This Certificate of Coverage shall remain in effect for the duration of the General Permit.

MEMORANDUM OF LEASE
THIS MEMORANDUM OF LEASE ("Memorandum") is signed as of December 15,
2017, by ALLEN OF FAYETTEVILLE I, LLC, a North Carolina limited liability company,
with its principal offices in Cumberland County, North Carolina ("Landlord"), and
CONCRETE SERVICE CO., INC., a North Carolina corporation, with its principal offices in
Cumberland County, North Carolina ("Tenant").
Landlord and Tenant have entered into a lease ("Lease") dated as of the date of this
Memorandum for valuable consideration with respect to certain "Premises" in the Town of
Lumberton, Robeson County, North Carolina, more fully described and/or depicted on attached

I. DIRECTIONS TO SITE: From FRO take 1-95 south to Exit 17, and turn left at the light. Follow the
main road around, left through the traffic signal and the road becomes 5th Street. Go about 2 miles and
follow TO Street as it branches to the right. Go another mile, cross the river, then 3 blocks and turn right
onto Walnut Street. Go two blocks and the plant is on the left.
U. SAFETY: Standard FRO safety gear is required, including a reflective vest. The inspector should be
mindful of vehicular and heavy equipment traffic.
M. FACILITY/PROCESS DESCRIPTION: Argos Ready Mix — Lumberton Plant (No. 116) is a
138 cu yd/hr trick mix concrete batch plant located in Lumberton, Robeson County. The facility has a
split silo containing 150 tons of cement, and 75 tons of flyash, and separate weight hopper for sand and
course aggregate, which is fed via conveyor. The facility's emission sources are controlled by a central
dust collector. Concrete is composed essentially of water, cement, sand (fine aggregate) and coarse
aggregate. The constituents that make up the concrete produced here are stored, conveyed, measured, and
discharged into trucks for transport to a job site. The raw materials are delivered by truck; the cement is
transferred to the elevated storage silos pneumatically, and the sand and coarse aggregate are transferred
into stockpiles on the ground. A front-end loader delivers the materials into the conveyor, which conveys
them to the weigh hopper, which combines the proper amounts of each material. The sand, aggregate, and
cement are all gravity fed from the weigh hopper, via a conveyor belt, into the mixer trucks. The concrete
is then mixed with water inside the truck on the way to the site where the concrete is to be poured.

IV. INSPECTION SUMMARY: On 22 September 2017, Mark Brantley, FRO DWR, nand I, Joshua Harris,
FRO DAQ, arrived on site to conduct a multimedia inspection of Argos Ready Mix — Lumberton Plant
(No. 116). We met Dewey Jernigan, Operations Manager, and Philip Powell, Plant Manager, and
explained that even though his air permit has been rescinded, the facility may still receive regular air
quality inspections, or "Compliance Assurance Visits." Mr. Jernigan verified the FacFinder information,
and did not note any changes to the facility's contact information. We provided Mr. Jernigan a copy of
the "Facility Compliance Tracking Checklist" to use if he'd like since the facility's permit has been
rescinded as requested under 2Q .0102(d). We reviewed the facility's records, and bagfilters are opened
and inspected annually by an outside contractor. The facility appeared to be well -maintained, and Mr.
Powell stated that they are still doing everything the same way it was done before the permit was
rescinded. Mr. Powell provided the plant's production for 2016, and the current rate is roughly the same
as when the facility applied for rescission. The 2016 production was 14,651 cubic yards, and does not
make the facility exceed the 5 TPY exemption threshold. We reviewed the facility's stormwater records,
then toured the facility. There were no sources operating at the time, and there have been no changes to
the facility's sources or controls since the last inspection. Mr. Jernigan stated that the facility does not
have a crusher on site, and contracts a third party to crush waste concrete. There are no water heaters,
boilers, or engines on site.

