Staff with the Fayetteville Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) has reviewed
your request received on December 8, 2016 for a determination that stormwater discharge outfall (SDO) number two be
granted representative outfall status for stormwater outfall number one. Based on the information and maps provided and
the site visit on July 15, 2016, we are approving this request. In accordance with 40 CFR §122.21(g)(7), you are
authorized to sample outfall number two as a representative outfall. This approval is effective with the next sampling
event. Please be reminded that the permit requires Qualitative (visual) Monitoring to be performed at all stormwater
discharge outfalls, regardless of representative outfall status.
Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) to document that representative outfall
status has been approved. If changes in drainage areas, structures, processes, storage practices, or other activities occur
that significantly alter the basis of this approval, representative outfall status is no longer valid. In that case, you should
resume sampling at all SDOs, or reapply to this office for representative outfall status based on updated information. If

To Whom It May Concern:
As part of our preventative maintenance program, we keep all oils, antifreeze and
diesel fuels in separate labeled containers. We do not, however, do customer oil
changes on a large basis. When we do customer oil changes, these liquids are
stored in a designated location, on pallets, at our facility. In the event of small
leaks while working in the shop, we use oil dry solvents to soak up the fluids. This
is also put in separate and labeled containers. Our antifreeze is also disposed of in
limited quantities due to not doing customer servicing, however the small amount
that we do have, is put into containers and labeled as well. We have an air
condition machine that is used to release old freon out while working on our shop
vehicles and cars we repair to be sold. At this time we do not service customer air

We appreciated being able to meet with you, Mr. McKeithan and Mr. Soles at your facility in July. We still need to
receive the requested Response Letter for the Notice of Violation which was due August 1". In the letter please include
the reason why the violations stated in the Notice of Violation occurred
(i.e. The Stormwater Pollution Prevention Plan and neither the Analytical nor the Qualitative Monitoring had been
implemented) and a Plan of Action to prevent these violations from recurring. The letter needs to be signed by yourself
or by Mr. McKeithan if you designate him as your agent. It states in the General Permit NCG100000 that if stormwater
monitoring has not occurred on a semi-annual basis that monthly monitoring may be required for all parameters. At this
time, this Division is not requiring monthly monitoring, but if additional monitoring has not occurred between January 1,
2017 and June 30, 2017, monthly monitoring will be required. The site map for the Stormwater Pollution Plan will need
to be modified including the information specified in General Permit NCG100000. Also, the qualitative monitoring forms
will need to be completed when you do the stormwater monitoring. Please send us a copy of the Annual Summary Data
Monitoring Report Form (DMR) which will need to be completed at the end of the year (see attachment). Please forward
this email to Mr. Mike McKeithan. If you or he have any questions about the DMR or the Representative Outfall Status
Request forms please contact me.

On May 5, 2016, Melissa Joyner from the Fayetteville Regional Office of the Division of Energy, Mineral and Land
Resources, conducted a site inspection for the A -Bishop Towing & Recovery facility located on Dunn Road, Cumberland
County, North Carolina. A copy of the Compliance Inspection Report is enclosed for your review. Arnold Cherry,
employee, was also present during the inspection and his time and assistance is greatly appreciated. The site visit and file
review revealed that the subject facility is covered by NPDES Stormwater General Permit NCG100000, Certificate of
Coverage NCG100222, Permit coverage authorizes the discharge of stormwater from the facility to receiving waters
designated as Locks Creek, a Class C water in the Cape Fear River Basin.
As a result of the site inspection, the following permit conditions violations are noted:
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) was not available for review at this facility and has not been properly
implemented.
Z) Qualitative Monitoring
Qualitative monitoring has not been conducted and recorded in accordance with permit requirements.
3) Analytical Monitoring
Analytical monitoring has not been conducted and recorded in accordance with permit requirements.
Other Observations:
Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the
inspection.
• Additionally, according to our database the annual invoice has not been paid for 2013, 2014 and 2015.
Requested Response:
You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice. Your written
response should include a reasonable explanation as to why the aforementioned violations have occurred as well as a
Plan of Action to prevent these violation(s) from recurring.

Inspection Summary:
Melissa Joyner met with Mr.Geraid Bishop, owner, and Arnold Cherry, employee, at the A -Bishop Towing & Recovery
facility on May 5, 2016. This facility had previously received a Notice of Violation on May 19, 2014 for not having a
Stormwater Pollution Prevention Plan (SPPP), and not conducting Analytical or Qualitative monitoring. The SPPP was not
available for review and was not being implemented. The SPPP was provided at a later date to the Inspector by the
environmental consulting firm Mid Atlantic Engineering & Environmental Services. Analytical and Qualitative monitoring was
still not being conducted. It is a requirement of General Permit NCG100000 that the SPPP be actively implemented and
that Analytical and Qualitative monitoring be conducted on a semi-annual basis.
Ms. Joyner reviewed the grounds of the facility, including outfall one located on the northeast side of the facility, adjacent to
Dunn Road. In the SPPP it was stated that there are two outfalls with the second outfall not being associated with the
industrial activities. There was fluid noted on a dirt road upslope of a ditch on the west side of the site which appeared to be
a second outfall. Both outfalls would need to be monitored. Exposed cars and car parts were observed throughout the site.
There were also fluid stains on the ground of the outdoor processing areas. An exposed, half-filled drum with the lid removed
was, on the ground. Discolored liquid was observed inside of the drum. Bulk storage containers including several drums
were placed on pallets in a covered storage area, The storage containers were less than 660 gallons and the combination of
the containers appeared to total less than 1,320 ga[Ions,therefore secondary containment is not necessary. The concrete
swale leading to the outfall had dirt in it and was in need of maintenance. The recommendations in the SPPP need to be
followed to prevent possible off -site impacts from stormwater containing contaminants from exposed cars, car parts and the
open drum.

