requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between
the state of North Carolina and the U.S. Environmental Protection Agency, dated October t 5, 2007 (or as
subsequently amended.)

The General Permit authorizes discharges of stormwater only, and it specifies your obligations with
respect to stormwater discharge controls, management, monitoring, and record keeping. Please review
the new permit to familiarize yourself with all changes in the reissued permit. Significant changes to the
General Permit are outlined in the attached Technical Bulletin.
Your coverage under the General Permit is transferable only through the specific action of DWQ.
This permit does not affect the legal requirements to obtain other permits which may be required by
DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Enclosed please find a copy of the Compliance Evaluation Inspection for the visit conducted at the subject
facility on July 19, 2011 by Ms. Donna Hood of this Office.
As discussed during the inspection, this facility has three iNlIDLS stormwater permits. The predominate
business at the facility usually determines the type of stormwater permit required for the site. At the Poplar Tent
Road site, the predominate business was determined to be the `wholesale trade of non-metal waste' category,
NPDES general. stormwater permit NCG 130000. This Office is in receipt of the request to rescind NPDES permit
NTCG020297, which was issued for the mine at the same site, that has been closed since 1999. The NPDES
NCG120077 is being rescinded per a letter issued from the Division of Water Quality on September 2, 2005
(enclosed) stating the change in coverage to the NPDES NG 130000. While NCG 130040 is the applicable permit, it
is currently cxpi.red dLiC to lack of submittal of a new Notice of lntcrit (NOT) with the annual fee. Upon submitting
the annual fee, please also submit anew NOT for continued coverage under the NCG 130040 permit. A new NOI
should always accompany the annual fees.

At the time of the inspection, two other industrial stormwater permits were in existence for the same facility. They are as
follows: 1. NCG020297/mining permit 2. NCG12007711andfill permit. A letter had been issued by the Division of Water
Quality in September 2, 2005 changing the landfill permit to the current permit NCG130040. While the facility still
performs some landfill activities, it is not the predominant activity at the facility. For the mining permit, the facility ceased
mining and received a closure letter from the Division of Land Resources in 1999. The facility has requested rescission of
the NCG020297 permit,
The active non-metal scrap permit, NCG130040, needs to have a new Notice of Intent (NOI) sent in when the annual fees
are paid this year. Please be advised that a new N01 must be submitted every year with the fees. This should be the
only applicable industrial stormwater permit for this site at this time.
OUTFALM
Outfalls 001, 002, 003, and 004 were observed during the inspection. Outfall 005 (at the creek) was not observed due to
its locale as well as similarity to Outfall 004. Outfall 001 has continuous discharge to Coddle Creek as well as the bulk of
the industrial activity. Outfall 002 has flow from groundwater only and no contributions from the industrial process on site.
Outfall 003 has been re -rerouted into the pond which discharges to Outfall 001 and is therefore an internal outfall only.
Outfall 004 and 005 receive flow from graveled parking areas and have several hundred feet of sheet flow before reaching
the receiving stream. No negative impacts to the receiving stream were observed at the time of the inspection. Monitoring
Outfal4 002 could cease because no industrial activity discharges to it. Monitoring should cease at Outfall 003 because it
is an internal outfall. The facility could move the monitoring of Outfall 004 and Outfall 005 closer to the parking areas to
observe the site's actual stormwater contribution if desired. Qualitative monitoring should occur during a representative
storm event. If during that storm event an outfall does not discharge, please record "No Discharge" on the associated
qualitative monitoring form. While periodical monitoring of outfalls is expected, said monitoring should never infringe on
the safety of any person doing the monitoring. (i.e. at nightlin the dark and/or extreme storm events)
During the inspection an area for the washout of trucks was observed. At this time, no permit is needed for the operation
and discharge of the washwater entering the oillwater seperator.(Division letter enclosed) However, the oil/water
seperater should have regular preventive maintenance performed to ensure its proper operation.

