On May 20, 2015, a site inspection was conducted for the Sampson County Disposal, LLC Landfill facility
located at 7434 Roseboro Highway in Roseboro, Sampson County, North Carolina. A copy of the
Compliance Inspection Report is enclosed for your review. The time and assistance provided by you and Mr.
Joe Smith, Operations Manager, is greatly appreciated. The site visit and file review revealed that the subject
facility is covered by NPDES Stormwater General Permit-NCG120000, Certificate of Coverage- NCG120054.
Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as
Bearskin Swamp (Turlington Millpond), a class C;Sw waterbody in the Cape Fear River Basin.
As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG120000
permit. Please refer to the enclosed Compliance Inspection Report for additional comments and
observations made during the inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil
penalty assessment of up to $25,000 per day for each violation. If you or your staff has any questions,

Inspection Summary:
Met with Bryan Wuester, Landfill Manager, and Joe Smith, Operations Manager. Reviewed facility's records of semi-annual
Qualitative Monitoring and weekly visual inspections as well as their Analytical Monitoring reports. Representative outfall
status has been granted for outfalls 2, 6 and 10. Facility was in Tier Two monthly monitoring in 2013 For outfalls 2 and 6, but
have returned to the semi-annual schedule after having three consecutive monitoring events with all parameters below the
benchmark values. Additional outfalls at the C&D location need to be added to the monitoring schedule. Facility has three
approved erosion control plans and it was determined at the time of inspection that the facility is in compliance with those
plans. Facility also has a permit through the Division of Waste Management (DWM) to operate a landfill. Compliance with
the landfill permit is determined by staff with DWM. All necessary secondary containment is provided and equipment
utilized at the facility appeared to be properly operated and maintained.

In response to your renewal application for continued coverage under stormwater General Permit NCG120000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215,1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:

• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013, Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/­wq/wslsu/current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/1 for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections S, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections 8, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

Staff with the Fayetteville Regional Office of the Division of Water Quality has reviewed your petition dated June
18, 2010 for a change in the Representative Outfaii Status for the Sampson County Disposal facility. Specifically, the
petition requests that stormwater discharge outfall (SDO) 2 be granted representative outfall status for stormwater outfalls
1 and 2, SDO 6 be representative of SDOs 3, 4, 5, 6, 7 and 8, and SDO 10 be representative of SDOs 9 and 10. Based
on the information and map provided, as well as requested analytical monitoring data for SDO 3, we are approving this
request. In accordance with 40 CFR §122.21(g)(7), you are authorized to monitor stormwater outfalls 2, 6 and 10 as
representative outfalls. This approval is effective with the next sampling event. Please be reminded that the permit
requires Qualitative Monitoring to be performed at all stormwater discharge outfalls, regardless of representative outfall
status.
Please remember that any actions you initiate in response to benchmark exceedances as directed in the tiered
response provisions of your permit must address all drainage areas represented by SDOs 2, 6 and 10, where appropriate.
Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) to. document that representative

Inc. is submitting this petition for representative outfall status as described in Part 111, Section D
of the permit guidelines for Stormwater General Permit NCG120000.
Current Outfall Status
SCD currently has representative outfall status granted on September 9, 2008 (attached). Due to
recent expansion of the landfill operating area, the erosion and sediment control features have
been upgraded and the stormwater discharge outfalls (SDO) have been renumbered, as seen on
Figure 1 (attached). Two (2) new sediment ponds have been installed on site.
Industrial Activities
SCD is receiving municipal solid waste originating from residential, commercial, and industrial
sources as permitted under NC Solid Waste Permit No. 82-02. Stormwater runoff associated
with the development of the site has been delineated by drainage area as shown on Figure 1 and
summarized by outfall watershed area in Table 1. Currently, there are ten (10) SDOs for the
Phase 1 and 2 operations which warrant "representative outfalls."

Potential Pollutant Exposure
SCD potential pollutants are (1) the active landfill, (2) vehicular traffic, (3) the leachate storage
tank area, and (4) the waste processing area. The active landfill is the primary potential pollutant
area as defined by the general permit. The leachate storage tank area functions to collect
stormwater that comes into contact with waste prior to discharge to the Town of Roseboro, NC
POTW (Publicly Owned Treatment Works) or recirculation with the facility. This storage area
includes glass -fused to steel bolted tanks inside a secondary containment. The vehicle traffic
associated with waste disposal, operations, and maintenance are transient across the site. Lastly,
the waste processing area accepts semi -solid wastes for mixing with other dryer wastes for
disposal in the landfill. This area includes recessed double -lined steel containment for mixing,
including a concrete apron on all sides. However, the predominant exposure would include
operational equipment which is maintained within the active landfill area. As shown in Figure
1, the proposed SDO 2, SDO 6, and SDO 10 are representative locations which include all four
(4) potential pollutant exposure activities and their watersheds cover the majority of the site.
Proposed Representative Outfall
SDO 2 represents the potential leachate pollutant and waste processing area. Active landfill
operations are represented due to SDO 1 discharging in to the drainage area for SDO 2. SCD
proposes SDO 2 be representative for SDO 1 and 2. SDO 6 represents a drainage area with
potential pollutant exposure originating from vehicular traffic. SCD proposes SDO 6 be
representative for SDO 3-8. Approximately 13.1 acres drain into Sediment Basin A (SDO 6)
located on the northeast corner of the site. SDO 10 represents the largest drainage area with the
highest potential pollutant exposure originating from the active landfill activity and vehicular
traffic. SCD proposes SDO 10 be representative for SDO 9 and 10. Approximately 37 acres
drain into Sediment Basin M (SDO 10) located on the northwestern corner of the site.

