On June 15, 2010, Dave Parnell of the Raleigh Regional Office, conducted two stormwater inspections
at the referenced facilities for the above referenced permits. The assistance of Mr. John Brown was
essential and was appreciated. See the attached inspection reports. Please note, this letter is structured
to give guidance for required activities:
NCG13056 South Wake C&D Transfer Station
This NCG130000 permit was issued on June 12, 2009 and will expire on May 31, 2013. The one
year grace period to implement the requirements of the permit expired on June 12, 2010. A
Stormwater Pollution Prevention Plant (SP3) was produced during the inspection for my review.
All required aspects of the SP3 are being met by this facility. The record of qualitative monitoring
was also reviewed during my inspection and found to be in compliance of your permit.
However; as we discussed there appears to be a need for a third Stormwater Discharge Outfall
(SDO) for the excess container storage yard. This area appears to lie outside of the drainage areas
of the two existing SDO. Please update the site map to include all required SDO as Mr. Brown
and I discussed during the inspeciton.
NCG 13057 Capitol Waste C&D Transfer Station
This NCG130000 permit was issued on August 17, 2009 and will expire on May')], 2013. The one
year grace period for implementation of the requirements of the permit expire on August 17, 2010.
A SP3 was produced and reviewed during the inspection.
The following issues are required to be addressed prior to August 17.
1. Provide a detailed site plan which includes the two current SDO and the proposed SDO(s) that
would be monitored for the driveway and the excess container storage areas.

2. Develop and implement a plan to provide adequate secondary containment for bulk storage of
regulated liquid materials. See Part 11, Section A, 2. (b) of the NCG130000 Stormwater permit
for guidance.
3. Determine the amount of motor oil (in gallons) used per month for vehicle maintenance activity
and report to the stormwater permitting unit of DWQ, if the amount exceeds 55 gallons. If the
amount of motor oil used exceeds 55 gallons per month when averaged over the calendar year,
this facility is required to perform analytical monitoring as required in Table 3 in Part II,
Section C of the NCG130000 permit.
The record of qualitative monitoring (for one SDO) was reviewed and, as discussed, would need to
be expanded to include the three or four total SDO that are yet to be determined for this site.
Please provide a written response to this letter, including a schedule with dates for completion, within
30 days of the receipt of this letter. Address the facility's compliance efforts with respect to the bold
item contained in the section of the letter pertaining to NCG13056. Also, be advised of the items
contained in the section pertaining to NCG 13057, which are required to be implemented by August
17, 2010. If you have any questions about the permits, record keeping requirements, or other issues,

The facility drains to a UT to Williams Creek (class WS-111; NSW) in Apex (Wake County). No vehicle maintenance or haz
waste. I have a note from Ken that you have already been to this facility. Does the RRO have any concerns about
issuing this facility a COC for this general permit?

In accordance with your application for a discharge permit received on March 23, 2009, we
are forwarding herewith the subject certificate of coverage to discharge under the subject state --
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage.
Per the requirements of the Neuse Riparian Buffer Rule, all stormwater drainage from
portions of this site that have been constructed after July 22, 1997 must be discharged through a
correctly designed level spreader or another device that meets diffuse flow requirements per 15A
N6AC12B .0233. Diffuse flow requirements are described in Chapter 8 of the North Carolina
Stormwatcr BMP Manual, available at: http://h2o.enr.state.nc.us/sLi/bmp forms.htm.

Richardson Smith Gardner & Associates. Inc. (RSG), on behalf of our client. Shotwell Transfer
Station 11, Inc., is submitting this Notice of Intent (NOI) pursuant to the letter dated March 5,
2009 (copy attached) from Mr. Danny Smith of the Division of Water Quality. The above -
referenced letter indicated that the CRD transfer station located at 1506 '/ N. Salem Street in
Apex, North Carolina is operating; without a stor-lttwater permit. The letter requested that a NOI
under General Permit No. 130000 be submitted for this facility by April 6, 2009.

It has come to the attention of the North Carolina Division of Water Quality that Shotwell Transfer Station 2, Inc. has
not obtained a Stormwater Permit for the site at 1506 N. Salem Street, Apex, NC. Judy Garrett of this offif* visited
the site on February 12, 2009. It was noted that this facility is a C&D Transfer Station with uncovered staging areas
where waste materials are sorted and either recycled or transported to a C&D Landfill.
General Permit No. NCG130000 is required for all owners or operators of stormwater point source discharges
associated with activities classified as establishments primarily engaged in : the wholesale trade of non -medal waste
and scrap(hereafter referred to as the non-metal waste recycling industry, a portion of standard industrial claseif(cation
(SIC)5093),, and like activities deemed by DWQ to be similar in process and/or the exposure of raw Faterials
products, byproducts or waste materials. Operation of this facility without a permit is a violation of NCGS 143-
215.1(a}(1).
Please also note that all C&D Landfills are required to obtain coverage under General Permit No. NCG120001.
Enclosed are application forms, also called a Notices of Intent for Coverage under these permits. Please return these
forms with the application fee by April 6, 2009 to:

It has come to the attention of the North Carolina Division of Water Quality that Shotwell Transfer Station 2; Inc. has
not obtained a Stormwater Permit for the site at 1 SW N. Salem Street, Apex, NC. Judy Garrett of this offitpe visited
the site on February 12, 2009. It was noted that this facility is a C&D Transfer Station with uncovered staging areas
where waste materials are sorted and either recycled or transported to a C&D Landfill.
General Permit No. NCG130000 is required for all owners or operators of stormwater point source discharges
associated with activities classified as establishments primarily engaged in : the wholesale trade of non -mewl waste
and scrap(hereafter referred to as the non-metal waste recycling industry, a portion of standard industrial classification
(SIC)5093); and like activities deemed by DWQ to be similar in process and/or the exposure of raw materials
products, byproducts or waste materials. Operation of this facility without a permit is a violation of NCGS 143-
215.1(a)(1).
Please also note that all C&D Landfills are required to obtain coverage under General Permit No. NCG120007.
Enclosed are application forms, also called a Notices of Intent for Coverage under these permits. Please return these
forms with the application fee by April 6, 2009 to:
