On behalf of Johnston County, Smith Gardner Inc. (S+G) has prepared this official notification
to the Division of Energy, Minerals and Land Resources (DEMLR) - Stormwater Permitting
Program to inform you that the Johnston County Landfill (COC#NCG120087) has entered Tier
3 status due to four (4) exceedances over the TSS benchmark value at SDO 4A-5A, during this
permit term.
CURRENT NPOES PERMIT STATUS
As you are aware, Representative Outfall Status (ROS) was granted' for the site in August
2014 following a stormwater records review and site visit by the DEMLR-Stormwater
permitting program. Since the current permit was issued (November 2012), the Johnston
County Landfill has conducted qualitative monitoring at SDO 4A-5A ten (10) times (as shown
in the table below). Please note that SDO 4A-5A is has not been in Tier 2 status for TSS prior
to the last sampling event (February 2015), when this outfall went into Tier 2 and Tier 3
status simultaneously for TSS.

ON -GOING SITE IMPROVEMENT STATUS
SDO 4A-5A has a drainage area that encompasses the area of a significant portion of the
active operations at the landfill. Daily cover and other exposed soils in this area are a
necessity for daily operations at the facility. Several best management practices have been
utilized in this area in accordance with the approved erosion and sediment control plan.
F Below is a list of site practices that are in use to minimize TSS levels at this SDO:
` • Stabilization of outer landfill slopes draining to basin (in addition to grass, wood chips
have been used frequently);
• Use of slope drains;
Installation of rip -rap channels in high flow areas;
Installation of check -dams and filter berms;
Placement of coir-fiber wattles in channels; and
Regular maintenance of Basin 5A (including removal of sediment from basin and
replacement of stone surrounding the riser structure).
PLANNED ADDITIONAL MEASURES
At this time, Johnston County is prepared to continue the above BMPs that have shown to
reduce TSS in most conditions. In addition to these_ items, Johnston County plans to move
this sampling location (SDO 4A-5A) approximately 700 feet toward the property tine where
the stormwater from this basin actually Leaves -the property.
Johnston County will monitor this outfall monthly until three (3) consecutive events
measuring under the TSS thresholds have.been confirmed.

On August 14„ 2014, Dave Parnell of the.Raleigh Regional Office (RRO), Division of Energy,
Minerals and Land Quality (DEMLR), conducted a Compliance Evaluation Inspection (CEI) in
order to address the possibility of this facility being granted Representative Outfall Status (ROS).
As described in your application, there are currently twelve Stormwater Discharge Outfalls (SDO) ,
with all. discharging to drainage features which ultimately discharge to the Neuse River.
During the site visit, it was noted that you have a clear understanding of the requirements of the
NCG120000 permit and are currently monitoring all of the outfalls as required. An evaluation of
each of the subject SDO was conducted and sampling techniques at each SDO were agreed upon.
After reviewing sample results and outfall locations, it is understandable that the similarities among
some outfalls would allow for ROS designations.
Therefore; it is determined that the following outfalls can be representative of other outfalls at this
time:

SDO #4A-5A represents the drainage area with the highest potential pollutant exposure originating
from the active landfill activity + vehicle traffic. SDO # 4A-5A will be representative for SDO # 1,
4A-2, 4A-3, 4A-4, 4A-6, 5-1, 5-2, and 5-3. The drainage area for this ROS is approximately 26.1
Acres.
SDO #B represents a drainage area with potential pollutant exposure originating from yard waste
processing + vehicle traffic. -SDO #B will be representative for SDO # C.- The drainage area for
this ROS is approximately 12.3 Acres.
SDO # A represents a drainage area with potential pollutant exposure resulting from vehicular
maintenance/ storage of petroleum . There will be no change to this SDO or Drainage Area.
Continue all monitoring as required by your NPDES permit.
Analytical sampling is required at the frequency and for the parameters set forth in the permit for
each specific outfall.
In the event that topography and activities change at the facility, the above approval of the
representative outfall may be revisited/re-opened by the Division of Energy, Mineral and Land
Quality. Sampling is required if new outfalls are added or if outfall locations are changed. In
addition, after further analytical data is obtained from these locations, DEMLR may revisit the
request for representative outfall status.
Please note that the representative outfall designation is only for analytical monitoring
requirements of the General Stornnwater Permit. The qualitative monitoring requirements are
still effective for all stormwater outfalls.

