VAN DER VAART Secretary TRACY DAVIS Director On May 19, 2016, a site inspection was conducted for the Anson County Airport facility located at 2980 Airport Road, Anson County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Gary Fincher, Airport Manager was also present during the inspection and his time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG150000, Certificate of Coverage NCG150012. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Hurricane Creek, a Class C waterbody in the Yadkin -Pee Dee River Basin. As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG150000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Melissa Joyner met with Mr. Gary Fincher, Airport Manager who provided the facility's Stormwater Pollution Prevention Plan (SPPP) for review. The SPPP appeared orderly and comprehensive but was in need of a few modifications.: 1. The site map needs to be updated with the information stipulated in the general stormwater permit (see attached permit). 2. The Preventative Maintenance and Good Housekeeping program should include documentation of the maintenance of the outfalls and recording of the visual checks of the AST manually activated drain. 3. The SPPP needs to be reviewed and updated on an annual basis. This review should include recertification that the outfalls have been evaluated for non-stormwater discharges and the reevaluation of the Best Management Practices. 4. A feasability study should be included in the SPPP. The Qualitative Monitoring records were reviewed and were found to be up to date and satisfactory. Observations were made of outfalls 3, 4, 9 and 10 (near the industrial activity areas). They were in need of maintenance due to excessive vegetation. The fueling area and wash pad (grassed area) were also observed and appeared to be in good condition. Page: 2 ti. A copy of the Compliance Inspection Report is enclosed for your review. Mr. Gary Fincher, Airport Manager, was also present during the inspection and his time and assistance is greatly appreciated. Met with Mr. Gary Fincher, Airport Manager, who provided the facility's Stormwater Pollution Prevention Plan (SWPPP) for review. Facility's SWPPP was developed by LPA Group of NC, which contained all permit -required components and was found to be very detailed yet well laid out and easy to follow, One item of clarification that was discussed was that the permit only requires Qualitative (visual) Monitoring to be conducted twice per year as opposed to quarterly as written into the SWPPP. Mr. Fincher was advised that he could leave his monitoring schedule as quarterly if he chooses, but is only required to do it semi-annually. A monitoring record was available from March 2011, however there were no other records for the first year of permit coverage, which started in March 2010. It was relayed to Mr. Fincher that the general permit contains a compliance schedule of 12 months for development of the SWPPP and to provide any necessary secondary containment, however all other conditions of the permit became effective immediately upon issuance. It was also relayed that a Notice of Violation would be issued for failure to conduct monitoring during the first year of coverage. Observations were made of the facility's fueling area, wash pad and the four outfalls that receive runoff from these industrial activity areas. As detailed in the Compliance Inspection Report completed by Mr. Lawyer, the NCG150000 General Permit does contain a compliance schedule of 12 months to develop a Stormwater Pollution Prevention Plan and provide any necessary secondary containment, however there is no such compliance schedule for the monitoring requirements listed in the permit. Therefore, the requirement to conduct semi-annual Qualitative Monitoring began upon issuance of coverage, which was on March 26, 2010. Based on this date of permit coverage, Qualitative Monitoring should have been performed and documented at least twice during the 2010 calendar year. Again, this was explained in detail in Mr. Lawyer's inspection report. In regards to the identification of each outfall that would receive storm flow from industrial activity areas, this would have needed to be done within a time frame that would have allowed monitoring to be conducted semi-annually beginning with the first year of coverage. Based on the aforementioned information, staff with the Fayetteville Regional Office of the Division of Water Quality supports the issuance of the Notice of Violation (NOV-201 1 -PC-0387) to Anson County for failure to comply with the monitoring conditions of the NCG150000 General Permit by the Anson County Airport, Certificate of Coverage NCG150012. We respectfully take exception that the Airport was not in compliance regarding the monitoring requirement of the permit. We understand that there has been some confusion on this issue as outlined in the February 161h and March 10tt', 2011 emails from Mr. Mike Randall and his comments regarding this issue at the North Carolina Airports Association conference earlier this year. Our interpretation of the general permit would have required the Anson County Airport to begin monitoring after the development of our SWPPP, not prior to nor during its development. This interpretation is based upon the following three items: 1. Our review has not revealed a clear requirement outlining the date that monitoring should begin. To the contrary, it can easily be interpreted that monitoring should not start until the SWPPP has been completed. 2. The permit requires visual inspection of each industrial activity stormwater outfall. However, the identification of each industrial activity stormwater outfall is a developmental step within the SWPPP. By deduction, the SWPPP would need to be complete and outfall points identified before monitoring could begin. 3, The permit references the SWPPP in its direction regarding the required documentation and records keeping in Section D, Paragraph 6 of the permit. We would like to clearly state that the Anson County Airport has always had the best intentions as to its total compliance with the stormwater permit requirements and will continue to do so.