V. EQUIPMENT ON SITE:

VI. APPLICABLE AIR QUALITY REGULATIONS:
A. 15A NCAC 2D .0515 -- PARTICULATES FROM MISC. INDUSTRIAL PROCESSES —
Particulate emissions shall not exceed allowable emission rates as calculated by the following
equations:
E = 4.10 * (P) ° 6' for P < 30 tonslhr, or
E = 55 * (P) 0' - 40 for P >30 tons/hr
APPEARED IN COMPLIANCE: These calculations were made when the facility was permitted,
and the previous permit reviews indicated that that facility, when controls are properly maintained
and operated, would not exceed these limits. The facility's particulate emissions are controlled by
bagfilters. Each bagfilter appeared to have regular maintenance conducted, with annual internal
inspections conducted by an outside contractor, the last of which was conducted on 22 August 2017.
The facility conducts regular external inspections monthly. There were no dust accumulations near
their exhaust point, which would indicate an operational problem.
B. 15A NCAC 2D .0521-- CONTROL OF VISIBLE EMISSIONS —Visible emissions shall not
exceed 20% opacity.
APPEARED IN COMPLIANCE: The facility was not operating at the time of the inspection. Mr.
Powell stated thathe does not see visible emissions while the plant is operating, and that he hasn't
received any dust complaints. DAQ has not received any complaints pertaining to this facility.
C. 15A NCAC 2D .0535 — NOT'IFICATION REQUIREMENT —Notify DAQ in the event of excess
emissions lasting longer than 4 hours resulting from malfunctions, breakdowns, or abnormal
conditions.
APPEARED 17V COMPLLANCE. There are no indications, and neither Mr. Jernigan nor Mr.
Powell were aware of any instances of excess emissions which would require a notification by the
facility. There have been no complaints received by the facility or DAQ.
D. 15A NCAC 2D .0540 — PARTICULATES FROM FUGITIVE DUST EMISSION SOURCES —
Fugitive dust emissions shall not contribute to substantive complaints, or excessive dust emissions
across the property boundary.
APPEARED IN COMPLIANCE: No fugitive dust concerns at the property boundaries were noted
during the inspection. The facility utilizes wet suppression methods to minimize fugitive dust
emissions. There have been no complaints received by the facility or by DAQ.
V11. NON-COMPLIANCE HISTORY SINCE 2010: This facility has no history of non-compliance since
2010.
VM. RISK MANAGEMENT (112r): This facility does not store any 112(r) subject materials above threshold
limits. Therefor,, it is not required to maintain a written Risk Management Plan (RUT).
IX. CONCLUSION AND RECOMMENDATIONS:
- Argos Ready Mix —Lumberton Plant (No. 11 b) appeared to be IN COMPLIANCE with
applicable air quality regulations on the date of inspection.

Mineral, and Land Resources (DEMLR) is forwarding herewith the reissued Certificate of
Coverage (COC). This permit is reissued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as
subsequently amended.) A new Certificate of Coverage (COC) is included with this
letter.

The General Permit authorizes discharges of stormwater and wastewater (if applicable),
and it specifies your obligations with respect to discharge controls, management,
monitoring, and record keeping. Please review the new permit to familiarize yourself with
all changes in the reissued permit. Significant changes to the General Permit are
outlined in the Technical Bulletin, which is also available on the website above. Your
facility has six months from receipt of the permit to update your Stormwater Pollution
Prevention Plan (SPPP) to reflect any new permit requirements.

How does the new General Permit affect Tier Status?
The first sample period of your permit begins August 1, 2017. Tier 3 actions in Part IV of
your permit are triggered by benchmark exceedances on four occasions beginning on the
effective date of this permit and do not count prior exceedances. Likewise, Tier 2 actions
are triggered by two consecutive benchmark exceedances beginning on the effective date
of this permit and do not count prior exceedances. However, if your facility is already in
Tier 2 (monitoring stormwater discharges monthly) or Tier 3, you must continue monthly
monitoring until relieved through conditions of the permit or by DEMLR staff approval.
When does electronic DMR reporting start?
We are setting up our database with final permit parameters and the outfalls that
permittees submitted on-line. All NGG14 Permittees will receive notification when our
eDMR system is ready for these permittees to register and begin reporting.

DEMLR. This permit does not affect the legal requirements to obtain other permits which

relieve the permittee from responsibility for compliance with any other applicable federal,
state, or local law, rule, standard, ordinance, order, judgment, or decree.

