On September 4, 2015, a site inspection was conducted for the Asphalt Emulsion, Inc. facility located at 151
Emmett Road in Dunn, Harnett County, North Carolina. A copy of the Compliance Inspection Report is
enclosed for your review. Mr. Billy Rowland, Plant Manager, and Mr. Ezra Estep were also present during the
inspection and their time and assistance is greatly appreciated. The site visit and file review revealed that the
subject facility is covered by NPDES Stormwater General Permit NCG160000, Certificate of Coverage
NCG160177. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters
designated as an unnamed tributary to the Black River (Little Black River) (Popes Lake, Rhodes Pond), a
Class C;Sw waterbody in the Cape Fear River Basin.
As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG160000
permit. Please refer to the enclosed Compliance Inspection Report for additional comments and
observations made during the inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil
penalty assessment of up to $25,000 per day for each violation. If you or your staff have any questions,

Inspection Summary:
Inspection conducted to ensure compliance with the conditions of the NCG160000 Stormwater General Permit for asphalt
plants. Met with Mr. Billy Rowland, Plant Manager. Reviewed facility's Integrated Control Plan, which incorporates both a
Stormwater Poilution Prevention Plan (SPPP) and Spill Prevention Control and Countermeasure plan (SPCC). The Plan was
developed/rewritten by a consultant in August 2015 and appeared to contain all NCG160000 permit -required components.
Discussed with Mr. Rowland the requirement to document an annual review/update, which should include, an updated list of
any significant spills or leaks for the previous three years or notation that no spills have occurred, a written re -certification
that the stormwater outfalls have been evaluated for the presence of any non-stormwater discharges, a documented
re-evaluation of the effectiveness of onsite stormwater BMPs, and a review/comparison of analytical monitoring data to the
benchmark values as listed in the permit. Records of semi-annual analytical monitoring conducted from 2010 to present
were available for review and there have been no exceedances of benchmark values. After the records review, observations
were made of site conditions including secondary containment around tank farm, stormwater drains, loading/off-loading
areas, etc. Facility appeared to be well operated and maintained.

This COC is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection
Agency, dated October 15, 2007 (or as subsequently amended.)
The General Permit authorizes discharges of stormwater and specifies your obligations for discharge controls,
management, monitoring, reporting, and record keeping. Please review the new permit to familiarize yourself
with'all of the changes. Parts III and IV contain the Standard Conditions, including Compliance and Liability,
Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions.
Your facility has six months from receipt of the COC to update its Stormwater Pollution Prevention Plan
(SPPP) to comply with changes in SPPP requirements. Other changes are effective immediately. Please note
that Tier 3 Actions (if applicable) are triggered by four benchmark exceedances beginning on the effective
date of the renewal permit and do not count prior exceedances. Please visit our website above to review the
new General Permit carefully.
Your coverage under the General Permit is transferable only through the specific action of DEMLR. This
permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does
it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,

(DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between the state ofNorth Carolina and the U.S. Environmental Protection
Agency, dated October 15, 2007 (or as subsequently amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG160000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges orstormwater only, and it specifies your obligations with respect to stormwater discharge controls,
management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Part 1 Section A — This part explains that the No Exposure Exclusion from permitting option may be available to the permittee.
• Part II Section A— Several minor expansions and clarifications of the required content of the Stormwater Pollution Prevention Plan have
been added. Please be sure that your plan is updated to comply with the new requirements.
• Part II Section B — Analytical monitoring frequency has been increased to twice per year.
• Part Il Section B — Analytical monitoring for pH and Total Petroleum Hydrocarbons (TPH) have been added.
• Part 11 Section B — New provisions require the permittee to execute Tier One and Tier Two response actions, based on the first benchmark
exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute
monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. The
previous provisions for averaging of analytical results and cutoff concentrations have been removed.
• Part II Section B — New provisions establish that four exceedences of any particular benchmark will trigger increased DWQ involvement in
the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may
direct the implementation or installation of specific stormwater control measures.
• Part 11 Section B — Separate monitoring parameters for discharges from vehicle maintenance areas have been removed (previously in Part II
Section D.)
• Part II Section C — Qualitative monitoring must now be conducted during a representative storm event.

• Part III Section E — Item 2. requires submittal of a new reporting form, the Annual Summary DMR. This annual summary of only the
analytical monitoring results (if any) should be submitted to the local DWQ Regional Office. The Annual Summary DMR reporting form
will be posted on the Stormwater Permitting Unit's website in the near future.
• Part III Section E — Item 9. requires the reporting of spills to DWQ, a provision not previously included in NCG 160000.

On September 10, 2009, Mark Brantley, Environmental Chemist, from the Fayetteville Regional
Office of the Division of Water Quality, conducted a site inspection for the Asphalt Emulsions, INC.
Harnett County Facility located at 151 Emmett Road, Harnett County, North Carolina. A copy of the
inspection report is enclosed for your review. Mr. Billy Rowland and Mr. Ezra Estep were also present
during the inspection and their time and assistance is greatly appreciated. Stormwater from the facility
drains to an unnamed triburary to the Black River, a class C-Sw water int ehte Cape Fear River Basin.
The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General
Perm it-NCG 160177.
Accordingly, the following observations and/or permit conditions violations were noted during
the Division of Water Quality inspection:
