In accordance with your application for a discharge permit received on July 18, 2016, we are forwarding
herewith the subject certificate of coverage to discharge stormwater under the subject state — NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-
215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection
Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the Division of
Energy, Mineral, and Land Resources. The Division may require modification or revocation and
reissuance of the certificate of coverage. Also note, as stated in Part II Section A of the permit, the
permittee shall develop and implement a Stormwater Pollution Prevention Plan (SPPP).
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Energy, Mining, and Land Resources, or permits required by the Division of Water
Resources, Coastal Area Management Act, or any other federal or local governmental permit that may be
required.

Thanks for communicating with Chad & Craig. I will include verbiage about a SWPP, and also highlight that the permit
is only for discharge of stormwater and other discharges (leachate or other waste) are not permitted.

Comments from Chad Broadway
Hi Zahid,
They definitely have an area of concentrated flow that constitutes an outfall at the front of the site, it was
previously located directly beside the facility entrance and then shifted slightly south when they did some
site work. There is likely an outfall at the rear of the facility as well, but it's been difficult to fully evaluate
due to the amount of materials stored in that area. If they have a SWPPP, it's news to me. The owner
has never presented one and i think it's unlikely they've gone above and beyond to create one when it
wasn't previously required.
I would agree with Craig that a permit be issued, as this is a first good step, but I would like to voice my
concerns that their operations involve material storage and processing in outdoor areas that leads to
excessive stormwater contamination and a high potential for the discharge of wastewater in the form of
leachate.
Aside from what you and I talked about on the phone yesterday regarding the company's corporate filing
being expired/inactive with the Secretary of State, I don't have any further concerns. Thanks again for
your involvement with this.

Comments from Craig Miller
Hi Zahid,
The facility drains to an unnamed tributary to Little Sugar Creek and SIC code is 5093. Other BMPs used
include some processing (sorting & baling) conducted indoors and containment of ice melt to prevent
runoff of the ice melt from mixing with materials stored outside. She said they have a SWPPP, but I doubt
that's correct. Chad, can you verify? According to Chad's inspection report and from what I remember
being on site, they have 2 outfalls, one at the front that discharges to the MS4 on N. Graham St and the
other at the northeast (rear) corner of the property into a partially vegetated area and eventually enters
the M54 on Concordia Ave. Neither outfall is well-defined (no pipe, etc.), but there are low points where
a majority of stormwater discharges.
l recommend that the permit be issued.
