In accordance with your application for a discharge permit received on April 22, 2013, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state — NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
Per the requirements of the Tar -Pamlico Riparian Buffer Rule, all stormwater drainage to
stream buffers, from portions of this site that have been constructed after January 1, 2000, must be
discharged through a correctly designed level spreader or another device that meets diffuse flow
requirements per 15A NCAC 2B .0259. Diffuse flow requirements are described in Chapter 8 of the
North Carolina Stormwater BMP Manual, available at: http://Portal,ncdenr.orgjweb/wq/ws/su/bmp-
manual.
This permit does not affect the legal requirements to obtain other permits which may be
required by the Division of Water Quality or permits required by the Land Quality Section of the
Division of Energy, Mining and Land Resources, Coastal Area Management Act or any other federal or
local governmental permit that may be required.

This certificate of coverage shall become effective June 12, 2013.

Yes. We could probably modify the COC under NCG10 to include additional monitoring, and it would be considered a
minor modification. In an extreme case, we could rescind the permit (actually, I think there's a different term for when
the State takes that action, rather than the permittee, but it escapes me. Terminate the permit, maybe? Karen said
once a DWQ Director in recent history had never done it. Danny probably knows the distinction.) h .
A slower resolution would be to work with the permittee to address the immediate issues and then not renew coverage
under NCG10 for this facility in 2017... but that's three years. They would either (1) not get another stormwater permit
at all or (2) have to apply for an individual stormwater permit. That's a long time to wait if there's a serious problem. If
there really is a reason NCG10 is just not appropriate given the circumstances, the easiest thing is to instruct the
permittee to request a rescission of the COC under NCG10 and either apply for an individual SW permit, or— if what
we're dealing with here really is a wastewater discharge — apply for a wastewater permit of some kind. Our next step
would hinge on his following through. Alternative pursuits would be other compliance and enforcement angles (WQ
standard violations, hazardous waste violations, etc.).
It really depends on what the real facts are.
Thanks for helping to fill the gaps on our knowledge about this place, Autumn. At this stage, we'll let the key players in
RRO coordinate on the next step and advise Central Office from there.

I received a message last week from Bryan Webb about his knowledge of possible groundwater/soil/ and hazardous
waste at Medoc site. He also mentioned solid waste. As you might recall, Mary Whaley wrote an NOV and was working
with the site on {solid waste}matters and she was involved in ensuring that solid waste requirements were met.
I am not sure how recently Mr. Webb was at the site, but our two site visits/ inspection/surface water sampling "from a
surface water investigation" came back with no indication of contamination to the stream that borders the property.
This is the extinct of our efforts for SWP investigation and no prior knowledge of hazardous waste determinations or UST
soil contamination determinations, or any information regarding groundwater.
The complaint from Mr. Bryan Webb alleges issues based on solid waste, hazardous waste, soil, and groundwater.
Since our DWR SWP section has now merged with Aquifer Protection section, RRO can determine if there are any wells on
the property that can be tested for groundwater contamination? And I am happy to make a joint site visit with any of
the sections, if that is what is needed to answer Mr. Webb's complaint.

Attached is a copy of my Mercury Switch inspection report from June 2013. As we discussed, the report focused upon
the Highway 48 (1 called it retail) location and not the October Road site.
Mr. Mills did take me on a tour of the October road location with the preface that their plan was to use that site to begin
crushing once the proper permits were in place. He also mentioned Autumn as the person who was helping him with
the permits.

I'm a little confused, too. The COC permit NCGl00229 matches the facility location at 280 October Lane in Enfield, but
this appears to cover an already -operational site. Or, at least one that has been Unless Samuel Mills has an alias, I
don't know why the exchanges below reference Samuel Lynch ... unless son and father are mixed up in the records
provided to us, and son has a different last name. It sounds like this business owner is days within final approval by
Halifax County for operation, so maybe that's the final step (and reason for urgency of action, according to Brian Wells).
Solid Waste or RRO colleagues, are there any relevant updates about this project or any contamination history?

