A copy of the Compliance Inspection Report is enclosed for your review. Mr. Billy Rowland, Plant Manager, and Mr. Ezra Estep were also present during the inspection and their time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG160000, Certificate of Coverage NCG160177. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as an unnamed tributary to the Black River (Little Black River) (Popes Lake, Rhodes Pond), a Class C;Sw waterbody in the Cape Fear River Basin. As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG160000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. Met with Mr. Billy Rowland, Plant Manager. Reviewed facility's Integrated Control Plan, which incorporates both a Stormwater Poilution Prevention Plan (SPPP) and Spill Prevention Control and Countermeasure plan (SPCC). The Plan was developed/rewritten by a consultant in August 2015 and appeared to contain all NCG160000 permit -required components. Discussed with Mr. Rowland the requirement to document an annual review/update, which should include, an updated list of any significant spills or leaks for the previous three years or notation that no spills have occurred, a written re -certification that the stormwater outfalls have been evaluated for the presence of any non-stormwater discharges, a documented re-evaluation of the effectiveness of onsite stormwater BMPs, and a review/comparison of analytical monitoring data to the benchmark values as listed in the permit. Records of semi-annual analytical monitoring conducted from 2010 to present were available for review and there have been no exceedances of benchmark values. After the records review, observations were made of site conditions including secondary containment around tank farm, stormwater drains, loading/off-loading areas, etc. Facility appeared to be well operated and maintained. Please be sure that your plan is updated to comply with the new requirements. • Part II Section B — Analytical monitoring frequency has been increased to twice per year. • Part Il Section B — Analytical monitoring for pH and Total Petroleum Hydrocarbons (TPH) have been added. • Part 11 Section B — New provisions require the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. The previous provisions for averaging of analytical results and cutoff concentrations have been removed. • Part II Section B — New provisions establish that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures. • Part 11 Section B — Separate monitoring parameters for discharges from vehicle maintenance areas have been removed (previously in Part II Section D.) • Part II Section C — Qualitative monitoring must now be conducted during a representative storm event.