Safety Considerations: All Standard DAQ FRO safety gear is required. Watch for moving mixer trucks,
cement/flyash tanker trucks, sand and aggregate haul trucks, and front end loaders.
Directions:
From FRO take I-95 south to Exit 17, and turn left at the light. Follow the main road around, left through
the traffic signal and the road becomes 5`h Street. Go about 2 miles and follow 2"a Street as it branches to
the right. Go another mile, cross the river, then 3 blocks and turn right onto Walnut Street. Go two
blocks and the plant is on the left.
Facility Description:
Concrete is composed essentially of water, cement, sand (fine aggregate), and coarse aggregate. Fly ash
is used as a specialty aggregate. The plant stores, conveys, measures and discharge these constituents into
the truck for mixing and transport to the customer site. The cement is delivered to the facility via a
company transfer truck whereas the fly -ash, stone, and sand are brought by a vendor transfer/dump trucks.
The cement and fly ash are transferred to the elevated silo by pneumatics. The aggregates are transferred
to the elevated storage bin by front-end loader and belt conveyor. From these elevated bins, gravity or a
screw conveyors it to the weigh hopper and dispenses the components, where proper amounts of each
material are supplied to the truck. This facility has a central dust collector control device for controlling
emissions generated from the silos, weigh hopper, and truck mix area.

Inspection Summa :
On 20 September 2016, I, Mark Brantley, of DWR FRO, met with Mr. Philip Powell, Plant Manager, and
Mr. Dewey Jernigan, Operations Manager, to conduct a compliance inspection. Mr. Powell stated that the
facility had received no complaints from anyone regarding air quality as far as he knew. He stated that
there had been no changes at the facility since the last inspection and that none were planned. I did not
observe leaks or holes in the bagfilter housing or ductwork. I did not observe excessive dust deposits
around the bagfilter, silos, or truck mix area. The facility has no boiler, hot water heater, or emergency
generator. There was no portable crusher at the facility at the time.
• The fact finder information was updated to reflect Mr. Philip Powell as facility manager instead
of Mr. Ted Dover.
• Since the previous inspection, the permit has been rescinded for this facility on 19 August 2016.
Information is recorded by the facility in logbooks regarding monthly inspections of the baghouse
and weekly inspections of all other equipment.
Regulatory Review:
15A NCAC 2D .0515 PARTICULATE CONTROL REQUIREMENT — Particulate matter emissions
from the emission sources shall not exceed allowable emission rates.
Appeared in Compliance: This facility was previously permitted, and the most recent permit review
indicated compliance so long as the facility operates and maintains the control devices, as designed and
recommended by the manufacturer, on all point sources at the facility. There have not been any
modifications to the facility since the facility's last permit review. All control devices appeared to be
operated and maintained as required.
ISA NCAC 2D .0521 VISIBLE EMISSIONS CONTROL REQUIREMENT - Visible emissions from
the facility's emission sources shall not be more than 20%.
APPEARED IN COMPLIANCE - The facility maintains logbooks regarding inspections and
maintenance of the facility's bagflter, which they continue to perform monthly. There were no
indications the visible emissions limit had been exceeded.
15A NCAC 2D .0535 NOTIFICATION REQUIREMENT - The facility is required to notify DAQ if
excess emissions occur for more than a 4-hour period caused by a breakdown or other abnormal
condition.
APPEARED IN COMPLIANCE - There were no indications of excessive emissions which would
require notification of DAQ.
15A NCAC 2D.0540 FUGITIVE DUST CONTROL REQUIREMENT — The facility shall not cause
complaints or excess visible emissions beyond the property line.
APPEARED IN COMPLIANCE - The facility has not received any direct complaints nor has DAQ
received complaints about fugitive dust beyond the property line. l saw no fugitive dust emissions during
the inspection.

Enclosed please find the Compliance Inspection Report for the inspection conducted
October 31, 2012 of the Ready Mixed Concrete Company - Plant 116 located at 201
South Walnut Street, Lumberton North Carolina by Mr. Paul Rawls of my staff. Your
assistance and cooperation as.well as that of Mr. Gary Blanchard, Plant Manager during
the inspection is greatly appreciated. Stormwater, should it leave the site, would drain to
the City of Lumberton Municipal Separate Storm Sewer System (MS4) & the Lumber
River in the Lumber River Basin The subject facility is covered by NPDES Stormwater
General Permit No. NCG140000, Certificate of Coverage No. NCG140179. While most
items covered were considered compliant there are items that need your attention.
These and other findings of the inspection are listed below and in the enclosed
inspection report.
- The site was found to be neat and well maintained.
- Stormwater on the site drains to the City of Lumberton MS4 via four storm drains. It
should be noted that the Ready Mixed Concrete Company (Company) performs
stormwater qualitative and analytical monitoring at a point where the MS4 piping
discharges into an open channel on the east side of South Cedar Street.
Please note that the sample point identified above contains offsite stormwater
from nearby railroad activities, municipal street drainage and other businesses.