1.0 INTRODUCTION
This Stormwater Pollution Prevention Plan (SPPP) has been prepared for the A -Bishop
Towing and Recovery facility located at 714 Dunn Road in Fayetteville, Cumberland
County, North Carolina (Drawing 1.1). The SPPP is designed to meet the requirements of
the U.S. EPA's National Pollutant Discharge Elimination System (NPDES) program for
stormwater discharges and North Carolina Department of Environment and Natural
Resources (NCDENR), Division of Water Resources General Stormwater Permit
NCG 100000.
2.0 SITE PLAN
2.1 Site Activities
The facility site map (Drawing 2.1) identifies the site drainage features, outfall locations
and locations of significant materials at the facility.,The facility operates on approximately
24.87 acres (hereafter referred to as the "site") and fully dismantles late model foreign
and domestic automobiles and light trucks for the sale of auto parts. The facility also
performs vehicle towing and recovery services. The site consists of the following:
• Main office area;
• Dismantling garage and associated maintenance bays;
• Miscellaneous covered parts storage areas;
• Transmission/core storage building;
• General parts storage building (includes frame machine and body work area);
• Temporary vehicle storage area (tow yard);
• Fluid storage areas; and
• Vehicle holding and staging areas.
The site consists of three industrial activity drainage areas, as shown on Drawing 2.1. The
on -site industrial activities (vehicle holding, dismantling, crushing and parts storage) are
primarily conducted in Drainage Area No. 1, with additional vehicle holding and staging
activities also conducted in Drainage Areas No. 2 and 3, respectively. Stormwater at the
site either infiltrates the sandy site soils, leaves the site as sheetflow or discharges off -site
at Outfalls No. 1 and 2 (Note: Outfall No. 2 is not associated with industrial activities).
Runoff from the site ultimately discharges into Blue Creek, which runs along the northern
property boundary of the site.
2.2 Site Description
The A -Bishop Towing and Recovery facility is located at 714 Dunn Road in Fayetteville,
North Carolina. Primary dismantling and recovery operations are conducted on the
northwest portion of the site, with the central and southern portions of the site used for
vehicle staging operations. The temporary vehicle storage area (tow yard) is located on
the northeast portion of. the site.

Incoming vehicles are brought to the site, inspected and staged. in the holding area,
located along Dunn Road on the northwest portion of the site (Drainage Area No. 1). The
vehicles will be taken from the holding area to the dismantling garage, where the parts will
be removed and the fluids drained (Note: prior to implementation of this Plan, previous
facility operations included staging of the vehicles prior to fluid draining/parts removal).
Used oil is collected inside the dismantling garage using mobile drip pails, which are then
transferred into designated 55-gallon drums. The drums are staged on wooden pallets
underneath the covered storage area located adjacent to the west of the dismantling
garage. Antifreeze is removed from the vehicles prior to being recycled and reused in
personal vehicles and/or vehicles associated with the facility's towing and recovery
operations. Fuel tanks associated with the incoming vehicles are required to be empty,
and therefore gasoline is not removed during the initial dismantling activities. Residual
fluids recovered during vehicle crushing activities are containerized into 55-gallon drums,
prior to being hauled off -site by a certified disposal contractor (AAA Environmental).
Vehicle draining and dismantling activities are conducted inside the dismantling garage
on the northwest portion of the site. Parts with the greatest potential to impact stormwater
(transmissions, cores, etc.) are either stored on covered storage racks or inside one of
several on -site storage buildings/sheds. Batteries are removed from the vehicles and
stored on pallets inside the dismantling garage prior to being either reused or transported
off -site for disposal. Tires in good condition are removed from the vehicles and stored on
covered racks on the southern portion of the site for reuse. Scrap tires are temporarily
stockpiled at various locations across the site, prior to being transported off -site for
disposal at the local landfill. Rims are also removed from the vehicles, separated from the
tires and either stockpiled at various locations throughout the site, prior to being
transported off -site for sale as scrap metal.
After draining/dismantling, the vehicles are staged at various locations throughout the
central and southern portions of the site. In the event of crushing, these activities will be
conducted using an outside contractor and mobile crusher. The vehicles are then
crushed, loaded onto tractor trailers and hauled off -site for sale as scrap metal. Metal fuel
tanks are removed from the vehicles, crushed and then hauled off -site for sale as scrap
metal. Plastic fuel tanks are removed from the vehicles and temporarily stockpiled on -site
prior to being hauled off -site for disposal at the local landfill.
Vehicle staging activities take place across the central and southern portions of the site
(majority of the site) and thus have the greatest potential to impact stormwater. These
activities present a significant threat to stormwater due to the oils, greases, etc. that may
be present on the vehicles and subsequently come into contact with stormwater.
Significant threats to stormwater from the on -site operations include the following:
• Oils, greases, etc that may be present on vehicles stored in their designated areas;
• Release of residual fluids from vehicles during crushing operations;
• Release of petroleum during fuel transfer and storage operations;

• Release of residual fluids during transfer and storage operations; and
• Sediment erosion due to the consistent use of forklifts and facility vehicles.
3.0 SITE ASSESSMENT
Specific potential stormwater contaminant sources are identified and discussed below.
3.1 Narrative Description/Potential Pollutants
3.1.1 Storage Practices
Storage of various materials occurs throughout the site. A list of stored material is
summarized below. Please note that the actual quantity and location of materials stored
at the facility may change due to inventory and facility operations.
Auto Parts — Parts with the greatest potential to impact stormwater (transmissions, cores,
etc.) are either stored on covered storage racks or inside the parts storage buildings/
sheds located on the northwest portion of the site. The remaining parts are either stored
under cover inside designated storage areas or outside on racks, pallets and the ground.
There is a potential for stormwater contamination if these materials come into contact with
stormwater or if any oils/fluids from these materials leak onto the ground surface on the
yard and come into contact with stormwater.
Batteries — Batteries are removed from the vehicles and stored inside the dismantling
garage on the northwest portion of the site. The batteries are stored on pallets (to
minimize contact with the ground surface) prior to being either reused or transported off -
site for disposal. There is minimal potential for stormwater contamination since the
batteries are stored indoors and under cover with no exposure to stormwater.
Tire Storage — Tires in good condition are removed from the vehicles and reused on
facility vehicle and/or personal vehicles. Scrap tires are temporarily stockpiled at various
locations across the site, prior to being transported off -site for disposal at the local landfill.
There is a potential for stormwater contamination if residual solids wash off of these tires.
Rim Storage — Rims are removed from the vehicles, separated from the tires and either
stored inside a designated storage area for commercial resale or stockpiled at various
locations throughout the site, prior to being transported off -site for sale as scrap metal.
There is a potential for stormwater contamination if residual materials or solids are
released from the rims after coming into contact with stormwater.
Fuel Tank Storage — Metal fuel tanks are removed from the vehicles, crushed and then
hauled off -site for sale as scrap metal. Plastic fuel tanks are removed from the vehicles
and temporarily stockpiled on -site, prior to being transported off -site for disposal at the
local landfill. There is a potential for stormwater contamination if fuel from these tanks
leaks onto the ground surface and comes into contact with stormwater.

Vehicle Storage — Prior to dismantling, incoming vehicles are stored in the designated
holding area located along Dunn Road .on the northwest portion of the site (Drainage
Area No. 1). Since vehicles are staged in these areas prior to being drained and the parts
removed, the vehicles and their cores may contain motors, transmissions, fluids, small
mechanical parts, etc. There is a potential for stormwater exposure if residual liquids are
released from the vehicles or if fine solids are washed from the vehicles while positioned
in the holding area.
Mercury Switches — Mercury containing convenience lighting switches are removed from
vehicles prior to crushing. The switches are stored and shipped for recycling/disposal
through the End -of -Life Vehicle Solutions (ELVS) program, designed to promote proper
management of these switches.
Potential pollutants associated with the storage practices above include oils, greases,
petroleum, other vehicle fluids (transmission fluid, wiper fluid, hydraulic fluid), metals, and
suspended solids.
3.1.2 Loading and Unloading Activities
The following is a brief description of loading and unloading practices at the,facility.
Scrap Vehicles -- Scrap vehicles are brought to the site, inspected and then stored in the
holding area located along Dunn Road on the northwest portion of the site (Drainage
Area No. 1). After the fluids are drained and the parts removed, the vehicles are staged at
various locations throughout the central and southern portions of the site. These vehicles
may potentially be crushed, loaded onto tractor trailers and hauled off -site for sale as
scrap metal. Vehicle crushing activities would be conducted using an outside contractor
and a mobile crusher.
Used Batteries — Batteries are removed from the vehicles and stored inside the
dismantling garage on the northwest portion of the site. The batteries are stored on
wooden pallets (to prevent contact with the ground surface) prior to being either reused or
transported off -site for proper disposal.

Fuel Tanks — Fuel tanks are drained and removed from the vehicles prior to crushing.
Metal fuel tanks are crushed and transported off -site for sale as scrap metal. Plastic fuel
tanks are temporarily stockpiled on -site prior to being transported off -site for disposal at
the local landfill.
Tires and Rims — Tires are removed from the vehicles, separated from the rims and either
reused on facility/personal vehicles or stockpiled at various locations across the site, prior
to being transported off -site for disposal at the local landfill. Rims are also removed from
the vehicles and either resold or staged at various locations throughout the site, prior to
being transported off -site for sale as scrap metal.
Residual Fluids — Used oil, transmission fluid, antifreeze and other liquids are removed
from the vehicles and transferred into their respective storage containers prior to being
either recycled/reused (antifreeze) or picked up and hauled off -site by AAA Enironmentai.
Crushed Vehicles — In the event of crushing, these activities would be conducted using an
outside contractor and mobile crusher. The crushed vehicles would then be loaded onto
tractor trailers and transported off -site for sale as scrap metal.
Loading/Unloading _ Areas — The following general steps are taken when loading or
unloading fluid storage vessels (if necessary):
1. Facility personnel will be present during the entire loading/unloading operation;
2. Tanker trucks (if utilized) will be inspected and not allowed to load/unload if there
are active leaks, evidence of a slow leak, or conditions which might otherwise
contribute to a spill;
3. The tanker truck (if utilized) will be properly positioned as close as possible to the
storage vessel, the parking brakes set, the transmission in gear, wheel chocks put
in place, and engine, lights, and unnecessary electrical equipment turned off. The
operation of equipment necessary to transfer liquid is acceptable;
4. The tank will be checked to verify available capacity for the volume to be
delivered;
5. Valves will be checked to assure that product to be unloaded will be transferred
into the proper tank. Unloading hose connections will be checked for tightness;
6. Drip pails will be used when connecting/disconnecting hoses;
7. Lines, hoses, and connections will be observed for leaks during loading/unloading;
8. Sorbent pads will be placed under the hose connections at the tanker truck (if
utilized) in the case of small quantity spills and/or leaks;
9. After load inglunloading is completed, all hoses will be checked to assure proper
disconnection;
10. Upon completion, the pump will be stopped and compartment valve closed; and
I I. The transfer hose will be elevated at the compartment end and the pump re-
started to evacuate material in the hose, or the wet hose will be drained into an
appropriate receptacle.

Potential pollutants associated with the loading/unloading areas above include oils,
greases, and petroleum.
3.1.3 Outdoor Process Areas
The outdoor processing areas at the facility include the storage of tires and rims and
vehicle holding, storage and potential crushing. These activities and storage practices
primarily take place across the central/southern portions of the site. As previously stated,
the primary threats to stormwater associated with these practices are the release of
residual fluids from the vehicles.
3.1.4 Dust/Particulate Generating and Control Practices
There are no dust/particulate generating activities at the facility. Since portions of the site
consist of dirt and gravel access roads and vehicle staging areas, there is a potential for
dust generation from high winds or through vehicle traffic on the site.
3.1.5 Waste Disposal Practices
Parts from vehicles that can be salvaged for resale are removed from the vehicles and
stored under cover or inside various site buildings and storage sheds. Mercury switches
are removed from the vehicles and stored on -site, pending proper disposal via ELVS.
Used oil, transmission fluid, antifreeze and other liquids are removed from the vehicles
and transferred into their respective storage containers prior to being either recycled and
reused (antifreeze) or picked up and hauled off -site by AAA Environmental. Scrap tires
and plastic fuel tanks are transported off -site for disposal at the local landfill. Scrap rims
and crushed vehicles (potential) are transported off -site for sale as scrap metal. The
primary threats to stormwater associated with these practices are the release of fluids
from the vehicles and associated components.
3.1.6 Vehicle and Equipment Leaks
There is a potential for oil, grease, and petroleum buildup from equipment and vehicle
leaks in these areas, which could contact stormwater.
3.2 Spill Incidents
There have been no reported significant spills or leaks of pollutants at the facility in the
last three years. EPA defines "significant spills" as releases in a 24-hour period of
hazardous substances in excess of reportable quantities under Section 311 of the Clean
Water Act and Section 102 of CERCLA. A list of significant spills is provided as Table 3.1.

3.3 Nan-Stormwater Discharge Certification
The general stormwater permit requires that each stormwater outfall be evaluated for the
presence of non-stormwater discharges. A certification statement must be signed in
accordance with Part III, Section B, Paragraph 5 of the permit.
Stormwater at the site either infiltrates the sandy site soils, leaves the site as sheetflow
(Drainage Area No. 2) or discharges off -site at Outfall No. 1. Nan-stormwater discharges
would be seen by the observance of surface flow during dry periods. In order to evaluate
the facility for non-stormwater discharges, the drainage surfaces will be visually inspected
by the pollution prevention team leader or a member of the team. The observation tests
will be conducted during dry periods, when there is no potential for Stormwater flow.
Observed flow may indicate the presence of non-stormwater discharges. The visual
inspections will be documented on the attached Non-Stormwater Discharge Assessment
and Certification (Table 3.2). The certification form will be maintained on file with this
SPPP.
4.0 STORMWATER MANAGEMENT PLAN
The facility currently employs measures that reduce or eliminate the potential for
stormwater contamination.
4.1 Feasibility_Study - Operations and Storage Practices
This feasibility study addresses the technical, and in general terms the economical,
feasibility of changing operations and storage practices to eliminate or reduce exposure of
materials and processes to stormwater.
4.1.1 Operations
Current facility operations result in some exposure of stormwater to potential
contaminants. Operations that could be changed include the following:
Requiring all vehicles to be free of liquids (oils, fuels, antifreeze, etc.) prior to
entering the site;
Improved housekeeping; and
Conducting vehicle crushing operations (if necessary) on impervious surfaces,
under cover and/or constructing berms/canopies to divert stormwater from these
operations.
Although each of these is technically feasible, these changes may not be considered
economically feasible with respect to current operations and the minimal stormwater
exposure at the site. General housekeeping will continue to be improved across the
facility, in accordance with Section 6.0.