Comment: This inspection was a result of ROS request. Sample data was reviewed for each outfall and
geographic data was reviewed prior to the inspection. The inspection included the drainage
areas for the proposed ROS, secondary containement and other adjacent outfalls. A change in
the ROS proposal resulted in the request for another submission being sent to DENR. A

Subsequent to a meeting held today at the Johnston County Landfill, COC#120087, we are resubmitting to you this
request for representative outfall status.
The above mentioned site meeting was attended by Mr. Dave Parnell (NCDENR), Mr. Rick Proctor (Johnston County), Mr.
Kevin Shields (Johnston County), and Mr. Don Misenheimer (S+G). A historical data review and visual inspection of
outfalls was performed, and after which, all parties determined that the County would benefit from resubmitting the
Representative Outfall request. This resubmittal requests to further reduce the number of requested Representative
Outfalls from four (4) to three (3), as described in the attached request letter.

On June 12, 2013, Mitch Hayes of the Raleigh Regional Office conducted the subject inspection.
Everyone's assistance with this inspection was greatly appreciated. Below is a list of findings and
recommendations developed from the inspection:
1. The subject permit was reissued and became effective November 01, 2012 and will expire October
31, 2017. Request for permit renewal is required 180 days prior to permit expiration date.
2. Facility is compliant with the sediment and erosion control plan. All aspects of the SWPPP are being
maintained. The oil water separator installed in the vehicle maintenance area is pumped out and
disposed by Noble Oil as needed.
3. The facility contains 12 distinct stormwater discharge outfalis. At the present, the facility is Tier One
for fecal coliform at SDO A, and Tier Two for sediment at SDO 4A-6. Inspection SDO A does not
reveal a source of fecal coliform. Staff noted that ducks regularly perch on top of the overflow filter.
Inspection of SDO 4A-5 and 4A-6 are located at the bottom of an active landfill. Due to recent
excessive rainfall within the last 3 days, both of sediment basins priorto the discharge outfall were in
need of cleaning. Work was expected to begin the next day. Both of the SDO's were discharging
milky brown water. All other SDO outfalls were discharging clear water.

Inspection Summary:

In response to your renewal application for continued coverage under Stormwater General Permit NCG120000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG120000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of Stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/weblwq/ws/sulcurrent-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are

to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D. Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

On July 17, 2012, Dave Parnell of the Raleigh Regional Office (RRO) observed the landfill site,
with you and Mr. Rick Proctor of the Johnston County staff. The purpose of this site visit was to
evaluate the facility's request for Representative Outfall Status (ROS).
In a correspondence dated June 14, 2012, you proposed combining twelve existing outfalls into
four ROS designations. The reasons cited were that the 4 ROS would be contiguous and similar
in activity to the existing outfalls. One of the outfalls (SDO-A) is strictly for vehicle
maintenance activity area and is not represent other land uses.
The site, visit and subsequent sample data review revealed only one sample event has been
collected by Johnston County. Accordingly, we are not approving your request for
Representative Outfall Status at this time. Please proceed with the required monitoring for
Year 5, Period 2 monitoring schedule, as required by your permit. Once you have secured this
data (one additioan sample event), please submit these results to the attention of Dave Parnell at
the Raleigh Regional Office for review. After this analytical data is obtained from all locations,
DWQ will revisit your request.
The RRO commends you on your proposal and manner by which similar outfalls are propose
for combining. For example, in your proposal you selected outfalls that capture stormwater from
active cells that had bench mark exceedences as the designated ROS sample location. This
office looks forward to seeing the additional data and revisiting your request in short order.

