C©� Mtn On behalf of the Nash County Landfill, Garrett & Moore has reviewed the Notice of Violation (NOV) of Stormwater Permit NCG120049 dated April 26, 2010. We have worked closely with Nash County Landfill staff to respond to the items listed in the NOV. Following is a discussion of our findings and actions taken to comply with the applicable Stormwater Permit. 1. Determination of Applicable Stormwater General Permit — Garrett & Moore reviewed available documentation provided by Nash County Landfill staff to determine which Stormwater General Permits are applicable. The Nash County Landfill is permitted by the North Carolina Division of Solid Waste Management. As such, the facility is eligible for coverage under General Permit NCG120000. Review of documentation provided by the Division of Water Quality central office confirms that the facility has been issued certificate of coverage number NCG120049. Item 3 of the NOV states that the Nash County Landfill has received an approval for the Sediment and Erosion Control Plan, issued by the Division of Land Resources. The Nash County Landfill facility is not under development, and does not have an active Sediment and Erosion Control Plan. Therefore, the Construction Stormwater General Permit (NCG010000) in not currently applicable to the facility. Based on our review of the available documentation and knowledge of ongoing operations at the facility, it is our opinion that the applicable stormwater general permit is NCG120000, for which the facility already holds a certificate of coverage. 2. Analytical Sampling of Stormwater Discharges — Item 1 of the NOV requests that Nash County provide sampling data associated with NCG120000. Working with Nash County Landfill staff, we are unable to determine if the required analytical sampling 1258 Benson Road • Garner, North Carolina 27529 -O: 919-792-1900 • F: 866-311-7206 Mr. Danny Smith May 13, 2010 Page 2of3 required by NCG120000 has been performed. Moving forward, the Nash County Landfill will contract with an independent sampling and analysis firm to perform the required semi-annual sampling for Chemical Oxygen Demand (COD), Fecal Coliform, and Total Suspended Solids (TSS). Weather permitting, the first sample for 2010 will be collected and analyzed prior to June 30, 2010. It should be noted that Nash County performs surface water sampling at four locations as a portion of the semi-annual groundwater monitoring program for the facility. Samples taken from the four surface water locations are analyzed for Appendix I volatile organic compounds (VOCs) and Appendix I metals as required by the state solid waste regulations. While these constituents are not required as part of the sampling protocol for NCG120000, results have indicated that the presence and ongoing operation of the facility have not caused a violation of the 15A NCAC 2B surface water quality standards. 3. Stormwater Discharge Outfall Map — Item 2 of the NOV requests that the County prepare a Stormwater Discharge Outfall (SDO) map in accordance with the requirements of NCG120000. We have prepared a SDO map that meets the requirements of NCG120000, and have provided a copy as an attachment to this letter. The map identifies the site SDO where the semi-annual analytical sampling will take place as well as stormwater best management practices (BMPs) that will be subject to qualitative (visual) inspection. Sampling frequency, methods, and parameters are indicated on the map for each BMP and SDO. 4. Compliance with Construction Stormwater General Permit NCGO10000 — Item 3 of the NOV states that the Nash County Landfill has been issued an approval for the Erosion and Sediment Control Plan by the Division of Land Resources. As discussed in Item 1 of this response, coverage under NCGO10000 is not applicable at this time. While the site is not currently covered by NCGO10000, Nash County recognizes the value in the regular visual inspections and record keeping procedures described in the Construction Stormwater General Permit. As requested in your NOV, Nash County will inspect the existing stormwater BMPs at the frequency described in NCGO10000 and maintain documentation of inspections. 5. Copies of All Permits Issued for the Facility — Working with Nash County staff, we have developed a comprehensive Surface Water Inspection and Analysis Procedures handbook for use by landfill staff and regulators. The handbook contains copies of NCG120000 and NCGO10000 (for reference), inspection forms, and documentation of rainfall data, inspections, and other pertinent information. We trust this letter provides an adequate response to the items listed in the NOV. Your help was essential and was appreciated. This was the first time DWQ inspected this facility. See the attached inspection checklist. A number of issues emerged as discussed below. Please note, this letter is structured to give guidance for required activities: 1. This permit was first issued in July 14, 1994, at which time analytical sampling of each stormwater outfall was required once a year, for Chemical Oxygen Demand (COD), Fecal Coliform, and Total Suspended Solids (TSS). No laboratory data for those parameters was produced during the inspection. If a further search can show that sampling for those parameters was carried out, please contact this office with the new information. When this permit was renewed in 2007, analytical sampling was increased to two times per year, and total rainfall was added. Failure to test for these parameters is a violation of your permit. 2. At the time of the inspection, you were unsure of the location of the Stormwater Discharge Outfalls (SDO). As we discussed, the permit requires that analytical and qualitative monitoring be conducted at each (all) designated SDO, in a frequency directed by tables within your permit. As required by your permit, please prepare a site map of the facility. This map must identify the SDO, and begin documenting the analytical and qualitative monitoring required at each (all) SDO. 3. A Construction Stormwater General Permit (NCGO10000) is issued at the time of the approval of an S & E Control Plan. This permit applies to projects that receive a Division of Land Resources (DLR) (or local delegated program) Sediment and Erosion Control Plan for land disturbance of 1 acre or greater. Specifically, the General Permit (NCGO10000) authorizes the discharge of stormwater under the National Pollutant Discharge Elimination System (NPDES) in accordance with Title 15A North Carolina Administrative Code 2H.0100 Enclosed with this letter is a copy of the NCG010000 permit and inspection record keeping; forms, and a technical bulletin. This permit requires a rain gauge to be maintained on site, rainfall data to be collected daily, weekly monitoring of all control measures, monitoring; of all control measures within 24 hours of a 0.5 inch rain event or greater, record keeping, and full compliance with erosion control plan requirements. Please document the required data for compliance with the NCG10000 permit on a form such as the one enclosed. if you have any questions about the permit, record keeping requirements, or other issues please do not hesitate to call me. 4. Copies of all DWQ permit issued for the facility are required to be on site at the landfill. We discussed using a form that is useful for the Qualitative (visual) inspections of outfalls. You may download it from http:l/h2o.enr.state.nc.us/su/documents/SWU- 242Qualitative_Monitoring Form 12608.pdf. However, there is also space for the same information on the new one -page form you are receiving; with NCGOI, so you may wish to use it instead. Please provide a written response to this letter, within 30 days of the receipt of this letter, detailing Nash County's compliance efforts with respect to the bold items in item #1, #2, #3 and #4. The compliance refers to requiring a Stormwater Pollution Prevention Plan which is not a requirement of this permit. The corrected compliance language that should go under Part III, Section A: 1. is shown below. We have also attached a new page reflecting this change for your permit file (Part III page 1 of 11). This new page should replace the current page in your permit. SECTION A: COMPLIANCE AND LIABILITY 1. Compliance Schedule The permittee shall comply with the permit in accordance with the following schedule: Existing Facilities: Upon the effective date of the Certificate of Coverage the permittee shall comply with all of the conditions detailed in Part H, Section A. Final Limitations and Controls for Stormwater Discharges. New Facilities: Upon the beginning of discharges from the operation of the industrial activity the permittee shall comply with all conditions detailed in Part II, Section A: Final Limitations and Controls for Stormwater Discharges.