Current facility storage practices result in some exposure of stormwater to potential
contaminants. Storage practices that could be changed include:
• Constructing berms to divert stormwater away from vehicle storage areas;
• Improved housekeeping; and
• Storing all recovered fluids in secondary containment structures.
Although each of these is technically feasible, these changes may not be considered
economically feasible with respect to current operations and the minimal stormwater
exposure at the site. As indicated above, general housekeeping will continue to be
improved across the facility, in accordance with Section 6.0.
4.2 Secondary Containment
The general stormwater permit requires the permit holder to develop a schedule to
provide secondary containment for bulk storage of liquid materials, storage of Section 313
of Title III of the Superfund Amendments and Reauthorization Act (SARA) water priority
chemicals, or storage of hazardous materials to 'prevent leaks and spills from
contaminating stormwater runoff. Bulk storage is defined as a single aboveground
container having a capacity of greater than 660 gallons or multiple aboveground storage
containers located in close proximity to each other having a total combined storage
capacity of greater than 1,320 gallons. The secondary containment devices should be
controlled by manually activated valves or other similar devices and should be secured by
a locking mechanism. If the discharge from the containments can impact stormwater, the
water that accumulates in the containment areas shall be visually observed for color,
foam, outfall staining, visible sheens, and dry weather flow prior to release of the
accumulated stormwater. Records documenting the individual making the observation,
the description of the accumulated stormwater, and the date and time of the release shall
be kept for a period of five years.
Used oil is stored in 55-gallon drums in the covered storage area located adjacent to the
west of the dismantling garage. These storage vessels are all less than 660-gallons and
do not have a total combined capacity of 1,320-gallons; therefore, secondary containment
is not required for these vessels.
4.3 Best Management Practices
BMPs are measures/practices used to reduce the amount of pollution entering surface
waters and can take the form of a process, activity or physical structure. The following
BMPs are used at the facility to help reduce the potential for stormwater pollution.
• The facility has chain -link fencing and locked gates for security measures;
• A designated holding area is used at the site and vehicles are stored with hoods

down in these areas to limit stormwater contact with engines, parts, etc;
• Draining of scrap vehicles occurs primarily under cover and over dedicated drain
stations inside the dismantling garage;
• Dismantling activities are primarily conducted under cover inside the dismantling
garage;
• Parts with the greatest potential to impact stormwater (transmissions, cores, etc.)
are stored indoors and/or under cover;
• Batteries are removed from the vehicles prior to crushing and stored inside the
dismantling garage prior to being reused or taken off site for disposal;
• Scrap. tires are stored throughout the site prior to being transported off -site for
disposal at the local landfill;
• Mercury switches are removed during the dismantling process and are recycled/
disposed through ELVS;
• Fluids removed from the vehicles are stored in their respective storage vessels
(55-gallon drums) with the lids covered and/or tightly sealed;
• Only storage containers with good structural integrity are used at the site;
• Recovered antifreeze is recycled and reused in facility vehicles and/or personal
vehicles;
• Spilled fluids are cleaned up to the extent practicable using appropriate absorbent
materials and the wastes disposed in a manner so as to prevent their entry into
surface water or groundwater;
• Storage containers, equipment and tanks are routinely inspected to detect
potential leaks and perform preventative maintenance;
• Loading/unloading operations are supervised by facility personnel;
• Leaking equipment is promptly repaired;
• Adequate supplies of spill control absorbents are kept on -site for emergency spill
response. Absorbent materials are put on observed petroleum spills and cleaned -
up in a timely manner. Employees are made aware of the location and proper use
of these materials; and
• Employees are trained on proper housekeeping, waste disposal, and pollution
prevention.
4.4 Facility Inspections
Facility and stormwater system inspections shall be performed semi-annually (at a
minimum) between January and June, July and December, and whenever a stormwater
problem is identified. Stormwater inspections will include:
Vehicle holding and storage areas;
Dismantling garage;
Parts storage areas;
Battery, tire, transmission, core and scrap storage areas;
Spill response materials;
Totes, drums and other storage vessels;

• Drains, conveyance systems and outfalls; and
• Qualitative monitoring at each outfall for color, foam, outfall staining, visible sheens
and dry weather flow.
During these inspections, consideration will be given to potential spill areas, existing spills
and leaks, potential new stormwater pollution contact sources, existing BMPs, new 13MPs,
erosion problems and housekeeping practices. A summary and narrative description of
stormwater control systems, plant equipment and systems will be included if these areas
differ significantly from those outlined in the SPPP or the latest facility inspection.
Inspection records shall be maintained in the facility files with the SPPP. A stormwater
systems inspections checklist is provided in Table 4.2.
5.0 SPILL PREVENTION AND RESPONSE PLAN
The following activities are intended to prevent spills and also specify actions to be taken
in the case of a spill.
5.1 Spill Prevention Measures
Many of the spill prevention measures implemented at the site can be found in Section
4.3 as best management practices. In addition to those found in Section 4.3, the following
spill prevention measures are implemented at the facility.
• The facility will conduct stormwater pollution prevention briefings as necessary for
their operating personnel to assure adequate understanding of pollution prevention
for the entire facility. Such briefings will highlight and describe known spill events or
failures, malfunctioning components, and recently developed precautionary
measures;
• Facility personnel will be trained in initial emergency response for chemical,
petroleum, and oil spills. The training will familiarize personnel with emergency
procedures, emergency equipment, and emergency systems;
• The facility will have designated personnel available who are accountable for spill
prevention and response;
Facility rules will be comprehensive and follow good operating and housekeeping
practices. Care will be taken to assure that materials and chemicals are stored
properly;
• Contractors or other temporary personnel using the facilities will be informed about
the facility's provisions for stormwater pollution prevention and directed to dispose
of hazardous materials and other chemicals and wastes properly;
• Personnel training will be documented and records retained with the stormwater.