It is suggested that if during Analytical and/or Qualitative Monitoring there are
indications of the presence of significant stormwater contamination the Company
not only evaluate onsite conditions but also evaluate possible upstream sources for
the presence of contaminants. The Company should keep written records of
investigations, evaluations and responses to such events similar to records called for
in Section C of the permit.
- Discharge Monitoring Reports. A review of your records revealed that you have
sampled the SDO noted above but not on a quarterly basis or for Settleable Solids as
called for in your permit. Please review your permit for Process Wastewater
Monitoring that outlines proper sampling frequencies and parameters.
These deficiencies should be corrected by following permit conditions in the
future. Further you are asked to submit all required data that has to date not
been submitted by December 1, 2012.
During the inspection it was noted that land on the east side of South Cedar Street is
utilized as the "Return" area. Concrete returned to the facility is deposited on this land
and is later repurposed as fill, road base or other uses. It was noted that recent work
by the City has disturbed the site.and that stormwater BMPs may need improvement.
The Company is urged to maintain the area in such a manner to prevent impact to
receiving waters. Also please note that if there is a point source discharge from this
area it should be considered as a SDO and monitored as called for in the permit.
There was no visible sign of previous discharges from this area at the time of the
inspection.
I am told that during the inspection there was a discussion pertaining to two 250
gallon containers of truck washing liquid and the possible requirement to place those
containers in the onsite secondary containment area. Mr. Rawls has reviewed the
terms and conditions of your permit and has determined that those containers are
not required to be in the containment area. We do however suggest that the
containers be placed in the secondary containment area to prevent the release of
the noted material to the land, surface or ground waters should the containers or
associated piping fail. This suggestion is made in the spirit of environmental
protection but the final decision is that of Ready Mixed Concrete Company.
- Secondary containment was noted as locked in keeping with proper secondary
containment practices.

- Employee training includes an online videos, discussions of environmental and safety
related items with the facility manager as well as an employee test.

There was no visible signs of previous discharges from this area at the time of the inspection
I am told that during the inspection there was a discussion pertaining to two 250

gallon containers of truck washing liquid and the possible requirement to place those
containers in the onsite secondary containment area. Mr. Rawls has reviewed the
terms and conditions of the permit and has determined that those containers are
not required to be in the containment area. We do however suggest that the
containers be placed in the secondary containment area to prevent the release of
the noted material to the land, surface or ground waters should the containers or associated piping
fail. This suggestion is made in the spirit of environmental protection but the final decision is
that of the Ready Mixed Concrete Company,
Secondary containment was noted as locked in keeping with proper secondary
containment practices.
Records were available and organized,
Employee training includes an online videos, discussions of environmental and safety related items
with the facility manager as well as an employee test.

- As discussed all staff that are part of stormwater management on the site should review the permit as
often as necessary to be aware of the terms and conditions contained in the document,

Enclosed please find a copy of the Compliance Evaluation Inspection form from the' inspection conducted on
September 23, 2008. The Compliance Evaluation Inspection was conducted by Danny Strickland of the
Fayetteville Regional Office. The facility was found to be.in Compliance with permit NCG140179. Asa reminder,
preservation of the Waters of the State can only be achieved through consistent N13DES Permit compliance.
+ During the inspection, I found that this facility has only one outfall that everything on the site flows too.
This outfall is sampled at the edge•of the property. I also, found during my inspection that they were only
sampling annually for Qualitative monitoring requirements, which require semi-annual monitoring, and
semi-annually for Analytical monitoring requirements, which only require annually monitoring. I talked to
Andy Palma about this error and he said it would be corrected.

certify that you have developed and implemented the SPPP as per the conditions of the permit. This form
must be completed and returned to the Division within 30 days of receipt of this letter.

permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
The stormwater permit you are receiving, NCG140000, does not permit wasting concrete, dumping excess
concrete, directly into storm sewer outfalls or into waters of the state. Any facility which either dumps excess
concrete or washes excess concrete into storm sewers or waters of the state will be operating in direct violation to
both the terms of this permit and the North Carolina General Statutes. Such a discharge shall be considered an
illegal discharge and may subject the owner to enforcement actions in accordance with North Carolina General
Statutes 143-215.6A
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to request an individual permit by submitting an individual permit application. Unless
such demand is made, this certificate of coverage shall be final and binding.