On behalf of Sampson County Disposal, LLC (SCD), Richardson Smith Gardner & Associates,
Inc. is submitting this petition for representative outfall status as described in Part III, Section D
of the permit guidelines for Stormwater General Permit NCG120000.
Current Outfall Status
SCD currently has representative outfall status granted on September 9, 2008 (attached). Due to
recent expansion of the landfill operating area, the erosion and sediment control features have
been upgraded and the stormwater discharge outfalls (SDO) have been renumbered, as seen on
Figure I (attached). Two (2) new sediment ponds have been installed on site.
Industrial Activities
SCD is receiving municipal solid waste originating from residential, commercial, and industrial
sources as permitted under NC Solid Waste Permit No. 82-02. Stormwater runoff associated
with the development of the site has been delineated by drainage area as shown on Figure 1 and
summarized by outfall watershed area in Table 1. Currently, there are ten (10) SDOs for the
PWi se 1 and 2 operations which warrant "representative outfalls."

Potential Pollutant Exposure
SCD potential pollutants are (1) the active landfill, (2) vehicular traffic, (3) the leachate storage
tank area, and (4) the waste processing area. The active landfill is the primary potential pollutant
area as defined by the general permit. The leachate storage tank area functions to collect
stormwater that comes into contact with waste prior to discharge to the Town of Roseboro, NC
POTW (Publicly Owned Treatment Works) or recirculation with the facility. This storage area
includes glass -fused to steel bolted tanks inside a secondary containment. The vehicle traffic
associated with waste disposal, operations, and maintenance are transient across the site. Lastly,
the waste processing area accepts semi -solid wastes for mixing with other dryer wastes for
disposal in the landfill. This area includes recessed double -lined steel containment for mixing,
including a concrete apron on all sides. However, the predominant exposure would include
operational equipment which is maintained within the active landfill area. As shown in Figure
1, the proposed SDO 2 SDO 6 and SDO 10 are representative locations which include all four
(4) potential pollutant exposure activities and their watersheds cover the majority of the site.
Proposed Representative Outfall
SDO 2 represents the potential leachate pollutant and waste processing area. Active landfill
operations are represented due to SDO 1 discharging in to the drainage area for SDO 2. SCD
proposes SDO 2 be representative for SDO 1 and 2. SDO 6 represents a drainage area with
potential pollutant exposure originating from vehicular traffic. SCD proposes SDO 6 be
representative for SDO 3-8. Approximately 13.1 acres drain into Sediment Basin A (SDO 6)
located on the northeast corner of the site. SDO 10 represents the largest drainage area with the
highest potential pollutant exposure originating from the active landfill activity and vehicular
traffic. SCD proposes SDO 10 be representative for SDO 9 and 10. Approximately 37 acres
drain into Sediment Basin M (SDO 10) located on the northwestern comer of the site.

Dear Bryan:
Richardson Smith Gardner and Associates (RSG) is pleased to submit this Year Three, Period 3,
Tier Two (April 2010) Discharge Monitoring Report (DMR) for stormwater monitoring at the
Sampson County Disposal, LLC (SCD) Municipal Solid Waste (MSW) Landfill. The site is
located in Roseboro, North Carolina. The SCD facility is currently permitted to discharge water
from landfill related activities under Certificate of Coverage (COC) Number NCG 120054,
General Permit Number NCG 120000.
As you are aware, the Request for Representative Outfall Status was granted to SCD by the
North Carolina Department of Environment and Natural Resources (NCDENR), Division of
Water Quality (DWQ). Currently, your facility is required to monitor discharge at the following
Stormwater Discharge Outfall (SDO) locations:
1) Outfalls 1 and 2;
2) Outfall 3;
3) Outfall6.
For this submittal we are providing you with three (3) copies of the report, each including:
• Figure prepared by RSG(attaehed);
• Stormwater Discharge Outfall (SDO) Monitoring Report (attached)
Note that SCD is currently required to follow Tier Two response actions at the basin associated
with Outfalls 1/2 due to two consecutive Total Suspended Solids (TSS) results above the
established Benclunark Value, and at Outfall 6 due to two consecutive Fecal Coiifoim results
above the established Benchmark Values. The results of the Tier 2 responses are summarized
below.

If: The first valid sampling results are above a benchmark value, or outside of the benchmark
range, for any parameter at any outfall;
Then: The permittee shall:
1) Repeat all the required actions outlined above in Tier One:
a) Conduct a stormtia,ater- urianagenrerit inspection of the, facility within tA,o ►seeks of
receiving sampling results.
Response: The facility and operations in the vicinity ofOutfalls #1/2 and #6 were
visually inspected the week of August 24, 2009. Inspections were conducted again
during the week of December 28, 2009, and April 12, 2010.
b) Identify and evaluate possible causes of the benchmark value exceedence.
Response: Outfalls #1 and #2, which are collectively sampled as SW #l, are adjacent
to the main access road to the landfill. The berms along the road in this area have
recently been repaired. It is possible that sediment levels in this area were elevated at
the time due to the immature vegetative growth along the road. There is no obvious
cause for the elevated Fecal at Outfall #6.
c) Identify potential and select the specific: source controls, operational controls, or
physical improvements to reduce concentrations of the parameters of concern, or to
bring concentrations to within the benchmark range.
Response: After the visual inspection of the area of Outfall #1/2, it was determined
that additional straw and vegetative control would be beneficial, as well as the
installation of additional silt fencing. The basin associated with Outfall #6 was visually
inspected and no obvious reason for the elevated Fecal was identified, therefore no
additional action was taken in this area..
d) Implement the selected actions within two months of the inspection.
Response: The remedial actions to minimize sediment in this area were completed by
October 31, 2009.
e) Maintain on site a written summary record of each instance of a Tier One response.
Include the date and value of the benchmark exceedence, the inspection date, the
personnel conducting the inspection; the selected actions, and the date the selected
actions were implemented.
Response: Records of this event will be maintained on site.

2) Immediately institute monthly monitoring for all parameters at every outfall where a
sampling result exceeded the benchmark value for two consecutive samples. Monthly
(analytical and qualitative) monitoring shall continue until three consecutive sample
results are below the benchmark values, or within the benchmark range:
Response: The facility has impleniented Tier Two sampling protocol. Monthly
analytical and visual monitoring was initiated in October 2009 and has continued
monthly since. The site did not experience a qualifying rain event in November 2009.
Due to the elevated Fecal at Outfall #6, and the No Discharge for Outfall 112, Tier Two
sampling continued in December 2009 and January 2010. There were no exceedences
in the February 2010 event,' but both locations had exceedences during March 2010.
Note Nrat at least three "clean" monthly samples must be collected at Outfall % and
Outfall #6 (until all results are below the applicable threshold).
3) If no discharge occurs during the sampling period, the permittee is required to
submit a monthly monitoring report indicating "No Flow" to comply with reporting
requirements:
Response: The site did not experience a qualifying rain event in April 2010 (this
event), therefore, "No Flow" is reported..
4) Maintain on site a record of the Tier Two response.
Response: Records of this event will be maintained on site.

result exceeded the benchmark value for two consecutive samples. Monthly (analytical and
qualitative) monitoring shall continue until three consecutive sample results are below the
benchmark values, or within the benchmark range:
Response: The facility has implemented Tier Two sampling protocol. Monthly analytical and
visual monitoring was initiated in October 2009 and has continued monthly since. The site did
not experience a qualifying rain event in November 2009. Due to the elevated Fecal at Outfall #6,
and the No Discharge for Outfall 1/2, Tier Two sampling continued in December 2009 and
January 2010. There were no exceedences in the February 2010 event, but both locations had
exceedences during March 2010 (this current event). Note that at least three "clean" monthly
samples must be collected at Outfall % and Outfall #6 (until all results are below the applicable
threshold).

Carroll Environmental Services, LLC (CES) is submitting this Year Three, Period 2, Tier Two (December
2009) Discharge Monitoring Report (DMR) for storm water monitoring at the Sampson County Disposal,
LLC (SCD) Municipal Solid Waste Landfill (MSWL) active site. As indicated in the attached Figure 1, the
subject site is located in Roseboro, Sampson County, North Carolina. The SCD facility is currently
permitted to discharge water from landfill related activities under Certificate of Coverage (COC) Number
NCG120054, General Permit Number NCG120000.
.As you are aware, the Request for Representative Outfall Status was granted to SCD by the North Carolina
Department of Environment and Natural Resources (NCDENR), Division of Water Quality (DWQ).
Currently, your facility is required to monitor discharge at the following Stormwater Discharge Outfall
(SDO) locations:

1) Outfalls 1 and 2;
2) Outfall 3;
3) Outfall6.
For this submittal we are providing you with three (3) copies of the report, each including:
• Figure provided to CES by SCD, prepared by Richardson Smith Gardner (RSG) (Attachment 1);
• Analytical and Field Data provided by EnviroChem (Attachment 2);
• Stormwater Discharge Outfall (SDO) Monitoring Report (Attachment 3); and,
• Qualitative Monitoring Forms (Attachment 4).
Note that SCD is currently required to follow Tier Two response actions at the basin associated with
Outfalls 1 /2 due to two consecutive Total Suspended Solids (TSS) results above the established Benchmark
Value, and at Outfall 6 due to two consecutive Fecal Coliform results above the established Benchmark
Values. The results of the Tier 2 responses are summarized below.