The primary threats for a liquid spill to impact stormwater is associated with fluid
management operations at the facility. Spill response materials are available to clean up
spills in a timely manner. Spill response contractors are available to respond to larger
spills.
5.3.1 Outdoor Spill Procedures
An important facet of an effective response procedure during an oil release incident is to
keep the release separated from surface waters, to minimize its spreading, and to
minimize or prevent human and environmental exposure. Efforts should be made to
emphasize oil containment at the source. Such steps will also reduce unnecessary
contamination of soils and continuing potential for stormwater contact and pollution. A
proper cleanup of spills will usually involve the procedures outlined in this section.
5.311.1 Detection
Upon detecting a spill, personnel will first work to contain the spill and then contact the
pollution prevention team leader (if appropriate). Additionally, if deemed necessary by the
leader, the proper state agencies shall be notified.

5.3.1.2 Stop Spill Source
To prevent further pollution, the spill source shall be determined and additional spillage
curtailed.
5.3.1.3 Contain Spill
To rapidly contain the spill, absorbent materials, dirt, sand bags, and oil booms will be
utilized as needed. Absorbent materials should be readily available at the facility. These
materials should be made convenient to areas where spills are likely to occur. If
necessary, downgradient stormwater drains shall be plugged and/or blocked.
5.3.1.4 Remove Pollutants
After containment, the pollutant shall be removed using a portable, manually operated
pump or other appropriate means and then transferred to 55-gallon drums, tank trucks, or
other appropriate containers for reuse or proper disposal. If needed, a commercial
cleanup contractor service may be retained during an oil or hazardous substance spill
cleanup operation.
5.3.1.5 Cleanup
After as much of the pollutant as possible has been removed, the spill residue will be
cleaned up utilizing available absorbent materials.
5.3.2 Indoor Spill Procedures
In case of a spill inside the facility building, the following general procedures are to be
taken:
• Evacuate non -authorized personnel from area;
• Check MSDS_ sheets for warnings, exposure and clean up information;
• Dress in appropriate protective clothing, goggles and gloves;
• Stop or contain leak and/or spill;
• Neutralize chemical using water or other appropriate neutralizing, agent (check
MSDS sheets);
• Wash area of spill with water, if appropriate;
Dispose of waste according to federal, state and local health and EPA regulations;
and
Dispose of clean up materials, clothing, etc. in accordance with federal, state, and
local regulations.

Careful contingency planning is of vital importance in minimizing costs of cleaning up a
spill and mitigating environmental damage. Specific duties of facility personnel during a
spill incident should be established. Operators should know how to immediately stop and
contain the flow of oil, petroleum, chemicals, or hazardous materials in an emergency.
Some of the methods that could be used are:
• The downslope drainage path can be blocked with a compacted earthen dam and
used as a storage pond into which a spill can be directed;
• To prevent the lateral migration of a large spill on a permeable surface, a ditch can
be dug around the periphery. of the spill and flooded with water or lined with plastic
to restrict the in -ground spread of the spill;
• Spills on paved, hard -packed, or hard (frozen) surfaces can be deflected into a
containment structure and away from surface waters and drains with sand bag
barriers or .spill control booms. A spill into a drain or surface water can turn a
relatively simple land spill into a complicated and expensive water spill; and
A common technique for picking up thin layers of oil is to use sorbents. "Packaged"
sorbents are available as sheets, pads, rolls, "sweeps," "pillows," and booms.
Each form has specific advantages for particular spill conditions.
5.4 Outside Contractors
Contractors or other temporary personnel using the facilities shall be informed about the
facility's provisions for stormwater pollution prevention and directed to dispose significant
materials and other chemicals and wastes properly.
6.0 PREVENTATIVE MAINTENANCE AND GOOD HOUSEKEEPING PLAN
6.1 Preventative Maintenance Program
A preventative maintenance program used in conjunction with facility inspections is the
heart of the pollution prevention plan. Equipment, drum and tank repairs will be initiated
when defects and flaws are revealed during an inspection and before failure occurs.
Equipment, tanks and storage areas are evaluated almost daily during normal facility
operations. Additionally, normal equipment maintenance schedules will be implemented
according to equipment manufacturer's recommendations. With proper scheduling,
preventative maintenance operations can be carried out without disrupting facility
operations. The preventative maintenance program consists of the semi-annual facility
inspections. Any deficiencies or areas that need to be addressed will be noted on the
Stormwater Systems Inspection Checklist included as Table 4.2, or equivalent.

Good housekeeping principles will be practiced throughout the facility. Employees will be
trained on the location and use of housekeeping materials, spill response materials, and
personal protective equipment. Keeping the facility clean and orderly will help facilitate
identification of spills, leaks, and general maintenance problems. Therefore, a "clean as
you go" attitude will be encouraged. Employees will be on the lookout for potential spills
and conditions that could lead to direct contact of stormwater with polluting materials.
Although inspections are performed semi-annually, most areas are observed more often
during normal operations. Areas that need addressed are done so in a timely manner.
7.0 TRAINING SCHEDULES
If the pollution prevention program is to succeed, the people involved must be properly
oriented, trained, and motivated. Basic issues that personnel working in potential spill
areas should be acquainted with are:
• Proper precautions to prevent spills;
• Automotive fluids management;
• Good housekeeping;
• Preventative maintenance;
• Specific duties of designated personnel;
• Emergency response procedures; and
• Facility inspection procedures.
Employees are trained annually in stormwater pollution prevention techniques and the
issues outlined above. Documentation of training should be kept on Table 7.1.
8.0 POLLUTION PREVENTION TEAM
The Pollution Prevention Team is responsible for implementing, maintaining, and
updating, as necessary, the SPPP. The Pollution Prevention Team members and their
areas of responsibility are listed in Table 5.1.
9.0 SAMPLING AND MONITORING REQUIREMENTS
The two types of monitoring required by the general stormwater permit are described on
the following page.

Qualitative (visual) monitoring requirements for the facility are outlined in Part 11, Section
C of the facility's general permit (Appendix B). Qualitative monitoring should take place at
Outfall No. 1 during analytical (quantitative) monitoring events. Results of the qualitative
monitoring events should be recorded on the appropriate Stormwater Discharge Outfall
(SDO) monitoring forms (Appendix A) and maintained at the facility in Appendix C of this
plan.
9.2 Quantitative Monitoring
Quantitative (analytical) monitoring of stormwater discharges must be performed semi-
annually at Outfall No. 1. Grab samples of stormwater must be obtained during a
measurable storm event, with a minimum of 60-days separating each sample date.
Table 9.1 outlines the quantitative monitoring requirements and monitoring frequency
for the facility. Results of quantitative monitoring events should be recorded on the
appropriate SDO monitoring forms (Appendix A) and submitted to the Division of Water
Quality no later than 30-days from receipt of laboratory analytical results. Copies of the
SDO monitoring forms and laboratory analytical results should also be maintained at the
facility in Appendix C of this plan.
10.0 STORMWATER POLLUTION PREVENTION PLAN EVALUATION
10.1 SPPP Revisions
This Stormwater Pollution Prevention Plan shall be reviewed and/or amended within two
weeks of the following occurrences:
• Revision of applicable regulations;
• Changes in facility design, construction, operations, or maintenance which
materially affect the potential for stormwater contact with significant materials;
• Identification of an SPPP deficiency or recommendation of follow-up measures
during inspections; and
• Notification from the State that the plan does not meet a minimum requirement of
the permit.
10.2 Annual Review and Update
The plan shall be reviewed at least once every year and will be amended if such review
indicates that the plan does not reflect current operations or physical facility features or is
deficient in some way. This review shall include re -certification that stormwater outfalls
have been evaluated for the presence of non-stormwater discharges (Table 3.2).
Records documenting the reviews/amendments shall be documented on Table 10.1.

1. All parameters to be measured in milligrams per liter (mg/L) except pH and total rainfall.
pH to be measure in standard units and total rainfall to be measured in inches using a
standard rain gauge. If pH values outside this range are recorded in sampled stormwater
discharges, but ambient precipitation pH levels are lower, then the lower threshold
of this benchmark range is the pH of the precipitation (within instrument accuracy)
instead of 6 S.U. Readings from an on -site or local rain gauge (or local precipitation
data) must be documented to demonstrate background concentrations were below the
benchmark pH range of 6-9.
2. All samples must be grab samples.
3. All samples must be collected during a representative storm event. A representative storm
event is an event that measures greater than 0.1 inches of rainfall and that is preceded by
at least 72 hours in which no storm event measuring 0.1 inches has occurred. A single
storm event may contain up to 10 consecutive hours of no precipitation.
4. A minimum of 60-days must separate sampling events.
5. E=xceedences of benchmark values require the permittee to increase monitoring, increase
management actions, increase record keeping, or install stormwater best management
practices in a tiered program. See the general permit for tier requirements.
6. The requirement for Total Toxic Organics may be waived if the facility does not use or
store organic solvents OR if the facility implements a Solvent Management Plan.
7. If no discharge occurs during a sampling period, a monitoring report indicating "No Flow'
must be submitted within 30-days of the samnlina period.

Mid -Atlantic conducted an initial site visit on June 6, 2014 to interview facility management and
evaluate facility operations, storage practices, best management practices and stormwater outfalls.
This information is currently being used to prepare a site -specific SPPP, as required by General Permit
NCG100000; and
Coordinate the required stormwater monitoring activities (qualitative and quantitative) in accordance
with General Permit NCG100000. Bishop's will conduct a sampling event during the next qualifying rain
event which occurs during normal business hours or when an employee can safely and reasonably
collect the sample. A completed DMR will then be submitted to your office upon receipt of data
results.

