SPPP to be compliant with
this permit. For example, the site location map must identify any receiving waters that are impaired, and training
records must include signatures of employees trained annually.
• If a facility opts out of monitoring on the basis of removing accumulated material in a week or less, a log of when
material is generated and removed, as well as other details about removal, must be kept with the SPPP.
• Because of the transition to a new permit, the compliance schedule in Part III, Section A does not address your
facility's situation. However, many items in the SPPP are similar to those under the old NCG220000. Therefore, the
Division expects your operation to have its SPPP revised and implemented to comply with this permit within six
months of receipt of this permit package.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit does not
affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the permittee
from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order,
judgment, or decree.

Please find attached copies of the Certificate of Coverage for the Anson
Wood Products facility and the NCG220000 general permit. You may notice
that the general permit expired in November 2008. This is the most
current permit as it has yet to be renewed. Until the general permit is
renewed, your facility falls under the conditions of the expired permit.
You should have received a renewal notice, but if not you are still
responsible for renewing coverage and will receive a copy of the renewed
permit once issued. If you need assistance with this process, please

Dear Mr. Jordan:
On May 6, 2008, I, Trent Allen from the Fayetteville Regional Office of the Division of Water
Quality, conducted a site inspection for the Anson Wood Products, Inc. facility located off Parson Street,
Anson County, North Carolina. A copy of the inspection report is enclosed for your review. Douglas E.
Richardson and Derrick Coble were also present during the inspection and their time and assistance is
greatly appreciated. Stormwater from the facility drains to Jones Creek, located in the Yadkin — Pee
Dee River Basin. The site visit and file review revealed that the subject facility is covered by NPDES
Stormwater General Permit-NCG220014.
Accordingly, the following observations were noted during the Division of Water Quality
inspection (please see the attached addendum for information about your permit):

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the
federal Clean Water Act and then delegated to the Division of Water Quality for implementation in
North Carolina. The NPDES permitting program for stormwater discharges was established in 1990.
Phase I focuses on site and operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten
categories are required to obtain permit coverage under a general permit or an individual permit,
depending upon the facilities SIC code and the industrial activity occurring at the facility. There are
currently 19 active general stormwater permits in North Carolina. One condition that is applicable to
both the general permits and individual stormwater permits is the requirement to develop and implement
site -specific comprehensive stormwater pollution prevention plans (SPPP). These plans are required to
include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent
pollutant discharge.

monitoring forms, and a Notice of Intent [which is the application of for coverage under a NPDES
General Stormwater Permit] can be found at this web site.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. That said;
please see the above -mentioned web site in order to obtain a copy of the permit such that you may fully
comply with all the conditions therein. Failure to properly comply with conditions of the permit, like
those bulleted below, constitutes violations and is subject civil penalty assessment of up to $25,000
per day, per violation.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit
coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the
Division of Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NO1) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and .determine whether a Certificate of
Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered
by the General Permit. That is, the permittee is authorized to discharge stormwater, process
wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit
expires or is modified or revoked.
+ Any other point source discharge to surface water of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or approval.
+ There are currently 19 active general permits. Permit conditions vary accordingly; however, most
of the permits have following condition requirements (you must read your entire permit to ensure
full compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting and recording of Qualitative Monitoring
o Collection, reporting and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the facility
along with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring
results shall also be maintained on -site. The Permittee shall retain records of all
monitoring information, including all calibration and maintenance records and all original
strip chart recordings for continuous monitoring instrumentation, and copies of all reports
required by this general permit for a period of least 5 years for the date of the sample
measurement, report or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the
general permit. In order to receive automatic authorization to discharge beyond the
-expiration date, the pennittee shall submit forms and fees as are required by the agency
authorized to issue permits no later than 180-days prior to expiration date. Any permittee
that has not requested renewal at least 180 days prior to expiration, or any permittee that
does not have a permit after the expiration and has not requested renewal at least 180
days prior to expiration, will be subject to enforcement. Failure to renew your permit is
a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is
not transferable to any person expect after notice to and approval by the Director. The
Director may require modification or revocation and reissuance of the Certificate of
Coverage to change the name and incorporate such other requirements as may be
necessary under the Clean Water Act. The Permit is NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of
Water Quality views changes of name or ownership as a modification that requires the
Director's approval and reissuance of the permit. Name and ownership changes required
you to complete a Name/ownership Change Form from the Division and mail it back to
the Division of Water Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Quality (DWQ) is forwarding herewith the reissued stormwater general permit. The permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of
North Carolina and the U.S. Environmental Protection Agency, dated May 9, 1994, or as subsequently amended.
The following information is included with your permit package:
• A new Certificate of Coverage
+ A copy of General Stormwater Permit NCG220000
• A copy of the Analytical Monitoring Form
• A copy of the Qualitative Monitoring Form
The only differences between this reissued version of the General Permit and the original version are the Analytical
Monitoring Requirements (See Part 11, Section B). Sampling parameters of pH and Oil and Grease have been dropped
immediately and the frequency for analytical monitoring has been changed from quarterly to annually once 12 quarters
have been sampled. (See Table 1, footnote 1 on Measurement Frequency).
Your coverage under this General Permit is not transferable except after notice to DWO. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility for
compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree..