If: The sampling results are above the benchmark values, or outside of a benchmark range, for any specific
parameter at any specific outfall two times in a row;
Then: The permittee shall:
1) Repeat all the required actions outlined above in Tier One:
a) Conduct a stormwater management inspection of the facility within two weeks of receiving
sampling results.
Response: The facility and operations in the vicinity of Outfalls #1/2 and #6 were visually
inspected the week of August 24, 2009. Inspections were conducted again during the week of
December 28, 2009.
b) Identify and evaluate possible causes of the benchmark value exceedence.
Response: Outfalls #1 and #2, which are collectively samples as SW #1, are adjacent to the main
access road to the landfill. The berms along the road in this area have recently been repaired. It is
possible that sediment levels in this area were elevated at the time due to the immature vegetative
growth along the road. There is no obvious cause for the elevated Fecal at Outfall #6.
c) Identify potential, and select the specific: source controls, operational controls, or physical
improvements to reduce concentrations of the parameters of concern, or to bring concentrations to
within the benchmark range.
Response: After the visual inspection of the area of Outfall #1/2, it was determined that additional
straw and vegetative control would be beneficial, as well as the installation of additional silt fencing.
This current event indicated that the efforts were successful as the TSS concentration in the current

Dear Bryan:
Carroll Environmental Services, LLC (CES) is pleased to submit this Year Two, Period 1 (June 2009)
Discharge Monitoring Report (DMR) for storm water monitoring at the Sampson County Disposal, LLC
(SCD) Municipal Solid Waste Landfill (MSWL) active site. As indicated in the attached Figure 1, the
subject site is located in Roseboro, Sampson County, North Carolina. The SCD facility is currently
•permitted to discharge water from landfill related activities under Certificate of Coverage (COC) Number
NCG120054, General Permit Number NCG120000.
•
As you are aware, the Request for Representative Outfall Status was granted to SCD by the North Carolina
Department of Environment and Natural Resources (NCDENR), Division of Water Quality (DWQ).
Currently, your facility is required to monitor discharge at the following Stormwater Discharge Outfall
(SDO) locations:
1) Outfalls 1 and 2;
2) Outfall 3;
3) Outfall6.
For this submittal we are providing you with three (3) copies of the report, each including:
• Figures provided to CES by SCD, prepared by Richardson Smith Gardner (RSG) (Attachment 1);
• Analytical and Field Data provided by Microbac (Attachment 2);
• Stormwater Discharge Outfall (SDO) Monitoring Reports (Attachment 3); and,
• Qualitative Monitoring Forms (Attachment 4).
Note that SCD is currently required to follow Tier l response actions at the basin associated with Outfall 6
due to Chemical Oxygen Demand (COD), Fecal Coliform, and Total Suspended Solids results all being
above their established Benchmark Values. The results of the Tier 1 responses are summarized below.

Tier One
If: The sampling results are above a benchmark value, or outside of a benchmark range, for any parameter
at any outfall
Then: The permittee shall:
1) Conduct a stormwater management inspection of the facility within two weeks of receiving
sampling results.
Response: The facility and operations in the vicinity of Outfall 46 was visually inspected the week
of August 24, 2009.
2) Identify and evaluate possible causes of the benchmark value exceedence.
Response: Outfall 46 is located to the northeast of the active landfill. It is possible that sediment
levels in this area were elevated at the time due to the immature vegetative growth on the external
slope of the landfill and some recent construction activities. However, there was no physical
indication of the cause for the elevated COD and Fecal results The pond is well away from the
landfill, although there is known wildlife in the area, including mammals, birds, and reptiles..
3) Identify potential, and select the specific: source controls, operational controls, or physical
improvements to reduce concentrations of the parameters of concern, or to bring concentrations to
within the benchmark range.
Response: The vegetative cover in the area continues to mature, and sediment should be reduced in
the future. The pond was also drained during the week of September 21, and inspected for a
potential source of the elevated Fecal and COD. Nothing obvious was noted. Internal visual
monitoring of the water quality at the Outfall will be conducted periodically to verify the water
quality. If the monitoring indicates the need for active measures, additional measure will be taken.
4) Implement the selected actions within two months of inspection.
Response: If active measures are required to bring TSS levels below the Benchmark limit of 100
mg/L, they will be implemented by October 31, 2009.
S) Maintain on site a written summary record of each instance of a Tier One response. Include the date
and value of the benchmark exceedence, the inspection date, the personnel conducting the
inspection, the selected actions, and the date the selected actions were implemented.
Response: Records of this event will be maintained on site.

Two response is detailed below:
Tier Two Criteria and Responses
If. The sampling results are above the benchmark values, or outside of a benchmark range, for any specific
parameter at any specific outfall two times in a row;
Then: The permittee shall:
1) Repeat all the required actions outlined above in Tier One:
a) Conduct a stormwater management inspection of the facility within two weeks of receiving
sampling results.
Response: The facility and operations in the vicinity of Outfalls #1/2 were visually inspected the
week of August 24, 2009.
b) Identify and evaluate possible causes of the benchmark value exceedence.
Response: Outfalls 91 and #2, which are collectively samples as Stormwater #1, are adjacent to the
main access road to the landfill. The berms along the road in this area have recently been repaired.
It is possible that sediment levels in this area were elevated at the time due to the immature
vegetative growth along the road.
c) Identify potential, and select the specific: source controls, operational controls, or physical
improvements to reduce concentrations of the parameters of concern, or to bring concentrations to
within the benchmark range.
Response: After the visual inspection of the area, it was determined that additional straw and
vegetative control would be beneficial, as well as the installation of additional silt fencing.
d) Implement the selected actions within two months of the inspection.
Response: The remedial actions to minimize sediment in this area will be completed by October 31,
2009.
e) Maintain on site a written summary record of each instance of a Tier One response. Include the date
and value of the benchmark exceedence, the inspection date, the personnel conducting the
inspection, the selected actions, and the date the selected actions were implemented.
Response: Records of this event will be maintained on site.

2) Immediately institute monthly monitoring for all parameters at every outfall where a sampling
result exceeded the benchmark value for two consecutive samples. Monthly (analytical and
qualitative) monitoring shall continue until three consecutive sample results are below the
benchmark values, or within the benchmark range:
Response: The facility has implemented Tier Two sampling protocol. Monthly analytical and
visual monitoring will be initiated as soon as possible in October 2009.
3) If no discharge occurs during the sampling period, the permittee is required to submit a monthly
monitoring report indicating "No Flow" to comply with reporting requirements:
Response: If no discharge occurs from this area during the monthly monitoring period, a report
indicating "No Flow" will be submitted.
4) Maintain on site a record of the Tier Two response.
Response: Records of this event will be maintained on site.

On September 24, 2009, I, Trent Allen from the Fayetteville Regional Office of the Division of Water
Quality, conducted a site inspection at,the Sampson County Disposal Incorporated facility located 7434
Roseboro Highway, Sampson County, North Carolina. A copy of the Compliance Inspection Report is enclosed
for your review. Shawn Carroll was also present during the inspection and his time and assistance is greatly
appreciated. Stormwater from this facility drains to Bearskin Swamp, a Class C;Sw stream located in the Cape
Fear River Basin. The site visit and file review revealed that the subject facility is covered by NPDES
Stormwater General Permit-NCG120054.
Accordingly, the following observations were noted during the Division of Water Quality inspection:

If: The sampling results are above a benchmark value, or outside of the benchmark range, for any
parameter at any outfall;
Then: The permittee shall:
I . Conduct a stormwater management inspection of the facility within two weeks of receiving
sampling results.
2. Identify and evaluate possible causes of the benchmark value exceedence.
3. Identify potential, and select the specific: source controls, operational controls, or physical
improvements to reduce concentrations of the parameters of concern, or to bring
concentrations to within the benchmark range.
4. Implement the selected actions within two months of the inspection.
5. Maintain on site a written summary record of each instance of a Tier One response. Include
the date and value of the benchmark exceedence, the inspection date, the personnel
conducting the inspection, the selected actions, and the date the selected actions were
implemented.

If: During the term of this permit, the sampling results are above the benchmark values, or outside
of the benchmark range, for any specific parameter at a specific discharge outfall two times in a
row;
Then: The permittee shall:
1. Repeat all the required actions outlined above in Tier One.
2. Immediately institute monthly monitoring for all parameters at every outfall where a
sampling result exceeded the benchmark value for two consecutive samples. Monthly
(analytical and qualitative) monitoring shall continue until three consecutive sample results
are below the benchmark values, or within the benchmark range.
3. If no discharge occurs during the sampling period, the permittee is required to submit a
monthly monitoring report indicating "No Flow" to comply with reporting requirements.
4. Maintain on site a record of the Tier Two response.

During the term of this permit, if the sampling results exceed the benchmark value, or are outside
the benchmark range, for any specific parameter at any specific outfall on more than four
occasions, DWQ may:
• Require that the permittee increase or decrease the monitoring frequency for the
remainder of the permit;
• rescind coverage under the General Permit, and require that the permittee apply for an
individual stormwater discharge permit;
• require the permittee to install structural stormwater controls; or
• require the permittee to install other stormwater control measures
SECTION C: QUALITATIVE MONITORING REQUIREMENTS
Qualitative monitoring requires a visual inspection of each stormwater outfall regardless of
representative outfall status and shall be performed as specified in Table 4. If no stormwater
discharge is occurring during the time of the weekly inspection a check to ensure that all
sedimentation and erosion controls are being properly implemented will be performed.
Qualitative monitoring is for the purpose of evaluating the effectiveness of sedimentation and
erosion controls, and assessing new sources of stormwater pollution. No analytical tests are
required.
Qualitative monitoring shall be conducted at least once every seven calendar days, and within 24
hours after any storm event of greater than 0.5 inches of rain per 24 hour period. During stormy
periods, or whenever runoff occurs daily, all sedimentation and erosion control facilities shall be
inspected daily and immediately before closing operations for the weekend or other holiday.
The operator shall keep a record of these qualitative monitoring inspections on site.
Uncontrolled releases of mud or muddy water or visible sedimentation found off site shall be
recorded with a brief explanation as to the measures taken to prevent future releases as well as
any measures taken to clean up the sediment that has left the site. This record shall be made
available to DWQ or authorized agent upon request.

SECTION D: ON -SITE VEHICLE MAINTENANCE MONITORING REQUIREMENTS
Facilities which have any vehicle maintenance activity occurring on -site which uses more than 55
gallons of new motor oil per month when averaged over the calendar year shall perform
analytical monitoring as specified in Table 5. This monitoring shall be performed at all outfalls
which discharge stormwater runoff from the vehicle maintenance areas, in accordance with the
schedule presented in Table 2.
All analytical monitoring shall be performed during a representative storm event.

5. Equipment utilized during the land disturbing or landfill operational activities on a site
shall be operated and maintained in such a manner as to prevent potential or actual
pollution of the surface or ground waters of the state. Fuels, lubricants, coolants, and
hydraulic fluids, or any other petroleum products, shall not be discharged onto the ground
or into surface waters. Spent fluids shall be disposed of in a manner so as not to enter the
waters, surface or ground, of the state and in accordance with applicable state and federal
disposal regulations. Any spilled fluids shall be cleaned up to the extent practicable and
disposed of in a manner so as not to allow their entry into the waters, surface or ground,
of the state.
SECTION B: ANALYTICAL MONITORING REQUIREMENTS

Inspection Summary:
This inspection was conducted in conjunction with a site visit to evaluate and discuss the facility's recent request for
Representative Outfall Status (ROS). The NCG120000 general stormwater permit for landfills does not require the
development of a Stormwater Pollution Prevention Plan (SPPP), but instead requires that the landfill obtain and follow an
approved erosion and sedimentation control plan through the Division of Land Resources, Land Quality Section
(DLR-LQS) as well as obtain a permit through the Division of Waste Management (DWM) for a sanitary landfill. The
Sampson County landfill has obtained both. The NCG120000 permit also requires that the facility provide any necessary
secondary containment and maintain records of any releases of stormwater from the containment structures. Any
equipment used during operational activities must be operated and maintained to prevent any pollution to the ground or
surface waters. During the inspection, secondary containment was observed and there was no apparent evidence of any
spills or leaks from equipment. During the previous permit cycle, Analytical Monitoring was not conducted because the
permit had language that exempted monitoring if stormwater basins were designed to hold the 10-year storm. As
discussed during the site visit, landfills are required by DWM to install basins that will hold the 25-year storm. The current
permit cycle does not contain the monitoring exemption and since the facility currently has eight basins, personnel
submitted their request for ROS in order to limit the analytical monitoring requirements to which they are now subject. A
separate letter granting ROS to three of the facility's eight basins will be sent as a result of the site visit allowing personnel
to conduct analytical monitoring at only those three outfalls instead of all eight. Analytical monitoring was conducted
earlier in 2008 at outfalls 003 and 006 due to discharges from the basins during a heavy rain event. Qualitative Monitoring
at all of the facility's outfalls is another requirement of the NCG120000 permit and this has not changed from the previous
permit cycle. The frequency of these visual observations is weekly to coincide with the facilty's coverage under the
NCGO10000 general permit, which the facility is subject to due to ongoing land disturbance. Several months of visual
monitoring records were available for review at the time of inspection. Additional Analytical Monitoring is required for
facilities that conduct onsite vehicle maintenance, which this facility does, however this monitoring is effectively waived
considering that all vehicle maintenance activities are conducted within the active landfill area where stormwater runoff as
well as any leachate is collected by a series of undergound pipes and sent into the leachate storage system for
subsequent reapplication to the active landfill to aid in decomposition. At the time of inspection, the facility appeared to be
very well maintained and personnel seem to be well aware of all permit requirements.

determination that stormwater discharge outfall (SDO) 003 be granted representative outfall status for stormwater
outfalls 001; 002, 003, 004, 005, 006, 007 and 008. in response to this request, Mike Lawyer of this office
conducted a site visit on September 3, 2008 where he met with you, Mr. Shawn Carroll, Landfill Division Env.
Operative with Waste Industries, and your engineers with Richardson Smith Gardner & Associates, Inc. Based on
the information and map provided with the request letter along with observations made and discussions held
during the site visit, this office has made the following decision. Stormwater Outfall 002 shall be representative of
outfalls 001 and 002; Stormwater Outfall 003 shall be representative of outfalls 003, 004 and 005; and Stormwater
Outfall 006 shall be representative of outfalls 006, 007 and 008. In accordance with 40 CFR §122.21(g)(7), you
are authorized to monitor stormwater outfalls 002, 003 and 006 as representative outfalls. This approval is
effective with the next sampling event. Please be reminded that the permit requires Qualitative Monitoring to be
performed at all stormwater discharge outfalls, regardless of representative outfall status.
Please remember that any actions you initiate in response to benchmark exceedances as directed in the
tiered response provisions of your permit must address all drainage areas represented by SDOs 002, 003 and
006, where appropriate.
Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) to document that

