This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except upon approval of the Division of Energy, Mineral, and Land Resources. The Division of Energy, Mineral, and Land Resources may require modification or revocation and reissuance of the certificate of coverage. Coverage under this General Permit is granted with the condition that the permittee performs additional sampling requirements as outlined in the amended conditions to the COC. This COC requires you to sample each SDO semi-annually for total suspended solids (TSS), non -polar oil & grease (O&G), fecal coliform, chemical oxygen demand (COD), copper (Cu), zinc (Zn), and pH. Benchmarks are specified where applicable, and you must follow Tiered Response actions in the event of a benchmark exceedance as specified in the General Permit (Part 11, p. 7 of 9). Please note that monitoring at your site is required and not triggered only by on -site vehicle maintenance activities or a certain amount of gallons of motor oil/hydraulic oil used per month, as it is for other permittees under NCG130000, The parameters include metals and other constituents which may be present in the discharge from this site, based on sampling and recommendations by Charlotte -Mecklenburg Storm Water Services. The Division will consider the data upon renewal of coverage under this General Permit to determine if coverage under a different General Permit or an individual permit is more appropriate. Amended conditions 1. This Certificate of Coverage is an enforceable part of the permit. 2. A copy of the DEMLR letter granting ROS must be kept on site. DEMLR's ROS letter remains in effect through the subsequent reissuance of this permit and as long as the pertinent site conditions and operations remain unchanged, unless the ROS letter provides for other conditions or duration. 4 For each sampled measureable storm event the total precipitation must be recorded from an on -site rain gauge. (Where isolated sites are unmanned for extended periods, a local rain gauge reading may be substituted for an on -site gauge, upon prior DEMLR written approval.) 5 The permittee shall compare monitoring results to the benchmark values. Exceedances of the benchmarks require the permittee to increase monitoring, increase management actions, increase record keeping, and/or install stormwater best management practices (BMPs) in accordance with the Tiered Response actions outlined in Part 11, p. 7 of 9 in the General Permit (Tier One, Tier Two, and Tier Three). The pH values should be within the range of 6.0-9.0 S.U. and must be measured in the field in accordance with NPDES test procedure requirements in 40 CFR §136 (See Part III, Section D of the General Permit). This certificate of coverage shall become effective September 30, 2016. This Certificate of Coverage shall remain in effect for the duration of the General Permit. This is an NOI from Queen City Transfer Station in Charlotte for coverage under the NCG130000 General Permit. This is the site that Char -heck Storm Water Services had sampled and contacted us about. We worked with them to send a letter directing them to apply for a stormwater permit. It hasn't been NC's usual practice to include Municipal Transfer Stations in the stormwater program, but the activity could be considered a sub -category of 5093 (some states do consider waste transfer stations included in that SIC), and analytical sampling demonstrated a potential problem with this particular site. Attached is the NOI and�the correspondence we sent them in July after working with Chad Broadway in Charlotte on the action to take. Is Mooresville Regional Office okay if we move ahead with issuing this COC? I can issue it as soon as tomorrow, or I'll be glad to hold it until your staff have had a chance to look it over if you prefer. Let us know if MRO has any questions or concerns. VAN DER VAART Sri MY TRACY DAVIS Subject: NPDES Stormwater Permit Requirement Queen City Transfer Station - Charlotte, NC Mecklenburg County Dear Mr. Bouck: As you are aware from previous correspondence, stormwater runoff from the subject facility located at 3130 Jeff Adams Drive in Charlotte, North Carolina has been sampled by Charlotte -Mecklenburg Storm Water Services (CMSWS) on multiple occasions during the previous four years. The monitoring was conducted by local officials with CMSWS under authority granted by Charlotte City Code Chapter 18, Section 18-82. The monitoring was also conducted as part of a cooperative working agreement between Mecklenburg County and the North Carolina Department of Environmental Quality (NCDEQ) - Division of Energy, Mineral and Land Resources (DEMLR). Monitoring events conducted on October 27, 2015 and June 6, 2012 indicate runoff from your facility significantly exceeds the North Carolina Water Quality Standards for Fecal Coliform, Turbidity, Copper, Zinc, and Biochemical Oxygen Demand (BOD). Since the stormwater sample was not collected from the stream, the stream standards do not necessarily apply; however, these standards can be used to indicate the potential of polluted runoff from the facility to impact the receiving stream. NCDEQ has evaluated results from these two monitoring events, along with findings from inspections conducted by CMSWS on March 10, 2016, March 26, 2015, and February 27, 2014, and determined that stormwater runoff from your facility has a persistent, high potential to pollute surface waters. Based on this high potential to pollute surface water and the nature of operations at the subject facility, NCDEQ is requiring your facility to obtain a stormwater discharge permit under the National Pollutant Discharge Elimination System (NPDES) program. This action is consistent with the authority available to us in the NPDES federal rules at 40 CFR §122.26(a)(9)(i)(D) and §122.26(a)(9)(iii) to address significant contributors of pollutants to surface waters, and consistent with the practice by some states to view transfer stations as scrap and/or waste recycling facilities that are subject to permitting. Although your operation may not routinely fall in this permit category, industrial activities at this facility are deemed to be similar in nature and your facility is being designated for permit coverage.