On behalf of the Johnston County (the County), Richardson Smith Gardner & Associates, Inc. is
submitting this petition for representative outfall status as described in Part III, Section D of the
pen -nit guidelines for Stornwater General Permit NCG120000.
Current Outfall Status
As you are aware, the County currently is required to monitor discharge atwnine-(9) Stormwater
Discharge Outfall (SDO) locations. Due to the addition of a yard waste•processing area, two (2)
additional SDOs have been added to the monitoring network,, as seen on Figure 1 (attached).
One (1) additional SDO related to current landfill activities has also been added to the network.
Thus, a total of twelve (12) SDOs are currently in the monitoring network and wan -ant
"representative outfalls."
Industrial Activities
The County is receiving municipal solid waste (MSW),originating from residential, commercial,
and industrial sources, as well as, construction and demolition debris (C&D) wastes as permitted
under NC Solid Waste Permit No. 51-03. Stormwater runoff associated with the development of
the site has been delineated by the drainage areas,as shown on Figure I and summarized by
outfall watershed area in Table 1. Note that the County also operates a Landfill Equalization
Facility (permit attached) which includes a wastewater equalization lagoon. The watershed
area for this lagoon has been provided on Figure 1. This lagoon has no associated stormwater
discharge and is maintained and operated under permit No.- WQ0020340. No additional
industrial activities are performed in this watershed. a

Potential Pollutant Exposure
Potential sources of pollutants at the site are (1) the active landfill units, (2) vehicular traffic, (3)
vehicular maintenance, and (4) the yard waste processing area. The active landfill units are the
primary potential pollutant area as defined by the general permit. The vehicle traffic associated
with waste disposal operations are transient across the site. The vehicle maintenance associated
with County owned and maintained vehicles occur in the Landfill Maintenance Building, shown
on Figure 1. Lastly, the yard waste processing area accepts yard wastes for preparation and
delivery back to the public. As shown in Figure 1, the proposed SDO 4A-5A, SDO 5-2, SDO-A
and SDO C are representative locations which include all four (4) potential pollutant exposure
activities.
Proposed Representative Outfall
G SDO 4A-5A represents the drainage area with the highest potential pollutant exposure
originating from the active landfill activity and vehicular traffic. The County
proposes SDO 4A-5A be representative for SDO 1, 4A-2, 4A-3, 4A-4, and 4A-6.
Approximately 26.1 acres drain into Sediment Basin No. 5A (SDO 4A-5A) located
at the north end of the active Phase 4A MSW landfill unit.
O SDO 5-2 represents a drainage area with potential pollutant exposure originating from
vehicular traffic. The County proposes SDO 5-2 be representative for SDO 5-1 and
SDO 5-3. Approximately 9.1 acres drain into Sediment Basin No. 5-2 (SDO 5-2)
located on the west side of the inactive Phase 5 MSW landfill unit.

Sediment Basin No. A (SDO A) located on the southern portion of the site.

representative for SDO B. Approximately 14.2 acres drain into Sediment Basin C
(SDO C) located on the southeastern corner of the site.

have the right to request an adjudicatory hearing upon written request within 30 days following
receipt of this permit. This request must be in the form of a written petition, conforming to
Chapter 150B of North Carolina General Statutes, and filed with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless such demands are made
this permit shall be final and binding.
Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility

construction and operation of the Landfill Equalization Facility consisting of: a mechanical bar
screen rated at 8.75 mgd with a manual bypass bar screen; a I2-inch Parshall-Flume;
approximately 450 linear feet of 24—inch gravity sanitary sewer line; utilization of the existing
lined solid waste landfill basin as a wastewater equalization basin with an approximate total
volume of 5.1 million gallons (basin bottom to maximum water level with 2-feet freeboard) of
which approximately 900,000 gallons (basin effluent to high water level) will be utilized for flow
equalization; approximately 180 feet of 8-inch gravity landfill leachate sewer line; with no
increase in volume of flow into the Johnston's County's existing sewerage system, pursuant to
the application received October 25, 2007, and in conformity with the project plan,
specifications, and other supporting data subsequently filed and approved by the Department of
Environment and Natural Resources and considered a part of this permit.
This permit also grants permission for the:
continued operation of approximately 27,760 linear feet of 12-inch force chain for raw sewage
and 26,930 linear feet of 8-inch force main for waste activated sludge installed in a common
trench between the Central Johnston County Regional Wastewater Treatment Facility
(NC0030716) and the Johnston County Landfill and continued operation of a 1,340 GPM sewage
pump station with duplex submersible pumps, high-water alarm with remote telemetry, on -site
standby power, and approximately 5,400 linear feet of 12-inch force main for transmission of
wastewater from McGees Crossroads and Cleveland areas via connecting force mains directly to
the Central Johnston County Regional Wastewater Treatment Facility (NC0030716) with no

