This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). The following information is included with your permit package: • A new Certificate of Coverage (COC) • A copy of General Permit NCG120000 • A copy of the Technical Bulletin for the General Permit • Two copies of the Discharge Monitoring Report (DMR) Form • Two copies of the Qualitative Monitoring Report Form The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. The more significant changes in the General Permit since your last COC was issued are noted either in the Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current- notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are posted on the Stormwater Permitting Unit's website with the new General Permit. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined in the "Definitions" section of the permit. • Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm Event." A measurable storm event is defined in the permit. • Section D: If the permittee fails to respond effectively to problems identified by qualitative monitoring, DWQ may require the permittee to perform corrective action. Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit, including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than 30 days from the date the facility receives the sampling results from the laboratory. Also note that existing permittees do not need to submit a renewal request prior to expiration unless directed by the Division. Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law, rule, standard, ordinance, order, judgment, or decree. DWQ records indicate an Ash Monofill site has been permitted under NCG120000 since 1993. The site includes a wood waste area, white goods facility, borrow pit. Stormwater runoff generated at such facilities is regulated by General Permit NCG120000. All outfalls at the site discharge to Brewers Creek. There was no discharge observed the day of the inspection with the exception of flow at the Mono SB-1 Internal Location. The permittee should be reminded that Ash Leachate is excluded from coverage under the NCG120000, and is not permitted for discharge. It appeared that flow from Mono SB-1 commingled with storm flow on site. For this reason, sampling of the NCG120040 Page 2 Internal Outfall MonoSB-1 (non -storm related) and sampling of Brewers Creek downstream at Justice Road was completed the day of the inspection. Halifax County is currently working with the Division of Waste Management and Engineering Firm -Richardson, Smith, Garner and Associates, Inc., to construct a leachate collection system for the three Ash Monofiils. Please understand discharge of stormmwater associated with the Ash Monofills is not covered by the NCG120000, and would require an NPDES wastewater discharge permit prior to discharge to surface waters. The sampling results are provided for your review. Please provide a written response to the following: 1. Please confirm the MonoSB-1 and Brewer Creek Downstream Sample Results have been reviewed and explain how coal ash leachate is currently being managed on the site to ensure that a discharge is not occurring to waters of the state. A discharge to waters of the state requires a NPDES wastewater discharge permit. 2. Please provide a schedule for the installation and completion of the Leachate Collection System, and indicate the ultimate disposal solution of the wastewater of the Leachate Collection System. However, the permittee is required to respond to the DWQ Surface Water Protection Section Raleigh Regional Office inquiry on the status of the Leachate Collection System installation and completion, as internal outfalf sample results show the Leachate has the potential to negatively affect water quality and the NCG120000 does not cover this discharge. The sample results from Brewers Creek downstream exhibited reduction chemistry (Fe and Mn) and/or soil composition that appears to be consistent with other streams receiving C & D landfill discharges. However, the results showed the presence of Boron at 88 ug/L. This indicates potential for elevated levels of Boron, and possibly other (coal ash constitiuents: As, Li, Ni, Mo, Se, TI, or V) which were seen at elevated levels at the Mono-SB1 internal outfall. Hg is another constituient of concern as no Low Level Hg was obtained during the sample event. There is a riser in the 2Id cell which goes to a sump pump to bring any rain water coming down on the coal ash, down to a sediment basin which then flows out to a creek. I don't know if you are familiar at all with the site, but it was built as a lined coal ash landfill in the 1990's. Until a little over one and one half years ago, very little coal ash had been put at the site. In Jan. or February of last year, many of the structural fill sites around the county received NOV's from the Solid Waste Section, so at that time, the coal fired power plant in Weldon started sending all of their ash to the County Industrial Coal Ash LP. The sediment basin where the leachate from the coal ash goes, now has an obvious black sediment in it. This leachate then can seep through the rip rap at the drain pipe and flow to the nearby creek. There is not really any flow at this time, but with a significant rain event, I am concerned with the coal ash leachate that would be entering the creek. In talking to Myrle this AM, it sounds like there