Orange County is currently in Tier 11 monitoring for the facility due to high TSS. There were three measurable storm events during the month of January. Unfortunately, the events occurred at a time when a first flush sample could not be collected. Orange County continues to monitor the installed BMP's that help to control the amount of onsite erosion and subsequent discharge of contaminated water. This includes monitoring the growth of our vegetative cover and minimizing the amount of disturbed land. This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part 11 of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections 8, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections 8, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. However, the facility must complete the requirements of Tier One in the NCG120000 permit in response to the benchmark exceedances seen during the December 2008 sampling event for fecal and TSS at both the active MSW and active C&D outfalls. Outfalls Observed: -New C&D stormwater basin (designed for 25 year storm) was dry the day of the inspection- no discharge. This outfall eventually flows to Duke Forest. -The landfill accepts portland cement /construction debris that is sprayed nightly and covered weekly. -The active MSW stormwater basin was not discharging the day of the inspection, but full observation of the outfall was hindered by fencing. It is recommended that a gate be installed to allow complete access to the outfall. -The old MSW landfill was closed in 1995. The old C&D landfill was closed in 2005. -A leachate collection system was installed where the "closed leachate pond" was located, and the leachate is sent to the OWASA Collection System. -A stormwater pond by a borrow area/wood waste collection area was observed, but the volume was not overflowing/discharging the day of the inspection. The borrow area/wood waste collection area did not have any wood waste or borrow material stored at the time. Some erosion and rilling of banks was present, but sediment movement to the pond was not apparent, and most of the area has a vegetative cover. UNC has an on -going project aimed at capturing the methane gas at the landfill for use as an energy source. Installation of the piping to capture the gas was not yet complete the day of the inspection. Please review Part 11 Monitoring, Controls, and Limitations for permitted discharges - page 4 of 7 in the NCG'120000 permit and ensure requirements for Tier One have been documented as they were not reviewed the day of the inspection. Vehicle maintenance is done near the site, but covered by Orange County Government as separate garage from the landfill. The garage has not been considered as part of the Landfill permit. Further research into the status of the garage and any permit requirements relating to it, needs to be done. It was noted that the facility is not using more than 55 gallons of new motor oil per month, but a large storage building of bulk petroleum products is located at the garage. The building has secondary containment and would fall under federal SPCC requirements. This new page should replace the current page in your permit. Application Return #1029 Guilford County On January.29, 2001 the Division of Water Quality received your Notice of Intent (NOI) requesting coverage under general stormwater permit NCG I20000. After a review of the NOI and a► follow up call to Mr. Dave Southard, it was determined that the landfill will hold only construction and demolition debris, and is therefore exempt from obtaining an industrial stormwater permit. Currently there are four ways to claim a stormwater permit exemption. They are I) the industry is a category 1 I facility and has eliminated all exposure, 2) the activity does not meet the "industrial" definition, 3) all stormwater from the facility drains into a detention pond that does not discharge during a 25 year/ 24 hour storm event, and 4), thene are no point source discharges for the entire facility. Because the landfill will only house construction and demolition debris it is not included as an "industrial" activity in the regulations governing the stormwater permitting program. If tthe landfill were housing wastes associated with an "industrial" activity or any sanitary landfill waste it would be considered an "industrial" activity. Based on this information your NOI is being returned to you, and your permit fee ($80.00) will also be returned under separate cover. If at any time your facility plans change so that you will no longer fall under any (of the stormwater permit exemption categories, you must apply for and obtain a stormwater permit before making those changes.