Pollution Prevention Plan was at the site available for review. Qualitative and Quantitative Monitoring have not been
conducted since the site has been permitted in 2001. There is one outfall on the property located adjacent to Dunn Road.
A concrete Swale adjacent to the road leads to the outfall. Sediment is noted in the swale which should be maintained to
prevent sediment from entering the outfall. There were containers of motor oil and various hydraulic fluids located in,
drums on pallets under an open -sided, roofed area adjacent to the main shop. Some of the drums did not have caps on
them. It is possible for Fluids to spill out of the drums if they are uncovered. Another open -sided, roofed area contained
motors and machinery parts which were not on pallets. They should be kept on pallets to prevent possible stormwater
runoff of residues from these parts. Motors are noted on the ground. They should be put on pallets, under a covered area.
Old oil and other old chemicals are picked up by another company and disposed of off -site, per Cathy Freeman.

This letter is to inform you that the A -Bishop Facility located at 714 Dunn Road has failed
to maintain a compliance standing for the Stormwater Discharge Permit, NCG100222, issued
for a Certificate of Coverage by NC DENR.
On March 7, 2013, a site inspection found this Facility failing to fully Implement Its
SWPPP per Permit requirements. In a response letter hand delivered to you on March 11.
2013, the items missing were laid out requesting all to be completed and put into place by
March 26, 2013.
1. In the processing area outside, there is heavy sediment laying on the concrete parking
area and in the concrete swale leading to the open throat collection box. While it Is
evident not all this sediment comes from this Facility, keeping the parking area Itself
clean will aid in reducing sediment transport Into the Stormwater System.
2. Old tires npt mounted on rims need to be stacked on their side and covered. Used
tires not properly stored can create a fire hazard and mosquito breeding ground,
3. Used batteries should be removed from salvage vehicles storing them under cover
preferably over a containment pallet.
4. Old fuel tanks should never be stored outside where It is exposed to falling
precipitation. These tanks can collect stormwater creating a surcharge onto the
ground of residue left in them.
5. Motors removed for resale need to be stored under cover and off the ground.
6. The SPRP need to be updated so as to include emergency contact Information. It is
recommended this information be posted or If kept with the SPPP available to all
employees.
7. For the period of coverage under the past permit, 2011-2012 no Qualitative or
Analytical Monitoring was conducted. Your permit requires both of these tests done on
a semi-annual basis.

On March 7, 2013 a site inspection was conducted for the A -Bishop Towing & Recovery
Facility located at 714 Dunn Road in Fayetteville, NC. This facility drains to Locks Creek in the
Cape Fear River Basin. Your Facility has been granted a Certificate of Coverage, NCGl00222
under the NPDES General Permit NCG30000 for Stormwater Discharge. A copy of the field
collection report has been enclosed for your review and records. Following is a list of concerns
to be addressed taken from the inspection conducted;
1. In the processing area outside, there is heavy sediment laying on the concrete parking

In response to your renewal application for continued coverage under stormwater General Permit NCG100000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG100000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also; please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (httpa/portal.ncdenr.org/web/wa/ws/su/_current-
notices), or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are

Some of the changes include:
Part II:
• Section A: The. Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A.lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,

9. Corrective Actions Needed:
Provide adequate permanent ground cover on all areas where development has been completed according to the time
limits in the approved plan, including the following areas: All bare, inactive and eroding slopes.
Install erosion and sediment control devices sufficient to retain sediment on the tract, including silt fence around the
stockpiles on the site.
Maintain all sedimentation and erosion control measures as specified in the approved plan and as required to prevent
sedimentation damage including the following: Construction entrance, silt fence, silt fence outlet, sediment trap, diversion
ditch and matting.
Provide adequate temporary or permanent ground cover on areas where land -disturbing activity has ceased in 7 or 14
days according to NCG 010000 permit conditions at the following locations: All bare, inactive and eroding slopes.
10. COMMENTS: 1. The construction entrance is in need of maintenance.
2. Swales on the south side of the site had erosion with matting being undermined. They need to be stabilized with sufficient
permanent groundcover as do all inactive, bare slopes. Gully and sheet erosion are noted on the slopes.

involving the sale of used motor vehicle parts at a facility named A -Bishop located on Dunn Road in Fayetteville,
Cumberland County, NC. The purpose of this letter is to advise you that coverage under the NGG100000 General
Stormwater Permit is required for all owners or operators of stormwater point source discharges associated with activities
classified as establishments primarily engaged in activities classified as Used Motor Vehicle Parts (Standard Industrial
Classification (SIC) 50151 and Automobile Wrecking for Scrap (a portion of SIC 5093).
Enclosed with this letter is a copy of the Notice of Intent (NOI) application to obtain coverage under the NCG100000
general permit. Within 30 calendar days from receipt of this letter, a completed NOI application should be submitted to the
Stormwater Permitting Unit at the address listed on the form. Failure to obtain coverage, if applicable, could result in
