we are forwarding herewith the subject certificate of coverage (COC) to discharge under the subject
state - NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to request an individual permit by submitting an
individual permit application. Unless such demand is made, this certificate of coverage shall be
final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Energy, Mineral and Land Resources (Division). The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not
affect the legal requirements to obtain other permits which may be required by the Division or
permits required by the Division of Water Resources, Coastal Area Management Act or any other
federal, state or local governmental permit that may be required.

Please review the attached NOI application with the objective of responding to me with a recommendation to issue the
permit. I recognize that you may not visit each new permittee during this NOI review, but it affords you the opportunity
to log the permit into your regional database and add the facility to a future monitoring and compliance visit schedule.
Therefore, your recommendation now to issue the permit serves as your acknowledgement that (1) the, facility is located
in your region, (2) that there are no current complaints outstanding about the facility that have not been dealt with, and
(3) that the facility may ultimately be inspected by the regional staff. I've also attached a scanned copy of the NOI and a
location map for your review.

Hi Donna,
1 concur that NCG13 seems approprrote.
I agree that this seems very like the shingle recycler, even if it is our first time for this exact business. This is apparently a
specialized business cleaning roofs in preparation for rebuilding or refurbishing them. They have been in Charlotte since
1983, according to their website. Between the aerial photo that I interpret as indicating no formal organization of
materials on the site, and Mr. Martin referring to the recycle operation as a 'new venture', it looks like the recycling is a
new aspect of their business. I assume they disposed of the previous cleaned off materials in other ways since 1983.
Analysis by following the material from the job site:
At the iob site, i.e. at the roof: They apparently use a dry vacuum or pressurized water stream plus vacuum to
loosen and remove some/all gravel from tar and gravel roofs; they remove ballast and the rubber membrane
from rubber -membrane roofs; they probably remove asphalt impregnated felts from felt roofs (although I only
could identify rubber membranes in Erin's photos.) This part is in the nature of a construction service business,
and is not an NPDES manufacturing activity. No stormwater permit required, so far.
• Over the road transportation: Not an NPDES activity as far as the hauling of the materials over the road from
the job site. No industrial NPDES permit is required for hauling along highways.
At the depot / home office:
o This is probably not a haz materials TSD facility - - not captured by NPDES, no permit required, so far;
o This is not a solid waste disposal facility, nor is it like a solid waste transfer station, where materials are
temporarily stored on their way to disposal. (Note however, that Mr. Martin reports that current
industry practice is for this material to go into landfills, a clear indication that the material is a solid
waste.) This activity would not be captured by NPDES on the basis of being a TSD facility; and solid
waste transfer stations are not captured by NPDES, either.
o But, they are taking solid waste, segregating it (rubber membranes separate from gravel), and
wholesaling it to customers for recycling into their products. Presumably either as rubber stock, or
various grades of gravel. There may be other specialized distinctions that we are not aware of, like
whether the gravel was previously loose ballast, or what size it is, or whether it was embedded in
tar/asphalt and so may contain some residual petroleum contaminants. This sure seems like recycling
per 40 CFR 122.26(b)(14)(vi), and the SIC code 5093 (Scrap and Waste Materials) referenced therein.
NCG13 only requires an SPPP, and visual monitoring, and does not require testing the runoff, except if vehicle
maintenance areas are present. I'd suggest that one path forward would be to issue coverage under NCG13, and
follow up with an inspection to be sure this operator is acting responsibly based on his visual observations and
his SPPP. If we subsequently discover that this approach has not been successful in controlling the discharges
from his site, we could move him into an individual permit that addresses any concerns we might have. [KBP
background perspective: I am not too far from Mr. Martin's comment that the material on his site came from
fully exposed roofs, and would be not too different from them in pollution generation when they are on his
site. We don't worry about asphalt roads generating petroleum discharges.]
My only contrary thought is that his problems in Naples, Florida, originated with one of his vacuum truck drivers
discharging the pressure water slurry into a storm drain. Very bad. And, I presume they won't repeat that
incident. I think we could alert Mr. Martin that our determination to cover him under NCG13 (no monitoring)
could be influenced by whether or not it appears that he has robustly protective procedures in place at the
home office/depot for the handling of return slurries from the job sites.) If we aren't convinced, then perhaps
an individual permit with analytical testing would be more in order.
[KBP personal opinion: This is a new service offered by this company in NC, and it is an environmentally beneficial
service. They are to be appreciated on that count. However, I'm disappointed in Mr. Martin's answer to Erin Hall's
questions. He could have said, "We are aware that there maybe potential for petroleum contaminated discharges from
the materials we have on site, and we are taking measures to mitigate any polluted discharges. We actually did have an
egregious discharge of concentrated pollutants into Naples Bay, and were fined $5000 for it in 2011. But now we know
the risk, and are taking measures to be responsible environmental citizens as we lead the way in revolutionizing our
industry."
But instead, he said, "We do not expect any environmental concerns or excessive stormwater discharges as the material
that is openly stored is already on commercial roofs facilitating the some type of water runoff." This denial is a
disappointing approach to corporate risk control, after such a promising beginning circumstance. Oh well.]

Hey Donna,
met with Chad Martin and Ron Shafer (R. K. Hydro -Vac). I put together a quick overall snapshot of the site that is
attached as the .pdf. I also have three photos attached that shows the materials onsite, which consist of gravel and the
rubber sheeting material that is found on commercial and industrial roofs.
Regarding the attached .pdf, I indicated the high point (topographically) on the property and marked where I would say
was their outfalls. Outfall (1) only collects stormwater from the employee/vehicle parking areas (no industrial activities).
The stormwater from the other side discharges from the outdoor material storage area through a grassy area then
converges at an open channel ditch that discharges into a trib. of Paw Creek.
They couldn't find any business license paperwork, etc. that indicated their SIC. They still feel that 422699 is the best fit.
Based on all of this information, should I have them go ahead and submit an NOI for NCG13? I told them I would contact
you then let them know.

I went to a facility that recycles shingles a few weeks ago. They fell under the wholesale non-metal recycle permit,
NCG13 and it looks as though RK Hydro does as well. There should be an SIC number on the form they submitted to
obtain a federal EIN (Employer Identification Number) tax number.

recycle'. Can you get their Standard Industrial Classification (SIC) code? That will be a major determining factor and the
first step. They should know what their SIC code is. Theoretically. O
I would love to come to the inspection, but I am not sure what time you have it scheduled. My middle son is getting his
braces the afternoon of the 1P, so I would need to leave by 11:30 am.

it was overlooked during the inspection as an outfall as Ron's report indicates stormwater discharges as sheet flow and
no outfalls were present.) Looking at aerial photos, there does appear to be a drainage ditch on their property.
Here is an email exchange between Mr. Martin and l regarding industrial activities, storage, etc. His response is in red:
Would you mind emailing me a quick overview of: what your company does (industrial activity); how the material is
stored (on pavement, gravel, container; uncovered/covered); is material exposed to stormwater runoff, how long
material is stored onsite; estimated quantity that may be stored at any given time, etc.; and how stormwater discharges
from your site (pipe, open channel ditch, etc.)?
Our current operation, R.K. Hydro -Vac, Inc. (www.rkhydrovac.com), is the industry leader for commercial roof
vacuuming services. We provide rock & gravel removal from commercial flat roofs as a service to local roofing
contractors. Leveraging our position in the marketplace and already being on a majority of the commercial flat roofs in
the area, our new venture will be setup as a container service, recycling the roofing materials that are currently being
landfilled as a result of normalized industry practices. At full operational capacity, we fully expect to revolutionize the
industry by being able to divert hundreds of thousands of tons of material from landfills each year. The material will be
placed into a container from the roofs and transported back to R.K.'s facility being dumped onsite on to a gravel ground
surface. The material will be stored approximately 2-6 months before it is shipped off to the reprocessing centers and
as -is offtake customers requiring the new commodity product. At any given time, there will be several dozen tons of
material stored in piles on R.K. facility and any resulting stormwater discharges will runoff through the natural grade and
open ditches on the R.K. property. We do not expect any environmental concerns or excessive stormwater discharges
as the material that is openly stored is already on commercial roofs facilitating the same type of water runoff.
have also attached two MS Word documents that Mr. Martin emailed to me. In his email regarding these two
documents he states they are the compiled chemical & physical data specifications of the original roofing material that
they (RK Hydro -Vac) are collecting and storing onsite. Currently I am scheduled to meet with him and Ron Schafer
(President) to do a site evaluation on Dec. 111h at 10:00 a.m. I won't be completing an inspection report for this (unless I
feel it's necessary after the visit).
A few things: 1. If by the information I've provided you feel they would need to apply for a stormwater permit, then I
don't think I would need to conduct a site visit since we inspected them in 2012; 2. If you think a site visit is necessary to
properly figure out if they need a permit and you would like to go along on Dec. 11`h, then please let me know; or 3. 1
can conduct the site visit and report back to you on what I find.
