NPDES Stormwater General Perm it-NCG210155 Montgomery County Dear Mr. Jordan: Dee Freeman Secretary On June 8, 2010,1, Hughie White from the Fayetteville Regional Office of the Division of Water Quality, conducted a site inspection for the Jordan Lumber and Supply facility located at on NC 109 N, Mount Gilead, Montgomery County, North Carolina. A copy of the inspection report is attached for your review. Mr. John Coyle was also present during the inspection and his time and assistance is greatly appreciated. Stormwater from the facility drains to Clarks Creek, a Class C water located in the Yadkin -Pee Dee River Basin. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-NCG210155. Yes ❑ No ■ Other Observations: During the inspection it was noted that there appears to be several more areas where stormwater runoff would leave the mill property as point source discharges. It is requested that the facility perform an evaluation of the entire property as soon as possible and document all new stormwater outfalls that are discovered. As a reminder, once these outfalls are determined, monitoring of these outfalls needs to begin, in accordance with the requirements outlined within the permit. Please refer to the enclosed inspection report for more details about monitoring and the permit requirements. You are asked to respond to this office, in writing, within thirty (30) days of receipt of this notice. Your response should include, at a minimum, plans to eliminate the violations stated above and a detailed plan on evaluating the facility for additional stormwater outfalls and implementation of monitoring requirements for any additional outfalls. Please be advised that violations of the NPDES General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. The plan appeared to be complete and current. At the time of this inspection, the facility did not have a copy of the current stormwater permit only a copy of the old permit. A copy of the new permit was left with the permittee for future reference. Qualitative monitoring is not being performed semi-annually, as required. Also, analytical monitoring is being performed at vehicle maintenance areas, but it is being done annually instead of semi-annually, as required by the current permit. The previous permit only required annual analytical monitoring. Also, during this inspection, the only documented outfall was observed. After a review of the outfall and sampling location, it was suggested to move the location of the outfall to the actual property line with the railroad right-of-way, due to the fact that the current outfall sampling point is not all inclusive of the stormwater that leaves the property in that drainage basin. An additional inspection of the property revealed several more areas where it appears that stormwater runoff would leave the property as point source discharges. These points of discharge would be considered additional outfalls. An evaluation of the mill property needs to be performed to indentify all possible outfalls. These new outfalls need to be documented and the sampling requirements need to begin being performed, both qualitative and analytical. As a reminder, any outfalls that may discharge stormwater from areas where there are accumulations or stockpiles of sawdust, mulch, bark, etc. for more than seven days, analytical monitoring needs to be performed; which includes pH, chemical oxygen demand, total suspended solids, and documentation of total rainfall. The more significant changes to the General Permit include the following: • Permit cover page, second paragraph — The General Permit now may cover activities that DWQ determines to be similar in either the process, or in the exposed materials, to the Timber Products Industry. • Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL, may not be eligible for continued coverage at the next renewal of the General Permit. • Part I Section B second paragraph — A new clarification that the permit does not authorize discharges that DWQ determines are wastewaters. • Part II Section A —The required contents of the Stormwater Pollution Prevention Plan have been expanded and clarified. • Part II Section B Table 1 — A new requirement to sample stormwater discharges twice per year for those facilities with exposed piles of certain materials remaining on site longer than seven days. • Part II Section B Tables 2 and 3 and following — For permittees with exposed piles, there are new provisions requiring the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part II Section B — For permittees with exposed piles, a new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control'actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures. • Part It Section C — Clarification that under the qualitative monitoring provisions of the permit, the permittee is obligated to respond to repeated observations of stormwater pollution. DWQ may impose additional stormwater management requirements if the permittee is non -responsive, or if the responses are ineffective.
