Box 1950 Smithfield, NC 27577 Dear Mr. Jones: You have our approval to place fill material in a total fill of 0.62 acres of wetlands or waters for the purpose of constructing a commercial area at Classic Ford, as you described in your revised application dated 6 August 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Additional written DWQ approval is required for the stormwater pond. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Storniwater, Non-Discharge and Water Supply Watershed regulations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearini, send a written petition which conforms to Chapter 150B of the North Carolina General. Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final. and binding unless you ask for a hearing. Anderson, iedmont Region Coordinator Habitat Conservation Program DATE: July 26, 1996 SUBJECT: 401 Water Quality Certification for Jim Jones for Automobile Dealership, Johnston County, Buffalo Creek, Neuse River Basin, 960593 Staff biologists with the North Carolina Wildlife Resources Commission have reviewed the SLI jest application for 401 Water Quality Certification with respect to anticipated project impacts on aquatic habitats. A site visit was made on July 22, 1996. Our comments are provided in accordance with certain provisions of the Fish and Wildlife Coordination Act (Stat. 401, as amended; 16 U.S.G. 661 et. seq.), and Section 401(b) of the Clean Water Act of 1977 (as amended), and North Carolina General Statutes (G. S. 113-131 et seq.). The applicant proposes to expand an existing automobile dealership and is requesting to impact 0,52 acres of wetlands along Buffalo Creek, Previously 0.3 acres have been impacted under NW 26. There are an estimated 1,1 acres of wetlands on the. site, These wetlands receive runoff from the adjacent road nrens in addition to runoff .from the applicant's property. We have the following recommendations concerning the issuance of this certification: 1. The storinwater pond should be sized to receive the runoff from all the adjacent areas that are currently flowing to this wetland. 2. The landscaped islands should be eliminated to reduce the impacts to the wetland areas and remove the essential disturbances further from Buffalo Creek. An effort should be made to maintain a minimum of a 65-foot buffer from the top of the creek bank instead of the centerline. 3. Woody shrubs and/or trees should be re-established along the creek banks that have been cleared. Woody vegetation will help to maintain soils and prevent the need f'or riprap and to reduce scouring of the creek. Place deed restrictions on the property to prevent any future wetland destruction by current or future owners. Sufficient water should be routed to remaining wetlands to maintain hydrology.
