On February 28, 2013, a site inspection was conducted for the Moore County C&D Landfill facility located of
Turning Leaf Way, Moore County, North Carolina. A copy of the Compliance Inspection Report is enclosed for
your review. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters
designated as an unnamed tributary to Horse Creek, a Class WS-II;HQW stream in the Lumber River Basin, The
site visit and file review revealed that the subject facility is covered by NPDES Stormwater General Permit-
NCG120000, Certificate of Coverage-NCG120084.
As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG120000
permit. Please refer to the enclosed Compliance inspection Report for additional comments and observations
made during the inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty
assessment of up to $25,000 per day for each violation. If you or your staff has any questions, comments, or

Inspection Summary:
The facility uses a single wall tank to store used motor oil in at this time. They are currently working with their engineer to
replace this tank with a double walled tank.
Qualitative monitoring was being conducted at the time of the inspection. Requested that Mr. Baucom use a seperate
reporting form for each outfall instead of using a single form for all 3 outfalls.Make sure to sign the forms once completed.
Make sure all analytical monitoring parameters are sampled. Went over where to sample with Mr. Beane. Samples should
be pulled from the end of the outfall pipes, and not from the sediment ponds themself.
The new permit requirments were discussed - The TSS limit has dropped due to discharging into a HQW water.
There are now 3 Tiers if sample results are over the benchmark values in the permit.
If there is no flow in the sampling period, a DMR must still be submitted showing NO -FLOW.

On March .11,,.2011, we received a Notice of Violation (NOV-201 1 -PC-0 172) stating that
the'Moore County C&D Landfill ,was not in compliance,with.the.NPDES Storm water
permit:-NCG 120000, Certificate of Coverage NCG 120084 by not having performed
qualitative and analytical monitoring of storm water.
The permit that you refer to also referenced the Certificate of Coverage — NCG 120084
which is based on our erosion and sedimentation control plan for our Landfill expansion
project. This plan includes the construction of three sediment basins at our C&D
Landfill. We have not begun construction of these basins and it was my
misunderstanding that we were to begin monitoring storm water only after these basins
were constructed. I state this not to excuse our failure to monitor but to explain that we
honestly thought that we were in compliance with the requirements as set -forth in our
permit.
We have met with Trent Allen from your department and have explained and discussed
this misunderstanding with him in great detail. Mr. Allen has been very informative and
helpful in thoroughly explaining the situation and the cause for the notice that we
received. Moore County takes pride in complying with all requirements as set forth by
NCDENR and takes great measures to foster an environmentally compliant organization
that realizes the severity of a Notice of Violation. We fully acknowledge that we
misunderstood what was required of us and can confirm that we have expeditiously
implemented the appropriate management plan to fully comply with the requirements for
storm water monitoring.

Given this unique situation and in the confusion as to whether we were to monitor before
or after the construction of these sediment basins and also given our clean track record in
complying with NCDENR regulations in the past, we ask that you please consider
resending this Notice of Violation. Please understand that we acknowledge our mistake

Inspection Summary:
Part of the landfill has not been constructed yet and two sediment basins have not been constructed. There is only one
sediment basin at this time. No sampling has been performed at the time of this inspection. Requested that Mr. Beane
begin sampling according to the permit as soon as possible on outfall #3 and as soon as outfalls #1 and #2 are built, start
sampling those also. Make sure to check monthly oil usage and perform on -site vehicle maintenance monitoring as
required.

Trent Allen and I conducted a site visit for the subject facility yesterday. We met with the county's Public Works Director
and county engineer. They explained that this landfill has been in operation since the 1950s and has maintained a permit
with the Division of Waste Management and modified it whenever opening a new cell. For whatever reason, Solid Waste
realized during this recent permit modification for a new cell that the site did not have coverage under the stormwater
permit and is withholding issuance of their landfill permit until we issue ours. According to county personnel, they are
still in the construction phase for the new cell and will have two or three basins throughout the entire site once
completed. Trent and I explained the conditions of the general permit and relayed that coverage would likely be issued
within the next 30 days or so. We have no concerns with issuance of a COC for this facility.