The above referenced facility is currently covered for Stormwater discharge under General Permit
NCG220000. This permit expires on November 30, 2003. The Division staff is currently in the process of
renewing this permit and is scheduled to have the permit reissued by fall of 2003. Once the permit is
reissued, the above referenced facility would be eligible for continued coverage under the reissued
permit. If you wish for the above referenced facility to be covered under the reissued permit, you must
apply to the Division of Water Quality (DWQ) for renewal of permit coverage. Enclosed you will find a
Permit Coverage Renewal Application Form. The application must be completed and returned by
June 3, 2003.
Failure to apply for coverage under the reissued NCG220000 may result in a civil assessment of at least
$250.00 and/or a lapse in permit coverage for the above referenced facility. Larger penalties may be
assessed depending on the delinquency of the request. Discharge of stormwater from the above
referenced facility without coverage under a valid stormwater NPDES permit would constitute a violation
of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of
industrial facilities in any of the 11 categories of "storm water discharges associated with industrial
activity," (except construction activities). If you feel the above referenced facility can certify a condition of
"no exposure", i.e. the facility industrial materials and operations are not exposed to stormwater, you can
apply for the no exposure exclusion. For additional information contact the Central Office Stormwater

If the subject stormwater discharge to waters of the state has been terminated, please complete the

The Division of Water Quality has received your letter dated December 18, 2000, enclosing a Notice.of
Intent with respect to the.NCG220000 stormwater general permit. You appear to misunderstand the Division's
letter of November 22; 2000 as well as your obligations under State and,federal law.,
The NCG04 permit expired. The Division has been advised by the Attorney General's Office that the
NCG04`permit expired by its'terms on August 31, 1997 and that DWQ's letter purporting to extend the permit
past its expiration date was not authorized by law. Your attorneys have been aware of this for quite some time.
The Division issued the NCG220000 general permit to provide a general permit option for the chip mills
previously covered under the NCG04 permit when it expired. The Division's letter of November 22, 2000
directs you to submit a new Notice of Intent, as is required under 15A NCAC 2H .0127(e). The letter does not
direct you to submit an application for an individual NPDES permit, although it does allow you to choose that
permitting option.
State and federal law require a NPDES stormwater permit for the point source discharge of stormwater
from wood chip mills. You have only two permitting options: you may seek coverage under the NCG220000
general permit or you may apply for an individual NPDES permit. At the current time, you have not clearly
expressed an intent to apply for coverage under the NCG220000. The cover letter you submitted with your
NOI on December 20, 2000 specifically requests that DWQ not issue a certificate of coverage to your facility.
If you are currently discharging stormwater associated with your industrial activity as a wood chip mill,
you are subject to the requirements of the Clean Water Act, including potential citizens' suits. If you wish to be
covered under the NCG220000, you must within 30 days from receipt of this letter submit a letter
unambiguously requesting that the Division issue coverage to your facility based upon the Notice of Intent you

submitted in December, 2000. If any parts, measurement frequencies or sampling requirements contained in

additional 30 days to submit an application for an individual NPDES permit. Sixty days following your receipt of

On November 20, 2000 the Division of Water Quality issued NPDES Stormwater General
Permit NCG220000. This general permit is applicable to owners or operators of stormwater point
source discharges associated with wood chip mills who were covered by NPDES Stormwater
General Permit NCG040000 on August 30, 1997. Our records indicate that your facility in
Wadesboro, NC (COC number NCG040158) was covered by the NCG040000 permit on August
30, 1997.
Part I Section A of the NCG220000 permit requires that "All persons desiring to be
covered by this General Permit must register with the Division of Water Quality by the filing of a
Notice of Intent (NOI) and applicable fees. The N01 shall be submitted within 30 days of issuance
of this General Permit."
Attached is a NOI for coverage under the NCG220000 permit. If you wish to be covered
by this stormwater general permit you must complete the attached NOI and return it, along with
the items outlined in the Final Checklist on Page 3 of 3, to the Division of Water Quality by
December 20, 2000.