First let me express my appreciation for all of your time and assistance last week.
Stacey, please pass this along to Clark as well. From my notes, there were two
unresolved issues after our meeting that I was going to check into and I have
answers for both.
One, the exemption from analytical monitoring for facilities that have basins
designed to hold the 10-year storm was indeed removed intentionally and was so from
all general stormwater permits. Apparently this issue has already been brought to
the Stormwater Permitting Unit's attention by another regional office as it relates
to landfills that require basins to hold the 25-year storm and the Unit agrees that
this should be readdressed, but probably won't be until the next permit cycle. So,
we're all stuck with that monitoring requirement until then. Having said that,
you're proactive approach to request representative outfall status is certainly
warranted and I should have a letter granting the status on the three outfalls that
we discussed out to you this week.
Second, I described your facility's situation concerning vehicle maintenance to a
staff member with the Stormwater Permitting Unit and she agreed that analytical
monitoring per that section of the general permit would not apply considering that
stormwater runoff from those activities is captured by your leachate recycling
system and basically does not leave the site. I will reference this exemption in my
inspection summary that will come under separate cover from the Representative
Outfall Status request approval letter. Please be advised that should your vehicle
maintenance activities change where Stormwater that leaves the site is exposed to
such activities, then your site will be subject to those monitoring requirements.
I hope this addresses your concerns, but if not or if I could be of any assistance

Industrial Activities
The Sampson County Disposal landfill will receive municipal solid waste (MSW) originating
from residential, commercial, and industrial sources as permitted under NC Solid Waste Permit
No. 82-02. Stormwater runoff associated with the development of the site has been delineated
by drainage area as shown on Figure 1 (attached) and summarized by outfall watershed area in
Table 1. Currently, there are eight (8) outfall points for the active operations which warrant a
"representative outfall."

Potential Pollutant Exposure
The potential pollutants are (1) the active landfill, (2) vehicular traffic, (3) the leachate storage
tank area, and (4) the waste processing area. The active landfill is the primary potential pollutant
area as defined by the general pen -nit. The leachate storage tank area functions to collect
stormwater that comes into contact with waste prior to discharge to the Town of Roseboro, NC
POTW (Publicly Owned Treatment Works). This storage area includes glass -fused to steel
bolted tanks inside a secondary containment. The vehicle traffic associated with waste disposal,
operations, and maintenance are transient across the site. Lastly, the waste processing area
accepts semi -solid wastes for mixing with other dryer wastes for disposal in the landfill. This
area includes recessed double -lined steel containment for mixing, including a concrete apron on
all sides. However, the predominant exposure would include operational equipment which is
maintained within the active landfill area. As shown in Figure 1, the proposed Outfall 3
represents a likely point for monitoring since it includes representative potential pollutant
exposure activities from the landfill activity.
Proposed Representative Outfall
Outfall 3 represents the largest drainage area with a representative potential pollutant exposure
originating from the site. Outfall 3 is located on the southeast corner of the site at Sediment
Basin D. Approximately 25 acres drains into Sediment Basin D, which represents both the
covered inactive and active phase of the landfill. Outfall 2 represents the potential leachate
pollutant area and waste processing area. However, the drainage area has a small watershed and
includes secondary containment. The remaining outfall areas are substantially similar to one
another in terms of size and potential pollutant exposure.

The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.

Draft Permit Fact Sheet that accompanied the public notice (httQ://portal.ncdenr.org/web/wa/ws/suZcurrent-

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (0&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH ) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it

Staff with the Fayetteville Regional Office of the Division of Water Quality has reviewed your petition dated June
18, 2010 for a change in the Representative Outfall Status for the Sampson County Disposal facility. Specifically, the
petition requests that stormwater discharge outfall (SDO) 2 be granted representative outfall status for stormwater outfalls
1 and 2, SDO 6 be representative of SDOs 3, 4, 5, 6, 7 and 8, and SDO 10 be representative of SDOs 9 and 10. Based
on the information and map provided, as well as requested analytical monitoring data for SDO 3, we are approving this
request. In accordance with 40 CFR §122.21(g)(7), you are authorized to monitor stormwater outfalls 2, 6 and 10 as
representative outfalls. This approval is effective with the next sampling event. Please be reminded that the permit
requires Qualitative Monitoring to be performed at all stormwater discharge outfalls, regardless of representative outfall
status.
Please remember that any actions you initiate in response to benchmark exceedances as directed in the tiered
response provisions of your permit must address all drainage areas represented by SDOs 2, 6 and 10, where appropriate.
Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) to document that representative

On behalf of Sampson County Disposal, LLC (SCD), Richardson Smith Gardner & Associates,
Inc. is submitting this petition for representative outfall status as described in Part III, Section D
of the permit guidelines for Stormwater General Permit NCG120000.
Current Outfall Status
SCD currently has representative outfall status granted on September 9, 2008 (attached). Due to
recent expansion of the landfill operating area, the erosion and sediment control features have
been upgraded and the stormwater discharge outfalls (SDO) have been renumbered, as seen on
Figure 1 (attached). Two (2) new'sediment ponds have been installed on site.
Industrial Activities
SCD is receiving municipal solid waste originating from residential, commercial, and industrial
sources as permitted under NC Solid Waste Permit No. 82-02. Stormwater runoff associated
with the development of the site has been delineated by drainage area as shown on Figure 1 and
summarized by outfall watershed area in Table 1. Currently, there are ten (10) SDOs for the
Phase 1 and 2 operations which warrant "representative outfalls."

