A copy of the Compliance Inspection Report is enclosed for your review. Dewayne Allen also present during the inspection and time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG150051, Certificate of Coverage NCG150051. Henson Regional Supervisor Surface Water Protection Section NC Department of Environment and Natural Resources 225 Green Street, Suite 714 Fayetteville, NC 28301 Subject: Notice of Violation (NOV-2011-PC-0158) Lumberton Regional Airport NPDES Stormwater General Permit-NCG 150000 Robeson County Dear Ms. Henson: DEMR-FRO MAR 14 2011 This letter is in response to the violation notice the Lumberton Regional Airport received from your department for not conducting Qualitative Monitoring of our industrial outfall. I would like to emphasize the Airport's intent to implement the monitoring plan and fully comply with all the requirements of NPDES Stormwater General Permit-NCG150000. We look forward to working with your office as we move forward in the implementation of our Stormwater Pollution Prevention Plan (SWPPP). Between the time the SWPPP was due and Mr. Lawyer's visit, there were no days where rainfall greater than 0.1 inches occurred preceded by 3 days in which no storm greater than 0.1 inches had occurred. We have had two rainfalls since Mr. Lawyer's visit, but the first one was only .01 inches of rain and the second occurred during the night while we were closed. We have implemented our monitoring plan with this first rainfall. (See attached) Concerning the Notice of Violation, we respectfully take exception that we were not in compliance with the monitoring portion of the permit. As you may understand, there has been some confusion on this issue as outlined in the February 16, 2011 email from Mr. Mike Randall to Mr. Lawyer. Based on our review of the general permit, the Lumberton Municipal Airport believed that we were not obligated to conduct any monitoring before we had our SWPPP completed for the following reasons: 1. There is no clear requirement within the permit on when monitoring should commence. On the contrary, as a layman reading the permit, it infers that monitoring should not commence until after development of the SWPPP. 2. Section B, Paragraph 1 of the permit reads, "Qualitative monitoring requires a visual inspection of each stormwater discharge outfall (SDO) associated with industrial activity Telephone: 910.739.6480 Fax: 910.671.3947 • Page 2 March 11, 2011 regardless of representative outfall status and shall be performed as specified below in Tablel." As you know, the specific outfalls for industrial activity were not confirmed until the development of the SWPPP. By inference, the SWPPP would need to be complete before monitoring could commence. 3. Section D, Paragraph 6 of the permit reads, "Visual monitoring shall be documented and records maintained at the facility along with the Stormwater Pollution Prevention Plan." In our opinion, this statement certainly implies the monitoring is tied to the SWPPP. Based on this information, we ask DENR to reconsider the Notice of Violation due to monitoring. We cannot see any clear directive in the permit that requires the Airport to perform monitoring prior to the development of the SWPPP. However, we do want to emphasize our previous statement, that the Lumberton Regional Airport is and has always intended to work with DENR in every way possible and to fully comply with the requirements of the stormwater permit. Our SWPPP went into effect January 29; 2011. Since we have had.a representative storm event, we collected a sample on February 25, 2011 and completed the SDO form for inclusion in our SWPPP.