subject state — NPDES general permit. This pern-iit is issued pursuant to the requircinents of

Enclosed is a copy of the Compliance Evaluation Inspection Report for the Stormwater
inspection conducted at the subject facility on May 21, 2008 by Mr. Wes Bell of this Office.
This report is being issued as a Notice of� Violation (NOV) due to the facility's failure to
develop and implement a Stormwater Pollution Prevention Plan -which are violations of the
subject Stormwater Permit and North Carolina General Statute (G.S.) 143-215.1, as detailed in
the Stormwater Pollution Prevention Plan/Summary, Qualitative Monitoring, and
Analytical Monitoring Sections of the attached report. Pursuant to G.S. 143-215.6A, a civil
penalty of not more than twenty-five thousand dollars ($25,000.00) per violation, per day, may
be assessed against any person who violates or fails to act in accordance with the terms;
conditions, or requirements of any permit issued pursuant to G.S. 143-215.1.
It is requested that a written response be submitted to this Office by .tune 17. 2008,
addressing the above -noted violations in the attached report. In responding to the violations,
please address your comments to the attention of Mrs. Marcia Allocco.

Inspection Summary:
STORMWATER POLLUTION PREVENTION PLAN SECTION cont'd:
Several oil stains on the ground were observed adjacent to the used motor oil storage tanks adjacent to the vehicle
maintenance building. In addition, leakages were observed from the secondary containment structures and sections of
the structure's walls had shifted at the joints. All secondary containment structures must be repaired to ensure all liquids
(including stormwater) are properly contained. All soillgravel contaminated with oil shall be properly cleaned up and
disposed. Please be advised that pursuant to G.S. 143-215.88A, any person who intentionally or negligently discharges
oil or other hazardous substances, or knowlingly causes or permits the discharge of oil in violation of G.S. 143-215.83(a),
or who fails to report a discharge as required by G.S. 143-215.85(b), or who fails to comply with the cleanup requirements
of G.S. 143-215.84(a), shall incur, in addition to any other penalty provided by law, a penalty not to exceed five thousand
dollars ($5,000.00) for each such violation.
The facility should also incorporate the following as part of the implementation of the preventive maintenance/good
housekeeping component of the SPPP:
- a cover for the dumpster at the vehicle maintenance area.
- measures to control the amount of sediment runoff during stormwater events".
- guidance to the mechanics regarding the proper application and removal of "oil dry".
Note: * denotes that these measures should be emphasized due to turbidity being one of the listed factors to the
impairment designation of the receiving stream (Coddle Creek).

developed in July 2006. The SPPP did not contain/document: site map with listed

discharges, and facility site inspections (twice per year). In addition, the SPPP had not

Comment: The facility is subject to the analytical monitoring requirements for vehcile
maintenance at one designated stormwater outfail (pond). No analytical monitoring had
been performed in 2007. The General Manager indicated that analytical samples were
collected in 2006; however, no documention was available for review. Please be
advised that all documentation related to the Stormwater Permit must be kept for a
period of five years.

In accordance with your application for a discharge permit received on October 22, 2004
we are forwarding herewith the subject certificate of coverage (COC) to discharge under the
subject state —NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).
The permit previously held by US Tire Recycling, NCG120077, is rescinded immediately
upon issuance of this new Certificate of Coverage for the NCG 130000 general stormwater
permit.
If any parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to request an individual permit by submitting an
individual permit application. Unless such demand is made, this certificate of coverage shall be
final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage. This permit does not affect the legal

is hereby authorized to discharge stormwater from a facility located at
US Tire Recycling
6322 Poplar Tent Road
Concord
Cabarrus County
to receiving waters designated as an unnamed tributary to Coddle Creek, a class C stream in the Yadkin River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts 1, II, III,
IV, V and VI of General Permit No. NCGi30000 as attached.
This Certificate of Coverage shall become effective September 2, 2005.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