5. Equipment utilized during the land disturbing or landfill operational activities on a site
shall be operated and maintained in such a manner as to prevent potential or actual
pollution of the surface or ground waters of the state. Fuels, lubricants, coolants, and
hydraulic fluids, or any other petroleum products, shall not be discharged onto the ground
or into surface waters. Spent fluids shall be disposed of in a manner so as not to enter the
waters, surface or ground, of the state and in accordance with applicable state and federal
disposal regulations. Any spilled fluids shall be cleaned up to the extent practicable and
disposed of in a manner so as not to allow their entry into the waters, surface or ground,
of the state.
SECTION B: ANALYTICAL MONITORING REQUIREMENTS
Analytical monitoring of stormwater discharges shall be performed as specified in Table 1.

A representative storm event is a storm event that measures greater than 0.1 inches of rainfall

inches has occurred. A single storm event may contain up to 10 consecutive hours of no
precipitation. For example, if it rains for 2 hours without producing any collectable discharge,
and then stops, a sample may be collected if a rain producing a discharge begins again within the
next 10 hours.

The permittee shall complete the analytical samplings in accordance with the schedule specified
in Table 2. A minimum of 60 days must separate Period 1 and Period 2 sample dates unless
monthly monitoring has been instituted under a Tier Two response.

If: The sampling results are above a benchmark value, or outside of the benchmark' range, for any
at any outfall;
Then: The permittee shall:
1. Conduct a stormwater management inspection of the facility within two weeks of receiving
sampling results.
2. Identify and evaluate possible causes of the benchmark value exceedence.
3. Identify potential, and select the specific: source controls, operational controls, or physical
improvements to reduce concentrations of the parameters of concern, or to bring
concentrations to within the benchmark range.
4. Implement the selected actions within two months of the inspection.
5. Maintain on site a written summary record of each instance of a Tier One response. Include
the date and value of the benchmark exceedence, the inspection date, the personnel
conducting the inspection, the selected actions, and the date the selected actions were
Tier Two Criteria and
If: During the term of this permit, the sampling results are above the benchmark values, or outside
of the benchmark range, for any specific parameter at a specific discharge outfall two times in a
row;
Then: The permittee shall:
1. Repeat all the required actions outlined above in Tier One.
2. Immediately institute monthly monitoring for all parameters at every outfall where a
sampling result exceeded the benchmark value for two consecutive samples. Monthly
(analytical and qualitative) monitoring shall continue until three consecutive sample results
are below the benchmark values, or within the benchmark range.
3. If no discharge occurs during the sampling period, the permittee is required to submit a
monthly monitoring report indicating "No Flow" to comply with reporting requirements.
4. Maintain on site a record of the Tier Two response.

During the term of this permit, if the sampling results exceed the benchmark value, or are outside
the benchmark range, for any specific parameter at any specific outfall on more than four
occasions, DWQ may:
• Require that the permittee increase or decrease the monitoring frequency for the
remainder of the permit;
• rescind coverage under the General Permit, and require that the permittee apply for an
individual stormwater discharge permit;
• require the permittee to install structural stormwater controls; or
• require the permittee to install other stormwater control measures
SECTION C: QUALITATIVE MONITORING REQUIREMENTS
Qualitative monitoring requires a visual inspection of each stormwater outfall regardless of
representative outfall status and shall be performed as specified in Table 4. If no stormwater
discharge is occurring during the time of the weekly inspection a check to ensure that all
sedimentation and erosion controls are being properly implemented will be performed.
Qualitative monitoring is for the purpose of evaluating the effectiveness of sedimentation and
erosion controls, and assessing new sources of stormwater pollution. No analytical tests are
required.
Qualitative monitoring shall be conducted at least once every seven calendar days, and within 24
hours after any storm event of greater than 0.5 inches of rain per 24 hour period. During stormy
periods, or whenever runoff occurs daily, all sedimentation and erosion control facilities shall be
inspected daily and immediately before closing operations for the weekend or other holiday.
The operator shall keep a record of these qualitative monitoring inspections on site.
Uncontrolled releases of mud or muddy water or visible sedimentation found off site shall be
recorded with a brief explanation as to the measures taken to prevent future releases as well as
any measures taken to clean up the sediment that has left the site. This record shall be made
available to DWQ or authorized agent upon request.