increase in volume of flow to the existing sewerage system, pursuant to the permit issued on
June 13, 2003, and in conformity with the project plan, specifications, and other supporting data
subsequently filed and approved by the Department of Environment and Natural Resources and
considered a part of this permit.
This Modified Permit shall void Permit No. WQ0020340, issued on June 13, 2003, shall
be effective from the date of issuance until rescinded, and shall be subject to the following
conditions and limitations:
This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
The wastewater collection facilities shall be properly maintained and operated at all
times. The Permittee shall maintain compliance with an individual system -wide
collection system permit for the operation and maintenance of these facilities as required
by 15A NCAC 2T .0400. If an individual permit is not required, the following
performance criteria shall be met as provided in 15A NCAC 2T .0400:
(a) The sewer system shall be effectively maintained and operated at all times to prevent
discharge to land or surface waters, and to prevent any contravention of groundwater
standards or surface water standards.
(b) A reap of the sewer system shall be developed and actively maintained.
(c) An operation and maintenance plan including pump station inspection frequency,
preventative maintenance schedule, spare parts inventory and overflow response
shall be developed and implemented.
(d) Pump stations that are not connected to a telemetry system (i.e., remote alarm
system) shall be inspected by the permittee or its representative every day (i.e.,
365 days per year). Pump stations that are connected to a telemetry system shall
be inspected at least once per week.
(e) High -priority sewers shall be inspected by the permittee or its representative at
least once every six -months and inspections are documented.
(f) A general observation by the pern-ittee or its representative of the entire sewer
system shall be conducted at least once per year.
(g) Overflows and bypasses shall be reported to the appropriate Division regional
office in accordance with 15A NCAC 02B .0506(a), and public notice shall be
provided as required by G.S. 143-215.1C.

(h) A Grease Control Program shall be established as follows:
(i) For publicly owned collection systems, the Grease Control Program shall
include at least bi-annual distribution of educational materials for both
commercial and residential users and the legal means to require grease
interceptors for new construction and retrofit, if necessary, of grease
interceptors at existing establishments. The plan shall also include legal
means for inspections of the grease interceptors, enforcement for violators
and the legal means to control grease entering the system from other
public and private satellite sewer systems_
(ii) For privately owned collection systems, the Grease Control Program shall
include at least bi-annual distribution of grease education materials to
users of the collection system by the permittee or its representative.
(iii) Grease education materials shall be distributed more often than required in
Parts (i) and (ii) of this Subparagraph if necessary to prevent grease -
related sanitary sewer overflows.
(i) Right-of-ways and easements shall be maintained in the full easement width for
personnel and equipment accessibility.
(j) Documentation shall be kept for Subparagraphs (a) through (i) for a minimum of
three years with exception of the, map, which shall be maintained for the life of the
system.
4. The sewage and wastewater collected by this, system shall be treated in the Central Johnston
County Regional Wastewater Treatment Facility (NC0030716) existing sewerage system

6. Construction of the sewers, pump station(s) and force main shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of
wastewater to the surface waters of the State.
7. A copy of the approved plans and specifications shall be maintained on file by the Pertnittee
for the life of the wastewater collection facilities.

Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted

and partially certified, you shall retain the responsibility to track further construction
approved under the same permit, and shall provide a'final certificate of completion once the

9. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division, in accordance with North Carolina
General Statute 143-215.6A to 143-215.6C.
10. The issuance of this permit does not exempt the Permittee from complying with any and
all statutes, rules, regulations, or ordinances that may be imposed by other government
agencies (i.e., local, state, and federal) having jurisdiction, including but not limited to
applicable river buffer rules in 15A NCAC 2B .0200, soil erosion and sedimentation
control requirements in 15A NCAC Chapter 4 and under the Division's General Permit
NCG010000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200
and 15A NCAC 2H .0500.
11, The Permittee shall provide for the pump station and force main the following items:
(a) Pump Station Reliability:
(i) Pump stations, except when exempted by Subparagraph 0)(2) of 15A
NCAC 02T.0305, shall be designed with multiple pumps such that peals
flow can be pumped with the largest pump out of service.
(ii) A standby power source or pump is required at all pump stations except
for those pump stations subject to. Subparagraph 0)(2) of ISA NCAC
02T.0305. Controls shall be provided to automatically activate the
standby source and signal an alarm condition.
(iii) As an alternative to Part (ii) for pump stations with an average daily
design flow less than 15,000 gallons per day as calculated using 15A
NCAC 02T.0114, a portable power source or pumping capability may be
utilized. It shall be demonstrated to the Division that the portable source
is owned or contracted by the permittee and is compatible with the
station. If the portable power source or pump is dedicated to multiple
pump stations, an evaluation of all the pump stations' storage capacities
and the rotation schedule of the portable power source or pump, including
travel timeframes, shall be provided in the case of a multiple station power
outage.

(iv) As an alternative to Part (ii) for pump or vacuum stations connecting a
single building to an alternative sewer system, wet well storage
requirements shall be documented to provide 24-hours worth of
wastewater storage or, exceed the greatest power outage over the last three
years or the documented response time to replace a failed pump,
whichever is greater. Documentation shall be required pursuant to the
permit application.
(v) All pump stations designed for two pumps or more shall have a telemetry
system to provide remote notification of a problem condition to include
power failure and high water alarm.
(vi) High water audio and visual alarm.
(b) Pump stations shall have a permanent weatherproof sign stating the pump station
identifier, 24-hour emergency number and instructions io call in case of
emergency. Simplex pump or vacuum stations serving a single-family residence
shall have a placard or sticker placed inside the control panel with a 24-hour
emergency contact number.
(c) Screened vents for all wet wells.
(d) The public shall be restricted access to the site and equipment.
(e) Air relief valves shall be provided at all high points along force mains where the
vertical distance exceeds ten feet.
12. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
that may be required by this Division, such as the construction of additional or
replacement wastewater collection facilities.
13. The facilities shall be constructed in accordance with the requirements of the North
Carolina Sedimentation Pollution Control Act.
14. If applicable, the Operational Agreement between the Permittee and the
Environmental Management Commission is incorporated herein by reference and is
made a condition of this Permit. Noncompliance with the terms of the Operational
Agreement may subject the Permittee to an enforcement action by the Division in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C. A copy
of the Articles of Incorporation, Declarations, and Bylaws that have been properly
filed shall be submitted with the engineer's certification prior to operation.
15. Any abandoning of the existing facilities must be done in accordance with the
requirements of the Division of Water Quality's Mooresville Regional Office.

forwarding herewWi. `,he subject certificate of coverage (COC) to discharge under the subject state -- NPDES
general permit. This permit is issued -pursuant to the requirernents.of North Carolina General Statute 143-215
and the N. r _ _andum of Agreement between North Carolina and the US Environmental Protection Agency
dated October 15, 2007 (or as subsequeniily !mended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the
certificate of coverage. This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other federal or local governmental permit that may be required.

Barry and I looked over the site plan for the Johnston County Landfill last week. We see no reason not to issue the
permit. They may have some outfalls that would qualify for Representative Outfall status but that will be determined
later when I do a site visit. So, the bottom line is that the RRO recommends issuance of permit NCG120087.

Please review the attached NOI application with the objective of responding to me with a recommendation to issue the
permit. I recognize that you may not visit each new permittee during this NOI review, but it affords you the opportunity
to log the permit into your regional database and add the facility to a future monitoring and compliance visit schedule.
Therefore, your recommendation now to issue the permit serves as your acknowledgement that (1) the facility is located
in your region, (2) that there are no current complaints outstanding about the facility that have not been dealt with, and
(3) that the facility may ultimately be inspected by the regional staff. I've also attached a scanned copy of the NOI and a
location map for your review.