Potential Pollutant Exposure
SCD potential pollutants are (1) the active landfill, (2) vehicular traffic, (3) the leachate storage
tank area, and (4j the waste processing area. The active landfill is the primary potential pollutant
area as defined by the general permit. The leachate storage tank area functions to collect
stormwater that comes into contact with waste prior to discharge to the Town of Roseboro, NC

includes glass -fused to steel bolted tanks inside a secondary containment. The vehicle traffic
associated with waste disposal, operations, and maintenance are transient across the site. Lastly,
the waste processing area accepts semi -solid wastes for mixing with other dryer wastes for
disposal in the landfill. This area includes recessed double -lined steel containment for mixing,
including a concrete apron on all sides. However, the predominant exposure would include
operational equipment which is maintained within the active landfill area. As shown in Figure
1, the proposed SDO 2. SDO 6. and SDO 10 are representative locations which include all four
(4) potential pollutant exposure activities and their watersheds cover the majority of the site.
Proposed Representative Outfall
SDO 2 represents the potential leachate pollutant and waste processing area. Active landfill
operations are represented due to SDO 1 discharging in to the drainage area for SDO 2. SCD
proposes SDO 2 be representative for SDO 1, and 2. SDO 6 represents a drainage area with
potential pollutant exposure originating from vehicular traffic. SCD proposes SDO 6 be
representative for SDO 3-8. Approximately 13.1 acres drain into Sediment Basin A (SDO 6)
located on the northeast corner of the site. SDO 10 represents the largest drainage area with the
highest potential pollutant exposure originating from the active landfill activity and vehicular
traffic. SCD proposes SDO 10 be representative for SDO 9 and 10. Approximately 37 acres
drain into Sediment Basin M (SDO 10) located on the northwestern corner of the site.

permit guidelines for Stormwater General Permit NCG120000.
Industrial Activities
The Sampson County Disposal landfill will receive municipal solid waste (MSW) originating
from residential, commercial, and industrial sources as permitted under NC Solid Waste Permit
No. 82-02. Stormwater runoff associated with the development of the site has been delineated
by drainage area as shown on Figure l (attached) and summarized by outfall watershed area in
Table 1. Currently, there are eight (8) outfall points for the active operations which warrant a
"representative outfall."

Potential Pollutant Exposure
The potential pollutants are (1) the active landfill, (2) vehicular traffic, (3) the leachate storage
tank area, and (4) the waste processing area. The active landfill is the primary potential pollutant
area as defined by the general permit. The leachate storage tank area functions to collect
stormwater that comes into contact with waste prior to discharge to the Town of Roseboro, NC
POTW (Publicly Owned Treatment Works). This storage area includes glass -fused to steel
bolted tanks inside a secondary containment. The vehicle traffic associated with waste disposal,
operations, and maintenance are transient across the site. Lastly, the waste processing area
accepts semi -solid wastes for mixing with other dryer wastes for disposal in the landfill. This
area includes recessed double -lined steel containment for mixing, including a concrete apron on
all sides. However, the predominant exposure would include operational equipment which is
maintained within the active landfill area. As shown in Figure 1, the proposed Outfall 3
represents a likely point for monitoring since it includes representative potential pollutant
exposure activities from the landfill activity.
Proposed Representative Outfall
Outfall 3 represents the largest drainage area with a representative potential pollutant exposure
originating from the site. Outfall 3 is located on the southeast corner of the site at Sediment
Basin D. Approximately 25 acres drains into Sediment Basin D, which represents both the
covered inactive and active phase of the landfill. Outfall 2 represents the potential leachate
pollutant area and waste processing area. However, the drainage area has a small watershed and
includes secondary containment. The remaining outfall areas are substantially similar to one
another in terms of size and potential pollutant exposure.

requirement of this permit. The corrected compliance language that should go under Part III, Section A: 1. is
shown below. We have also attached a new page reflecting this change for your permit file (Part III page 1 of
11). This new page should replace the current page in your permit.
SECTION A: COMPLIANCE AND LIABILITY
1. Compliance Schedule
The permittee shall comply with the permit in accordance with the following schedule:
Existing Facilities: Upon the effective date of the Certificate of Coverage the permittee shall comply
with all of the conditions detailed in Part 11, Section A: Final Limitations and Controls for Stormwater
Discharges.
New Facilities: Upon the beginning of discharges from the operation of the industrial activity the
permittee shall comply with all conditions detailed in Part II, Section A: Final Limitations and Controls
for Stormwater Discharges.

on August 31, 2(X)2. The Division staffis currently in the process ol' rewriting this permit and is scheduled to have
the permit reissued by late summer ol'2(x)2. Once tine permit is reissued, your facility would he eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this lime period may result in it civil assessment of al least $250.00. Larger
penalties may be assessed depending on the dclinqucncy of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assess nnctits of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). it' you feel your facility can certify a condition of "no exposure", i.e. the I'acilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