SECTION D: ON -SITE VEHICLE MAINTENANCE MONITORING REQUIREMENTS
Facilities which have any vehicle maintenance activity occurring on -site which uses more than 55
gallons of new motor oil per month when averaged over the calendar year shall perform
analytical monitoring as specified in Table 5. This monitoring shall be performed at all outfalls
which discharge stormwater runoff from the vehicle maintenance areas, in accordance with the
schedule presented in Table 2.
All analytical monitoring shall be performed during a representative storm event.

In compliance with the provisions of North Carolina General Statute 143-215.1, other lawful
standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission and the Federal Water Pollution Control Act, as amended, this permit
is hereby issued to all owners or operators, hereafter permittees, which are covered by this permit
as evidenced by receipt of a Certificate of Coverage by the Environmental Management
Commission to allow the discharge of stormwater to the surface waters of North Carolina or
separate storm sewer systems conveying stormwater to surface waters in accordance with the
terms and conditions set forth herein.
Coverage under this general permit is applicable to all owners or operators of stormwater point
source discharges associated with activities classified as Landfills that are permitted by the North

discharges from open dumps, hazardous waste disposal sites, or discharges of wastes (including

PART I INTRODUCTION
SECTION A: GENERAL PERMIT COVERAGE
All persons desiring to be covered by this General Permit must register with the Division of
Water Quality by the filing of a Notice of Intent (NOI) and applicable fees. The NOI shall be
submitted and a certificate of coverage issued prior to any discharge of stormwater associated
with industrial activity that has a point source discharge to the surface waters of the state.
Any owner or operator not wishing to be covered or limited by this General Permit may make
application for an individual NPDES permit in accordance with NPDES procedures in 15A
NCAC 2H .0100, stating the reasons supporting the request. Any application for an individual
permit should be made at least 180 days prior to commencement of discharge.
This General Permit does not cover activities or discharges covered by an individual NPDES
permit until the individual permit has expired or has been revoked. Any person conducting an
activity covered by an individual permit but which could be covered by this General Permit may
request that the individual permit be revoked and coverage under this General Permit be
provided.
Facilities submitting NOIs for coverage under this permit, and facilities submitting renewal
forms for continued coverage under this permit, prior to establishment or approval of a Total
Maximum Daily Load (TMDL) for pollutant(s) for stormwater discharges (i.e. wet weather
flows), may be covered under this permit during its term. For such facilities, continued coverage
under the reissuance of this permit is subject to the facility demonstrating that it does not have a
reasonable potential to violate applicable water quality standards for such pollutants due to the
stormwater discharge(s). For facilities that do have a reasonable potential for violation of
applicable water quality standards due to the stormwater discharge(s), the facility shall apply for
an individual permit 180 days prior to the expiration of this general permit. Once the individual
permit is issued and becomes effective the facility will no longer have coverage under the general
permit. Impaired waters scheduled for TMDL development are on North Carolina's 303(d) List

SECTION B: PERMITTED ACTIVITIES
Until this permit expires or is modified or revoked, the permittee is authorized to discharge
stormwater to the surface waters of North Carolina or separate storm sewer system which has
been adequately treated and managed in accordance with the terms and conditions of this General
Permit. All stormwater discharges shall be in accordance with the conditions of this permit.
Any other point source discharge to surface waters of the state is prohibited unless it is an
allowable non-stormwater discharge or is covered by another permit, authorization or approval.
The stormwater discharges allowed by this General Permit shall not cause or contribute to
violations of Water Quality Standards.
This permit does not relieve the permittee from responsibility for compliance with any other
applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

