Mineral, and Land Resources (DEMLR) is forwarding herewith the reissued Certificate of
Coverage (COC). This permit is reissued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as
subsequently amended.) A new Certificate of Coverage (COC) is included with this
letter.
You must print a copy of the new NCG150000 General Permit from our website here:

The General Permit authorizes discharges of stormwater, and it specifies your obligations
with respect to discharge controls, management, monitoring, and record keeping. Please
review the new permit to familiarize yourself with all changes in the reissued permit. Your
facility has six months from receipt of the permit to update your Stormwater Pollution
Prevention Plan (SPPP) to reflect any new permit requirements.

DEMLR. This permit does not affect the legal requirements to obtain other permits which
may be required by the N.C. Department of Environmental Quality (DEQ), nor does it

On September 24, 2014, Mike Lawyer, Environmental Specialist from the Fayetteville Regional Office of the
Division of Energy, Mineral and Land Resources, conducted a Site inspection for the Harnett Regional Jetport
facility located at 615 Airport Road, Erwin, Harnett County, North Carolina. A copy of the Compliance
Inspection Report is enclosed for your review. Your time and assistance during the inspection is greatly
appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater
General Permit-NCG150000, Certificate of Coverage-NCG150061. Permit coverage authorizes the discharge
of stormwater from the facility to receiving waters designated as Thorntons Creek and Cape Fear River, Class
WS-IV waterbodies in the Cape Fear River Basin.
As a result of the site inspection, the following deficiencies are noted:
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has been developed, however there is no documentation of an
annual review/update, which should include an updated list of significant spills/leaks for the previous three
years or notation that none have occurred. There is also no documentation of annual employee training.
2) Qualitative Monitoring
Qualitative monitoring has not been conducted and recorded in accordance with permit requirements.

during the inspection.

This letter is in response to the violation notice the Harnett County Jetport
received for not conducting semi-annual Qualitative Monitoring of our
industrial outfall. I wish to emphasize our intention and commitment to
implement the monitoring plan and fully comply with all the requirements of
NPDES Stormwater General Permit-NCG150000.
After finalizing our plan (SWPPP) in February 2011, documenting a qualitative
sampling during a significant event in March 2011 and a review of our SDO by
Mr. Mike Lawyer during the inspection, we assert we are in compliance with
the monitoring requirements of NCG150000. Jetport staff will continue to
comply by ensuring our documented monitoring reports remain on a semi-
annual cycle.
But concerning the Notice of Violation, we respectfully take exception that we
were not in compliance with the monitoring portion of the permit. Based on
our review of the general permit, the Harnett County Jetport believed that we
were not obligated to conduct any monitoring before we had our SWPPP
completed for the following reasons:
There is no clear requirement within the permit on when monitoring
should commence. On the contrary, the permit infers that monitoring
should not commence until after development of the SWPPP.
2. Section D, Paragraph 6 of the permit reads, "Visual monitoring shall be
documented and records maintained at the facility along with the
strong roots • new growth

Stormwater Pollution Prevention Plan." In our opinion, this statement
certainly implies the monitoring is tied to the SWPPP.
Based on this information, we ask DENR to reconsider the Notice of Violation
due to monitoring. We cannot see any clear directive in the permit that
requires the Jetport to perform monitoring prior to the development of the
SWPPP.
We do want to emphasize our previous statement that the Harnett Regional
Jetport is and has always intended to work with DENR in every way possible
and to fully comply with the requirements of the stormwater permit. In
accordance with the General Permit and the SWPPP, samples have been
collected at each outfall and the SDO form completed.

Quality conducted a site inspection for the Harnett Regional Jetport facility located 615. Airport Road,
Erwin, Harnett County, North Carolina. A copy of the Compliance Inspection Report is enclosed for
your review. Your time and assistance during the inspection is greatly appreciated. Permit coverage
authorizes the discharge of stormwater from the facility to receiving waters designated as Thorntons
Creek and Cape Fear River, Class WS4V waters in the Cape Fear River Basin. The site visit and file

Inspection conducted to ensure compliance with the conditions of the NCG150000 general stormwater permit for General
Aviation facilities. Met with Mr. Barry Blevins, Administrator, who provided facility's SWPPP and available monitoring
records for review. Monitoring records were complete from events conducted during the first half of 201-1, facility's second
year of permit coverage, however according to Mr. Blevins, Qualitative Monitoring was not conducted during 2010,
facility's first year of permit coverage. After review of available documents, observations were made along with Mr. Blevins
of the facility's industrial activity areas including fuel storage and fueling locations, aircraft maintenance and washing
areas, and secondary containment of ASTs. Observations of the two outfalls (outfall #1 and #2) that receive stormwater
runoff from the industrial activity areas were also made. Facility does not perform any de-icing operations. Mr. Blevins was
advised that a Notice of Violation would be issued for failure to conduct and document Qualitative Monitoring during the
first year of permit coverage in 2010.