May not matter, but I wanted to point out that Samuel Mills appears to be the owner of Medoc Metals according to the

I had a call this morning from Mr. Brian Wells (910-579-2514) about this proposed used motor vehicle recycling
operation. I recognized it because I just responded to Autumn's forwarded inquiry about the stormwater permit. Julie
processed the permit application after RRO's approval to move ahead, and nothing in the file indicated any outstanding
issues with the site.
Brian said the soil and groundwater on this property is severely contaminated, and this business should not be allowed
to operate there. He indicated was a retired employee from DENR and gave me some of your names as specific
contacts. 1 encouraged him to contact the Raleigh Regional Office programs directly to investigate a potentially serious
concern with current site conditions, but he was reluctant and wants to maintain his distance. However, he did want me
to give you his number if any of you needed to contact him directly about his knowledge. Brian encouraged a rapid
response because the county is in the process of approving the business to begin very soon (maybe next week?)
Our issuance of the COC directs the operators to comply with stormwater discharge conditions of the NCG100000
General Permit. At the moment, our staff can't do much to renege that authorization. If there are issues with this site
that deem a General Permit inappropriate (or any discharge at all being allowed without further investigation or
clean-up), please advise our Program about the next step.

application/NOI was hand delivered to Mr. Lynch at the Medoc Store Location and he called subsequently and
was assisted over the phone with application questions. Can you let Mr. Roundtree know if we received Mr.
Lynch's application for stormwater COC NCG 100000 and if so, the status of issuance? I believe Halifax
Planning(Mr. Roundtrec) is holding off permitting locally until DWQ and DWM can confirm compliance with
state regulations at this site, and need the status.

consideration.
I left the owner, the permit application for the required NPDES NCG100000 Stormwater permit. He called
yesterday for assistance with the application, and my understanding is that he was mailing the completed
application to the DWQ Central Office Stormwater Permitting Unit yesterday.
I collected on -site water samples (not representative stormwater samples, as it was not raining the day of my
site visit). I also used field meters to collect conductivity, pH, dissolve oxygen, saturation, and temperature of
the upstream and nearby waterbodies. The conductivity if (high) could indicate water pollution, but the
conductivity readings were very low at the upstream and nearby waterbodies. The conductivity of the ponded
stormwater in the scrap yard was on the high side, so that sample was sent to DWQ Lab for Oil and Grease,
and Metals analysis. It will be 30 days before the results are available from the Lab. The results will give an
indication of what could be present in stormwater and could be reviewed by the Permitting Unit for
determining if the permit monitoring is appropriate, or if an individual permit (with other monitoring
parameters) will be needed.
Currently, I have no water quality violations to address and DWQ will normally give the owner 30-60 days to
submit a permit application for NPDES NCG 100000 permit. So at this time, RRO will wait to receive the
application and wait for the water sample results.
I have spoken with Mary and e-mailed the photos of the solid waste on -site. She is to visit the site and
determine if there is a solid waste violation. If there is a solid waste violation, then DWQ will likely hold off
on issuing a stormwater permit until that violation has been resolved.
I will be in touch with Mary as we move forward and will share the water results with you all when received
from the Lab.

DEMLR, DWR, and DWM colleagues,
had a call this morning from Mr. Brian Wells (910-579-2514) about this proposed used motor vehicle recycling
operation. I recognized it because I just responded to Autumn's forwarded inquiry about the stormwater permit. Julie
processed the permit application after RRO's approval to move ahead, and nothing in the file indicated any outstanding
issues with the site.
Brian said the soil and groundwater on this property is severely contaminated, and this business should not be allowed
to operate there. He indicated was a retired employee from DENR and gave me some of your names as specific
contacts. I encouraged him to contact the Raleigh Regional Office programs directly to investigate a potentially serious
concern with current site conditions, but he was reluctant and wants to maintain his distance. However, he did want me
to give you his number if any of you needed to contact him directly about his knowledge. Brian encouraged a rapid
response because the county is in the process of approving the business to begin very soon (maybe next week?)
Our issuance of the COC directs the operators to comply with stormwater discharge conditions of the NCG100000
General Permit. At the moment, our staff can't do much to renege that authorization. If there are issues with this site
that deem a General Permit inappropriate (or any discharge at all being allowed without further investigation or
clean-up), please advise our Program about the next step.

In cleaning up my e-mails, I lost the e-mail that accompanied this NO1. I hope it came from you.
There is not enough information for me to do much with this application. From the Lat/Long it appears that it
may be in the Little Fishing Creek basin, but I am not for sure. His map showed a Rock Spring Branch and a
Hazel Nut Branch, but I am not sure which tract is his. For sure they need the permit, but as far as stream info
— not absolute from application.