SECTION A: FINAL LIMITATIONS AND CONTROLS FOR STORMWATER
DISCHARGES
During the period beginning on the effective date of the permit and lasting until expiration the
permittee is authorized to discharge stormwater. Such discharges shall be controlled, limited and
monitored as specified below:
l . Prior to commencement of land disturbing activities, the permittee shall submit for
approval a Sedimentation and Erosion Control Plan (plan) to the Department of
Environment, Health, and Natural Resources, Division of Land Resources, Land Quality
Section, (or an approved local program) pursuant to the requirements of NC G.S. 113A-
54.1 and in conformity with the rules adopted by the Sedimentation and Erosion Control
Commission.
2. The permittee shall implement the plan, which has been approved by the approval
authority. The approved plan is considered a requirement or condition of this general
permit. Deviation from the approved plan, or approved amendment to the plan, shall
constitute a violation of the terms and conditions of this general permit. A signed copy of
the approved plan shall be maintained on the site at all times.
Prior to constructing or operating a landfill the permittee shall obtain a permit for a
sanitary landfill from the N.C. Department of Environment and Natural Resources,
Division of Waste Management, pursuant to the requirements of NC G.S. 130A - 294 and
in conformity with the rules adopted in 15A North Carolina Administrative Code,
Subchapter 13B Section .0500 or Section .1600. The landfill permit is considered a
requirement or condition of this general permit. Deviation from the landfill permit, or
approved amendment or revision of the landfill permit, shall constitute a violation of the
terms and conditions of this general permit. A signed copy of the landfill permit shall be
maintained on the site at all times.
4. Secondary Containment Requirements and Records. Secondary containment is required
for: bulk storage of liquid materials; storage in any amount of Section 313 of Title III of
the Superfund Amendments and Reauthorization Act (SARA) water priority chemicals;
and storage in any amount of hazardous substances, in order to prevent leaks and spills
from contaminating stormwater runoff. A table or summary of all such tanks and stored
materials and their associated secondary containment areas shall be maintained. If the
secondary containment devices are connected directly to stormwater conveyance systems,
the connection shall be controlled by manually activated valves or other similar devices
(which shall be secured closed with a locking mechanism) and any stormwater that
accumulates in the containment area shall be at a minimum visually observed for color,
foam, outfall staining, visible sheens and dry weather flow, prior to release of the
accumulated stormwater. Accumulated stormwater shall be released if found to be
uncontaminated by the material stored within the containment area. Records
documenting the individual making the observation, the description of the accumulated
stormwater, and the date and time of the release shall be kept for a period of five years.

Robert,
Trent Allen and I conducted a site visit for the subject facility yesterday. We met with the county's Public Works Director
and county engineer. They explained that this landfill has been in operation since the 1950s and has maintained a permit
with the Division of Waste Management and modified it whenever opening a new cell. For whatever reason, Solid Waste
realized during this recent permit modification for a new cell that the site did not have coverage under the stormwater
permit and is withholding issuance of their landfill permit until we issue ours. According to county personnel, they are
still in the construction phase for the new cell and will have two or three basins throughout the entire site once
completed. Trent and I explained the conditions of the general permit and relayed that coverage would likely be issued
within the next 30 days or so. We have no concerns with issuance of a COC for this facility.

Please see NO1 attached.
We have received an application for coverage of an existing C&D landfill facility under NCG 12 from Moore County. The
facility drains to a UT of Horse Creek (class WS-Il; HQW) in Aberdeen (Moore County). They do have vehicle
maintenance, but no haz waste. Does the FRO have any concerns about issuing this facility a CDC for this general
permit?