is a storm water permit for the landfill, but it sounds like it addressed mainly the C&D- nothing specific to the coal ash part of it. Is it possible for DWQ to check out the site, now that the coal ash is coming to the site in great quantities? Please let me know what you decide. Two other sedimentation basins located around the coal ash monofill receive stormwater from areas outside the monofill which have been vegetatively stabilized. (RSG) to perform stormwater training for Halifax County personnel. A copy of the training information is included in Attachment 3. During site training it was noted that prior samples had been collected from the pipe that discharges from the coal ash monofill into the sedimentation basin rather than the discharge from the sedimentation basin toward the surface water body. This confusion has�been rectified and future samples will be collected from the discharge pipe from the sedimentation basin. In the future, samples will also be collected twice per year. Comment No. 2 the site map indentifies three stormwater outfalls, SW-1, SW-2 and SW-3. Your facility also holds a Solid Waste permit for accepting fly ash, and that permit requires semi-annual sampling for a number of parameters. The outfalls have been analyzed for those parameters (a list of metals, mostly), but not for the three parameters noted in Item 1. It will be a simple matter to add COD, Fecal and TSS to the list of analytes from this point forward. Response No. 2 Sampling locations SW-1, SW-2 and SW-3 are not stormwater outfalls, but rather surface water sampling locations located upstream and downstream of the closed municipal solid waste (MSW) landfill unit. As such they are not appropriate locations for stormwater sampling. The future stormwater sampling location for the coal ash monofill will be from Mono-SIB-1 as shown on the attached Figure 1. Comment No. 3 DWQ requests that a copy of the data for years 2000 to the present for outfalls SW-1 through 3 be sent to RRO. The State is currently studying the relationship of coal ash storage and water quality in stormwater, so this data will be helpful in building this database. Response No. 3 As stated above, the three surface water sampling locations are associated with the closed MSW landfill unit and are therefore not appropriate for evaluating the impact of the lined coal ash monofill on stormwater. However, one surface water sample has been collected downstream of the coal ash monofill sedimentation basin discharge. Analytical data from this location have been previously submitted to NCDENR's Solid Waste Section on a semi-annual basis as a part of regular water quality monitoring for the site. Analytical data for this location from 2007 to present are included in Attachment 4 for your information. Accordingly, enclosed with this letter is a copy of the permit and inspection record keeping forms, and a technical bulletin. This permit requires a rain gauge to be maintained on site, rainfall data to be collected daily, weekly monitoring of all control measures, monitoring of all control measures within 24 hours of a 0.5 inch rain event or greater, record keeping, and full compliance with erosion control plan requirements. if you have any questions about the permit, record keeping requirements, or other issues please do not hesitate to call me. Response No. 4 There are currently two rock dams located adjacent to the borrow area (one to the north and one to the south). These will be visually inspected weekly and/or after a 0.5 inch rainfall event. The rock dam locations are shown on Figure 1. Additionally, a rain gauge is being installed so that daily rainfall measurements may be recorded. Comment No. 5 The secondary containment for the large fuel tank has a drain valve. The NCG 12 permit requires a lock of some kind (padlock, or cable plus padlock) to safeguard against unauthorized release of water and spilled petroleum to the ground. Please add a lock. This landfill has a cun,ent storm water permit (NCG120040). The entire project site is shown on the attached Figure 1. There are four sedimentation basins associated with this landfill. Two of these sedimentation basins are shown on Figure 2. The discharge pipe for the uppermost sedimentation basin was originally constructed to go underneath the lower (larger) sedimentation basin (Figure 2). Since the original construction, a new discharge pipe was installed to circumvent the lower sedimentation basin. The old discharge pipe was disconnected from the upper sedimentation basin, however it was not removed, nor was it blocked off at the discharge end. On September 18th, 2003, during Hurricane Isabel apparently a breach formed in the remaining section of this old pipe underneath the lower sedimentation basin. The approximate location of the breach is shown on Figure 2. An inspection of the stream area adjacent to the discharge pipe indicates no evidence of coal ash sediments being discharged into the stream. However, water was likely discharged by the breach. The amount of water that may have been discharged is unknown. Due to water in the sedimentation basin the breach was not noticed until Saturday September 20"'. The following week workers fixed the breach in the pipe and filled the discharge end of the pipe with rubble and concrete to prevent future discharges from this abandoned pipe.
